Hamd kendisinden ba\u015fka ilah olmayan, mutlak manada tek g\u00fc\u00e7 ve kudret sahibi olan Allah\u2019a mahsustur. Salat ve selam t\u00fcm peygamberlerin ve onlar\u0131 takip eden tabilerinin \u00fczerine olsun.<\/p>\n

143- Sekiz \u00e7ift; koyundan da iki, ke\u00e7iden de iki. De ki: “\u0130ki erke\u011fi mi haram k\u0131ld\u0131? Yoksa iki di\u015fiyi mi, ya da o iki ki\u015finin rahimlerinin, kendisini kapsad\u0131\u011f\u0131 (yavrular\u0131) m\u0131? E\u011fer do\u011fru s\u00f6zl\u00fcler iseniz bana bir ilimle haber verin.”(119)<\/strong>
\n144- Deveden de iki, s\u0131\u011f\u0131rdan da iki. De ki: “\u0130ki erke\u011fi mi haram k\u0131ld\u0131? \n145- De ki: “Bana vahyolunanlar i\u00e7inde, yiyen bir kimsenin yiyece\u011fi (\u015feyler) i\u00e7in, \u00f6l\u00fc eti, d\u00f6k\u00fclen kan, domuz eti -ki bu ger\u00e7ekten murdard\u0131r- ya da Allah’tan ba\u015fkas\u0131 ad\u0131na kesilmi\u015f bir f\u0131sk d\u0131\u015f\u0131nda, haram k\u0131l\u0131nm\u0131\u015f bir \u015fey bulmuyorum.(121) Kim ka\u00e7\u0131n\u0131lmaz bir ihtiya\u00e7la kar\u015f\u0131 kar\u015f\u0131ya kal\u0131rsa, -sald\u0131rmamak ve haddi a\u015fmamak \u015fart\u0131yla- (bu say\u0131lanlardan \u00f6lmeyecek kadar yiyebilir) . \u015e\u00fcphesiz senin Rabbin ba\u011f\u0131\u015flayand\u0131r, esirgeyendir.<\/strong><\/p>\n

Bu arada, Kur’an’\u0131n Araplar\u0131n b\u00e2t\u0131l inan\u00e7lara dayal\u0131 uygulamalar\u0131n\u0131n sa\u00e7mal\u0131\u011f\u0131n\u0131 g\u00f6stermek i\u00e7in ba\u015fvurdu\u011fu ayn\u0131 y\u00f6ntemin ayn\u0131 etkinlikle yiyecekler \u00fczerine ak\u0131l d\u0131\u015f\u0131 s\u0131n\u0131rlamalar getiren ve insanlar aras\u0131nda insanl\u0131k d\u0131\u015f\u0131 ay\u0131r\u0131mlar yapan d\u00fcnyan\u0131n daha ba\u015fka uluslararas\u0131 b\u00e2t\u0131l inan\u00e7lara dayal\u0131 uygulamalar\u0131n\u0131 a\u00e7\u0131\u011fa \u00e7\u0131karmak i\u00e7in de kullan\u0131labilece\u011fi belirtilmektedir.

Bakara’n\u0131n s\u00f6z\u00fc edilen ayetinde yasaklanan yaln\u0131zca ‘kan’ idi. Burada haram k\u0131l\u0131nan ise, ak\u0131t\u0131lan, yani hayvan yaraland\u0131\u011f\u0131nda veya kesildi\u011finde akan ‘kan’d\u0131r. Mesf\u00fbh (ak\u0131t\u0131lm\u0131\u015f) kelimesinin eklenmesi yaln\u0131zca ‘kan’\u0131n mahiyetini a\u00e7\u0131klamak i\u00e7in olup, ’emir’de herhangi bir de\u011fi\u015fiklik yapmaz. Fakat, bu d\u00f6rd\u00fcn yan\u0131s\u0131ra, Hz. Peygamber’in (s.a.) evcil maymunlar, keskin di\u015fli av hayvanlar\u0131 <K\u00d6PEK (\u00c7) gibi>ve pen\u00e7eli ku\u015flar gibi daha ba\u015fka baz\u0131 hayvanlar\u0131 da haram k\u0131ld\u0131\u011f\u0131n\u0131 veya onlardan i\u011frendirdi\u011fini ifade eden hadisler vard\u0131r. Bu nedenle, fakihler yasa\u011f\u0131 yaln\u0131zca bu d\u00f6rt nedenle s\u0131n\u0131rlamaz ve geni\u015fletirler.

Bunun yan\u0131s\u0131ra Hanefiler, l\u00e2\u015fe yiyen hayvanlar\u0131, av ku\u015flar\u0131n\u0131 ve \u00f6l\u00fc etiyle beslenen hayvanlar\u0131 mutlak \u015fekilde haram kabul ederken, \u0130mam Malik ve Evza\u00ee’ye g\u00f6re av ku\u015flar\u0131 hel\u00e2l ve Leys’e g\u00f6re de kedi hel\u00e2ldir, \u0130mam \u015eafi\u00ee’ye g\u00f6re ise, yaln\u0131zca (arslan, kurt ve kaplan gibi insanlara sald\u0131ran) etobur hayvanlar haramd\u0131r. \u0130krime karga ve porsu\u011fun hel\u00e2l oldu\u011fu g\u00f6r\u00fc\u015f\u00fcndedir. Yine Hanefi’lere g\u00f6re t\u00fcm s\u00fcr\u00fcngenler haramken \u0130bn Ebi Leyla, \u0130mam Malik ve Evzai’ye g\u00f6re y\u0131lan hel\u00e2ldir.
\nYukarda verdi\u011fimiz bilgilerin dikkatlice incelenmesi, ger\u00e7ek Kur’an’da an\u0131lan yaln\u0131zca d\u00f6rt \u015feyin haram oldu\u011fu ve bunlar\u0131n yan\u0131s\u0131ra, \u00e7e\u015fitli derecelerde i\u011fren\u00e7 daha ba\u015fka hayvanlar\u0131n bulundu\u011funu ortaya koyar. Dolay\u0131s\u0131yle, sahih hadislere g\u00f6re Ras\u00fblullah’\u0131n i\u011frendi\u011fi hayvanlar da \u00e7ok b\u00fcy\u00fck ihtimalle haram olup, haklar\u0131nda fakihlerin farkl\u0131 g\u00f6r\u00fc\u015flere sahip oldu\u011fu hayvanlar\u0131n i\u011fren\u00e7li\u011fi ise \u015f\u00fcphelidir.
\nBaz\u0131lar\u0131n\u0131n ki\u015fisel i\u011frenme duydu\u011fu hayvanlara gelince, \u0130sl\u00e2m Hukuku kimseyi sevmedi\u011fi \u015feye zorlamaz. Ayn\u0131 kural, baz\u0131 grup ve uluslar\u0131n belirli \u015feylerden i\u011frenmesi i\u00e7in de kullan\u0131labilir.
