Hamd kendisinden ba\u015fka ilah olmayan, mutlak manada tek g\u00fc\u00e7 ve kudret sahibi olan Allah\u2019a mahsustur. Salat ve selam t\u00fcm peygamberlerin ve onlar\u0131 takip eden tabilerinin \u00fczerine olsun.<\/p>\n

23- Ge\u00e7mi\u015f uygulamalar bir yana, bundan b\u00f6yle analar\u0131n\u0131z, k\u0131zlar\u0131n\u0131z, karde\u015fleriniz, halalar\u0131n\u0131z, teyzeleriniz, erkek karde\u015flerinizin k\u0131zlar\u0131, k\u0131z karde\u015flerinizin k\u0131zlar\u0131, sizi emziren s\u00fctanneleriniz, s\u00fctkarde\u015fleriniz, kaynanalar\u0131n\u0131z, cinsel ili\u015fkide bulundu\u011funuz E\u015flerinizden do\u011fan g\u00f6zetiminiz alt\u0131ndaki \u00fcvey k\u0131zlar\u0131n\u0131z -e\u011fer analar\u0131 ile cinsel ili\u015fkide bulunmam\u0131\u015f iseniz bu k\u0131zlar ile evlenmenizin sak\u0131ncas\u0131 yoktur- \u00f6z o\u011fullar\u0131n\u0131z\u0131n e\u015fleri ile evlenmeniz ve iki k\u0131z karde\u015fi birlikte nikah\u0131n\u0131z alt\u0131nda bulundurman\u0131z size haram k\u0131l\u0131nd\u0131. Hi\u00e7 ku\u015fkusuz Allah affedici ve merhametlidir.<\/em><\/strong><\/p>\n

Evlenilmesi yasak olan kad\u0131nlar, ilkel-ileri t\u00fcm milletlerde bilinmektedir. Ancak yasa\u011f\u0131n nedenleri ve dereceleri de\u011fi\u015fik milletlerin yan\u0131nda farkl\u0131l\u0131k arz etmi\u015ftir. \u0130lkel halklarda bu \u00e7emberin olduk\u00e7a geni\u015fken, ileri halklarda ise \u00e7emberin darald\u0131\u011f\u0131 g\u00f6r\u00fclmektedir.<\/p>\n

\u0130sl\u00e2m’da evlenilmesi yasak olan kad\u0131nlara gelince, bunlar \u015fu ayette, \u00f6ncekinde ve sonraki ayette a\u00e7\u0131klanan s\u0131n\u0131flard\u0131r. Bunlardan baz\u0131s\u0131 ebediyyen yasakt\u0131r, baz\u0131s\u0131 ise ge\u00e7icidir. Kimisi hesap nedeniyle, kimisi emzirmeden dolay\u0131, kimisi de evlilikten do\u011fan akrabal\u0131k y\u00fcz\u00fcnden yasakt\u0131r.<\/p>\n

Bunun d\u0131\u015f\u0131nda, di\u011fer toplumlarda tan\u0131nan her t\u00fcr ba\u011f\u0131 ortadan kald\u0131rm\u0131\u015ft\u0131r \u0130sl\u00e2m. \u0130nsanlar\u0131n \u0131rk, renk ve kavmiyetlerinin bir de bir \u0131rk ve bir vatan i\u00e7in deki s\u0131n\u0131fsal ve toplumsal konumlar\u0131n farkl\u0131l\u0131\u011f\u0131ndan do\u011fan ba\u011flar gibi…” \u0130sl\u00e2m \u015feriat\u0131nda yak\u0131nl\u0131k nedeniyle evlenilmesi yasak olan kad\u0131nlar d\u00f6rt s\u0131n\u0131ft\u0131r:<\/p>\n

Birincisi; ne kadar yukarda olursa olsun us\u00fbl, (yukar\u0131ya do\u011fru say) dolay\u0131s\u0131yle, ne kadar yukar\u0131da olurlarsa olsunlar ki\u015finin anas\u0131yla, gerek ana taraf\u0131ndan gerekse baba taraf\u0131ndan neneleriyle evlenmesi yasakt\u0131r. “…Analar\u0131n\u0131z size haram k\u0131l\u0131nd\u0131..”<\/strong><\/p>\n

\u0130kincisi; a\u015fa\u011f\u0131ya do\u011fru t\u00fcm \u00e7ocuklar (f\u00fcr\u00fb); Yani ki\u015finin k\u0131zlar\u0131yla ve k\u0131z erkek \u00e7ocuklar\u0131n\u0131n k\u0131zlar\u0131yla evlenmesi yasakt\u0131r. “…K\u0131z \u00e7ocuklar\u0131n\u0131z…”<\/strong><\/p>\n

\u00dc\u00e7\u00fcnc\u00fcs\u00fc; a\u015fa\u011f\u0131ya do\u011fru anne-baban\u0131n t\u00fcm \u00e7ocuklar\u0131. Buna g\u00f6re ki\u015finin k\u0131z karde\u015fiyle, erkek veya k\u0131z karde\u015flerinin k\u0131zlar\u0131yla ve karde\u015flerinin \u00e7ocuklar\u0131n\u0131n k\u0131zlar\u0131yla evlenmesi yasakt\u0131r. “…k\u0131z karde\u015fleriniz…” <\/strong>“…. Erkek karde\u015finizin k\u0131zlar\u0131 ve k\u0131z karde\u015finizin k\u0131zlar\u0131…”<\/strong><\/p>\n

D\u00f6rd\u00fcnc\u00fcs\u00fc; Dedelerine do\u011frudan ba\u011flanan \u00e7ocuklar\u0131, yani ki\u015finin halas\u0131, teyzesi, babas\u0131n\u0131n halas\u0131, babadan veya anadan taraf ninesinin halas\u0131 ile evlenmesi yasakt\u0131r. “…Halalar\u0131n\u0131z, teyzeleriniz…” <\/strong>Ancak dedelere do\u011frudan ba\u011flanmayan \u00e7ocuklarla evlenmek hel\u00e2ldir. Bu nedenle amca ve hala \u00e7ocuklar\u0131n\u0131n, day\u0131 ve teyze \u00e7ocuklar\u0131n\u0131n evlenmesi serbesttir.<\/p>\n

Evlilik nedeniyle meydana gelen yasaklar ise be\u015f tanedir:<\/p>\n

1- Kar\u0131n\u0131n yukar\u0131ya do\u011fru (usul) akrabas\u0131, adam\u0131n e\u015finin anas\u0131yla, ne kadar yukar\u0131da olursa olsun baba veya ana taraf\u0131ndan nenesiyle evlenmesi yasakt\u0131r. Bu yasak erke\u011fin e\u015fiyle yaln\u0131zca nikah ahdini ger\u00e7ekle\u015ftirmesiyle birlikte y\u00fcr\u00fcrl\u00fc\u011fe girer. Cinsel ili\u015fkide bulunmas\u0131 ya da bulunmamas\u0131 fark etmez. “…Kaynanalar\u0131n\u0131z…”<\/strong><\/p>\n

2- Kar\u0131n\u0131n a\u015fa\u011f\u0131ya do\u011fru t\u00fcm \u00e7ocuklar\u0131… Yani ki\u015finin e\u015finin k\u0131z\u0131yla ne kadar a\u015fa\u011f\u0131da olursa olsun erkek kad\u0131n t\u00fcm \u00e7ocuklar\u0131n\u0131n k\u0131zlar\u0131yla evlenmesi yasakt\u0131r. Ancak bu yasak, cinsel ili\u015fkide bulunmad\u0131\u011f\u0131 s\u00fcrece y\u00fcr\u00fcrl\u00fc\u011fe girmez. “…Cinsel ili\u015fkide bulundu\u011funuz e\u015flerinizden do\u011fan g\u00f6zetiminiz alt\u0131ndaki \u00fcvey k\u0131zlar\u0131n\u0131z. E\u011fer analar\u0131yla cinsel ili\u015fkide bulunmam\u0131\u015f iseniz bu k\u0131zlarla evlenmenizin sak\u0131ncas\u0131 yoktur.”<\/strong><\/p>\n

3- Baban\u0131n ve ne kadar yukar\u0131da olursa olsun her iki taraf\u0131n dedelerin e\u015fleri. Yani ki\u015finin babas\u0131n\u0131n kar\u0131s\u0131 ve ne kadar yukar\u0131da olursa olsun ana ve baba taraf\u0131ndan dedelerinden birinin kar\u0131s\u0131yla evlenmesi yasakt\u0131r. “Ge\u00e7mi\u015f uygulamalar bir yana bundan b\u00f6yle babalar\u0131n\u0131z\u0131n nikahlad\u0131\u011f\u0131 kad\u0131nlar\u0131 kendinize nikahlamay\u0131n.” <\/strong>Yani bu t\u00fcr nikahtan cahiliyede yapt\u0131klar\u0131 m\u00fcstesna. Bilindi\u011fi gibi cahiliyyeden bu nikah\u0131 caiz g\u00f6r\u00fcrlerdi.<\/p>\n

4- O\u011fullar\u0131n ve a\u015fa\u011f\u0131ya do\u011fru t\u00fcm \u00e7ocuklar\u0131n o\u011fullar\u0131n\u0131n e\u015fleri. Ki\u015finin kendi s\u00fclb\u00fcnden olan o\u011flunun ve ne kadar a\u015fa\u011f\u0131da olursa olsun o\u011flunun ve k\u0131z\u0131n\u0131n<\/p>\n

o\u011fullar\u0131n\u0131n kar\u0131lar\u0131yla evlenmesi yasakt\u0131r. “…\u00d6z o\u011fullar\u0131n\u0131z\u0131n e\u015fleriyle evlenmeniz haram k\u0131l\u0131nd\u0131…” <\/strong>B\u00f6ylece bu ayet cahiliyede evlatl\u0131\u011f\u0131n kar\u0131s\u0131yla evlenmeyi yasaklayan adeti iptal edip bu yasa\u011f\u0131 \u00f6z o\u011fullar\u0131n\u0131n kar\u0131s\u0131yla s\u0131n\u0131rland\u0131rmaktad\u0131r. Ahzab suresinde de\u011finilece\u011fi gibi evlatl\u0131klar \u00f6z babalar\u0131n\u0131n ad\u0131yla \u00e7a\u011fr\u0131l\u0131rlar.<\/p>\n

5- Kar\u0131n\u0131n k\u0131z karde\u015fi. Bu yasaklama ge\u00e7icidir. Ve kar\u0131n\u0131n sa\u011f olu\u015funa ve adam\u0131n nikah\u0131nda bulunmas\u0131yla ba\u011fl\u0131d\u0131r. Yasak olan iki k\u0131z karde\u015fi ayn\u0131 anda bir nikah alt\u0131nda tutmakt\u0131r.<\/p>\n

“…\u0130ki k\u0131z karde\u015fi birlikte nikah\u0131n\u0131z alt\u0131nda bulundurman\u0131z size haram k\u0131l\u0131nd\u0131… Ge\u00e7mi\u015f uygulamalar bir yana.” <\/strong>Yani cahiliye de yapt\u0131\u011f\u0131n\u0131z bu t\u00fcr nikah hari\u00e7. \u00c7\u00fcnk\u00fc o d\u00f6nemde bu nikah\u0131 caiz g\u00f6r\u00fcyorlard\u0131.<\/p>\n

Nesep ve evlilik dolay\u0131s\u0131yla yasak olanlar\u0131n t\u00fcm\u00fc emzirme nedeniyle de yasakt\u0131rlar. Bu da dokuz yasa\u011f\u0131 i\u00e7ermektedir:<\/p>\n

1- S\u00fct anne ve ondan yukar\u0131s\u0131 (usul) “…Sizi emziren s\u00fct anneleriniz.. ”<\/p>\n

2- S\u00fct k\u0131z\u0131 ve a\u015fa\u011f\u0131ya do\u011fru onun k\u0131zlar\u0131 (Adam\u0131n s\u00fct k\u0131z\u0131 nikah\u0131 alt\u0131ndaki kar\u0131s\u0131n\u0131n emzirdi\u011fi k\u0131zd\u0131r)<\/p>\n

6- Kar\u0131n\u0131n s\u00fct k\u0131z\u0131 (kad\u0131n\u0131n evlenmeden \u00f6nce emzirdi\u011fi k\u0131z) ve a\u015fa\u011f\u0131ya do\u011fru onun k\u0131zlar\u0131 . Kad\u0131nla cinsel ili\u015fkiye girilmedik\u00e7e bu yasak y\u00fcr\u00fcrl\u00fc\u011fe girmez.<\/p>\n

7- S\u00fct baba, s\u00fct dede ve bundan yukar\u0131s\u0131n\u0131n e\u015fleri. (S\u00fct baba \u00e7ocuklar\u0131 kar\u0131s\u0131na emzirten adamd\u0131r. Bu \u00e7ocu\u011fun yaln\u0131zca kendisini emziren e\u015fiyle evlenmesi yasak de\u011fildir, bu onun s\u00fct annesidir. S\u00fct babas\u0131n\u0131n kar\u0131s\u0131 olan di\u011fer kad\u0131nlarla evlenmesi yasakt\u0131r.)<\/p>\n

8- S\u00fct o\u011flunun ve ondan a\u015fa\u011f\u0131s\u0131n\u0131n kar\u0131lar\u0131.<\/p>\n

9- Kad\u0131nla s\u00fct k\u0131z karde\u015fini, s\u00fct halas\u0131m, s\u00fct teyzesinin veya emzirme nedeniyle mahrem olan herhangi bir kad\u0131n\u0131 nikah alt\u0131nda bulundurmak yasakt\u0131r.\u00b7<\/p>\n

Yukar\u0131da a\u00e7\u0131klanan yasaklar\u0131n bir, iki ve \u00fc\u00e7\u00fcnc\u00fcs\u00fc ayetin nass\u0131yla yasaklanm\u0131\u015ft\u0131r. Ancak di\u011fer yasaklar Resulullah’\u0131n (sal\u00e2t ve sel\u00e2m \u00fczerine olsun) “Nesep bak\u0131m\u0131ndan haram olanlar emzirme yoluyla da haramd\u0131r.”\u00b7(Buhari ve M\u00fcslim<\/strong>) hadisi uyar\u0131nca belirlenmi\u015ftir.<\/p>\n

Bunlar, \u0130sl\u00e2m \u015feriat\u0131nda evlenilmesi yasak olan kad\u0131nlard\u0131r. Ancak ayet yasaklaman\u0131n -\u00f6zel ya da genel- bir nedenini belirlememektedir. \u0130leri s\u00fcr\u00fclen t\u00fcm nedenler, insanlar\u0131n d\u00fc\u015f\u00fcnce, g\u00f6r\u00fc\u015f ve de de\u011ferlendirmesidir<\/p>\n

Ancak burada genel bir neden olacakt\u0131r. Ayn\u0131 zamanda her yasa\u011f\u0131n kendine \u00f6zg\u00fc yasaklama nedenleri de bulunacakt\u0131r. Baz\u0131 yasaklar\u0131n aras\u0131nda ortak dedenler de olacakt\u0131r ku\u015fkusuz.<\/p>\n

\u00d6rne\u011fin \u015f\u00f6yle denilebilir; “Akrabalar aras\u0131ndaki evlilik neslin c\u0131l\u0131zla\u015fmas\u0131na zamanla da zay\u0131fla\u015fmas\u0131na neden olmaktad\u0131r. \u00c7\u00fcnk\u00fc zay\u0131fl\u0131k \u00f6zellikleri \u00e7ocukta odakla\u015f\u0131p birle\u015firler. Bunun tersine, s\u00fcrekli yeni yabanc\u0131 kanlar\u0131n kar\u0131\u015fmas\u0131na f\u0131rsat verilirse \u00e7ocu\u011fun se\u00e7kin yetenekleri artar, neslin canl\u0131l\u0131k ve yetenekleri tazelenir.<\/p>\n

Ya da “Anneler, k\u0131zlar, k\u0131z karde\u015fler, halalar, teyzeler, erkek ve k\u0131z karde\u015fin k\u0131zlar\u0131, ayn\u0131 \u015fekilde emzirme nedeniyle akraba olunan benzerleri, kar\u0131lar\u0131n anneleri, e\u015flerin k\u0131zlar\u0131, -himayedeki \u00fcvey k\u0131zlar- gibi evlenmesi yasak s\u0131n\u0131flarla kurulacak ili\u015fkinin g\u00f6zetim, \u015fefkat, sayg\u0131 ve vakara dayanmas\u0131 istenmektedir. Bu y\u00fczden evlilik hayat\u0131nda bo\u015fanma ve ayr\u0131l\u0131\u011fa kadar g\u00f6t\u00fcren ihtilaflar gibi \u015feylere meydan verilmemesi arzu edilmektedir. \u00c7\u00fcnk\u00fc -bu ayr\u0131l\u0131klar\u0131n b\u0131rakt\u0131\u011f\u0131 k\u00f6t\u00fc etkilerle- kal\u0131c\u0131 olmas\u0131 istenen duygular tahrip olur” denilebilir.<\/p>\n

Veya \u015f\u00f6yle denilebilir: “Himaye edilen \u00fcvey k\u0131zlar, iki k\u0131z karde\u015fi bir nikahta bulundurmak, kar\u0131n\u0131n annesi ve baban\u0131n kar\u0131s\u0131 gibi s\u0131n\u0131flar\u0131n yasaklanmas\u0131yla o\u011fulluk ve karde\u015flik duygular\u0131n\u0131n zarar g\u00f6rmemesi hedeflenmektedir. \u00c7\u00fcnk\u00fc k\u0131z\u0131n\u0131n kocas\u0131 konusunda kendine rakip g\u00f6ren annenin -k\u0131z ve k\u0131z karde\u015f de bu durumdad\u0131r- hayat\u0131n\u0131 payla\u015ft\u0131\u011f\u0131 k\u0131z\u0131na, ya da bir anne-baba da birle\u015ftikleri k\u0131z karde\u015fine ve annesine -annesi oldu\u011fu halde- kar\u015f\u0131 tertemiz duygular\u0131n\u0131n devam etmesi m\u00fcmk\u00fcn de\u011fildir. Kendisinden sonra kar\u0131s\u0131n\u0131n o\u011fluna kalaca\u011f\u0131n\u0131 d\u00fc\u015f\u00fcnen baba ya da bo\u015fanan baban\u0131n kendisine rakip oldu\u011funu d\u00fc\u015f\u00fcnen o\u011ful da \u00f6yle. Baba ile o\u011ful aras\u0131nda lekelenmesi istenmeyen ili\u015fkiler nedeniyle ayn\u0131 \u015fey soyundan gelen o\u011fullar i\u00e7in de ge\u00e7erlidir.”<\/p>\n

\u015e\u00f6yle de denilebilir; Evlilik ili\u015fkisi, aile \u00e7emberinin geni\u015fleyip akrabal\u0131k ba\u011flar\u0131n\u0131n \u00f6tesine ta\u015fmas\u0131 i\u00e7in bir ara\u00e7t\u0131r. Bu y\u00fczden yak\u0131n akrabal\u0131k ba\u011flar\u0131yla birbirine ba\u011fl\u0131 kimseler aras\u0131nda evlenme zorunlulu\u011fu yoktur. Bir hikmeti bulunmad\u0131\u011f\u0131ndan bu durumda olanlar\u0131n evlenmesi yasaklanm\u0131\u015ft\u0131r. Akrabal\u0131k ba\u011f\u0131 nerdeyse kopmak \u00fczere olacak kadar uzak bulunanlar\u0131n d\u0131\u015f\u0131nda akrabalar\u0131n evlenmesine m\u00fcsaade edilmemi\u015ftir.”<\/p>\n

Nedeni ne olursa olsun biz, y\u00fcce Allah’\u0131n se\u00e7tiklerinin \u00f6tesinde bir hikmetin, bir iyili\u011fin bulundu\u011funu kabul ediyoruz. Bilmemiz ya da bilmememiz fark etmez. Bunun soruna herhangi bir etkisi s\u00f6z konusu de\u011fildir. Ho\u015fnutluk ve kabullenme ile birlikte uyup uygulama zorunlulu\u011fundan herhangi bir \u015fey eksiltmez. \u00c7\u00fcnk\u00fc Allah’\u0131n \u015feriat\u0131yla h\u00fckm olunmadan sonra da buna kar\u015f\u0131 g\u00f6\u011fs\u00fcnde herhangi bir s\u0131k\u0131nt\u0131 duymaks\u0131z\u0131n tam anlam\u0131yla teslim olmad\u0131k\u00e7a bir kalpte iman ger\u00e7ekle\u015fmez.<\/p>\n

Ard\u0131ndan Kur’an’\u0131n h\u00fck\u00fcm bildiren nass\u0131n\u0131n a\u00e7\u0131klad\u0131\u011f\u0131 t\u00fcm yasaklara ili\u015fkin son bir s\u00f6z yer almaktad\u0131r.<\/p>\n

Ku\u015fkusuz bu yasaklar, iki durumun d\u0131\u015f\u0131nda cahiliye gelene\u011finde de yasakt\u0131. Bunlar babalar\u0131n nikahlad\u0131klar\u0131 kad\u0131nlar ve iki k\u0131z karde\u015fi birlikte nikahlamakt\u0131. Cahiliye toplumunda ho\u015f kar\u015f\u0131lamamakla beraber caizdi bu t\u00fcr evlilik.<\/p>\n

Ancak -b\u00fct\u00fcn bu yasaklar\u0131 koyan- \u0130sl\u00e2m, bunlar\u0131 yasaklarken kesinlikle cahiliye gelene\u011fine dayanmamaktad\u0131r. Bu yasaklar\u0131 yeni ba\u015ftan ve kendine \u00f6zg\u00fc otoritesine dayanarak koymaktad\u0131r. H\u00fck\u00fcm \u015f\u00f6yle geliyor:<\/p>\n

“Analar\u0131n\u0131z size haram k\u0131l\u0131nd\u0131…”<\/strong><\/p>\n

Buradaki sorun g\u00f6stermelik bir sorun de\u011fildir. Bir b\u00fct\u00fcn olarak bu dinin sorunudur. Bu konudaki d\u00fc\u011f\u00fcm\u00fcn kavranmas\u0131 bir b\u00fct\u00fcn olarak bu dinin kavranmas\u0131 demektir. Onun dayand\u0131\u011f\u0131 temelin kavranmas\u0131 demektir. uluhiyet temeli ve tek ba\u015f\u0131na Allah’a \u00f6zg\u00fc k\u0131lma…<\/p>\n

Bu din, helal k\u0131lma (serbest b\u0131rakma) ve haram k\u0131lma (yasaklama)’n\u0131n tamamen Allah’a ait oldu\u011funu yerle\u015ftiriyor. \u00c7\u00fcnk\u00fc her ikisi de uluhiyetin en belirgin \u00f6zellikleridir. Allah’tan ba\u015fka hi\u00e7bir otoritenin helal k\u0131lma (serbest b\u0131rakma) ve haram k\u0131lma (yasaklama) yetkisi yoktur. Tek ba\u015f\u0131na Allah insanlar i\u00e7in diledi\u011fini helal diledi\u011fini haram k\u0131lar. Bunda ve \u015funda Allah’tan ba\u015fka hi\u00e7 kimse herhangi bir h\u00fck\u00fcm koyamaz. Kimse b\u00f6yle bir iddiaya kalk\u0131\u015famaz. \u00c7\u00fcnk\u00fc bu davran\u0131\u015f uluhiyyet iddias\u0131nda bulunmakla e\u015f anlaml\u0131d\u0131r.<\/p>\n

Bu y\u00fczden cahiliye herhangi bir \u015feyi serbest ya da yasak k\u0131ld\u0131\u011f\u0131nda bu yasaklama ve serbest b\u0131rakma temelden bat\u0131ld\u0131r. D\u00fczeltmek m\u00fcmk\u00fcn de\u011fildir. \u00c7\u00fcnk\u00fc daha ba\u015flang\u0131\u00e7tan varl\u0131\u011f\u0131 s\u00f6z konusu de\u011fildir. \u0130sl\u00e2m cahiliyenin helal ya da haram k\u0131ld\u0131\u011f\u0131 \u015feylerle kar\u015f\u0131la\u015f\u0131nca, i\u015fin ba\u015f\u0131nda temelden bunlar\u0131n batt\u0131\u011f\u0131na h\u00fckmeder ve onlar\u0131 t\u00fcmden yok sayar. \u00c7\u00fcnk\u00fc bunlar b\u00f6yle bir h\u00fck\u00fcm koymaya yetkisi bulunmayan -\u00e7\u00fcnk\u00fc ilah de\u011fildir- bir kaynaktan do\u011fmaktad\u0131rlar. Bundan sonra \u0130sl\u00e2m h\u00fck\u00fcmlerini yeni ba\u015ftan in\u015fa eder. Cahiliyede helal olan \u015feyi helal k\u0131larken ya da haram bir \u015feyi o da haram k\u0131larken bile bunu yeni ba\u015ftan belirliyor, \u0130sl\u00e2m. Temelden bat\u0131l kabul etti\u011fi cahiliyenin h\u00fck\u00fcmlerine bu konuda itibar etmez. \u00c7\u00fcnk\u00fc cahiliye bat\u0131ld\u0131r. Tek ba\u015f\u0131na bu h\u00fck\u00fcmleri koyma yetkisine sahip merciden kaynaklanmamaktad\u0131r. Ku\u015fkusuz bu merci y\u00fcce Allah’t\u0131r.<\/p>\n

\u0130nsan hayat\u0131ndaki her\u015feyi kapsayan helal ve harama ili\u015fkin \u0130sl\u00e2m’\u0131n g\u00f6r\u00fc\u015f\u00fc budur. Bu hayattaki hi\u00e7bir \u015fey bu \u00e7er\u00e7evenin d\u0131\u015f\u0131na \u00e7\u0131kamaz. Nikahta yeme i\u00e7mede, giyim-ku\u015famda, hareket ve davran\u0131\u015fta inan\u00e7 ve ili\u015fkilerde, ba\u011fl\u0131l\u0131klarda, gelenek ve hayat d\u00fczeninde onun \u015feriat\u0131na uymak suretiyle yetkisini y\u00fcce Allah’a dayand\u0131rmad\u0131k\u00e7a hi\u00e7 kimsenin helal veya haram k\u0131lma yetkisi yoktur.<\/p>\n

Bunun d\u0131\u015f\u0131nda insan hayat\u0131nda -b\u00fcy\u00fck, k\u00fc\u00e7\u00fck- yasaklama (haram) veya serbest (helal) b\u0131rakma i\u015flevini g\u00f6ren t\u00fcm mercilerin h\u00fck\u00fcmleri temelden bo\u015ftur, bat\u0131ld\u0131r. Ve temyizi m\u00fcmk\u00fcn de\u011fildir. \u0130sl\u00e2m \u015feriat\u0131nda yer alan h\u00fck\u00fcmler cahiliyede bulunan h\u00fck\u00fcmleri d\u00fczeltmek veya onlara dayanmak i\u00e7in gelmemi\u015flerdir.<\/p>\n

Aksine bunlar, tek ba\u015f\u0131na bu h\u00fck\u00fcmleri koyma yetkisine sahip merciden kaynaklanan yeni ba\u015ftan bir in\u015fad\u0131r.<\/p>\n

\u0130sl\u00e2m helal ve harama ili\u015fkin h\u00fck\u00fcmlerini b\u00f6yle in\u015fa etti. Sistem ve d\u00fczenini i\u015fte b\u00f6yle kurdu \u0130sl\u00e2m. Gelenek ve g\u00f6reneklerini \u0130sl\u00e2m b\u00f6yle d\u00fczenledi. Bu faaliyetinde tek ba\u015f\u0131na bu yetkiye sahip g\u00fcce dayanm\u0131\u015ft\u0131r ku\u015fkusuz.<\/p>\n

Kur’an bu g\u00f6r\u00fc\u015f\u00fcn yerle\u015fmesine b\u00fcy\u00fck \u00f6zen g\u00f6sterir. Bu y\u00fczden b\u00fct\u00fcn haram ve helal k\u0131lma olaylar\u0131nda cahiliye mensuplar\u0131yla tekrar tekrar m\u00fccadeleye giri\u015fmektedir. \u0130lkeyi belirlerken istink\u00e2r\u0131 bir soru y\u00f6neltmektedir: “De ki; Allah’\u0131n kullar\u0131 i\u00e7in \u00e7\u0131kard\u0131\u011f\u0131 ziyneti, temiz r\u0131z\u0131klan kim haram edermi\u015f?” (A’raf suresi; 32)<\/strong><\/p>\n

“De ki; gelin size Rabbinizin neleri haram k\u0131ld\u0131\u011f\u0131n\u0131 okuyal\u0131m.” (En’am suresi; 151)<\/strong><\/p>\n

“De ki; Bana vahyolunanlar i\u00e7inde yiyen bir kimsenin yiyece\u011finde \u00f6l\u00fc yahut ak\u0131t\u0131lan kan veya domuz etinin d\u0131\u015f\u0131nda haram edilmi\u015f bir \u015fey bulmuyorum…” (En’am suresi; 145)<\/strong><\/p>\n

Bu istink\u00e2ri sorularla y\u00fcce Allah onlar\u0131 \u015fu temel ilkeyle y\u00fczy\u00fcze getirmeyi istemektedir: Haram ve helal k\u0131lma hakk\u0131na tek ba\u015f\u0131na Allah sahiptir. Allah’\u0131n \u015feriat\u0131na uygun olarak onun otoritesine dayanandan ba\u015fka fert, s\u0131n\u0131f, ulus veya t\u00fcm insanlar i\u00e7inde hi\u00e7 kimsenin b\u00f6yle bir yetkisi s\u00f6z konusu de\u011fildir. Helal ve haram k\u0131lma -serbest b\u0131rakma ve yasaklama- \u015feriat demektir, din demektir. Buna g\u00f6re helal ve haram k\u0131lan b\u00fct\u00fcn insanlar\u0131n boyun e\u011fdi\u011fi din koyma yetkisine sahip kimsedir. Haram ve helal k\u0131lan Allah’tan ba\u015fka biriyse bu durumda insanlar ona boyun e\u011fiyorlar, onun dinindendirler, Allah’\u0131n de\u011fil.<\/p>\n

Bu \u015fekliyle sorun uluhiyyet ve \u00f6zellikleri sorunudur. Bu sorun din ve anlam\u0131 sorunudur. \u0130man ve s\u0131n\u0131rlar\u0131 sorunudur. O halde yery\u00fcz\u00fcndeki m\u00fcsl\u00fcmanlar, kendileri ile bu durumu g\u00f6zden ge\u00e7irmelidirler. Kendileri nerede bu din nerede? Nerede onlar nerede \u0130sl\u00e2m? Ona bir baks\u0131nlar. \u015eayet hen\u00fcz onlar m\u00fcsl\u00fcmanl\u0131k iddias\u0131n\u0131 s\u00fcrd\u00fcr\u00fcyorlarsa.<\/p>\n

    S\u00fbrenin giri\u015f b\u00f6l\u00fcm\u00fcnde de i\u015faret etti\u011fimiz ama\u00e7lar\u0131n ve konular\u0131n \u00e7o\u011funu i\u00e7eren bu c\u00fczde Nisa suresini incelemeye devam edece\u011fiz.     C\u00fcz\u00fcn ilk b\u00f6l\u00fcm\u00fcndeki ayet demetinde \u015funlar\u0131 buluyoruz: Aile kurumuna ili\u015fkin yasal d\u00fczenlemelerin devam\u0131; bu kurumu f\u0131trat\u0131n de\u011fi\u015fmez kurallar\u0131ndan olu\u015fmu\u015f bir temel \u00fczerine oturtmak; yine bu kurumu, e\u015flerin hayat\u0131n\u0131 etkileyen ge\u00e7ici \u015fartlar\u0131n sars\u0131nt\u0131lar\u0131ndan korumak; bunun yan\u0131s\u0131ra hem aileyi ve-hem de toplumu fuhu\u015fa d\u00fc\u015fmekten, yasaklar\u0131n \u00e7i\u011fnenmesinden ve aile-i\u00e7i ili\u015fkileri zedelemekten korumak konular\u0131 bulunmaktad\u0131r.<\/p>\n

    Yine bu derste, sosyal ve ekonomik d\u00fczenlemelere yeni h\u00fck\u00fcmlerin eklendi\u011fini g\u00f6r\u00fcyoruz. Bu h\u00fck\u00fcmler, mali ve ticari ili\u015fkileri i\u00e7erdikleri gibi baz\u0131 miras h\u00fck\u00fcmlerini ve hem erke\u011fin, hem de kad\u0131n\u0131n toplumda m\u00fclk edinmesinin hukuk\u00ee kurallar\u0131n\u0131 da a\u00e7\u0131klamaktad\u0131r.<\/p>\n

    B\u00fct\u00fcn bu yasal d\u00fczenlemelerin -surenin giri\u015f b\u00f6l\u00fcm\u00fcnde dedi\u011fimiz gibi temel amac\u0131 \u015fudur: M\u00fcsl\u00fcman toplumu, cahiliye d\u00fczeninden uzakla\u015ft\u0131r\u0131p \u0130slam’\u0131n \u00f6nerdi\u011fi hayat d\u00fczenine ge\u00e7irmek, ayr\u0131ca cahiliye sisteminin toplumsal niteliklerinin art\u0131klar\u0131n\u0131 silip yerlerine \u0130sl\u00e2m’\u0131n yeni toplumsal vas\u0131flar\u0131n\u0131 yerle\u015ftirmek. \u0130l\u00e2hi sistemin cahiliye batakl\u0131\u011f\u0131ndan \u00e7ekip \u00e7\u0131kard\u0131\u011f\u0131 bu \u0130sl\u00e2m toplumuna y\u00fckseli\u015f merdivenini basamak basamak \u00e7\u0131kmas\u0131n\u0131 sa\u011flayarak o y\u00fcce doru\u011fa t\u0131rmanmas\u0131na imkan haz\u0131rlamak.<\/p>\n

    Be\u015finci c\u00fcz\u00fcn ikinci b\u00f6l\u00fcm\u00fcn\u00fcn \u00e2yetlerinde \u0130sl\u00e2m d\u00fc\u015f\u00fcncesinin temel ilkelerinin belirlenmesinin yeniden ele al\u0131nd\u0131\u011f\u0131n\u0131 g\u00f6r\u00fcr\u00fcz. Bu ayetlerde iman\u0131n s\u0131n\u0131rlar\u0131 belirleniyor, m\u00fcsl\u00fcman olman\u0131n temel \u015fart\u0131 vurgulan\u0131yor.     \u00dc\u00e7\u00fcnc\u00fc b\u00f6l\u00fcmde bu surenin ana konular\u0131ndan biri olan ehl-i kitapla hesapla\u015fma konusu g\u00fcndeme geliyor. Bu hesapla\u015fma ayetlerinde kitap ehlinin m\u00fcsl\u00fcman cemaate ili\u015fkin k\u00f6t\u00fc niyetleri ve kirli emelleri a\u00e7\u0131\u011fa vuruluyor,<\/p>\n

    tuzaklar\u0131n\u0131n ve entrikalar\u0131n\u0131n mahiyeti a\u00e7\u0131klan\u0131p, tutumlar\u0131 belirtilerek sonunda kendilerini bekleyen k\u00f6t\u00fc ak\u0131betle ve ac\u0131kl\u0131 azapla tehdit ediliyorlar.<\/p>\n

    Bu c\u00fcz\u00fcn d\u00f6rd\u00fcnc\u00fc b\u00f6l\u00fcm\u00fcn\u00fc olu\u015fturan ayetlerin amac\u0131 ise; dinin anlam\u0131n\u0131, m\u00fcmin olman\u0131n vazge\u00e7ilmez \u015fart\u0131n\u0131 ve \u0130sl\u00e2m’\u0131n tan\u0131m\u0131n\u0131 kesin ve yoruma kapal\u0131 bir dille a\u00e7\u0131klamakt\u0131r. Bu ayetlerde \u0130sl\u00e2mi d\u00fczenin mahiyeti; m\u00fcsl\u00fcman\u0131n itaat, ba\u011fl\u0131l\u0131k, emir ve yasaklar\u0131 sadece y\u00fcce Allah’tan alma, s\u0131rf y\u00fcce Allah’\u0131n sisteminin hakemli\u011fine ba\u015fvurma, peygamberimizin h\u00fck\u00fcmlerine uyma ve boyun e\u011fme konular\u0131 a\u00e7\u0131kl\u0131\u011fa kavu\u015fturuluyor. Bunlar\u0131n yan\u0131s\u0131ra m\u00fcsl\u00fcmanlar\u0131n, emanetleri ehillerine teslim etme, insanlar aras\u0131nda adil h\u00fck\u00fcmler verme, insanlar\u0131n hayat\u0131nda y\u00fcce Allah’\u0131n sistemini egemen k\u0131lma uygulamalar\u0131na ili\u015fkin y\u00fck\u00fcml\u00fcl\u00fckleri vurgulanmakta ve bu y\u00fck\u00fcml\u00fcl\u00fckler, iman\u0131n pratikte ger\u00e7ekle\u015febilmesinin \u015fart\u0131 say\u0131lmaktad\u0131r. Bu prensiple ba\u011flant\u0131l\u0131 olarak m\u00fcmin olduklar\u0131n\u0131 iddia ettikleri halde iman\u0131n bu ilk \u015fart\u0131na, yani y\u00fcce Allah’\u0131 ve peygamberimizi her konuda hakem kabul edip bunlar\u0131n h\u00fck\u00fcmlerine tam bir g\u00f6n\u00fcl ho\u015fnutlu\u011fu ile teslim olma \u015fart\u0131na s\u0131rt \u00e7evirenlerin \u00e7eli\u015fkili tutumlar\u0131 hayretle kar\u015f\u0131lanmakta ve bu a\u00e7\u0131k ve kesin \u015fart\u0131 yerine getirmeyenlerin, bu yoldaki b\u00fct\u00fcn kuru iddialar\u0131na ra\u011fmen asla m\u00fcmin olamayacaklar\u0131 \u0131srarla vurgulanmaktad\u0131r.<\/p>\n

    Bu ilke ile ba\u011flant\u0131l\u0131 olarak yine bu be\u015finci b\u00f6l\u00fcmde m\u00fcsl\u00fcman cemaat, bu apa\u00e7\u0131k sistemi savunma u\u011frunda sava\u015fmaya \u00e7a\u011fr\u0131lmakta, bu \u00e7a\u011fr\u0131ya yan \u00e7izen y\u0131lg\u0131nlar ile ona s\u0131rt \u00e7eviren m\u00fcnaf\u0131klar k\u0131nanmakta, m\u00fcminlerin kalblerine cihad \u015fevki a\u015f\u0131lanmak amac\u0131 ile \u0130sl\u00e2mi sava\u015f\u0131n ama\u00e7lar\u0131 a\u00e7\u0131klanmakta; bask\u0131 alt\u0131nda ya\u015fayan m\u00fcminleri k\u00fcf\u00fcr diyar\u0131ndan kurtararak \u0130sl\u00e2m \u00fclkesine kavu\u015fturman\u0131n, onlara bu y\u00fcce sistemin egemenli\u011fi alt\u0131nda onurlu bir hayat s\u00fcrd\u00fcrme imk\u00e2n\u0131 sa\u011flaman\u0131n bu cihad\u0131n ba\u015fta gelen hedefi oldu\u011fu belirtilmektedir. Ayr\u0131ca kalbleri korkudan ve y\u0131lg\u0131nl\u0131ktan ar\u0131nd\u0131rmak amac\u0131 ile \u00f6l\u00fcm\u00fcn ecelin ve kaderin mahiyeti anlat\u0131lmaktad\u0131r. Bu b\u00f6l\u00fcm tek ba\u015f\u0131na bile kalsa cihada devam etmesini i\u00e7eren peygamberimizin (sal\u00e2t ve sel\u00e2m \u00fczerine olsun) \u015fahs\u0131na y\u00f6nelik bir emirle sona eriyor. Demek ki; bu dini, bu tutarl\u0131 il\u00e2hi sistemi egemen k\u0131lmak i\u00e7in s\u00fcrekli sava\u015fmak, ka\u00e7\u0131n\u0131lmaz bir g\u00f6revdir.<\/p>\n

    Bu c\u00fcz\u00fcn alt\u0131nc\u0131 b\u00f6l\u00fcm\u00fcn\u00fc olu\u015fturan ayetlerde sava\u015fma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc ile ba\u011flant\u0131l\u0131 olarak devletleraras\u0131 hukukun bir\u00e7ok kural\u0131 a\u00e7\u0131klan\u0131yor; \u0130sl\u00e2m toplumu ile ate\u015f-kes imzalam\u0131\u015f ya da bar\u0131\u015f antla\u015fmas\u0131 yapm\u0131\u015f d\u00fc\u015fman devletler aras\u0131ndaki ili\u015fkilerin nas\u0131l olmas\u0131 gerekti\u011fi anlat\u0131l\u0131yor. Buna g\u00f6re mesele basit bir kaba kuvvet, bir tepeleme ve boyunduruk alt\u0131na alma meselesi de\u011fildir. Tersine farkl\u0131 ideolojilere ba\u011fl\u0131 d\u00fc\u015fman bloklar\u0131n ba\u011fl\u0131lar\u0131na hadise ve \u015fartlar\u0131n gerektirdi\u011fi ger\u00e7ek\u00e7i bir yakla\u015f\u0131mla muamele yapmak gerekir.<\/p>\n

    Yedinci b\u00f6l\u00fcm\u00fcn ayetlerinde belirli bir \u0130sl\u00e2m devleti kuruldu\u011fu, \u0130sl\u00e2m’\u0131n aziz ve onurlu sanca\u011f\u0131 bu devletin g\u00f6klerinde dalgaland\u0131\u011f\u0131 halde buraya g\u00f6\u00e7 etmeyi ihmal ederek k\u00fcf\u00fcr diyar\u0131nda dini inan\u00e7lar\u0131n\u0131n zay\u0131flamas\u0131 ihtimaline meydan verenlerin \u00e7ekingenlikleri k\u0131nan\u0131rken bununla ba\u011flant\u0131l\u0131 olarak mali ve bedeni cihad g\u00f6revi i\u015flenmektedir. Bu k\u0131s\u0131m, m\u00fcminleri sava\u015fmaya, d\u00fc\u015fmanlar\u0131n\u0131n izini s\u00fcrmeye, onlara soluk ald\u0131rmamaya, d\u00fc\u015fmanlar\u0131n\u0131 kovalama hususunda gev\u015fekli\u011fe kap\u0131lmamaya te\u015fvik eder. Bunun yan\u0131s\u0131ra m\u00fcminlerin<\/p>\n

    durumu ile \u0130sl\u00e2m d\u00fc\u015fmanlar\u0131n\u0131n durumunu; her ikisinin istikametleri, ak\u0131betleri ve Ahirette g\u00f6recekleri kar\u015f\u0131l\u0131klar bak\u0131m\u0131ndan birbirlerinden farkl\u0131 olduklar\u0131n\u0131 belirten ayetler ile sona erer.<\/p>\n

    Sekizinci b\u00f6l\u00fcm\u00fcn ayetleri \u0130sl\u00e2m adaletinin bir \u015fahikas\u0131n\u0131, doruk noktas\u0131na ula\u015fm\u0131\u015f somut bir uygulamas\u0131n\u0131 g\u00f6zlerimizin \u00f6n\u00fcne getiriyor. Bilindi\u011fi gibi bir yahudi haks\u0131z olarak z\u0131rh h\u0131rs\u0131z\u0131 olmakla su\u00e7lanm\u0131\u015f ve bu su\u00e7lama as\u0131ls\u0131z \u015fahitlikler ile per\u00e7inlenmi\u015fti. \u0130\u015fte bunun \u00fczerine y\u00fcce Allah’\u0131n kat\u0131ndan birbiri pe\u015fi s\u0131ra inen bir dizi ayet, bu masum yahudiyi akl\u0131yor. Oysa yahudiler o s\u0131rada \u0130sl\u00e2m’a ve m\u00fcsl\u00fcmanlara kar\u015f\u0131 komplo \u00fcst\u00fcne komplo d\u00fczenlemekle me\u015fguld\u00fcrler. Fakat \u0130sl\u00e2m adaleti, sempati ve antipati gibi duygular\u0131n etkisi alt\u0131nda kalmayan ilahi bir adalettir. Bu olay; insanl\u0131\u011f\u0131n bu e\u015fsiz ve y\u00fcce sistemin d\u0131\u015f\u0131nda hi\u00e7bir sistemde ula\u015famad\u0131\u011f\u0131, benzerini ya\u015famad\u0131\u011f\u0131 bir adalet doru\u011fudur.’<\/p>\n

    Dokuzuncu b\u00f6l\u00fcm\u00fcn konusu; \u015firk, m\u00fc\u015frikler, \u015firk kaynakl\u0131 hurafeler, bu hurafelerin etkisi ile olu\u015fmu\u015f sap\u0131k sloganlar ve sa\u00e7ma d\u00fc\u015f\u00fcncelerdir. Bu k\u0131sm\u0131n ayetlerinde y\u00fcce Allah’\u0131n adaletine ili\u015fkin as\u0131ls\u0131z saplant\u0131lar ve kuruntular ele al\u0131n\u0131p d\u00fczeltiliyor, cezalar\u0131n ve \u00f6d\u00fcllerin bu saplant\u0131lara ve kuruntulara g\u00f6re de\u011fil, i\u015flenen amellere g\u00f6re bi\u00e7ilece\u011fi belirtiliyor; bunun yan\u0131s\u0131ra tek ger\u00e7ek dinin sadece \u0130sl\u00e2m oldu\u011fu ve bu dinin ayn\u0131 zamanda Hz. \u0130brahim’in (sel\u00e2m \u00fczerine olsun) de dini oldu\u011fu vurgulan\u0131yor.<\/p>\n

    Onuncu b\u00f6l\u00fcm\u00fcn ayetlerinde ise bu surenin ilk konusunu olu\u015fturan kad\u0131nlar\u0131n -\u00f6zellikle yetim k\u0131zlar\u0131n- ve kimsesiz \u00e7ocuklar\u0131n haklar\u0131na tekrar d\u00f6n\u00fcld\u00fc\u011f\u00fcn\u00fc g\u00f6r\u00fcr\u00fcz. Bununla ba\u011flant\u0131l\u0131 olarak kad\u0131n\u0131n, kocas\u0131 taraf\u0131ndan ihmal edilmesi ya da aldat\u0131lmas\u0131 olaylar\u0131na ili\u015fkin \u00e7\u00f6z\u00fcmler anlat\u0131l\u0131yor. Bu arada ideal kar\u0131-koca hayat\u0131n\u0131n ger\u00e7ekle\u015febilmesi i\u00e7in hangi \u015fartlara uyulmas\u0131 gerekti\u011fi a\u00e7\u0131klan\u0131yor. E\u011fer bu \u015fartlara uyulmaz ise ortak aile hayat\u0131n\u0131n y\u00fcr\u00fcyemeyece\u011fi ve bu \u015fartlara ili\u015fkin aksakl\u0131klar giderilemezse e\u015flerin birbirinden ayr\u0131lmalar\u0131n\u0131n daha hay\u0131rl\u0131 olaca\u011f\u0131 belirtiliyor.<\/p>\n

    E\u015flere adil davranma ve genel anlamda aile hayat\u0131na ili\u015fkin bu h\u00fck\u00fcmlerin arkas\u0131ndan gelen uyar\u0131c\u0131 sonu\u00e7 c\u00fcmlelerinde; bu h\u00fck\u00fcmler ile bu direktifler, y\u00fcce Allah’a, Allah’\u0131n g\u00f6klerin ve yery\u00fcz\u00fcn\u00fcn maliki olu\u015funa ve y\u00fcce Allah’\u0131n \u015fimdiki b\u00fct\u00fcn insanlar\u0131 ortadan kald\u0131r\u0131p yerlerine ba\u015fka insanlar getirmeye g\u00fcc\u00fc yetti\u011fine ba\u011flan\u0131yor. Bu da meselenin, ilahl\u0131\u011f\u0131n deh\u015fet verici ger\u00e7e\u011fi ile ilgili son derece \u00f6nemli bir husus oldu\u011funu kan\u0131tlar. Arkas\u0131ndan kalplerdeki Allah korkusu harekete ge\u00e7iriliyor ve m\u00fcminlere, her t\u00fcrl\u00fc insanlar aras\u0131 ili\u015fkilerinde ve verdikleri b\u00fct\u00fcn h\u00fck\u00fcmlerde mutlak anlamda adil olmalar\u0131 \u00e7a\u011fr\u0131s\u0131 yenileniyor. Bu \u00e7a\u011fr\u0131 yenilemesi, Kur’an’\u0131n bildi\u011fimiz \u00fcsl\u00fbbu uyar\u0131nca, belirli bir konunun dar alan\u0131ndan hareket ederek genel ve yayg\u0131n bir \u00e7evreye a\u00e7\u0131l\u0131yor.<\/p>\n

    Arkas\u0131ndan bu c\u00fcz\u00fcn son b\u00f6l\u00fcm\u00fcn\u00fc olu\u015fturan ayet demeti geliyor. Bu k\u0131sm\u0131n hemen hemen tek konusu m\u00fcnaf\u0131kl\u0131\u011f\u0131 ve m\u00fcnaf\u0131klar\u0131 k\u0131namak; m\u00fcminleri ciddi belirgin ve istikametli bir imana sahip olmaya \u00e7a\u011f\u0131rmakt\u0131r. Bunun gere\u011fi olarak m\u00fcminleri m\u00fcsl\u00fcman cemaatten ba\u015fka bir dost, bir dayanak edinmekten, \u0130sl\u00e2m y\u00f6netiminden ba\u015fkas\u0131na ba\u011fl\u0131l\u0131k g\u00f6stermekten ka\u00e7\u0131nmak, gerek m\u00fcnaf\u0131klara ve gerekse bu dinin a\u00e7\u0131k d\u00fc\u015fmanlar\u0131na kar\u015f\u0131 yersiz bir nezaket g\u00f6stererek ya da onlarla aradaki sosyal ve \u015fahsi ili\u015fkilerin etkisinde kalarak dini konularda gev\u015fek ve savsaklay\u0131c\u0131 davranmamalar\u0131m m\u00fcsl\u00fcmanlara \u00f6nemle telkin etmektir. Bu son tutum m\u00fcnaf\u0131kl\u0131\u011f\u0131n belirtilerinden biridir. M\u00fcnaf\u0131klar\u0131n yeri ise cehennemin en alt kat\u0131d\u0131r. M\u00fcnaf\u0131klar; k\u00e2firleri dost ve m\u00fcttefik edinen kimselerdir.<\/p>\n

    Daha sonra bu c\u00fczle birlikte bu b\u00f6l\u00fcm y\u00fcce Allah’\u0131n s\u0131fatlar\u0131na, O’nunla kullar\u0131 aras\u0131ndaki ili\u015fkinin niteli\u011fine ve yine O’nun yoldan \u00e7\u0131km\u0131\u015flar\u0131 ve sap\u0131klar\u0131 neden cezaland\u0131rd\u0131\u011f\u0131na ili\u015fkin etkili bir a\u00e7\u0131klama ile noktalan\u0131yor. E\u011fer kullar Allah’a iman etseler, O’na \u015f\u00fckretseler, O’nun onlar\u0131 cezaland\u0131rmakta hi\u00e7bir yarar\u0131 yoktur. Allah \u015f\u00f6yle buyuruyor:<\/p>\n

    “E\u011fer Allah’a \u015f\u00fckreder, inan\u0131rsan\u0131z, O sizi niye azaba \u00e7arpt\u0131rs\u0131n ki? Hi\u00e7 \u015f\u00fcphesiz, Allah \u015f\u00fckre kar\u015f\u0131l\u0131k verir ve her \u015feyi bilir.” (Nisa Suresi, 147)<\/strong><\/p>\n

    Bu ifade acayip bir ifade., Y\u00fcce Allah’\u0131n rahmetini, insanlara azap \u00e7ektirmede hi\u00e7bir yarar\u0131 olmad\u0131\u011f\u0131n\u0131, e\u011fer O’nun sistemine uygun ya\u015fasalar, bu sistemi sunu\u015fundaki l\u00fctfa ve ba\u011f\u0131\u015fa kar\u015f\u0131 \u015f\u00fckretseler insanlar\u0131 azaba \u00e7arpt\u0131rmas\u0131n\u0131n s\u00f6z konusu olmayaca\u011f\u0131n\u0131 kalplere duyuran, \u015fa\u015f\u0131rt\u0131c\u0131 derecede s\u0131cak ve cana yak\u0131n bir ifade. Fakat durum b\u00f6yleyken insanlar; k\u00e2firlikleri, ink\u00e2rc\u0131l\u0131klar\u0131, bu k\u00fcf\u00fcr ve ink\u00e2rc\u0131l\u0131\u011f\u0131n sebep oldu\u011fu psikolojik (ferdi), sosyal ve uluslararas\u0131 bozgunculuklar\u0131 y\u00fcz\u00fcnden il\u00e2hi azab\u0131 kendi elleri ile sat\u0131n al\u0131yorlar.<\/p>\n

    \u0130\u015fte bu c\u00fcz bu konular ve ama\u00e7lar y\u0131\u011f\u0131n\u0131n\u0131 bu kadar geni\u015f \u00e7apta ve boyutta sayfalar\u0131na s\u0131\u011fd\u0131r\u0131yor. Burada baz\u0131 k\u0131sa de\u011finmeler yapmakla yetiniyor ve y\u00fcce Allah’\u0131n yard\u0131m\u0131 ile tek tek ayetlerin ayr\u0131nt\u0131l\u0131 a\u00e7\u0131klamas\u0131na ge\u00e7iyoruz.<\/p>\n

    EVL\u0130L\u0130K KURUMU<\/strong><\/p>\n

    Bu surenin a\u015fa\u011f\u0131da inceleyece\u011fimiz ayetleri, aile kurumunu f\u0131tri temellere oturtma \u00e7abas\u0131n\u0131n tamamlay\u0131c\u0131s\u0131 niteli\u011fini ta\u015f\u0131r. Surenin ak\u0131\u015f\u0131 boyunca iki nokta d\u0131\u015f\u0131nda bu konuya bir daha de\u011finilmeyecektir. Bu iki nokta ile de bu son derece \u00f6nemli temel konuya ili\u015fkin ek niteli\u011finde baz\u0131 h\u00fck\u00fcmler a\u00e7\u0131klanacakt\u0131r. Ger\u00e7ekten aile kurumunun yasal d\u00fczenlemeye kavu\u015fturulmas\u0131 o kadar \u00f6nemlidir ki, insan hayat\u0131n\u0131n f\u0131tr\u00ee mecras\u0131 (do\u011fu\u015ftan gelen ak\u0131\u015f\u0131) i\u00e7inde dengeli ve sa\u011fl\u0131kl\u0131 seyri bu yasal d\u00fczenlemeye ba\u011fl\u0131 oldu\u011fu gibi bu kurumun amac\u0131ndan sapmas\u0131 kesinlikle yery\u00fcz\u00fcnde karga\u015fal\u0131\u011fa ve sosyal \u00e7alkant\u0131lara yol a\u00e7ar.<\/p>\n

    Bu b\u00f6l\u00fcm\u00fcn ayetleri kendileri ile evlenmenin yasak oldu\u011fu kad\u0131nlara ili\u015fkin ek bir a\u00e7\u0131klama g\u00fcndeme getiriyor; sa\u011fl\u0131kl\u0131 bir aile kurumu i\u00e7inde y\u00fcce Allah’\u0131n kad\u0131nlar ve erkekler taraf\u0131ndan ortakla\u015fa g\u00f6zetilmesini istedi\u011fi \u015fartlar\u0131 belirliyor. Bu \u015fartlar\u0131 g\u00f6zetmenin temiz ve sa\u011fl\u0131kl\u0131 bir aile yuvas\u0131n\u0131 g\u00fcvence alt\u0131na al\u0131c\u0131 niteli\u011fi yan\u0131nda insanlar i\u00e7in kolayl\u0131k ve problemsizlik sa\u011flad\u0131\u011f\u0131 anlat\u0131l\u0131yor. Bunlar\u0131n yan\u0131s\u0131ra bu kurumun dayana\u011f\u0131n\u0131 olu\u015fturan temel yasal kurallar ile evlilik akdini ger\u00e7ekle\u015ftiren taraflar\u0131n her ikisinin omuzlar\u0131na y\u00fcklenen kar\u015f\u0131l\u0131kl\u0131 haklar ve g\u00f6revler a\u00e7\u0131klan\u0131yor.<\/p>\n

    S\u00f6z\u00fc edilen aile kurumu d\u00fczenlemesine paralel olarak m\u00fcsl\u00fcman toplumda ge\u00e7erli olacak mali ili\u015fkilerin baz\u0131 yasalar\u0131 da belirtiliyor. Gerek ferdi te\u015febb\u00fcs ve gerekse miras yolu ile kazan\u0131lan mallara ili\u015fkin hukuki d\u00fczenlemeler getirilip bununla ba\u011flant\u0131l\u0131 olarak akraba olmayanlar aras\u0131nda evlilik yolu ile birbirine miras ge\u00e7i\u015fini sa\u011flayan s\u00f6zle\u015fmelerin nas\u0131l \u00e7\u00f6z\u00fcme ba\u011flanacaklar\u0131 a\u00e7\u0131klan\u0131yor.<\/p>\n

    Bu b\u00f6l\u00fcmde genel olarak \u015fu nokta dikkatimizi \u00e7ekmektedir. Bu k\u0131sm\u0131 olu\u015fturan ayetler, b\u00fct\u00fcn bu yasal d\u00fczenlemeler ve h\u00fck\u00fcmler ile iman\u0131n ba\u015fta gelen temel ilkesi aras\u0131nda s\u0131k\u0131 bir ba\u011f kuruyor. Bunun yan\u0131s\u0131ra bu yasal d\u00fczenlemelerin engin bilgi ve hikmet sahibi olan, Kur’an’\u0131n deyimi ile “Al\u00eem” ve “Hak\u00eem” olan y\u00fcce Allah’tan kaynakland\u0131\u011f\u0131 ger\u00e7e\u011fi de \u0131srarla vurgulan\u0131r.     A\u015fa\u011f\u0131da ayetlerini okuyaca\u011f\u0131m\u0131z bu b\u00f6l\u00fcm\u00fcn \u0131srarla vurgulad\u0131\u011f\u0131 bir ba\u015fka ger\u00e7ek de \u015fudur: Y\u00fcce Allah’\u0131n sistemi, insanlar\u0131n \u015fahsi arzular\u0131n\u0131n \u00fcr\u00fcn\u00fc olarak ortaya koymak istedikleri b\u00fct\u00fcn sistemlerden daha kolay, daha k\u00fclfetsiz ve f\u0131trata daha yak\u0131nd\u0131r. Y\u00fcce Allah’\u0131n bu sistemi ortaya koymu\u015f olmas\u0131, O’nun insan yetersizli\u011fini tel\u00e2fi edici bir rahmetidir.
