Hamd kendisinden ba\u015fka ilah olmayan, mutlak manada tek g\u00fc\u00e7 ve kudret sahibi olan Allah\u2019a mahsustur. Salat ve selam t\u00fcm peygamberlerin ve onlar\u0131 takip eden tabilerinin \u00fczerine olsun.<\/p>\n

34- Ancak, sizin onlara g\u00fc\u00e7 yetirmenizden \u00f6nce tevbe edenler ba\u015fka. Biliniz ki, \u015f\u00fcphesiz Allah ba\u011f\u0131\u015flayand\u0131r, esirgeyendir.(57)<\/strong>
\n35- Ey iman edenler, Allah’tan korkup-sak\u0131n\u0131n ve (sizi) O’na (yakla\u015ft\u0131racak) vesile aray\u0131n;(58) O’nun yolunda cihad edin,(59) umulur ki kurtulu\u015fa erersiniz.<\/strong>
\n36- Ger\u00e7ek \u015fu ki, k\u00fcfre sapanlar, yery\u00fcz\u00fcnde olanlar\u0131n t\u00fcm\u00fc ve bununla birlikte bir kat\u0131 daha onlar\u0131n olsa, bununla da k\u0131yamet g\u00fcn\u00fcn\u00fcn azab\u0131ndan (kurtulmak i\u00e7in) fidye vermeye kalk\u0131\u015fsalar, yine onlardan kabul edilmez. Onlar i\u00e7in ac\u0131kl\u0131 bir azab vard\u0131r.<\/strong>
\n37- (Orda) Ate\u015ften \u00e7\u0131kmak isterler, ama ondan \u00e7\u0131kacak de\u011filler. Onlar i\u00e7in s\u00fcrekli bir azab vard\u0131r.<\/strong>
\n38- H\u0131rs\u0131z erkek ve h\u0131rs\u0131z kad\u0131n\u0131n, (\u00e7al\u0131p) kazand\u0131klar\u0131na bir kar\u015f\u0131l\u0131k, Allah’tan da, ‘tekrar\u0131 \u00f6nleyen kesin bir ceza’ olmak \u00fczere ellerini kesin.(60) Allah \u00fcst\u00fcn ve g\u00fc\u00e7l\u00fc oland\u0131r, h\u00fck\u00fcm ve hikmet sahibidir.<\/strong>
\n39- Ancak kim i\u015fledi\u011fi zul\u00fcmden sonra tevbe eder ve (davran\u0131\u015flar\u0131n\u0131) d\u00fczeltirse, \u015f\u00fcphesiz Allah onun tevbesini kabul eder.(61) Muhakkak Allah, ba\u011f\u0131\u015flayand\u0131r, esirgeyendir.<\/strong>
\n40- G\u00f6klerin de, yerin de m\u00fclk\u00fcn\u00fcn Allah’a ait oldu\u011funu bilmiyor musun? O, kimi dilerse azabland\u0131r\u0131r, kimi dilerse ba\u011f\u0131\u015flar. Allah, her \u015feye g\u00fc\u00e7 yetirendir.<\/strong><\/p>\n

57. Burada, e\u011fer k\u00f6t\u00fcl\u00fck \u00e7\u0131karmaktan ve me\u015fru sistemi y\u0131kma giri\u015fiminden el \u00e7ekerler ve davran\u0131\u015flar\u0131yla kanuna ba\u011fl\u0131 ve bar\u0131\u015fsever iyi vatanda\u015flar olduklar\u0131n\u0131 g\u00f6sterirlerse, pi\u015fmanl\u0131klar\u0131ndan \u00f6nce su\u00e7lardan birini i\u015flemi\u015f bile olsalar, ayette ge\u00e7en cezalardan hi\u00e7birinin kendilerine verilmeyece\u011fi anlam\u0131 yatmaktad\u0131r. Bununla birlikte \u00f6ld\u00fcrme veya h\u0131rs\u0131zl\u0131k gibi, herhangi bir bireye kar\u015f\u0131 i\u015fledikleri bir su\u00e7tan dolay\u0131 mahkemeye \u00e7a\u011fr\u0131labilirler; fakat, i\u015fledikleri ihanet veya isyan, ya da Allah ve Ras\u00fbl\u00fcne kar\u015f\u0131 sava\u015f su\u00e7uyla yarg\u0131lanamazlar.

\n59. “Elinizden geleni yap\u0131n” ifadesi “C\u00e2hid\u00fb”nun anlam\u0131n\u0131 b\u00fct\u00fcn\u00fcyle vermemektedir. ‘Cahid\u00fb’da \u015fu anlam vard\u0131r: M\u00fcminler Allah’\u0131n yolu \u00fczerinde duran t\u00fcm g\u00fc\u00e7lerle m\u00fccadele etmelidirler. “Allah yolunda elinizden geleni yaparsan\u0131z, ancak, Allah’\u0131n r\u0131zas\u0131n\u0131 kazanabilir ve O’nu memnun edebilirsiniz. \nGer\u00e7ek ba\u015far\u0131 ve kurtulu\u015fun ise, t\u00fcmden ve yaln\u0131zca Allah’a kul olup, ba\u015fka hi\u00e7 bir \u015feye boyun e\u011fmeden a\u00e7\u0131ktan ve gizliden Allah’a itaatte yatt\u0131\u011f\u0131 ortadad\u0131r. B\u00f6yle olunca, d\u00fc\u015fmanla ku\u015fkusuz bir \u00e7at\u0131\u015fma durumu do\u011facakt\u0131r. Bu nedenle, “m\u00fcmin” t\u00fcm d\u00fc\u015fman ve kar\u015f\u0131t g\u00fc\u00e7lerle her zaman ve her durumda sava\u015fa tutu\u015fmad\u0131k\u00e7a amac\u0131na ula\u015famaz. Ne zaman t\u00fcm bu engelleri ortadan kald\u0131r\u0131rsa, i\u015fte o zaman Allah’\u0131n yolunda y\u00fcr\u00fcmesini s\u00fcrd\u00fcr\u00fcr.
\n60. H\u0131rs\u0131z\u0131n (iki de\u011fil) bir eli kesilir ve ilk h\u0131rs\u0131zl\u0131k olay\u0131nda sa\u011f elin kesilmesi konusunda icma vard\u0131r.
\nHz. Peygamber (s.a) emniyeti k\u00f6t\u00fcye kullan\u0131p emanete h\u0131yaneti h\u0131rs\u0131zl\u0131k saymam\u0131\u015f ve bu su\u00e7u i\u015fleyenin eli kesilmeyece\u011fini irade buyurmu\u015ftur. Bu da g\u00f6stermektedir ki, h\u0131rs\u0131zl\u0131k ancak birinin elinin alt\u0131ndaki mal haks\u0131z yere \u00e7al\u0131n\u0131p m\u00fclkiyete ge\u00e7irildi\u011fi zaman meydana gelir.
\nHz. Peygamber (s.a) yine, de\u011feri bir kalkandan daha az olan bir mal\u0131 \u00e7alan\u0131n elinin kesilmeyece\u011fini belirtmi\u015ftir. O zamanda bir kalkan\u0131n fiat\u0131 a) Abdullah \u0130bn Abbas’a (r.a) g\u00f6re on dirhem, b) \u0130bn \u00d6mer’e (r.a) g\u00f6re \u00fc\u00e7 dirhem, c) Hz. Ai\u015fe’ye (r.a) g\u00f6re bir dinar\u0131n d\u00f6rtte biriydi. Bu farkl\u0131l\u0131k, h\u0131rs\u0131zl\u0131kta elin kesilmesi i\u00e7in asgari s\u0131n\u0131r\u0131n ne oldu\u011fu konusunda fakihler aras\u0131nda g\u00f6r\u00fc\u015f ayr\u0131l\u0131\u011f\u0131na neden olmu\u015ftur. \u0130mam Ebu Han\u00eefe’ye g\u00f6re bu on dirhemdir, \u0130mam Malik, \u015eafi\u00ee ve Ahmed’e g\u00f6re ise bir dinar\u0131n d\u00f6rtte biridir. (O zaman dirhem \u00fc\u00e7 me\u015fh ve 1.1\/5 ratti g\u00fcm\u00fc\u015fe, dinar\u0131n d\u00f6rtte biri ise \u00fc\u00e7 dirhem’e e\u015fitti.)
\nYine \u00e7al\u0131nd\u0131\u011f\u0131nda el kesme gerekmeyen pek \u00e7ok \u015fey vard\u0131r. \u00d6rne\u011fin, Hz. Peygamber (s.a) “Meyve ve sebzelerin \u00e7al\u0131nmas\u0131nda el kesme yoktur” ve “yenilecek \u015feylerin \u00e7al\u0131nmas\u0131nda el kesme yoktur” buyurmu\u015flard\u0131r. Hz. Ai\u015fe’den (r.a) rivayet edilen bir hadise g\u00f6re, “Hz. Peygamber (s.a) zamam\u0131nda \u00f6nemsiz \u015feylerin \u00e7al\u0131nmas\u0131nda el kesilmezdi.” Halife Hz. Osman ve Hz. Ali (r.a) ku\u015f \u00e7alan\u0131n elinin kesilmemesine h\u00fckmetmi\u015f ve buna hi\u00e7bir sahabe kar\u015f\u0131 \u00e7\u0131kmam\u0131\u015ft\u0131. Hatta Halife Hz. \u00d6mer ve Hz. Ali (r.a) kamu hazinesinden yap\u0131lan h\u0131rs\u0131zl\u0131k kar\u015f\u0131s\u0131nda el kesmemi\u015f ve ashab i\u00e7inde buna kar\u015f\u0131 \u00e7\u0131kan bulundu\u011fu yolunda bir rivayet gelmemi\u015ftir.
\nYukar\u0131daki \u00f6rnekleri g\u00f6z \u00f6n\u00fcnde tutan fakihler, elin kesilmesini gerektiren h\u0131rs\u0131zl\u0131klara pek\u00e7ok \u015feyi almam\u0131\u015flard\u0131. \u0130mam Ebu Han\u00eefe’ye g\u00f6re sebze, meyve, et, pi\u015fmi\u015f yemek, hen\u00fcz toplanmam\u0131\u015f tah\u0131l, e\u011flence ve m\u00fczik aletlerin \u00e7al\u0131nmas\u0131 halinde el kesilmez. Bunlardan ayr\u0131 olarak \u0130mam, ormanda otlayan hayvanlar \u00e7al\u0131nd\u0131\u011f\u0131nda ve kamu hazinesinden (Devlet Hazinesi) yap\u0131lan h\u0131rs\u0131zl\u0131klar kar\u015f\u0131s\u0131nda yine el kesilmeyece\u011fi g\u00f6r\u00fc\u015f\u00fcndedir.
