Hamd kendisinden ba\u015fka ilah olmayan, mutlak manada tek g\u00fc\u00e7 ve kudret sahibi olan Allah\u2019a mahsustur. Salat ve selam t\u00fcm peygamberlerin ve onlar\u0131 takip eden tabilerinin \u00fczerine olsun.<\/p>\n

236- Kad\u0131nlara el s\u00fcrmeden ya da mehirlerini belirlemeden onlar\u0131 bo\u015faman\u0131z\u0131n bir sak\u0131ncas\u0131 yoktur. Fakat eli geni\u015f olan kendi g\u00fcc\u00fcne g\u00f6re ve eli dar olan da kendi g\u00fcc\u00fcne g\u00f6re olmak \u00fczere onlara geleneklere uygun bir hediye verin. Bu, iyilikseverler i\u00e7in bir bor\u00e7tur.<\/em><\/strong><\/p>\n

237- E\u011fer kad\u0131nlar\u0131n mehirlerini belirler de onlar\u0131 el s\u00fcrmeden bo\u015farsan\u0131z, kendilerinin ya da nik\u00e2hlar\u0131n\u0131 akdetmeye yetkili erke\u011fin ba\u011f\u0131\u015flamas\u0131 durumu d\u0131\u015f\u0131nda belirledi\u011finiz mehrin yar\u0131s\u0131n\u0131 \u00f6demeniz gerekir. Ba\u011f\u0131\u015flaman\u0131z (mehrin tamam\u0131n\u0131 b\u0131rakman\u0131) takvaya daha yak\u0131nd\u0131r. Birbirinize kar\u015f\u0131 erdemli\u011fi unutmay\u0131n. Hi\u00e7 \u015f\u00fcphesiz ne yaparsan\u0131z Allah onu g\u00f6r\u00fcr.<\/em><\/strong><\/p>\n

Burada s\u00f6z\u00fc edilen birinci durum, kendisi ile cinsel ili\u015fkide bulunulmam\u0131\u015f ve mehri de belirlenmemi\u015f kad\u0131n\u0131n durumudur. Oysa mehir farzd\u0131r. Bu durumda e\u015fini bo\u015fayan erke\u011fe d\u00fc\u015fen g\u00f6rev, bo\u015fad\u0131\u011f\u0131 e\u015fine maddi g\u00fcc\u00fc ile orant\u0131l\u0131 bir hediye vermesi, uygun bir ba\u011f\u0131\u015fta bulunmas\u0131d\u0131r. B\u00f6yle bir davran\u0131\u015f bir t\u00fcr tazminat olmas\u0131 yan\u0131nda psikolojik y\u00f6nden b\u00fcy\u00fck de\u011fer ta\u015f\u0131r. Bu beraberlik ba\u011f\u0131n\u0131n hen\u00fcz ba\u015flang\u0131\u00e7ta kopmas\u0131 kad\u0131n\u0131n ruhunda buruk bir ac\u0131 meydana getirir, bu ayr\u0131l\u0131\u011f\u0131 d\u00fc\u015fmanca bir darbe gibi alg\u0131lar. Fakat bo\u015fayan erke\u011fin verece\u011fi uygun bir hediye bu kasvetli havay\u0131 da\u011f\u0131t\u0131r kad\u0131n\u0131n ruhunda sevgi ve mazur g\u00f6rme meltemlerinin esmesini sa\u011flar, bo\u015fanmadan kaynaklanan \u00fcz\u00fcnt\u00fc ve psikolojik \u00e7\u00f6k\u00fcnt\u00fc duygular\u0131n\u0131 hafifletir. Buna g\u00f6re bu evlilik, sadece ba\u015far\u0131s\u0131z bir giri\u015fimdir, yoksa \u00f6ld\u00fcr\u00fcc\u00fc bir darbe de\u011fildir.<\/p>\n

Bu gerek\u00e7e ile verilecek hediyenin geleneklere uygun bir nitelikte olmas\u0131 tavsiye ediliyor. B\u00f6ylelikle aradaki insani sevginin kaybolmamas\u0131 ve tatl\u0131 hat\u0131ralar\u0131n korunmas\u0131 ama\u00e7lan\u0131yor. Bu arada kocaya g\u00fcc\u00fcn\u00fc a\u015facak bir y\u00fck de y\u00fcklenmiyor. Verilecek hediye zengin kocan\u0131n zenginli\u011fi oran\u0131nda olacak, fakir kocan\u0131n da ba\u011f\u0131\u015flama imk\u00e2nlar\u0131n\u0131n s\u0131n\u0131r\u0131n\u0131 a\u015fmayacak:<\/p>\n

“Onlara geleneklere uygun bir hediye verin. Bu, iyilikseverler i\u00e7in bir bor\u00e7tur.”<\/strong><\/p>\n

\u0130kinci durum, kendisi ile cinsel ili\u015fki kurulmadan bo\u015fanan kad\u0131n\u0131n mehrinin belirlenmi\u015f olmas\u0131 durumudur. Bu gibi durumlarda bo\u015fanan kad\u0131na belirlenen mehrin yar\u0131s\u0131n\u0131n verilmesi gerekir. Yasan\u0131n gere\u011fi budur. Fakat Kur’an-\u0131 Kerim, bundan sonras\u0131n\u0131 ho\u015fg\u00f6r\u00fcye, erdeme ve kolayla\u015ft\u0131r\u0131c\u0131l\u0131\u011fa b\u0131rak\u0131yor. Buna g\u00f6re, s\u00f6z\u00fcn\u00fc etti\u011fimiz bo\u015fanm\u0131\u015f kad\u0131n -e\u011fer ya\u015f\u0131 k\u00fc\u00e7\u00fck ise yetkili velisi- yasan\u0131n erke\u011fin omuzlar\u0131na bindirdi\u011fi y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc affedebilir, bu konudaki hakk\u0131ndan vazge\u00e7ebilir. Bu durumdaki fedak\u00e2rl\u0131k g\u00f6n\u00fcll\u00fc, g\u00fc\u00e7l\u00fc, ba\u011f\u0131\u015flay\u0131c\u0131, ho\u015fg\u00f6r\u00fcl\u00fc, evlilik ba\u011f\u0131 kopmu\u015f bir erke\u011fin mal\u0131na tenezz\u00fcl etmeyen bir kad\u0131n\u0131n fedak\u00e2rl\u0131\u011f\u0131d\u0131r. Bunun yan\u0131s\u0131ra Kur’an-\u0131 Kerim, bu kalpleri safla\u015ft\u0131rmadan, parlatmadan ve her t\u00fcrl\u00fc lekeden ar\u0131nd\u0131rmadan elde b\u0131rakmak istemiyor:<\/p>\n

“Ba\u011f\u0131\u015flaman\u0131z (mehrin tamam\u0131n\u0131 b\u0131rakman\u0131z) takva haline daha yak\u0131nd\u0131r. Birbirinize kar\u015f\u0131 erdemli\u011fi unutmay\u0131n. Hi\u00e7 \u015f\u00fcphesiz ne yaparsan\u0131z Allah onu g\u00f6r\u00fcr.”<\/strong><\/p>\n

Ayet bask\u0131s\u0131n\u0131 \u0131srarla s\u00fcrd\u00fcrerek bu kalplerdeki takva bilincini, ho\u015fg\u00f6r\u00fc bilincini, erdemlik duygusunu, Allah’\u0131n g\u00f6zetimi alt\u0131nda olduklar\u0131 bilincini uyarmak, harekete ge\u00e7irmek istiyor. B\u00f6ylece gerek ba\u015far\u0131l\u0131 olan ve gerekse ba\u015far\u0131s\u0131zl\u0131kla sonu\u00e7lanan evlilik ili\u015fkisine nezaketin ve erdemin egemen olmas\u0131n\u0131, bu ili\u015fkiye ad\u0131m atan kalplerin durum ne olursa olsun ar\u0131, lekesiz ve saf olarak Allah’a ba\u011fl\u0131 kalmalar\u0131n\u0131 sa\u011flamay\u0131 ama\u00e7l\u0131yor.<\/p>\n

NAMAZ VAZGE\u00c7\u0130LMEZ B\u0130R ZORUNLULUKTUR<\/strong><\/p>\n

Kalplerin Allah’a ba\u011fland\u0131\u011f\u0131, kar\u0131-koca ili\u015fkilerinde nezaketin ve \u00f6zverinin Allah’a ibadet d\u00fczeyine \u00e7\u0131kart\u0131ld\u0131\u011f\u0131 bu ifade ortam\u0131nda konu d\u0131\u015f\u0131na \u00e7\u0131k\u0131larak \u0130sl\u00e2m’\u0131n en b\u00fcy\u00fck ibadeti olan namazdan s\u00f6zediliyor. Oysa bo\u015famaya ili\u015fkin h\u00fck\u00fcmlerin anlat\u0131m\u0131 hen\u00fcz sona ermi\u015f de\u011fil. Daha dul kad\u0131n\u0131n, kocas\u0131n\u0131n evinde oturma ve mal\u0131ndan ge\u00e7imini saklama hakk\u0131na,kocas\u0131n\u0131n bu hakk\u0131, \u00f6lmeden evvel yapaca\u011f\u0131 bir vasiyyete ba\u011flamas\u0131na ve genel olarak bo\u015fanm\u0131\u015f kad\u0131nlar\u0131n, kocalar\u0131 \u00fczerinde bak\u0131m haklar\u0131 bulundu\u011funa ili\u015fkin h\u00fck\u00fcmler a\u00e7\u0131klanmad\u0131. B\u00f6yle bir kompozisyonda konu b\u00f6l\u00fcnerek araya namaz mevzuu s\u0131k\u0131\u015ft\u0131r\u0131l\u0131yor ve \u015fu mesaj veriliyor m\u00fcminlere; Anlat\u0131lan b\u00fct\u00fcn bu h\u00fck\u00fcmlerde Allah’\u0131n emrine uymak, namaz k\u0131lmak gibi bir ibadettir bu ibadet ile o itaat ayn\u0131 t\u00fcrdendir. Bu, Kur’an’a \u00f6zg\u00fc ince bir anlat\u0131m tarz\u0131d\u0131r. Verilecek hediye zengin kocan\u0131n zenginli\u011fi oran\u0131nda olacak, fakir kocan\u0131n da ba\u011f\u0131\u015flama imk\u00e2nlar\u0131n\u0131n s\u0131n\u0131r\u0131n\u0131 a\u015fmayacak:\"eli geni\u015f olan kendi g\u00fcc\u00fcne g\u00f6re ve eli dar olan da kendi g\u00fcc\u00fcne g\u00f6re...\" Ayette iyilik ve c\u00f6mertlik te\u015fvik edilerek bunlar arac\u0131l\u0131\u011f\u0131 ile kalplerin buruklu\u011fu ve ortal\u0131\u011f\u0131 saran karamsarl\u0131k havas\u0131 da\u011f\u0131t\u0131lmak isteniyor:\"Onlara geleneklere uygun bir hediye verin. Bu, iyilikseverler i\u00e7in bir bor\u00e7tur.\"\u0130kinci durum, kendisi ile cinsel ili\u015fki kurulmadan bo\u015fanan kad\u0131n\u0131n mehrinin belirlenmi\u015f olmas\u0131 durumudur. Bu gibi durumlarda bo\u015fanan kad\u0131na belirlenen mehrin yar\u0131s\u0131n\u0131n verilmesi gerekir. Yasan\u0131n gere\u011fi budur. Fakat Kur'an-\u0131 Kerim, bundan sonras\u0131n\u0131 ho\u015fg\u00f6r\u00fcye, erdeme ve kolayla\u015ft\u0131r\u0131c\u0131l\u0131\u011fa b\u0131rak\u0131yor. Buna g\u00f6re, s\u00f6z\u00fcn\u00fc etti\u011fimiz bo\u015fanm\u0131\u015f kad\u0131n -e\u011fer ya\u015f\u0131 k\u00fc\u00e7\u00fck ise yetkili velisi- yasan\u0131n erke\u011fin omuzlar\u0131na bindirdi\u011fi y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc affedebilir, bu konudaki hakk\u0131ndan vazge\u00e7ebilir. Bu durumdaki fedak\u00e2rl\u0131k g\u00f6n\u00fcll\u00fc, g\u00fc\u00e7l\u00fc, ba\u011f\u0131\u015flay\u0131c\u0131, ho\u015fg\u00f6r\u00fcl\u00fc, evlilik ba\u011f\u0131 kopmu\u015f bir erke\u011fin mal\u0131na tenezz\u00fcl etmeyen bir kad\u0131n\u0131n fedak\u00e2rl\u0131\u011f\u0131d\u0131r. Bunun yan\u0131s\u0131ra Kur'an-\u0131 Kerim, bu kalpleri safla\u015ft\u0131rmadan, parlatmadan ve her t\u00fcrl\u00fc lekeden ar\u0131nd\u0131rmadan elde b\u0131rakmak istemiyor:\"Ba\u011f\u0131\u015flaman\u0131z (mehrin tamam\u0131n\u0131 b\u0131rakman\u0131z) takva haline daha yak\u0131nd\u0131r. Birbirinize kar\u015f\u0131 erdemli\u011fi unutmay\u0131n. Hi\u00e7 \u015f\u00fcphesiz ne yaparsan\u0131z Allah onu g\u00f6r\u00fcr.\"Ayet bask\u0131s\u0131n\u0131 \u0131srarla s\u00fcrd\u00fcrerek bu kalplerdeki takva bilincini, ho\u015fg\u00f6r\u00fc bilincini, erdemlik duygusunu, Allah'\u0131n g\u00f6zetimi alt\u0131nda olduklar\u0131 bilincini uyarmak, harekete ge\u00e7irmek istiyor. B\u00f6ylece gerek ba\u015far\u0131l\u0131 olan ve gerekse ba\u015far\u0131s\u0131zl\u0131kla sonu\u00e7lanan evlilik ili\u015fkisine nezaketin ve erdemin egemen olmas\u0131n\u0131, bu ili\u015fkiye ad\u0131m atan kalplerin durum ne olursa olsun ar\u0131, lekesiz ve saf olarak Allah'a ba\u011fl\u0131 kalmalar\u0131n\u0131 sa\u011flamay\u0131 ama\u00e7l\u0131yor.NAMAZ VAZGE\u00c7\u0130LMEZ B\u0130R ZORUNLULUKTURKalplerin Allah'a ba\u011fland\u0131\u011f\u0131, kar\u0131-koca ili\u015fkilerinde nezaketin ve \u00f6zverinin Allah'a ibadet d\u00fczeyine \u00e7\u0131kart\u0131ld\u0131\u011f\u0131 bu ifade ortam\u0131nda konu d\u0131\u015f\u0131na \u00e7\u0131k\u0131larak \u0130sl\u00e2m'\u0131n en b\u00fcy\u00fck ibadeti olan namazdan s\u00f6zediliyor. Oysa bo\u015famaya ili\u015fkin h\u00fck\u00fcmlerin anlat\u0131m\u0131 hen\u00fcz sona ermi\u015f de\u011fil. Daha dul kad\u0131n\u0131n, kocas\u0131n\u0131n evinde oturma ve mal\u0131ndan ge\u00e7imini saklama hakk\u0131na,kocas\u0131n\u0131n bu hakk\u0131, \u00f6lmeden evvel yapaca\u011f\u0131 bir vasiyyete ba\u011flamas\u0131na ve genel olarak bo\u015fanm\u0131\u015f kad\u0131nlar\u0131n, kocalar\u0131 \u00fczerinde bak\u0131m haklar\u0131 bulundu\u011funa ili\u015fkin h\u00fck\u00fcmler a\u00e7\u0131klanmad\u0131. B\u00f6yle bir kompozisyonda konu b\u00f6l\u00fcnerek araya namaz mevzuu s\u0131k\u0131\u015ft\u0131r\u0131l\u0131yor ve \u015fu mesaj veriliyor m\u00fcminlere; Anlat\u0131lan b\u00fct\u00fcn bu h\u00fck\u00fcmlerde Allah'\u0131n emrine uymak, namaz k\u0131lmak gibi bir ibadettir bu ibadet ile o itaat ayn\u0131 t\u00fcrdendir. Bu, Kur'an'a \u00f6zg\u00fc ince bir anlat\u0131m tarz\u0131d\u0131r.
