Hamd kendisinden ba\u015fka ilah olmayan, mutlak manada tek g\u00fc\u00e7 ve kudret sahibi olan Allah\u2019a mahsustur. Salat ve selam t\u00fcm peygamberlerin ve onlar\u0131 takip eden tabilerinin \u00fczerine olsun<\/strong><\/p>\n

10- Ey iman edenler, m\u00fc’min kad\u0131nlar hicret etmi\u015fler olarak size geldikleri zaman, onlar\u0131 imtihan edin. Allah, onlar\u0131n imanlar\u0131n\u0131 daha iyi bilendir. \u015eayet onlar\u0131n (ger\u00e7ekten) m\u00fc’min kad\u0131nlar olduklar\u0131n\u0131 bilip-\u00f6\u011frenirseniz, art\u0131k sak\u0131n onlar\u0131 k\u00e2firlere geri \u00e7evirmeyin.(14) (\u00c7\u00fcnk\u00fc) Ne bunlar onlara helaldir, ne onlar bunlara helaldir. Onlara (k\u00e2fir kocalar\u0131na kendileri i\u00e7in) harcad\u0131klar\u0131n\u0131 verin. Onlara (hicret) eden m\u00fc’min kad\u0131nlara) \u00fccretlerini (mehirlerini) verdi\u011finiz takdirde(15) onlar\u0131n nik\u00e2hlaman\u0131zda sizin i\u00e7in bir g\u00fc\u00e7l\u00fck yoktur. K\u00e2fir (kad\u0131n) lar\u0131n ismetlerini (nik\u00e2hlar\u0131n\u0131) tutmay\u0131n ve (onlar i\u00e7in) harcad\u0131klar\u0131n\u0131z\u0131 isteyin. Onlar da (m\u00fc’min kad\u0131nlara) harcad\u0131klar\u0131n\u0131 istesinler.(16) Bu, Allah’\u0131n h\u00fckm\u00fcd\u00fcr. Sizin aran\u0131zda h\u00fckmeder. A\u00c7IKLAMA<\/strong><\/p>\n

14. Bu karar\u0131n arka plan\u0131 \u015fu \u015fekildedir: “Hudeybiye Antla\u015fmas\u0131’n\u0131n sonras\u0131nda, Mekke’den ka\u00e7\u0131p Medine’ye gelen M\u00fcsl\u00fcman erkekler, antla\u015fma gere\u011fince geri iade ediliyorlard\u0131. Daha sonra M\u00fcsl\u00fcman kad\u0131nlar da gelmeye ba\u015flad\u0131lar ve ilk olarak Ukbe bin Ebi Muayt’\u0131n k\u0131z\u0131 \u00dcmm\u00fc G\u00fcls\u00fcm hicret edip Medine’ye geldi. Mekkeli m\u00fc\u015frikler antla\u015fma gere\u011fince onun da iadesini talep etmi\u015f ve bu y\u00fczden \u00dcmm\u00fc G\u00fcls\u00fcm’\u00fcn iki karde\u015fi Velid bin Ukbe ile Umare bin Ukbe karde\u015flerini geri almak amac\u0131yla Medine’ye gelmi\u015flerdi.
\nO zaman antla\u015fma gere\u011fince, erkekler gibi kad\u0131nlar\u0131n da iade edilip edilmeyece\u011fi meselesi ortaya \u00e7\u0131km\u0131\u015f ve Allah bu meseleyi \u00e7\u00f6zmek \u00fczere, “Ey iman edenler, m\u00fcmin kad\u0131nlar hicret ederek size geldi\u011fi zaman onlar\u0131 imtihan edin. Allah onlar\u0131n imanlar\u0131n\u0131 daha iyi bilir. E\u011fer onlar\u0131n m\u00fcmin olduklar\u0131na kanaat getirirseniz, onlar\u0131 kafirlere iade etmeyin” ayetini indirmi\u015ftir.
\nBu konuyla ilgili hadisler m\u00e2n\u00e2ca rivayet edildi\u011fi i\u00e7in bir\u00e7ok kar\u0131\u015f\u0131kl\u0131klar meydana gelmi\u015ftir. Bu bak\u0131mdan bu kar\u0131\u015f\u0131kl\u0131\u011f\u0131n \u00e7\u00f6z\u00fclmesi gerekmektedir. Hudeybiye Antla\u015fmas\u0131’yla ilgili hadisler, umumiyetle m\u00e2n\u00e2ca rivayet edildiklerinden dolay\u0131, antla\u015fman\u0131n \u015fartlar\u0131 ayr\u0131 rivayetlerde farkl\u0131 laf\u0131zlarla nakledilmi\u015flerdir. \u00d6rne\u011fin, bir rivayette, “Sizden (bize) kim gelirse, onu size iade etmeyece\u011fiz, ama bizden size kim gelirse, siz onu bize iade edeceksiniz.” (M\u00fcslim) denirken, ba\u015fka bir rivayette, “Velisinin izni olmadan, Rasulullah’\u0131n ashab\u0131ndan biri (Medine’ye) gelecek olursa, onu (Mekke’ye) iade edecek” denmektedir. Yine daha farkl\u0131 bir rivayet, “Velisinin izni olmadan Kurey\u015f’ten kim Muhammed’le gelirse, o Kurey\u015f’e geri verilecektir. (\u0130bn Hi\u015fam, \u0130bni Cerir, Vak\u0131d\u00ee) laf\u0131zlar\u0131yla naklolunmaktad\u0131r. T\u00fcm bu rivayetlerden a\u00e7\u0131k\u00e7a anla\u015f\u0131ld\u0131\u011f\u0131 gibi, antla\u015fman\u0131n \u015fartlar\u0131 ayn\u0131 kelimelerle de\u011fil, m\u00e2n\u00e2ca rivayet edilmi\u015flerdir. Genellikle bu konuda, \u00e7o\u011fu rivayetlerin m\u00e2n\u00e2ca rivayet edilmi\u015f olmas\u0131, bir\u00e7ok m\u00fcfessir ve muhaddisin, bu antla\u015fman\u0131n kad\u0131n ve erke\u011fin ikisini birden kapsad\u0131\u011f\u0131n\u0131 sanmalar\u0131na yol a\u00e7m\u0131\u015ft\u0131r. Oysa mesele, hemen bu yorumu kabullenebilece\u011fimiz kadar basit de\u011fildir. \u00c7\u00fcnk\u00fc bu antla\u015fma erkek ve kad\u0131nlar\u0131 kaps\u0131yorsa e\u011fer, taraflardan biri antla\u015fmay\u0131 iptal edemez. \u0130ptal etti\u011fini d\u00fc\u015f\u00fcnsek bile, o takdirde Kurey\u015fliler k\u0131yameti kopar\u0131rd\u0131. Zira zaten onlar bu t\u00fcr nedenler ar\u0131yorlard\u0131. Ancak g\u00f6r\u00fcyoruz ki, Allah’\u0131n bu karar\u0131na onlar\u0131n hi\u00e7bir itiraz\u0131 olmam\u0131\u015ft\u0131r. \u015ea\u015f\u0131lacak olan, pek\u00e7ok kimsenin nedense bu noktay\u0131 d\u00fc\u015f\u00fcnmemi\u015f olmas\u0131d\u0131r. \u00dcstelik baz\u0131lar\u0131 (\u00f6rne\u011fin Kad\u0131 Ebu Bekir, \u0130bn’ul-Arab\u00ee) bu noktay\u0131 d\u00fc\u015f\u00fcnm\u00fc\u015f olmas\u0131na ra\u011fmen, Kurey\u015flilerin ses \u00e7\u0131karmay\u0131\u015flar\u0131n\u0131 Allah’\u0131n bir mucizesi olarak nitelemi\u015flerdir. Bu kimselerin yapt\u0131klar\u0131 bu tevilden, kalplerinin nas\u0131l olup da itmi’nan buldu\u011funa hayret ediyorum do\u011frusu.
\nGer\u00e7ekte bu antla\u015fmay\u0131 M\u00fcsl\u00fcmanlar de\u011fil, Kurey\u015fliler, dikte ettirmi\u015flerdir. Onlar\u0131n temsilcisi olan S\u00fcheyl bin Amr’\u0131n yazd\u0131rd\u0131\u011f\u0131 antla\u015fman\u0131n s\u00f6zkonusu maddesinin metni \u015f\u00f6yledir:
\n“Sana bizden bir erkek (racul) gelirse, o gelen kimse senin dininde olsa bile, onu bize iade edeceksin.” (Bu antla\u015fman\u0131n laf\u0131zlar\u0131 Buhar\u00ee’de Kitab-ul-\u015eurut, Bab’ul-\u015eurut fi’l Cihad ve Mesalih’de g\u00fc\u00e7l\u00fc senetlerle nakledilmi\u015ftir.) S\u00fcheyl bin Amr’\u0131n, antla\u015fmay\u0131 yazd\u0131r\u0131rken, “Racul” kelimesini zihninde bir an kad\u0131n ve erkek olarak d\u00fc\u015f\u00fcnmesi m\u00fcmk\u00fcnd\u00fcr. Ancak antla\u015fman\u0131n ilgili maddesinde kelime “Racul” olarak yaz\u0131lm\u0131\u015ft\u0131r ve Arap\u00e7a’da bu kelime sadece erkekler i\u00e7in kullan\u0131l\u0131r. Bu y\u00fczden \u00dcmm\u00fc G\u00fcls\u00fcm’\u00fcn karde\u015fleri onun iadesi i\u00e7in Hz. Peygamber’e (s.a.) ba\u015fvurduklar\u0131nda (\u0130mam Z\u00fchr\u00ee’nin rivayetine g\u00f6re) , Hz. Peygamber (s.a) onlar\u0131 geri \u00e7evirerek, “Bu antla\u015fma kad\u0131nlar i\u00e7in de\u011fil, sadece erkekler i\u00e7in ge\u00e7erlidir” demi\u015ftir. (Ahkamu’l Kur’an, \u0130bnu’l Arab\u00ee, Tefsir-i Kebir, \u0130mam Raz\u00ee) Bu ana kadar Kurey\u015fliler antla\u015fman\u0131n erkek ve kad\u0131n\u0131 kapsad\u0131\u011f\u0131 d\u00fc\u015f\u00fcncesinde olduklar\u0131ndan, Hz. Peygamber’in (s.a.) antla\u015fman\u0131n bu kelimesine dikkat \u00e7ekmesi \u00fczerine \u015fa\u015f\u0131r\u0131p kald\u0131lar ve mecburen boyun e\u011fdiler.
\nAntla\u015fman\u0131n bu \u015fart\u0131 gere\u011fince, M\u00fcsl\u00fcmanlar\u0131n, hangi maksatla gelirse gelsin hi\u00e7bir kad\u0131n\u0131 Kurey\u015f’e iade etme zorunlulu\u011fu yoktu. Ancak \u0130sl\u00e2m’\u0131 ilgilendiren husus Medine’ye s\u0131\u011f\u0131nmak i\u00e7in Mekke’den ka\u00e7\u0131p gelen di\u011fer kad\u0131nlar de\u011fil M\u00fcsl\u00fcman kad\u0131nlard\u0131. Bu bak\u0131mdan Allah Te\u00e2l\u00e2, hicret ederek gelen kad\u0131nlar\u0131n imanlar\u0131n\u0131 a\u00e7\u0131\u011fa vurmalar\u0131n\u0131 ve sorguya \u00e7ekildikten sonra da m\u00fcmin olduklar\u0131na kanaat getirilirse \u015fayet, kafirlere geri g\u00f6nderilmemelerini bildiren ayeti inzal etmi\u015ftir. Allah’\u0131n bu emirleri, \u015f\u00f6yle uygulan\u0131yordu: E\u011fer bir kad\u0131n Mekke’den hicret edip Medine’ye gelirse, ona Allah’\u0131n birli\u011fine ve Muhammed’in Allah’\u0131n el\u00e7isi oldu\u011funa inan\u0131p inanmad\u0131\u011f\u0131 ve sadece Allah ve Rasul\u00fc i\u00e7in mi hicret etti\u011fi soruluyordu. Yani kocas\u0131yla kavga etti\u011fi veya Medine’deki bir M\u00fcsl\u00fcmana a\u015f\u0131k oldu\u011fu ya da d\u00fcnyevi birtak\u0131m \u00e7\u0131karlar i\u00e7in mi hicret etti\u011fi \u00f6\u011frenilmeye \u00e7al\u0131\u015f\u0131l\u0131yordu. \nBu ayetten, \u015fahitlik yasas\u0131n\u0131n bir prensibi elde edilmektedir. Bu kural, Hz. Peygamber’in (s.a.) fiil\u00ee uygulamas\u0131yla daha da net anla\u015f\u0131lmaktad\u0131r. Ayet-i Kerime’de \u00fc\u00e7 husus vurgulanm\u0131\u015ft\u0131r. Birincisi, hicret eden kad\u0131nlar kendilerini m\u00fcmine olarak tan\u0131tt\u0131klar\u0131nda, onlar\u0131n iman iddialar\u0131n\u0131n do\u011frulu\u011fu ara\u015ft\u0131r\u0131lacakt\u0131r. \u0130kincisi, onlar\u0131n ger\u00e7ekten iman edip etmediklerini ancak Allah bilir. \u0130\u00e7lerinde ta\u015f\u0131d\u0131klar\u0131 iman\u0131n bilinmesi m\u00fcmk\u00fcn de\u011fildir. \u00dc\u00e7\u00fcnc\u00fcs\u00fc, sorgu bitiminde m\u00fcmin olduklar\u0131na kanaat getirilirse e\u011fer, onlar kafirlere iade edilmeyeceklerdir. Kad\u0131nlar\u0131n iman iddialar\u0131n\u0131n tahkiki emri gere\u011fince Hz. Peygamber, onlara yemin ettirir, yemin ederlerse kabul ederdi.
\nBu uygulamadan \u00e7\u0131kan sonuca g\u00f6re, mahkemede hakimin ger\u00e7ek bilgi sahibi olmas\u0131 \u015fart de\u011fildir. \u015eahitlerden al\u0131nan bilgi yeterlidir. Bir di\u011fer kural, yemin eden bir kimseye, yalanc\u0131 oldu\u011funa dair bir ba\u015fka delil bulunmad\u0131k\u00e7a g\u00fcvenilmelidir. \u00dc\u00e7\u00fcnc\u00fc bir kural ise, bir kimsenin inanc\u0131 hakk\u0131nda kendi s\u00f6ylediklerinin esas olmas\u0131d\u0131r. \u0130nanc\u0131n\u0131n s\u00f6yledi\u011fi gibi olup olmad\u0131\u011f\u0131n\u0131 kurcalamak ise, a\u00e7\u0131k bir belirti onun iman\u0131n\u0131 yalanlamad\u0131k\u00e7a do\u011fru de\u011fildir. D\u00f6rd\u00fcnc\u00fc kural, ba\u015fka bir kimsenin bilmesine imkan olmayan bir durumda \u015fahitlik yapan kimselerin a\u00e7\u0131klamalar\u0131 kabul edilmelidir. \u00d6rne\u011fin talak ve iddet hususunda, kad\u0131n\u0131n hay\u0131z ve taharet ile ilgili a\u00e7\u0131klamas\u0131 yeterlidir. Kad\u0131n\u0131n yalan veya do\u011fru s\u00f6ylemesi bizi ilgilendirmez. Ayr\u0131 kural, hadis rivayetleri i\u00e7in de ge\u00e7erlidir. S\u00f6zgelimi bir rav\u00ee, zahiren m\u00fcmin ve sika ise, onun rivayeti kabul edilir. Ancak aleyhte ba\u015fka bir karine varsa o takdirde o ravinin rivayeti reddedilebilir.<\/p>\n

15. Yani, hicret eden m\u00fcmine kad\u0131nlar\u0131n, kafir kocalar\u0131ndan ald\u0131klar\u0131 mehri \u0130sl\u00e2m Devleti iade edecektir. Serbest kalan bu kad\u0131nlar herhangi bir M\u00fcsl\u00fcman ile, mehir alarak yeniden evlenebilirler.<\/p>\n

16. Bu ayette, aile ve uluslararas\u0131 ili\u015fkilerle ilgili d\u00f6rt \u00f6nemli ilke a\u00e7\u0131klanm\u0131\u015ft\u0131r.<\/p>\n

a) M\u00fcsl\u00fcman bir kad\u0131n, kafir bir kocaya, kafir bir koca da M\u00fcsl\u00fcman bir kad\u0131na hel\u00e2l de\u011fildir.<\/p>\n

b) Evli olan M\u00fcsl\u00fcman bir kad\u0131n\u0131n nikah\u0131, Dar-ul K\u00fcf\u00fcr’den Dar-ul \u0130sl\u00e2m’a hicret ettikten sonra kendili\u011finden fesholur. Art\u0131k o diledi\u011fi bir M\u00fcsl\u00fcmanla mehir kar\u015f\u0131l\u0131\u011f\u0131 evlenebilir.<\/p>\n

c) M\u00fcsl\u00fcman bir erke\u011fe, kafir bir kad\u0131n\u0131 nikah\u0131 alt\u0131nda bulundurmak caiz de\u011fildir.<\/p>\n

d) Dar’ul-K\u00fcf\u00fcr ile Dar’ul-\u0130sl\u00e2m aras\u0131nda bar\u0131\u015f antla\u015fmas\u0131 oldu\u011funda, \u0130sl\u00e2m y\u00f6netimi kafir devlet ile, “Evli M\u00fcsl\u00fcman bir kad\u0131n Dar’ul-K\u00fcf\u00fcr’den, Dar’ul-\u0130sl\u00e2m’a hicret etti\u011finde onun mehrini \u0130sl\u00e2m y\u00f6netimi \u00f6deyecek, Dar’ul-K\u00fcf\u00fcr’de kalan M\u00fcsl\u00fcmanla evli bir kad\u0131n\u0131n mehrini de, k\u00fcf\u00fcr h\u00fck\u00fcmeti \u00f6deyecektir” \u015feklinde bir antla\u015fma yapmal\u0131d\u0131r. Bu h\u00fck\u00fcmlerin arka plan\u0131 \u015fu \u015fekildedir: \u0130sl\u00e2m’\u0131n ilk d\u00f6nemlerinde bir\u00e7ok kimse M\u00fcsl\u00fcman oldu\u011funda, onlar\u0131n han\u0131mlar\u0131, yine bir\u00e7ok kad\u0131n M\u00fcsl\u00fcman oldu\u011funda onlar\u0131n kocalar\u0131 \u0130sl\u00e2m’\u0131 kabul etmemi\u015fti. \u00d6rne\u011fin, Hz. Peygamber’in (s.a.) k\u0131z\u0131 Zeyneb’in kocas\u0131 Ebu’l-As, \u0130sl\u00e2m’\u0131 kabul etmeyerek, uzun bir s\u00fcre \u0130sl\u00e2m’\u0131n d\u0131\u015f\u0131nda kalm\u0131\u015ft\u0131r. \u0130lk ba\u015fta, M\u00fcsl\u00fcman bir kad\u0131na kafir kocas\u0131 ve M\u00fcsl\u00fcman bir erke\u011fe de kafir kar\u0131s\u0131 haramd\u0131r, \u015feklinde bir h\u00fck\u00fcm bulunmad\u0131\u011f\u0131ndan onlar\u0131n aras\u0131nda evlilik ili\u015fkisi devam etmi\u015ftir. Hicretten sonra da bu durum b\u00f6yle devam etmi\u015ftir ve bu s\u00fcre zarf\u0131nda bir\u00e7ok kad\u0131n \u0130sl\u00e2m’\u0131 se\u00e7erek Medine’ye hicret ederken, kafir kocalar\u0131 Mekke’de kalm\u0131\u015ft\u0131r.
\nAyn\u0131 zamanda bir\u00e7ok M\u00fcsl\u00fcman da kafir kar\u0131lar\u0131n\u0131 Mekke’de b\u0131rakarak Medine’ye hicret etmi\u015ftir. Ancak bunlar aras\u0131nda evlilik ili\u015fkileri yine de devam ediyordu. Bu husus, \u00f6zellikle kad\u0131nlar a\u00e7\u0131s\u0131ndan \u00f6nemli bir sorun ortaya \u00e7\u0131karm\u0131\u015ft\u0131; zira erkekler ba\u015fka bir kad\u0131n\u0131 nikahlar\u0131 alt\u0131na alabilirken, \u00f6nceki nikahlar\u0131 fesholmadan kad\u0131nlar\u0131n bir ba\u015fkas\u0131yla evlenebilmeleri m\u00fcmk\u00fcn de\u011fildi. Hudeybiye Antla\u015fmas\u0131’ndan sonra, bu ayetler nazil olunca, M\u00fcsl\u00fcmanlarla m\u00fc\u015frikler aras\u0131ndaki evlilik ili\u015fkileri son buldu. Daha sonra da, bu mesele kesin bir karara ba\u011flanarak, a\u00e7\u0131k bir yasa haline gelmi\u015ftir. \u0130sl\u00e2m hukuk\u00e7ular\u0131 bu yasay\u0131 a\u015fa\u011f\u0131daki gibi d\u00f6rt b\u00f6l\u00fcmde d\u00fczenlemi\u015flerdir.<\/p>\n

b) Kad\u0131n ve kocan\u0131n, bir, M\u00fcsl\u00fcman di\u011feri kafir olmak \u00fczere, Dar’ul-K\u00fcf\u00fcr’de bulunmalar\u0131 durumu,<\/p>\n

c) Kad\u0131n ve kocadan birinin M\u00fcsl\u00fcman olarak Dar’ul-\u0130sl\u00e2m’a hicret edip, di\u011ferinin Dar’ul-K\u00fcf\u00fcr’de k\u00fcfr\u00fc tercih edip kalmas\u0131 durumu,<\/p>\n

d) Kad\u0131n ve kocadan birinin irtidat etmesi durumu,<\/p>\n

A\u015fa\u011f\u0131da bu d\u00f6rt durum hakk\u0131nda \u0130sl\u00e2m hukuk\u00e7ular\u0131n\u0131n m\u00fcteal\u00e2lar\u0131 beyan edilmi\u015ftir.<\/p>\n

1) Erkek \u0130sl\u00e2m’\u0131 kabul etmi\u015f, kad\u0131n da H\u0131ristiyan ve Yahudi olarak kendi dininde kalm\u0131\u015f ise, nikahlar\u0131 devam eder. \u00c7\u00fcnk\u00fc M\u00fcsl\u00fcman bir erke\u011fin Ehl-i Kitap’tan bir kad\u0131nla evlenmesi caizdir. Ve bu konuda t\u00fcm \u0130sl\u00e2m hukuk\u00e7ular\u0131 g\u00f6r\u00fc\u015f birli\u011fi i\u00e7indedir.
\n\u0130sl\u00e2m’\u0131 kabul eden bir erke\u011fin, kar\u0131s\u0131 Ehl-i Kitap’tan de\u011filse ve kendi dininde olmakta devam ediyorsa Hanefilere g\u00f6re, o kad\u0131n \u0130sl\u00e2m’a davet edilir, kabul ederse nikah devam eder, aksi takdirde son bulur. Bu s\u00fcre i\u00e7inde m\u00fcba\u015feret olmu\u015fsa kad\u0131na mehri verilir. E\u011fer olmam\u0131\u015fsa kad\u0131na mehir vermek gerekmez. \u00c7\u00fcnk\u00fc bu bo\u015fama onun kafir olmas\u0131 nedeniyledir. (El-Mebsut, Hidaye, Feth-ul-Kadir) . \u0130mam \u015eafii ve \u0130mam Ahmed’e g\u00f6re, erkek \u0130sl’am’\u0131 kabul etit\u011finde e\u011fer kad\u0131n ile koca aras\u0131nda m\u00fcba\u015feret vuku bulmam\u0131\u015fsa, nikah kendili\u011finden fesholur. M\u00fcba\u015feret olmu\u015fsa e\u011fer, kad\u0131n iddet bekler. \u00dc\u00e7\u00fcnc\u00fc aydan sonra h\u00e2l\u00e2 \u0130sl’am’\u0131 kabul etmemi\u015fse nikah fesholur. \u0130mam \u015eafii ayr\u0131ca, z\u0131mmilere din konusunda bask\u0131 yap\u0131lamayaca\u011f\u0131ndan dolay\u0131, kad\u0131n\u0131 \u0130sl\u00e2m’a \u00e7a\u011f\u0131rman\u0131n do\u011fru olamayaca\u011f\u0131n\u0131 s\u00f6yl\u00fcyor. Ancak bu, ger\u00e7ekte \u00e7ok zay\u0131f bir g\u00f6r\u00fc\u015ft\u00fcr. \u00c7\u00fcnk\u00fc z\u0131mm\u00ee bir kad\u0131na din konusunda bask\u0131, siz onu M\u00fcsl\u00fcman olmaya mecbur etti\u011finizde olur. Sadece “\u0130sl\u00e2m’\u0131 kabul edersen kar\u0131-koca olmaya devam edece\u011fiz, aksi takdirde ayr\u0131lmak zorunday\u0131z” demekle, din konusunda bask\u0131 yap\u0131lm\u0131\u015f olmaz.
\nNitekim Hz. Ali (r.a) d\u00f6neminde b\u00f6yle bir \u00f6rnek vard\u0131r. Irak’ta mecusi bir toprak sahibi, M\u00fcsl\u00fcman olmas\u0131na ra\u011fmen, kar\u0131s\u0131 dininde devam etmeyi tercih eder. Hz. Ali, kad\u0131n\u0131 \u0130sl\u00e2m’a davet eder, kad\u0131n kabul etmeyince Hz. Ali de onlar\u0131 birbirinden bo\u015far. (El-Mebsut) \u0130mam Malik’e g\u00f6re erkek M\u00fcsl\u00fcman olur da, kad\u0131nla aralar\u0131nda m\u00fcba\u015feret olmazsa nikah fesholur. M\u00fcba\u015feretin olmas\u0131 halinde ise, kad\u0131n \u0130sl\u00e2m’a davet edilir, kabul etmezse bo\u015fan\u0131rlar. (El-Mu\u011fni, \u0130bn Kudame) .
\nHanefilere g\u00f6re, kad\u0131n \u0130sl\u00e2m’\u0131 kabul etmi\u015f, fakat kocas\u0131 kafirse, o Ehl-i Kitap olsa da olmasa da, m\u00fcba\u015feret vuku bulsa da bulmasa da koca \u0130sl\u00e2m’a davet edilir, kabul etmezse kad\u0131 onlar\u0131 bo\u015far, kabul ederse nikahlar\u0131 devam eder. Bu s\u0131rada koca \u0130sl\u00e2m’\u0131 kabul etmemi\u015f ise \u0130sl\u00e2m’\u0131 inkar da etmiyorsa, kad\u0131n ona e\u015flik yapmaya devam eder, fakat yakla\u015famaz. Kocas\u0131 a\u00e7\u0131k\u00e7a \u0130sl\u00e2m’\u0131 reddetti\u011finde ise bo\u015fanma kesinle\u015fir. \u015eayet m\u00fcba\u015feret olmam\u0131\u015fsa kad\u0131n, mehrinin yar\u0131s\u0131n\u0131, olmu\u015fsa t\u00fcm\u00fcn\u00fc al\u0131r. Ayr\u0131ca iddet s\u00fcresi i\u00e7inde nafaka da al\u0131r. (El-Mebsut, Hidaye, Feth-ul Kadir) . \u0130mam \u015eafii’ye g\u00f6re, m\u00fcba\u015feret olmad\u0131\u011f\u0131 takdirde kad\u0131n \u0130sl\u00e2m’\u0131 ne zaman kabul ederse, o zaman nikah\u0131 da fesholur. M\u00fcba\u015feret olmu\u015fsa, iddet bitene kadar nikah devam eder. Koca, iddet bitene kadar \u0130sl\u00e2m’\u0131 kabul etmezse nikah fesholur. Ayr\u0131ca \u0130mam \u015eafii, yukar\u0131da zikredildi\u011fi gibi kafir kocaya \u0130slam’\u0131n tebli\u011f edilmesini caiz g\u00f6rmemektedir. Ancak “Bu takdirde z\u0131mm\u00eeye din konusunda bask\u0131 yap\u0131lm\u0131\u015f olur” \u015feklindeki bu g\u00f6r\u00fc\u015f zay\u0131f ve yanl\u0131\u015ft\u0131r. Hz. \u00d6mer (r.a) d\u00f6neminde bu t\u00fcrde bir\u00e7ok olay vuku bulmu\u015f ve \u0130sl\u00e2m’\u0131 kabul eden kad\u0131nlar\u0131n kocalar\u0131 da \u0130sl\u00e2m’a davet edilmi\u015f, kabul etmezse bo\u015fanm\u0131\u015flard\u0131r. \u00d6rne\u011fin Beni Ta\u011fleb’den bir H\u0131ristiyan\u0131n han\u0131m\u0131 \u0130sl\u00e2m’\u0131 se\u00e7ti\u011finde, kocaya “\u0130sl\u00e2m’\u0131 tebli\u011f edin. Kabul ederse mesele yok, etmezse ayr\u0131ls\u0131nlar” demi\u015ftir. Bu t\u00fcr hadiselere sahabe aras\u0131nda da rastlan\u0131lm\u0131\u015f ama bir ihtilaf rivayet edilmemi\u015ftir. (Ahkam’ul-Kur’an, Cassas, El-Mebsut, Feth’ul-Kadir) \u0130mam Malik’e g\u00f6re m\u00fcba\u015feret olmadan \u00f6nce kad\u0131n M\u00fcsl\u00fcman olmu\u015fsa, kocas\u0131na \u0130sl\u00e2m tebli\u011f edilir, \u0130sl\u00e2m’\u0131 kabul ederse nikahlar\u0131 devam eder, kabul etmezse ayr\u0131l\u0131rlar. Fakat m\u00fcba\u015feret olmu\u015fsa, kad\u0131n iddetini bekler ve bu s\u0131rada kocas\u0131 \u0130sl\u00e2m’\u0131 kabul ederse nikahlar\u0131 s\u00fcrer, kabul etmez ve kad\u0131n\u0131n iddeti de biterse nikah fesholur. \u0130mam Ahmed’ten nakledilen bir g\u00f6r\u00fc\u015f, \u0130mam \u015eafii’yi teyid ederken di\u011fer bir g\u00f6r\u00fc\u015f, “Kar\u0131 ve koca aras\u0131nda din ayr\u0131l\u0131\u011f\u0131 varsa m\u00fcba\u015feret olsun olmas\u0131n bo\u015fan\u0131rlar.” \u015feklindedir. 2) Daru’l K\u00fcf\u00fcr’de bir kad\u0131n \u0130sl\u00e2m’a girmi\u015f ama kocas\u0131 kafirse veyahut erkek \u0130sl\u00e2m’a girmi\u015f han\u0131m\u0131 (Ehli Kitap harici) kendi dininde devam ediyorsa, Hanefilere g\u00f6re, aralar\u0131nda m\u00fcba\u015feret olsa da olmasa da, kad\u0131n \u00fc\u00e7 ay ba\u015f\u0131 g\u00f6rene kadar ayr\u0131lamazlar. Kad\u0131n hay\u0131z g\u00f6rm\u00fcyorsa \u00fc\u00e7 ay ge\u00e7mesi gerekir. Bu esnada kafir olan\u0131 \u0130sl\u00e2m’a girerse nikah s\u00fcrer. Aksi takdirde iddet bitti\u011finde ayr\u0131l\u0131rlar. \u0130mam \u015eafii’ye g\u00f6re, m\u00fcba\u015feretin olup-olmamas\u0131 bu meselede \u00f6nemlidir.
\nM\u00fcba\u015feret olmam\u0131\u015fsa, dinlerin ayr\u0131 olmas\u0131 nedeniyle bo\u015fan\u0131rlar. M\u00fcba\u015feret olmu\u015fsa iddet s\u00fcresi bitene kadar nikahlar\u0131 devam eder. Kafir olan e\u015f, (kad\u0131n veya erkek) bu m\u00fcddet i\u00e7inde \u0130sl\u00e2m’\u0131 kabul etmezse ayr\u0131l\u0131rlar. (El-Mebsut, Fethu’l-Kadir, Ahkamu’l Kur’an, El-Cassas)<\/p>\n

3) E\u015fler aras\u0131nda din ayr\u0131l\u0131\u011f\u0131n\u0131n d\u0131\u015f\u0131nda, mekan ayr\u0131l\u0131\u011f\u0131 da bulunuyorsa, yani e\u015flerden biri Daru’l K\u00fcf\u00fcr’de kafir olarak kal\u0131r ve di\u011feri Dar\u00fc’l\u0130sl\u00e2m’a hicret ederse, Hanefi’lere g\u00f6re, nikah kendili\u011finden fesholur. \u015eayet hicret eden kad\u0131n ise, o hemen evlilik hakk\u0131na sahip olur. \u0130ddet \u015fart\u0131 aranmaz. Ancak yeni kocas\u0131 kendisiyle bir ay boyunca (\u00e7ocuk olup olmad\u0131\u011f\u0131 anla\u015f\u0131ls\u0131n diye) ili\u015fkide bulunamaz. Fakat kad\u0131n hamile olsa bile evlenebilir, fakat do\u011fuma kadar bekler. \u0130mam Ebu Yusuf ile \u0130mam Muhammed bu meselede \u0130mam Ebu Hanife’den olduk\u00e7a farkl\u0131 bir g\u00f6r\u00fc\u015f ileri s\u00fcrm\u00fc\u015flerdir. Onlara g\u00f6re, kad\u0131n iddet bekler ve e\u011fer hamile ise, do\u011furmadan nikah yapamaz. (El-Mebsut, Hidaye, Ahkamu’l Kur’an, El-Cassas) \u0130mam \u015eafii, \u0130mam Malik ve \u0130mam Ahmed’e g\u00f6re, mekan ayr\u0131l\u0131\u011f\u0131n\u0131n bu meseleyle bir alakas\u0131 yoktur. Problem olan din ayr\u0131l\u0131\u011f\u0131d\u0131r. \u015eayet e\u015fler aras\u0131nda din ayr\u0131l\u0131\u011f\u0131 varsa, ayr\u0131 yerlerde olmalar\u0131 h\u00fckm\u00fc de\u011fi\u015ftirmez. Yani Daru’l-\u0130sl\u00e2m’da, veya Daru’l K\u00fcf\u00fcr’de bulunmalar\u0131 farketmez. (El-Mu\u011fni) \u0130mam \u015eafii, yukardaki g\u00f6r\u00fc\u015f\u00fcn yan\u0131s\u0131ra, hicret edip Daru’l \u0130sl\u00e2m’a gelen kad\u0131n hakk\u0131nda “O, kafir kocas\u0131yla kavga edip, s\u0131rf ondan kurtulmak i\u00e7in hicret etmi\u015fse, mekan ayr\u0131l\u0131\u011f\u0131ndan de\u011fil, niyet dolay\u0131s\u0131yla ayr\u0131l\u0131r” demektedir (El-Mebsut, Hidaye) .
\nKur’an’\u0131n s\u00f6zkonusu ayeti \u00fczerinde dikkatlice d\u00fc\u015f\u00fcn\u00fcld\u00fc\u011f\u00fcnde, en isabetli g\u00f6r\u00fc\u015f\u00fcn Ebu Hanife’ye ait oldu\u011fu anla\u015f\u0131l\u0131r. \u00c7\u00fcnk\u00fc Allahu Te\u00e2l\u00e2, bu ayeti hicret eden m\u00fcmine kad\u0131nlar hakk\u0131nda indirmi\u015f ve Daru’l K\u00fcf\u00fcr’de b\u0131rakarak geldikleri kocalar\u0131n\u0131n kendilerine haram oldu\u011funu bildirmi\u015ftir. Daru’l \u0130sl\u00e2m’daki m\u00fcminlere ise, onlar\u0131 (hicret eden m\u00fcmine kad\u0131nlar\u0131) mehirlerini verme suretiyle nikahlayabilecekleri s\u00f6ylenirken, Muhacirlere Daru’l K\u00fcf\u00fcr’de bulunan kafir e\u015flerini nikahlar\u0131 alt\u0131nda tutmamalar\u0131 ve onlara verdikleri mehirleri geri istemeleri emredilmi\u015ftir. Bu \u00f6zel emirlerin sadece din ayr\u0131l\u0131\u011f\u0131 nedeniyle olmay\u0131p, mekan ayr\u0131l\u0131\u011f\u0131 nedeniyle de verildi\u011fi a\u00e7\u0131k\u00e7a ortadad\u0131r. \u015eayet M\u00fcsl\u00fcman kad\u0131nlar\u0131n hicret etmeleri dolay\u0131s\u0131yla kafir kocalar\u0131yla aralar\u0131ndaki nikah sona ermemi\u015f olsayd\u0131, o takdirde M\u00fcsl\u00fcman erkeklerin bu kad\u0131nlar\u0131 nikahlamalar\u0131na nas\u0131l izin verilebilirdi? \u00dcstelik bu izin verilirken iddet \u015fart\u0131 dahi aranmam\u0131\u015ft\u0131r. “Kafir kad\u0131nlar\u0131n ismetlerini (nikahlar\u0131n\u0131) tutmay\u0131n” ayetinin inmesinden sonra, Muhacirlerin kafir olan han\u0131mlar\u0131yla nikahlar\u0131 devam etmi\u015f olsayd\u0131 (veya nikahlar\u0131 kendili\u011finden fesh olmasayd\u0131) , onlara ayr\u0131ca “han\u0131mlar\u0131n\u0131z\u0131 bo\u015fay\u0131n” emri de verilirdi. Fakat ayette b\u00f6yle bir ima bile yoktur. Her ne kadar bu ayet nazil olduktan sonra Hz. \u00d6mer, Hz. Talha ve di\u011fer baz\u0131 Muhacirlerin Mekke’deki kafir e\u015flerini bo\u015fad\u0131klar\u0131 sabit ise de, bu talak\u0131n gerekli oldu\u011funa delil de\u011fildir. \u00c7\u00fcnk\u00fc onlar e\u015flerine talak g\u00f6ndermemi\u015f olsalar bile, yine de nikahlar\u0131 sona ermi\u015ftir.
\nBu konuda delil olarak Hz. Peygamber (s.a) d\u00f6nemindeki \u00fc\u00e7 hadise g\u00f6sterilebilir. Bu \u00f6rneklerden; s\u00f6zkonusu ayetlerin nazil olmas\u0131ndan sonra, Hz. Peygamber’in (s.a) mekan fark\u0131na ra\u011fmen m\u00fcmin ve kafir e\u015fler aras\u0131nda nikahlar\u0131n\u0131 devam ettirdi\u011fi anla\u015f\u0131lmaktad\u0131r:<\/p>\n

a) Mekke fethinden az bir zaman \u00f6nce, Ebu S\u00fcfyan \u0130sl\u00e2m’\u0131 kabul etmi\u015f ve e\u015fi Hind de \u0130sl\u00e2m’\u0131 kabul etmi\u015f ve nikahlar\u0131n\u0131 yenilememelerine ra\u011fmen, Hz. Peygamber (s.a) onlara nikahlar\u0131na devam etme izni vermi\u015ftir.<\/p>\n

b) Mekke’nin fethinden sonra Ebu Cehil’in o\u011flu \u0130krime ile Hakim bin Hizam, Mekke’den ka\u00e7m\u0131\u015flar ama onlar\u0131n ard\u0131ndan e\u015fleri \u0130sl\u00e2m’a girmi\u015ftir. Daha sonra kocalar\u0131 ad\u0131na “eman” almak i\u00e7in Hz. Peygamber’e (s.a) ba\u015fvuran bu kad\u0131nlar, kocalar\u0131n\u0131 geri \u00e7a\u011f\u0131rm\u0131\u015flar, onlar da Hz. Peygamber’in (s.a) huzuruna gelerek \u0130sl\u00e2m’\u0131 kabul etmi\u015flerdir. Hz. Peygamber (s.a) ise, onlar\u0131n nikahlar\u0131n\u0131 devam ettirmi\u015ftir.<\/p>\n

c) Hz. Peygamber’in (s.a.) k\u0131z\u0131 Zeynep hicret ederek Medine’ye gelmi\u015f ve kocas\u0131 Ebu’l-As kafir olarak Mekke’de ya\u015famaya devam etmi\u015ftir. M\u00fcsned-i Ahmed, Ebu Davud, Tirmiz\u00ee ve \u0130bn M\u00e2ce’nin \u0130bn Abbas’tan naklettikleri bir hadise g\u00f6re, Ebu’l-As hicretin 8. y\u0131l\u0131nda Medine’ye gelerek \u0130sl\u00e2m’\u0131 kabul etmi\u015ftir. Hz. Peygamber (s.a) onun e\u015fiyle nikah\u0131n\u0131 yenilemesine gerek g\u00f6rmeyerek onlar\u0131n eski nikahlar\u0131na devam etmelerine izin vermi\u015ftir. Asl\u0131nda ilk iki hadise, mekan ayr\u0131l\u0131\u011f\u0131 tarifine dahil de\u011fildir; zira mekan ayr\u0131l\u0131\u011f\u0131, bir kimsenin ge\u00e7ici olarak bir yere ka\u00e7mas\u0131ndan meydana gelmez. Bilakis mekan ayr\u0131l\u0131\u011f\u0131, bir kimsenin e\u015fini bir beldede b\u0131rak\u0131p kendisinin ba\u015fka bir beldeye m\u00fcstakilen yerle\u015fmesidir. G\u00fcn\u00fcm\u00fczdeki literat\u00fcre g\u00f6re ifade edecek olursak, o kimseyle han\u0131m\u0131 ayr\u0131 \u00fclkenin vatanda\u015flar\u0131 olmu\u015flard\u0131r. Hz. Zeynep hakk\u0131nda ise iki rivayet bulunmaktad\u0131r. \u0130bn Abbas’tan rivayet edileni yukarda zikredildi, di\u011ferini ise \u0130mam Ahmed, Tirmiz\u00ee, \u0130bni Mace, Abdullah bin Amr bin el-As’tan nakletmi\u015flerdir. Bu rivayete g\u00f6re, Hz. Peygamber (s.a) Hz. Zeyneb’i yeniden mehir kar\u015f\u0131l\u0131\u011f\u0131nda Ebu’l-As ile nikahlam\u0131\u015ft\u0131r. Bu iki rivayetten, \u00f6nce \u0130bni Abbas’\u0131nkini ele al\u0131rsak, birincisi bu rivayetin “Mekan ayr\u0131l\u0131\u011f\u0131n\u0131n yasal bir etkisi yoktur” diyenlere delil te\u015fkil etmedi\u011fini; ikincisi, \u0130bni Abbas’\u0131n rivayeti \u00fczerinde \u0131srar edildi\u011fi takdirde bunun kendi g\u00f6r\u00fc\u015flerine ters d\u00fc\u015ft\u00fc\u011f\u00fcn\u00fc g\u00f6r\u00fcr\u00fcz. \u00c7\u00fcnk\u00fc onlara g\u00f6re, aralar\u0131nda din ayr\u0131l\u0131\u011f\u0131 ihtilaf\u0131 bulunan ve m\u00fcba\u015feretin vuku buldu\u011fu bir \u00e7iftin bo\u015fanabilmeleri i\u00e7in iddet beklemeleri gerekmektedir. Ancak kafir olan e\u015f \u0130sl\u00e2m’\u0131 kabul ederse nikah devam eder, kabul etmezse iddet sonunda nikah kendili\u011finden fesh olur. Fakat onlar Hz. Zeyneb’in hadisesi ile istidlal ederlerken, aralar\u0131nda din ihtilaf\u0131 bulundu\u011funu ve \u00e7ok sene ge\u00e7ti\u011fini ileri s\u00fcrmektedirler. Oysa Ebu’l-As, Hz. Zeyneb hicret ettikten 6 sene sonra M\u00fcsl\u00fcman olmu\u015f ve M\u00fcsl\u00fcman kad\u0131nlar\u0131n m\u00fc\u015frik erkeklere haram oldu\u011funu bildiren s\u00f6zkonusu ayetler, o M\u00fcsl\u00fcman olmadan en az iki sene \u00f6nce inmi\u015ftir.<\/p>\n

4) \u0130rtidat meselesinde, birincisi e\u015flerin her ikisinin de dinden d\u00f6nmeleri; ikincisi, birinin M\u00fcsl\u00fcman kal\u0131rken di\u011ferinin d\u00f6nmesi \u015feklinde iki durum vard\u0131r.
\n\u015eayet e\u015flerin her ikisi de irtidat etmi\u015flerse, \u015eafiilere ve Hanbelilere g\u00f6re, m\u00fcba\u015feretten \u00f6nceyse hemen ayr\u0131l\u0131rlar, m\u00fcba\u015feretten sonraysa iddetin bitimi ile \u0130sl\u00e2m\u00ee nikahlar\u0131 son bulur. Bu g\u00f6r\u00fc\u015f\u00fcn aksine, Hanefiler k\u0131yas yoluyla bu nikah\u0131n fesholdu\u011funa kaildirler. Ancak Hz. Ebu Bekir (r.a) d\u00f6neminde vuku bulan irtidat olaylar\u0131nda binlerce ki\u015fi \u0130sl\u00e2m’dan d\u00f6nm\u00fc\u015f ve sonra tekrar \u0130sl\u00e2m’a girmi\u015flerdi. Sahabeden hi\u00e7 kimse onlara nikah yenileme (tecdid-i nikah) \u015fart\u0131 ko\u015fmad\u0131\u011f\u0131 i\u00e7in, biz sahabenin bu ittifak\u0131n\u0131 esas al\u0131p k\u0131yas\u0131n aksine e\u015flerin birlikte irtidat etmeleri durumunda onlar\u0131n nikahlar\u0131n\u0131n son bulmayaca\u011f\u0131n\u0131 kabul ediyoruz. (El-Mebsut, Hidaye, Fethu’l-Kadir, D\u00f6rt Mezhebin F\u0131k\u0131h Kitab\u0131)
\nErkek irtidat edip, han\u0131m\u0131 M\u00fcsl\u00fcman kal\u0131rsa, Hanefilere g\u00f6re, daha \u00f6nce m\u00fcba\u015feret olsun-olmas\u0131n hemen nikah fesholur. Fakat \u015eafiilere ve Hanbelilere g\u00f6re, m\u00fcba\u015feretten \u00f6ncesi ile sonras\u0131 aras\u0131nda fark vard\u0131r. \u015eayet m\u00fcba\u015feretten \u00f6nce irtidat etmi\u015fse nikah fesholur, m\u00fcba\u015feretten sonra ise, iddet s\u00fcresince nikah devam eder, bu esnada koca yeniden M\u00fcsl\u00fcman olursa mesele kalmaz. Aksi takdirde iddetin bitimiyle birlikte, kocan\u0131n irtidat g\u00fcn\u00fcnden itibaren nikah fesholmu\u015f say\u0131l\u0131r. Yani kad\u0131n\u0131n yeni bir iddet beklemeye ihtiyac\u0131 yoktur. M\u00fcba\u015feretten \u00f6nce kocas\u0131 irtidat eden kad\u0131n\u0131n mehrinin yar\u0131s\u0131n\u0131, m\u00fcba\u015feretten sonraysa mehrinin t\u00fcm\u00fcn\u00fc alaca\u011f\u0131 hususunda d\u00f6rt mezhebin alimleri ittifak etmi\u015flerdir.
\nKad\u0131n\u0131n irtidat edip, kocas\u0131n\u0131n M\u00fcsl\u00fcman kalmas\u0131 halinde, Hanefilerin kadim fetvas\u0131na g\u00f6re, nikah hemen fesholur. Ancak daha sonra Belh ve Semerkand ulemas\u0131 nikah\u0131n hemen fesh olmayaca\u011f\u0131 \u015feklinde \u00f6nceki g\u00f6r\u00fc\u015f\u00fcn aksine bir g\u00f6r\u00fc\u015f \u00f6ne s\u00fcrm\u00fc\u015flerdir. Bu g\u00f6r\u00fc\u015f, \u00f6nceki fetvan\u0131n kad\u0131nlar\u0131n kocalar\u0131ndan kurtulabilmek i\u00e7in irtidat etmelerine neden olaca\u011f\u0131 korkusuyla ileri s\u00fcr\u00fclm\u00fc\u015ft\u00fcr. Nitekim Malikilerin fetvas\u0131 da bu \u015fekildedir. Onlara g\u00f6re, kad\u0131n\u0131n kocas\u0131ndan ayr\u0131labilmek i\u00e7in irtidat hilesine ba\u015fvurdu\u011fu anla\u015f\u0131l\u0131rsa bo\u015fanma ger\u00e7ekle\u015fmez. \u015eafiilere g\u00f6re, kad\u0131n\u0131n irtidad\u0131 ile erke\u011fin irtidad\u0131 aras\u0131nda fark yoktur. Yani irtidad m\u00fcba\u015feretten \u00f6nce ger\u00e7ekle\u015fmi\u015fse, nikah hemen fesholur, m\u00fcba\u015feretten sonra olmu\u015fsa (iddet bitene kadar koca \u0130sl\u00e2m’a girmezse e\u011fer) irtidat etti\u011fi g\u00fcnden itibaren nikah fesholmu\u015f say\u0131l\u0131r. Kad\u0131n\u0131n m\u00fcba\u015feretten \u00f6nce irtidat etmesi halinde mehir hakk\u0131 olmayaca\u011f\u0131 ama m\u00fcba\u015feretten sonra irtidat ederse, mehrinin tamam\u0131n\u0131 alabilece\u011fi konusunda ittifak vard\u0131r.
