Hamd kendisinden ba\u015fka ilah olmayan, mutlak manada tek g\u00fc\u00e7 ve kudret sahibi olan Allah\u2019a mahsustur. Salat ve selam t\u00fcm peygamberlerin ve onlar\u0131 takip eden tabilerinin \u00fczerine olsun.<\/strong><\/p>\n

4- Ancak buna (imk\u00e2n) bulamayanlar (i\u00e7in de) birbirleriyle temas etmeden \u00f6nce, kesintisiz iki ay oru\u00e7 (y\u00fcklenmi\u015ftir) ; buna da g\u00fc\u00e7 yetiremeyenler altm\u0131\u015f yoksulu doyursun.(11) Bu (kolayl\u0131k) , Allah’a O’nun Resul\u00fcne iman etmeniz dolay\u0131s\u0131ylad\u0131r.(12) Bunlar, Allah’\u0131n s\u0131n\u0131rlar\u0131d\u0131r. K\u00e2firler i\u00e7inse ac\u0131 bir azab vard\u0131r.(13)<\/strong><\/p>\n

A\u00c7IKLAMA<\/strong><\/p>\n

11. Z\u0131har hakk\u0131nda Allah Te\u00e2l\u00e2 bu h\u00fck\u00fcmleri inzal etmi\u015ftir. \u0130sl\u00e2m hukuk\u00e7ular\u0131n\u0131n, bu ayetlerden ve Hz. Peygamber’in (s.a.) uygulamas\u0131ndan hareketle \u00fcmmet i\u00e7in ortaya koyduklar\u0131 genel kaideler a\u015fa\u011f\u0131da zikredilmi\u015ftir.
\na) Z\u0131har ile ilgili bu h\u00fck\u00fcm, Araplar’\u0131n cahiliye d\u00f6neminde z\u0131har yap\u0131p, kar\u0131 ve koca aras\u0131ndaki ili\u015fkiyi ebediyyen haram k\u0131lma \u015feklindeki geleneklerini ortadan kald\u0131rmaktad\u0131r. Burada, bu h\u00fck\u00fcm ile, cahiliyyedeki \u00f6rf, adet ve kanunlar y\u00fcr\u00fcrl\u00fckten kald\u0131r\u0131lm\u0131\u015f, z\u0131har\u0131n cahiliyye d\u00f6neminden kalma etkileri silinmi\u015f ve hi\u00e7 kimse i\u00e7in, han\u0131m\u0131n\u0131 annesine veya nikah\u0131 kendisine haram olan kimselere (muharremat) benzetmesinin caiz olmad\u0131\u011f\u0131 anlat\u0131lm\u0131\u015ft\u0131r. \u00c7\u00fcnk\u00fc \u0130sl\u00e2m nezdinde, bir kimsenin annesini veya nikah\u0131 kendisine haram olan kimseleri han\u0131m\u0131na benzetmeyi d\u00fc\u015f\u00fcnmesi ve bunu s\u00f6ylemek suretiyle hafife almas\u0131 \u00e7irkin bir davran\u0131\u015ft\u0131r. Bu noktada \u0130sl\u00e2m’\u0131n tavr\u0131 \u00fc\u00e7 temel esasa dayal\u0131d\u0131r. Birincisi, z\u0131har ile nikah akdi fasit olmaz ve kad\u0131n\u0131n, kocas\u0131 ile olan di\u011fer ili\u015fkileri devam eder. \u0130kincisi, z\u0131har yapan kocaya, han\u0131m\u0131 (cinsi m\u00fcnasebet bak\u0131m\u0131ndan) ge\u00e7ici bir s\u00fcre i\u00e7in haram olur. \u00dc\u00e7\u00fcnc\u00fcs\u00fc bu yasak, koca keffaretini \u00f6deyene de\u011fin s\u00fcrer ve ancak keffaret \u00f6dendikten sonra kalkar.
\nb) Z\u0131har\u0131n ge\u00e7erli olabilmesi i\u00e7in, kocan\u0131n ak\u0131l ve bali\u011f olup, sarho\u015f olmamas\u0131 konusunda g\u00f6r\u00fc\u015f birli\u011fi vard\u0131r. \u00c7ocuk ve delinin yapt\u0131\u011f\u0131 z\u0131har kabul edilmez. Ancak \u015fuurunu kaybeden kimsenin (\u00f6rne\u011fin uyuyan) , bu kelimeleri s\u00f6ylemesi halinde, z\u0131har\u0131n kabul edilip edilmeyece\u011fi konusunda g\u00f6r\u00fc\u015f ayr\u0131l\u0131\u011f\u0131 vard\u0131r. Bu ayr\u0131l\u0131klar \u015fu \u015fekildedir:<\/p>\n

1) Sekir (sarho\u015fluk, \u015fuurun yerinde olmamas\u0131) halinde z\u0131har yapan kimseler ile ilgili olarak, d\u00f6rt mezhebin fakihlerinin \u00e7o\u011funlu\u011fu, “M\u00fcsekkerat (sarho\u015f edici madde) kullanan bir kimsenin yapt\u0131\u011f\u0131 z\u0131har, t\u0131pk\u0131 talak gibi kabul edilir. \u00c7\u00fcnk\u00fc bu duruma kendisi sebebiyet vermi\u015ftir. Ancak bir hastal\u0131k nedeniyle ila\u00e7 al\u0131p \u015fuurunu kaybetmi\u015fse, yahud \u015fiddetli susuzluktan \u00f6t\u00fcr\u00fc can\u0131n\u0131 kurtarmak i\u00e7in \u015farap i\u00e7mi\u015f ve sarho\u015f olmu\u015fsa, bu kimsenin yapt\u0131\u011f\u0131 z\u0131har ve talak ge\u00e7erli olmaz” demektedirler. Hanefiler, \u015eafiler ve Hanbeliler bu g\u00f6r\u00fc\u015ftedirler. Sahabilerin g\u00f6r\u00fc\u015f\u00fc de genelde b\u00f6yledir. Fakat, sadece Hz. Osman (nedeni ne olursa olsun) , sarho\u015fluk halinde ne z\u0131har\u0131n, ne de talak\u0131n ge\u00e7erli olmayaca\u011f\u0131 g\u00f6r\u00fc\u015f\u00fcndedir. Yine Hanefi mezhebi imamlar\u0131ndan Tahavi ve Kerhi de bu g\u00f6r\u00fc\u015f\u00fc tercih etmi\u015flerdir. Hatta \u0130mam \u015eafii’den bu g\u00f6r\u00fc\u015f\u00fc do\u011frulayan bir rivayet de nakledilmektedir. Maliki mezhebinde ise, z\u0131har\u0131n ge\u00e7erli olabilmesi i\u00e7in, z\u0131har yapan ki\u015fi ne s\u00f6yledi\u011fini bilmelidir. \u015euurunu tamamen kaybetmi\u015fse, yapt\u0131\u011f\u0131 z\u0131har kabul edilmez.<\/p>\n

2) \u0130mam-\u0131 Ebu Hanife ve \u0130mam-\u0131 Malik’e g\u00f6re z\u0131har yapan kimse, M\u00fcsl\u00fcman olmal\u0131d\u0131r. Z\u0131mmiler \u00fczerine z\u0131har h\u00fckm\u00fc tatbik edilmez. \u00c7\u00fcnk\u00fc Kur’an’da ge\u00e7en ifade, “\u0130\u00e7inizden kad\u0131nlara z\u0131har yapanlar” \u015feklindedir. Yine Kur’an’da beyan edilen z\u0131har\u0131n \u00fc\u00e7 keffaret bi\u00e7iminden biri oru\u00e7 tutmakt\u0131r ve z\u0131mmilere oru\u00e7 tutma cezas\u0131 verilemez. \u0130mam-\u0131 \u015eafi ve \u0130mam-\u0131 Ahmed’e g\u00f6re ise, z\u0131har\u0131n h\u00fckm\u00fc M\u00fcsl\u00fcmanlar i\u00e7in de, z\u0131mmiler i\u00e7in de ge\u00e7erlidir, ancak z\u0131mmilere oru\u00e7 tutma cezas\u0131 verilemez. Onlar ya bir k\u00f6le azad ederler ya da 60 fakiri doyururlar. Bu iki bi\u00e7imdeki ceza z\u0131mmilere verilebilir.<\/p>\n

3) Erkekler gibi kad\u0131nlar da z\u0131har yapabilirler mi? S\u00f6z gelimi bir kad\u0131n kocas\u0131na, “Sen benim babam veya amcam gibisin” diyebilir mi? Dedi\u011fi takdirde bu z\u0131har olarak kabul edilebilir mi? D\u00f6rt mezhebe g\u00f6re de bu, z\u0131har olarak kabul edilmez ve buna z\u0131har h\u00fckm\u00fc uygulanmaz. \u00c7\u00fcn\u00fck Kur’an’da a\u00e7\u0131k\u00e7a bu h\u00fck\u00fcm, erke\u011fin han\u0131m\u0131na z\u0131har yapmas\u0131 hakk\u0131ndad\u0131r: “\u0130\u00e7inizden kad\u0131nlar\u0131na z\u0131har yapanlar…” G\u00f6r\u00fcld\u00fc\u011f\u00fc gibi bu ayette z\u0131har yapma hakk\u0131, talak (bo\u015fanma) hakk\u0131n\u0131 elinde tutanlara yani erkeklere verilmi\u015ftir. \u0130sl\u00e2m hukukunda kad\u0131na, kocas\u0131n\u0131 bo\u015fayabilme (talak) hakk\u0131 verilmedi\u011fi i\u00e7in kocas\u0131n\u0131 kendisine haram etme hakk\u0131 da verilmemi\u015ftir.
\nAyn\u0131 \u015fekilde, S\u00fcfyan-\u0131 Sevri, \u0130shak bin Rahaveyh, Ebu Sevr ve Leys bin Sa’da’dan kad\u0131n\u0131n bu davran\u0131\u015f\u0131n\u0131n \u00e7ok anlams\u0131z oldu\u011fu \u015feklinde rivayetler vard\u0131r. \u0130mam Yusuf ise, kad\u0131n\u0131n bu davran\u0131\u015f\u0131n\u0131n ve bu s\u00f6z\u00fcn\u00fcn z\u0131har olmad\u0131\u011f\u0131n\u0131, ancak bu t\u00fcr s\u00f6zler sarfeden kad\u0131nlara, yeminlerinden \u00f6t\u00fcr\u00fc keffaret gerekti\u011fini s\u00f6yler. \u00c7\u00fcnk\u00fc bir kad\u0131n\u0131n bu t\u00fcr s\u00f6zler sarfetmesi, kocas\u0131n\u0131 kendisine haram k\u0131lma konusunda yemin etmesi anlam\u0131na gelir.
\n\u0130bn Kudame, Ahmed bin Hanbel’in de ayn\u0131 g\u00f6r\u00fc\u015fte oldu\u011funu nakleder. \u0130mam Evzai: “Evlenmeden \u00f6nce, kocas\u0131 olacak kimse hakk\u0131nda, “Bu benim babam gibidir” diyen kad\u0131n\u0131n s\u00f6z\u00fc z\u0131har olarak kabul edilir. Evlendikten sonra bu s\u00f6z\u00fc s\u00f6ylerse, yemin olarak addedilir ve o takdirde yemin keffareti laz\u0131m gelir” demektedir. Bu g\u00f6r\u00fc\u015f\u00fcn aksine Hasan Basri, Z\u00fchri, \u0130brahim en-Nehai ve Hasan bin Ziyad Lului, bu s\u00f6z\u00fcn her hal\u00fckarda z\u0131har olaca\u011f\u0131n\u0131 ve z\u0131har keffaretini gerektirdi\u011fini s\u00f6ylerler. Ancak kad\u0131n\u0131n keffaret \u00f6ncesi kocas\u0131n\u0131n kendisine yakla\u015fmas\u0131na engel olma hakk\u0131 yoktur. \u0130brahim en-Nehai, bu g\u00f6r\u00fc\u015f\u00fcne delil olarak \u015fu olay\u0131 zikreder: Hz. Ebu Talha’n\u0131n k\u0131z\u0131 Ai\u015fe, Hz. Z\u00fcbeyr’in o\u011flu Musab’dan evlenme teklifi ald\u0131\u011f\u0131nda, “O benim babam\u0131n s\u0131rt\u0131 gibidir” s\u00f6zlerini sarfetmi\u015f, ancak bir s\u00fcre sonra O’nunla evlenmeye raz\u0131 olmu\u015ftur. Medine’de \u00e7o\u011fu sahabe olan alimlerden bu mesele hakk\u0131nda fetva istendi\u011finde, onlar Ai\u015fe’ye z\u0131har keffareti gerekti\u011fi \u015feklinde bir fetva vermi\u015flerdir. \u0130brahim en-Nehai bu rivayeti naklettikten sonra \u015f\u00f6yle der: “\u015eayet Ai\u015fe, evlendikten sonra bu s\u00f6zleri sarfetmi\u015f olsayd\u0131, O’na zihar keffareti laz\u0131m gelmezdi. c) Akil ve bali\u011f bir kimse, \u015fuuru yerindeyken z\u0131har yapt\u0131\u011f\u0131nda, onun k\u0131zg\u0131nl\u0131k, \u015faka, sevgi ve z\u0131har niyeti olmama vs. \u015feklindeki mazeretleri ge\u00e7erli kabul edilmez. Ancak sarfetti\u011fi kelimelerin de\u011fi\u015fik anlamlara gelme ihtimalleri bulunuyorsa, o taktirde, o ki\u015finin s\u00f6yledi\u011fi s\u00f6zlerin zahirine bak\u0131larak karar verilir. Nitekim, biz, ileride hangi kelimelerin z\u0131har olarak kabul edilece\u011fini, hangi kelimelerin kabul edilmeyece\u011fini beyan edece\u011fiz.<\/p>\n

d) Z\u0131har\u0131n, ancak nikah alt\u0131nda bulunan kad\u0131n i\u00e7in ge\u00e7erli oldu\u011fu hakk\u0131nda g\u00f6r\u00fc\u015f birli\u011fi vard\u0131r. Nikah alt\u0131nda bulunmayan kad\u0131nlara da z\u0131har yap\u0131l\u0131p yap\u0131lmayaca\u011f\u0131 hususunda ihtilaf edilmi\u015ftir. Bu konudaki de\u011fi\u015fik g\u00f6r\u00fc\u015fleri a\u015fa\u011f\u0131ya ald\u0131k.
\nHanefilere g\u00f6re; bir erkek, nikah\u0131 alt\u0131nda bulunmayan bir kad\u0131na “Seninle evlenirsem, sen bana annemin s\u0131rt\u0131 gibi ol” derse ve buna ra\u011fmen o kad\u0131nla evlenirse, ona z\u0131har keffareti laz\u0131m gelir. Hz. \u00d6mer de ayn\u0131 \u015fekilde fetva vermi\u015ftir. Nitekim O’nun d\u00f6neminde bir \u015fah\u0131s, bir kad\u0131na ayn\u0131 \u015fekilde z\u0131har yap\u0131p, sonra kendisiyle evlenince, Hz. \u00d6mer ona, z\u0131har keffareti vermesini emretmi\u015ftir.
\nMaliki ve Hanbeliler de ayn\u0131 g\u00f6r\u00fc\u015ftedirler. Ayr\u0131ca bir kimsenin, tahsis (belirleme) olmadan, bir \u00e7ok kad\u0131na z\u0131har yapmas\u0131 halinde o kad\u0131nlardan hangisiyle evlenirse evlensin, o kad\u0131na dokunmadan \u00f6nce z\u0131har keffareti vermesi gerekti\u011fi s\u00f6ylenmektedir. Said bin M\u00fcseyyeb, Urve bin Z\u00fcbeyr, Ata bin Ebi Rebah, Hasan Basri, \u0130shak bin Rahaveyh bu g\u00f6r\u00fc\u015ftedirler.
\n\u015eafiiler ise; nikahdan \u00f6nce z\u0131har\u0131n bir anlam ifade etmedi\u011fi g\u00f6r\u00fc\u015f\u00fcndedirler. \u0130bn Abbas ve Katade de bu g\u00f6r\u00fc\u015f\u00fc payla\u015fmaktad\u0131rlar.<\/p>\n

e) Belirli bir s\u00fcreye mahsusen z\u0131har yap\u0131labilir mi? Hanefiler ve \u015eafiilere g\u00f6re, belli bir s\u00fcre i\u00e7in z\u0131har yapan kimse, o s\u00fcre bitmeden \u00f6nce han\u0131m\u0131na yakla\u015f\u0131rsa keffaret vermesi gerekir. Ancak s\u00fcre bittikten sonra z\u0131har ortadan kalkar. Bu h\u00fckm\u00fcn delili, Ramazan ay\u0131 s\u00fcresi i\u00e7in han\u0131m\u0131na z\u0131har yapan Seleme bin Sehhar Beyadi vak\u0131as\u0131d\u0131r. Bu olay hakk\u0131nda Hz. Peygamber, bu konuda s\u00fcre tayin etmenin anlams\u0131z olaca\u011f\u0131 \u015feklinde bir \u015fey s\u00f6ylememi\u015ftir. Fakat bu g\u00f6r\u00fc\u015f\u00fcn aksine, \u0130mam Malik ve \u0130bn Ebi Leyla, z\u0131har\u0131n s\u00fcresi bulunmad\u0131\u011f\u0131n\u0131 ve s\u00fcre tayin etmenin anlams\u0131z olaca\u011f\u0131n\u0131, \u00e7\u00fcnk\u00fc haraml\u0131k vuku buldu\u011funu ve s\u00fcre sonunda bu haraml\u0131\u011f\u0131n ortadan kalkmayaca\u011f\u0131n\u0131 s\u00f6ylemi\u015flerdir.<\/p>\n

f) Z\u0131har, bir \u015farta ba\u011fl\u0131 olarak yap\u0131l\u0131rsa ve s\u00f6z konusu \u015farta ayk\u0131r\u0131 davran\u0131l\u0131rsa, keffaret gerekir. S\u00f6z gelimi, “\u015eayet eve gelirsem, bana annemin s\u0131rt\u0131 gibi ol” diyen bir kimsenin eve gelirse keffaret vermeden han\u0131m\u0131na yakla\u015fmas\u0131 caiz de\u011fildir.<\/p>\n

g) Han\u0131m\u0131na birden fazla z\u0131har yapan koca, Hanefilere ve \u015eafiilere g\u00f6re, bir defa veya birden fazla z\u0131har yapsa da z\u0131har ifadesini kulland\u0131\u011f\u0131 kadar keffaret verir. Ancak bir kez z\u0131har yapt\u0131ktan sonra, s\u00f6z\u00fcn\u00fc tekid i\u00e7in tekrarlarsa dahi, yine bir kez z\u0131har yapm\u0131\u015f olur. Bu g\u00f6r\u00fc\u015f\u00fcn aksine \u0130mam Ahmed ve \u0130mam Malik, “Z\u0131har ka\u00e7 kez yap\u0131l\u0131rsa yap\u0131ls\u0131n, tekid veya tekrar olsa da, bir kez yap\u0131lm\u0131\u015f say\u0131l\u0131r” demektedirler. Nitekim \u015ea’bi, Tavus, Ata bin Ebi Rebah, Hasan Basri ve Evzai de ayn\u0131 g\u00f6r\u00fc\u015ftedirler. Hz. Ali ise, “Koca, z\u0131har\u0131 bir meclisde bir ka\u00e7 kez yapsa da, bu bir z\u0131hard\u0131r. \u00c7e\u015fitli meclislerde ka\u00e7 kez z\u0131har yap\u0131lm\u0131\u015fsa, o kadar keffaret gerekir” \u015feklinde fetva vermi\u015ftir. Katade ve Amr bin Dinar da bu g\u00f6r\u00fc\u015f\u00fc payla\u015fmaktad\u0131rlar.<\/p>\n

\u011f) Erkek, iki veya daha fazla han\u0131m\u0131na hitabederek, z\u0131har yaparsa, yani onlara “Sizler bana anam\u0131n s\u0131rt\u0131 gibisiniz” derse, han\u0131mlar\u0131n\u0131n her birinin kendisine helal olabilmesi i\u00e7in, ayr\u0131 ayr\u0131 keffaret vermesi gerekir. \n\u0130mam Malik ve \u0130mam Ahmed ise, hepsi i\u00e7in bir keffaretin yeterli oldu\u011funu s\u00f6yl\u00fcyorlar. Nitekim Rebia, Evza\u00ee, \u0130shak bin Rahaveyh ve Ebu Sevr de ayn\u0131 g\u00f6r\u00fc\u015ftedirler.<\/p>\n

h) Bir kez z\u0131har keffareti veren bir kimsenin, yeniden z\u0131har yapt\u0131\u011f\u0131nda, keffaret vermeden kar\u0131s\u0131n\u0131n kendisine helal olmayaca\u011f\u0131 hususunda g\u00f6r\u00fc\u015f birli\u011fi vard\u0131r.<\/p>\n

\u0131) Keffaret vermeden \u00f6nce erkek han\u0131m\u0131na yakla\u015f\u0131rsa, bu d\u00f6rt mezhebe g\u00f6re de bir g\u00fcnaht\u0131r ve tevbe gerektirir. Fakat keffaret laz\u0131m gelmez. Hz. Peygamber, bu \u015fekilde davranan kimselere, tevbe etmelerini, keffaret vermeden \u00f6nce han\u0131mlar\u0131ndan uzak kalmalar\u0131n\u0131 s\u00f6ylemi\u015f ve ayr\u0131ca z\u0131har keffaretinden ba\u015fka bir ceza vermemi\u015ftir. Kabise bin Z\u00fcveyb, Said bin C\u00fcbeyr, Z\u00fchr\u00ee ve Katade, bu davran\u0131\u015fda bulunan bir kimsenin iki keffaret \u00f6demesi g\u00f6r\u00fc\u015f\u00fcndedirler. \u0130brahim en-Neha\u00ee ve Hasan Basri’ye g\u00f6re ise, \u00fc\u00e7 keffaret \u00f6demesi gerekir. Kanaatimizce, s\u00f6z konusu mesele hakk\u0131nda Rasulullah’\u0131n karar verdi\u011fini bildiren yukar\u0131daki hadis, bu kimselere ula\u015fmam\u0131\u015ft\u0131r.<\/p>\n

i) Kad\u0131n kime benzetildi\u011finde z\u0131har\u0131n vuku bulaca\u011f\u0131na dair fakihler aras\u0131nda g\u00f6r\u00fc\u015f ayr\u0131l\u0131\u011f\u0131 vard\u0131r. \u015ea’bi, sadece anneye benzetildi\u011finde z\u0131har\u0131n vuku bulaca\u011f\u0131n\u0131, Zahiriler ise, annenin s\u0131rt\u0131na benzetilmesi halinde z\u0131har su\u00e7unun ger\u00e7ekle\u015fmi\u015f olaca\u011f\u0131n\u0131, bunun d\u0131\u015f\u0131ndakilerin ise z\u0131har olarak kabul edilemeyece\u011fini s\u00f6ylemektedirler. Ancak \u00fcmmetin di\u011fer fakihleri, bu hususta onlara kat\u0131lmamaktad\u0131rlar. \u00c7\u00fcnk\u00fc Kur’an z\u0131har\u0131n g\u00fcnah, yalan ve anlams\u0131z bir davran\u0131\u015f oldu\u011funu beyan eder. Bu t\u00fcr bir nitelemeden bellidir ki, anne gibi, nik\u00e2h\u0131 haram olan di\u011fer kad\u0131nlara benzetmek de haramd\u0131r, beyhudedir, yaland\u0131r. Dolay\u0131s\u0131yla s\u00f6z konusu h\u00fck\u00fcm, onlar i\u00e7in de ge\u00e7erli olur.
\nHanefilere g\u00f6re, gerek nesep, gerek s\u00fct, gerekse evlilik nedeniyle ebedi haram olan t\u00fcm muharremat (nik\u00e2h\u0131 haram olan kad\u0131nlar) bu s\u0131n\u0131r i\u00e7ine girer. Ancak baz\u0131 \u015fartlar dolay\u0131s\u0131yla hel\u00e2l olabilen, ama ge\u00e7ici haraml\u0131\u011f\u0131 bulunan kad\u0131nlar (bald\u0131z, kad\u0131n\u0131n halas\u0131 vs.) z\u0131har kapsam\u0131na girmezler. Ebedi haram olan kad\u0131nlardan birinin, yine g\u00f6r\u00fclmesi haram olan bir uzvuna benzetme yap\u0131l\u0131rsa z\u0131har vuku bulur. Ama g\u00f6r\u00fclmesi hel\u00e2l olan el, ayak, y\u00fcz, di\u015f vs. gibi bir uzuv benzetildi\u011fi takdirde, bu z\u0131har olmaz. S\u00f6zgelimi, erkek han\u0131m\u0131na “Senin el ve ayaklar\u0131n, annemin el ve ayaklar\u0131 gibidir” derse bu z\u0131har de\u011fildir. \u015eafiilere g\u00f6re, bu h\u00fck\u00fcm nik\u00e2h\u0131 ebed\u00ee haram olan kad\u0131nlara (anne, k\u0131zkarde\u015f vs.) mahsustur. Fakat bir d\u00f6nem i\u00e7in nik\u00e2h\u0131n\u0131n hel\u00e2lli\u011fi s\u00f6z konusu olmu\u015f kad\u0131nlar buna (s\u00fct annesi, kay\u0131nvalide, bald\u0131z, gelin) dahil de\u011fildir.
\nBunun d\u0131\u015f\u0131nda, nik\u00e2h\u0131 ebedi olarak haram olan kad\u0131nlardan birinin g\u00f6r\u00fclmesi haram olan bir uzvunu, kendi han\u0131m\u0131na benzeten erkek z\u0131har yapm\u0131\u015f olur. Ancak genel bir benzetme z\u0131har de\u011fildir. Belirli bir uzuv ise, ancak z\u0131har niyetiyle benzetilirse z\u0131har olarak kabul edilir. S\u00f6zgelimi, bir kimse han\u0131m\u0131na “senin g\u00f6zlerin t\u0131pk\u0131 annemin g\u00f6zlerine benziyor”, veya “senin ellerin t\u0131pk\u0131 annemin elleri gibi yumu\u015fak”, ya da “sen t\u0131pk\u0131 annem gibi \u015fefkatlisin”, “senin s\u0131rt\u0131n, ellerin, ba\u015f\u0131n anneminki gibi”, \u015feklindeki s\u00f6zleri z\u0131har niyeti ile sarfederse, z\u0131har vuku bulur. Aksi takdirde bu t\u00fcr genel benzetmeleri iltifat amac\u0131yla s\u00f6ylerse, bu z\u0131har olmaz.
\nMalikilere g\u00f6re; bir kimsenin, nikah\u0131 kendisine haram olan bir kad\u0131n\u0131 han\u0131m\u0131na benzetmesi z\u0131hard\u0131r. Erke\u011fin han\u0131m\u0131na, “senin s\u0131rt\u0131n filan kad\u0131n\u0131n s\u0131rt\u0131na benziyor” demesi bile z\u0131hard\u0131r. Ayr\u0131ca Malikiler, erke\u011fin, nik\u00e2h\u0131 haram olan kad\u0131nlardan birinin uzvunu (bak\u0131lmas\u0131 helal bile olsa) , han\u0131m\u0131n\u0131n uzvuna benzetmesini z\u0131har kabul ederler. \u00c7\u00fcnk\u00fc ki\u015finin, annesinin herhangi bir uzvuna, han\u0131m\u0131n\u0131n uzvu gibi bakmas\u0131 haramd\u0131r.
\nHanbelilere g\u00f6re, nik\u00e2h\u0131 ebedi haram olan ile nik\u00e2h\u0131 bir zaman i\u00e7in hel\u00e2l olmu\u015f kad\u0131nlar (s\u00fct annesi, kay\u0131nvalide) z\u0131har kapsam\u0131na girer. Bald\u0131z ve nik\u00e2h\u0131 sonradan hel\u00e2l olabilecek kad\u0131nlar ise, \u0130mam Ahmed’in bir g\u00f6r\u00fc\u015f\u00fcne g\u00f6re, z\u0131har kapsam\u0131na girmekte, bir g\u00f6r\u00fc\u015f\u00fcne g\u00f6re ise girmemektedir. Yine Hanbeli mezhebine g\u00f6re sa\u00e7, t\u0131rnak, di\u015f gibi sabit olmayan uzuvlar hari\u00e7, bir erke\u011fin, nik\u00e2h\u0131 kendisine ebedi haram olan kad\u0131nlardan birinin uzvunu han\u0131m\u0131n\u0131n uzvuna benzetmesi z\u0131hard\u0131r.<\/p>\n

j) Bir kimsenin han\u0131m\u0131na “sen bana anam\u0131n s\u0131rt\u0131 gibisin” demesinin a\u00e7\u0131k\u00e7a bir z\u0131har oldu\u011fu konusunda g\u00f6r\u00fc\u015f birli\u011fi vard\u0131r. \u00c7\u00fcnk\u00fc Araplar z\u0131har yaparken, bu c\u00fcmleyi sarfederlerdi ve Kur’an’daki h\u00fck\u00fcm bu c\u00fcmlenin sarfedilmesi \u00fczerine nazil olmu\u015ftur. Ancak fakihler aras\u0131nda, hangi kelimelerin z\u0131har anlam\u0131na gelece\u011fi, hangi kelimelerin gelmeyece\u011fi hususunda ihtilaf vard\u0131r. Hanefilere g\u00f6re erke\u011fin, nik\u00e2h\u0131 kendisine ebedi olarak haram olan kad\u0131nlardan birinin, g\u00f6r\u00fclmesi haram olan bir uzvunu, han\u0131m\u0131n\u0131n bir uzvuna a\u00e7\u0131k\u00e7a benzetmesi z\u0131hard\u0131r. S\u00f6zgelimi, “Sen bana anam\u0131n (ya da nik\u00e2h\u0131 haram olan kad\u0131nlardan birinin) karn\u0131 veya bald\u0131r\u0131 gibisin” \u015feklindeki bir s\u00f6z z\u0131hard\u0131r. Bunun d\u0131\u015f\u0131ndaki kelimelerde ise ihtil\u00e2f etmi\u015flerdir. \u00d6rnek olarak, bir kimse han\u0131m\u0131na, “sen bana annemin s\u0131rt\u0131 gibi harams\u0131n” derse, bu Ebu Hanife’ye g\u00f6re a\u00e7\u0131k\u00e7a z\u0131hard\u0131r. \u0130mam Muhammed ve \u0130mam Ebu Yusuf’a g\u00f6re ise, z\u0131har niyetiyle s\u00f6ylemi\u015fse z\u0131har, talak niyetiyle s\u00f6ylenmi\u015fse talakt\u0131r. Bir niyet s\u00f6zkonusu de\u011filse, bu sadece anlams\u0131z bir s\u00f6zd\u00fcr.
\n\u0130mam Muhammed’e g\u00f6re ise, kesinlikle z\u0131hard\u0131r. Erkek, han\u0131m\u0131n\u0131 k\u0131zkarde\u015fi, annesi veya k\u0131z\u0131 olarak \u00e7a\u011f\u0131r\u0131rsa, bu bo\u015f bir s\u00f6zd\u00fcr. Nitekim Hz. Peygamber, bu \u015fekilde davranan birine k\u0131zg\u0131nl\u0131\u011f\u0131n\u0131 belli etmi\u015f ama z\u0131har h\u00fckm\u00fc vermemi\u015ftir. \u015eayet bir kimse han\u0131m\u0131na, “Sen bana annem gibi harams\u0131n” derse, bu s\u00f6z z\u0131har niyetiyle s\u00f6ylenmi\u015fse z\u0131har, talak niyetiyle s\u00f6ylenmi\u015fse talak, hi\u00e7 bir niyet s\u00f6z konusu de\u011filse yine z\u0131hard\u0131r. E\u011fer, “sen benim annem gibisin” veya “anneme benziyorsun” denilirse, ki\u015fiye “ne demek istedin?” \u015feklinde niyeti sorulmal\u0131d\u0131r. \u0130ltifat i\u00e7in s\u00f6ylenmi\u015fse ve z\u0131har niyeti yoksa, bu bir iltifat olarak kabul edilir. Z\u0131har niyetiyle s\u00f6ylenmi\u015fse, z\u0131har, talak niyetiyle s\u00f6ylenmi\u015fse talak olarak kabul edilir. \nHanbeli’lere g\u00f6re; bir kimsenin, han\u0131m\u0131n\u0131n bir uzvunu, nik\u00e2h\u0131 kendisine haram olan kad\u0131nlardan birinin uzvuna a\u00e7\u0131k\u00e7a benzetmesi, z\u0131hard\u0131r.
\nMalikilerin g\u00f6r\u00fc\u015f\u00fc de yakla\u015f\u0131k bu \u015fekildedir, ama ayr\u0131nt\u0131larda farkl\u0131 fetvalar vermi\u015flerdir. Yine bir kimse han\u0131m\u0131na “sen bana annemin s\u0131rt\u0131 gibi harams\u0131n” derse, Hanefilere g\u00f6re, niyet ne olursa olsun bu s\u00f6z z\u0131hard\u0131r.
\nFakihlerin, lugavi ve \u0131st\u0131lahi tan\u0131mlar\u0131 konusunda ihtilaf ettikleri z\u0131har ile ilgili kelimelerin iyice bilinmesi gerekir. \u00c7\u00fcnk\u00fc Arap olmayan di\u011fer toplumlar, Arap\u00e7a kelimelerle z\u0131har yapmazlar. Ayr\u0131ca z\u0131har ile ilgili Arap\u00e7a kelimelerin tam kar\u015f\u0131l\u0131\u011f\u0131n\u0131, bu toplumlar\u0131n dillerinde bulmak da m\u00fcmk\u00fcn de\u011fildir. Dolay\u0131s\u0131yla hangi kelimelerin (veya c\u00fcmlelerin) z\u0131har kabul edilip edilmeyece\u011fine karar verebilmek i\u00e7in, fakihlerin a\u00e7\u0131klamalar\u0131 do\u011frultusunda, bu t\u00fcr s\u00f6zler sarfeden kimselerin cinsel ili\u015fkiyi mi kastettikleri, yoksa ba\u015fka ihtimallerin mi s\u00f6zkonusu oldu\u011funu anlamam\u0131z m\u00fcmk\u00fcn olur.
\nS\u00f6zgelimi, t\u00fcm fakih ve m\u00fcfessirler, hakk\u0131nda h\u00fck\u00fcm verilen s\u00f6z\u00fcn “Ente aleyye kezahri umm\u00ee” (Sen, bana anam\u0131n s\u0131rt\u0131 gibisin) oldu\u011fu hususunda g\u00f6r\u00fc\u015f birli\u011fi i\u00e7indedirler. Herhalde yery\u00fcz\u00fcnde, hi\u00e7bir dilde \u00f6zellikle Urduca’da bu s\u00f6zler, z\u0131har anlam\u0131nda kullan\u0131lmamaktad\u0131r. Ancak di\u011fer dillerde de, Araplar\u0131n yukar\u0131da kastettikleri anlamda, yani “seninle cinsel ili\u015fkide bulunmak, annemle cinsel ili\u015fkide bulunmak gibidir” veya baz\u0131 eskilerin dedi\u011fi \u015fekilde “seninle m\u00fcba\u015feret edersem, annemle m\u00fcba\u015feret etmi\u015f gibi olay\u0131m” bi\u00e7iminde ba\u015fka kelimeler kullan\u0131lmaktad\u0131r.<\/p>\n

k) Kur’an’da keffareti gerektiren davran\u0131\u015f, sadece z\u0131har de\u011fil, ayr\u0131ca z\u0131hardan avdet etmedir. Yani bir kimse sadece z\u0131har yapm\u0131\u015f ama avdet etmemi\u015fse keffaret gerekmez. Bu ba\u011flamda, keffareti gerektiren avdetin niteli\u011fi sorulabilir. Bu husus hakk\u0131nda fakihlerin g\u00f6r\u00fc\u015flerini a\u015fa\u011f\u0131ya ald\u0131k.
\nHanefi’lere g\u00f6re, “avdet” ile kastedilen husus, cinsel ili\u015fkiye niyet etmektir. Fakat bu, sadece bu konuda istek duydu\u011fundan keffaretin gerekti\u011fi anlam\u0131na gelmez. Hatta bir kimse bu hususta niyet eder ama fiilen uygulamazsa keffaret laz\u0131m gelmez. Dolay\u0131s\u0131yla bunun do\u011fru anlam\u0131, ki\u015finin z\u0131har yapm\u0131\u015f olmas\u0131 nedeniyle, haraml\u0131\u011f\u0131 ortadan kald\u0131rmak (han\u0131m\u0131n\u0131n tekrar helal olabilmesini sa\u011flamak) i\u00e7in keffaret vermesi ve b\u00f6ylelikle haraml\u0131\u011f\u0131n ortadan kalkmas\u0131d\u0131r.
\n\u0130mam Malik’ten bu konuda \u00fc\u00e7 g\u00f6r\u00fc\u015f nakledilmektedir. Maliki’lere g\u00f6re, en me\u015fhur ve en sahih g\u00f6r\u00fc\u015f, yukar\u0131da a\u00e7\u0131kland\u0131\u011f\u0131 gibi Hanefi’lerin g\u00f6r\u00fc\u015f\u00fcd\u00fcr. \u0130mam Malik z\u0131har yoluyla han\u0131m\u0131 ile cinsel ili\u015fkiyi haram eden kimsenin keffaret vererek, haraml\u0131\u011f\u0131 ortadan kald\u0131rmas\u0131, avdettir demektedir. \u0130bn Kudame, Ahmet bin Hanbel’in g\u00f6r\u00fc\u015f\u00fcn\u00fcn de bu iki \u0130mam\u0131n g\u00f6r\u00fc\u015f\u00fcne yak\u0131n oldu\u011funu nakletmektedir. Ona g\u00f6re, z\u0131har yoluyla kendine han\u0131m\u0131 ile cinsel ili\u015fkiyi haram eden kimsenin keffaret vererek, han\u0131m\u0131n\u0131 kendisine helal k\u0131lmas\u0131 avdettir. Dolay\u0131s\u0131yla z\u0131har yapan kimseye, han\u0131m\u0131n\u0131n helal olabilmesi i\u00e7in keffaret emredilmi\u015ftir. T\u0131pk\u0131 bir kimseye, bir kad\u0131n\u0131n helal olabilmesi i\u00e7in nikah gerekti\u011fi gibi.
\n\u0130mam \u015eafii’nin g\u00f6r\u00fc\u015f\u00fc \u00fc\u00e7\u00fcnden de farkl\u0131d\u0131r. Ona g\u00f6re avdet, bir kimsenin z\u0131har yapt\u0131ktan sonra, han\u0131m\u0131n\u0131 h\u00e2l\u00e2 kar\u0131s\u0131 olarak al\u0131koymas\u0131d\u0131r. \u00c7\u00fcnk\u00fc kar\u0131s\u0131na z\u0131har yapan kimse, han\u0131m\u0131n\u0131 kendisine haram k\u0131lm\u0131\u015ft\u0131r. Dolay\u0131s\u0131yla o kimse z\u0131har yapt\u0131\u011f\u0131nda han\u0131m\u0131n\u0131 bo\u015famazsa ve bo\u015fama ile ilgili s\u00f6zlere s\u00f6yleyinceye kadar han\u0131m\u0131n\u0131 yan\u0131nda al\u0131koyarsa, o kimsenin s\u00f6z\u00fcnden avdet etmi\u015f oldu\u011fu anla\u015f\u0131l\u0131r ve ona keffaret gerekir.
\nYani, ki\u015fi z\u0131har ve talak\u0131 bir defada vermemi\u015fse, sonradan talak verse bile, yine de ona z\u0131har keffareti laz\u0131m gelir. Hatta talak vermek i\u00e7in \u00e7ok k\u0131sa bir teredd\u00fct etse dahi kefaret \u015fartt\u0131r.<\/p>\n

1) Kur’an’da beyan edilen h\u00fckme g\u00f6re, z\u0131har yapan kimse keffaret vermeden han\u0131m\u0131na yakla\u015famaz. Ayette ge\u00e7en “dokunmak” ifadesi ile elle dokunman\u0131n kastolundu\u011fu hususunda d\u00f6rt mezhep de g\u00f6r\u00fc\u015f birli\u011fi i\u00e7indedir. Dolay\u0131s\u0131yla z\u0131har yapan kimse i\u00e7in, keffaret vermeden \u00f6nce, de\u011fil han\u0131m\u0131 ile m\u00fcba\u015ferette bulunmak, ona dokunmas\u0131 bile imk\u00e2ns\u0131zd\u0131r. \u015eafii’lere g\u00f6re, \u015fehvetle dokunmak haramd\u0131r. Hanbeli’ler, ne \u015fekilde olursa olsun, kocan\u0131n han\u0131m\u0131ndan zevk almas\u0131n\u0131n haram oldu\u011fu g\u00f6r\u00fc\u015f\u00fcndedirler. Maliki’lere g\u00f6re ise, elleri ve y\u00fcz\u00fc m\u00fcstesna, kad\u0131n\u0131n bedenine bile bakmak caiz de\u011fildir.<\/p>\n

m) Z\u0131har yapan kimse, Talak-\u0131 Rici’den sonra han\u0131m\u0131na d\u00f6nd\u00fc\u011f\u00fc takdirde, yeniden keffaret vermedik\u00e7e ona dokunmas\u0131 m\u00fcmk\u00fcn de\u011fildir. \u015eayet Talak-\u0131 Bain’den sonra yeniden han\u0131m\u0131 ile evlenirse, yani \u00fc\u00e7 talakla bo\u015fad\u0131ktan sonra han\u0131m\u0131 ba\u015fka biriyle evlenip ondan bo\u015fanm\u0131\u015fsa ve daha sonra kendisiyle yeniden evlenirse, erkek keffaret vermeden \u00f6nce han\u0131m\u0131na dokunamaz. \u00c7\u00fcnk\u00fc o, han\u0131m\u0131n\u0131 annesine veya nik\u00e2h\u0131 haram olan kad\u0131nlara benzeterek \u00fczerine haram k\u0131lm\u0131\u015ft\u0131r. Bu haraml\u0131\u011f\u0131n ortadan kald\u0131r\u0131labilmesi i\u00e7in keffaret gerekti\u011fi hususunda d\u00f6rt mezhepte g\u00f6r\u00fc\u015f birli\u011fi i\u00e7indedir.<\/p>\n

n) Kad\u0131n, z\u0131har yapan kocas\u0131n\u0131 kendisine dokunmas\u0131na izin vermemekle y\u00fck\u00fcml\u00fcd\u00fcr. \u00c7\u00fcnk\u00fc kocas\u0131, z\u0131har yapmakla kad\u0131n\u0131 kendi hakk\u0131ndan mahrum etmi\u015ftir. Dolay\u0131s\u0131yla, erkek, keffaret vermekten ka\u00e7\u0131nd\u0131\u011f\u0131 takdirde, kad\u0131n mahkemeye ba\u015fvurabilir ve mahkeme de erke\u011fi, mevcut haraml\u0131\u011f\u0131 ortadan kald\u0131rmas\u0131 i\u00e7in keffaret vermeye mecbur eder. Erkek, keffareti vermedi\u011fi takdirde, mahkeme kendisini dayak, hapis veya her ikisiyle de cezaland\u0131r\u0131r. Bu hususta d\u00f6rt mezhep ittifak halindedir. Ancak Hanefi mezhebinde, kad\u0131n i\u00e7in bundan ba\u015fka bir \u00e7\u00f6z\u00fcm yolu g\u00f6sterilmez. Yani z\u0131har yap\u0131ld\u0131ktan sonra ge\u00e7en s\u00fcre boyunca, hakim kad\u0131n\u0131 bu m\u00fc\u015fk\u00fcl durumdan kurtaramazsa, kad\u0131n yine muallakta kal\u0131r. \u00c7\u00fcnk\u00fc z\u0131har nik\u00e2h\u0131 bozamaz. Sadece erke\u011fin han\u0131m\u0131ndan yararlanma hakk\u0131 ortadan kalkar. Malikilere g\u00f6re, erkek, han\u0131m\u0131na eziyet maksad\u0131yla z\u0131har yapar ve (keffaret vermeyerek) onu muallakta b\u0131rak\u0131rsa, hakk\u0131nda “\u00eeyla” vuku bulur.
\nYani erkek, kad\u0131n\u0131 d\u00f6rt aydan fazla muallakta b\u0131rakamaz. (\u00eeyla’n\u0131n anlam\u0131 i\u00e7in bkz. Bakara: 245-247) \u015eafii’lere g\u00f6re, z\u0131har yapan kimse i\u00e7in \u00eeyla’n\u0131n ge\u00e7erli olabilmesi, kad\u0131n\u0131n muallakta kalma s\u00fcresinin 4 ay\u0131 ge\u00e7mesi halinde s\u00f6z konusu olur. \u00c7\u00fcnk\u00fc \u015eafii mezhebine g\u00f6re keffaret, erkek z\u0131har yapmas\u0131na ra\u011fmen kad\u0131n\u0131 h\u00e2l\u00e2 han\u0131m\u0131 olarak al\u0131koyarsa vaciptir. Bu y\u00fczden erke\u011fin uzun bir s\u00fcre, kad\u0131n\u0131 muallakta b\u0131rakmas\u0131 m\u00fcmk\u00fcn de\u011fildir.<\/p>\n

o) Kur’an ve S\u00fcnnet’teki a\u00e7\u0131klamalardan anla\u015f\u0131ld\u0131\u011f\u0131 \u00fczere, z\u0131har i\u00e7in verilmesi gerekli keffaretin ilk maddesi bir k\u00f6le azad etmektir. K\u00f6le azad edemeyen kimse, arka arkaya iki ay oru\u00e7 tutar. \u015eayet bunu yapmaktan aciz ise, 60 fakiri doyurur. Keffaretle y\u00fck\u00fcml\u00fc ki\u015fi, bu \u00fc\u00e7\u00fcn\u00fc de yapacak g\u00fc\u00e7ten yoksun ise, bu \u015fartlardan birini yerine getirebilece\u011fi uygun bir vakti beklemek zorundad\u0131r. Ancak bu durumda olan ki\u015filere, keffareti verebilmeleri i\u00e7in yard\u0131m edildi\u011fi s\u00fcnnetle sabittir. Nitekim Hz. Peygamber, baz\u0131 zaaflar\u0131 neticesinde bu t\u00fcr durumlara d\u00fc\u015f\u00fcp, keffaret verme g\u00fcc\u00fcnden yoksun kimselere Beyt’ul-Mal’dan yard\u0131m etmi\u015ftir.<\/p>\n

\u00f6) Kur’an’da keffaretin ilk \u015fart\u0131 olarak emredilen k\u00f6le azad etmek, “rakabe” kelimesi ile ifade edilmi\u015ftir. Bu kelime, cariye ya da k\u00f6le kar\u015f\u0131l\u0131\u011f\u0131nda da kullan\u0131l\u0131r. Ayr\u0131ca bir ya\u015f s\u0131n\u0131r\u0131 s\u00f6zkonusu de\u011fildir. Hatta k\u00fc\u00e7\u00fck bir \u00e7ocuk da olabilir. Ancak fakihler aras\u0131nda, azad edilecek k\u00f6le ya da cariyenin m\u00fc’min veya kafir olup olmamas\u0131nda g\u00f6r\u00fc\u015f ayr\u0131l\u0131\u011f\u0131 vard\u0131r. Hanefi’lere ve Zahiri’lere g\u00f6re, azad edilecek k\u00f6le veya cariyenin m\u00fcmin ya da kafir olmas\u0131 farketmez. \u00c7\u00fcnk\u00fc Kur’an’da sadece “rakabe” kelimesi kullan\u0131lm\u0131\u015ft\u0131r. Bu g\u00f6r\u00fc\u015f\u00fcn aksine, \u015eafii’ler ve Hanbeliler, m\u00fcminlik \u015fart\u0131n\u0131 \u00f6ne s\u00fcrerler. \u00c7\u00fcnk\u00fc Kur’an’da bu t\u00fcr emirlerde m\u00fcminlik \u015fart\u0131 aranmaktad\u0131r. Dolay\u0131s\u0131yla k\u0131yasla istidlal etmi\u015flerdir.<\/p>\n

p) K\u00f6le azad edilmedi\u011fi takdirde haraml\u0131\u011f\u0131n kald\u0131r\u0131labilmesi i\u00e7in Kur’an, keffaret ile y\u00fck\u00fcml\u00fc ki\u015finin ard\u0131 ard\u0131na iki ay oru\u00e7 tutmas\u0131 gerekti\u011fini beyan eder. Allah’\u0131n bu h\u00fckm\u00fc ile nas\u0131l amel edilece\u011fi hususunda mezheplerin \u00f6ne s\u00fcrd\u00fc\u011f\u00fc g\u00f6r\u00fc\u015fleri a\u015fa\u011f\u0131ya ald\u0131k.<\/p>\n

aa) \u0130ki ay ile kameri aylar\u0131n kastedildi\u011fi hususunda ittifak vard\u0131r. \u015eayet keffaretle y\u00fck\u00fcml\u00fc ki\u015fi, oruca hilalin birinci g\u00fcn\u00fcnde ba\u015flarsa, iki ay\u0131 da tamamlamas\u0131 gerekir. Fakat ay\u0131n ortas\u0131nda bir g\u00fcn ba\u015flarsa Hanefi’lere ve Hanbeli’lere g\u00f6re 60 g\u00fcn oru\u00e7 tutmal\u0131d\u0131r. \u015eafii’lere g\u00f6re, birinci ve \u00fc\u00e7\u00fcnc\u00fc aydaki g\u00fcnler 30 g\u00fcne tekab\u00fcl ediyorsa, aradaki 29 g\u00fcn de, 30 g\u00fcn de olabilir.<\/p>\n

bb) Hanefi’lere ve \u015eafii’lere g\u00f6re, oruca Ramazan ve Kurban Bayram\u0131’na rastlamayacak \u015fekilde ba\u015flanmal\u0131d\u0131r. \u00c7\u00fcnk\u00fc Ramazan ve Kurban Bayram\u0131nda oru\u00e7 tutmak, keffaretteki tesels\u00fcl\u00fc kald\u0131r\u0131r. Dolay\u0131s\u0131yla yeniden oru\u00e7 tutmaya ba\u015flan\u0131lmas\u0131 gerekir, Hanbeli’lere g\u00f6re, Ramazan ve Kurban Bayramlar\u0131nda oru\u00e7 tutmamakla keffaretin tesels\u00fcl\u00fc bozulmaz.<\/p>\n

cc) \u0130ki ay aras\u0131nda herhangi bir \u00f6z\u00fcr dolay\u0131s\u0131yla veya bir \u00f6z\u00fcr olmaks\u0131z\u0131n orucun b\u0131rak\u0131lmas\u0131, Hanefi’lere ve \u015eafii’lere g\u00f6re tesels\u00fcl\u00fc bozar. Dolay\u0131s\u0131yla oru\u00e7 tutmaya yeniden ba\u015flanmas\u0131 gerekir. Muhammed el-Bak\u0131r, \u0130brahim En-Nehai, Said bin C\u00fcbeyr ve S\u00fcfyan es-Sevri bu g\u00f6r\u00fc\u015ftedirler. \u0130mam Malik ve \u0130mam Ahmed’e g\u00f6re, hastal\u0131k ve sefer dolay\u0131s\u0131yla oru\u00e7 b\u0131rak\u0131labilir. Ancak bir \u00f6z\u00fcr olmaks\u0131z\u0131n oru\u00e7 b\u0131rak\u0131l\u0131rsa tesels\u00fcl bozulur. \u00c7\u00fcnk\u00fc keffaret orucu, farz oru\u00e7tan daha “m\u00fcekked” de\u011fildir. Nitekim farz orucun \u00f6z\u00fcr dolay\u0131s\u0131yla b\u0131rak\u0131lmas\u0131n\u0131n caiz olmamas\u0131 i\u00e7in bir neden yoktur. \u0130bn Abbas, Hasan Basri, Ata bin Ebi Rabah, Said bin M\u00fcseyyeb, Amr bin Dinar, \u015e\u00e2bi, Tavus, M\u00fccahid, \u0130shak bin Rahaveyh, Ebu Ubeyde ve Ebu Sevr de bu g\u00f6r\u00fc\u015ftedirler.
\ndd) Z\u0131har yapt\u0131\u011f\u0131 han\u0131m\u0131yla bu iki ay aras\u0131nda m\u00fcba\u015feret eden kimsenin orucundaki tesels\u00fcl\u00fcn bozulaca\u011f\u0131 ve oruca yeniden ba\u015flamas\u0131 gerekti\u011fi hususunda t\u00fcm imamlar aras\u0131nda g\u00f6r\u00fc\u015f birli\u011fi vard\u0131r. \u00c7\u00fcnk\u00fc m\u00fckellef, iki ay ara vermeden oru\u00e7 tutarken, han\u0131m\u0131na dokunmamakla y\u00fck\u00fcml\u00fcd\u00fcr.<\/p>\n

r) Kur’an ve S\u00fcnnet’e g\u00f6re, keffaretin \u00fc\u00e7\u00fcnc\u00fc \u015f\u0131kk\u0131, (yani 60 fakiri doyurmak) ancak birinci ve ikinci \u015f\u0131klar\u0131 yerine getirmekten aciz olan kimseler i\u00e7in ge\u00e7erlidir. Bu hususta fakihlerin g\u00f6r\u00fc\u015fleri tafsilatl\u0131 olarak a\u015fa\u011f\u0131da verilmi\u015ftir.<\/p>\n

aa) Oru\u00e7 tutmaktan aciz olmak d\u00f6rt mezhebe g\u00f6re de m\u00fckellefin \u00e7ok ya\u015fl\u0131 olmas\u0131, hasta olmas\u0131, han\u0131m\u0131ndan iki ay uzak durdu\u011funda, sabredemeyip ona yakla\u015fma korkusu ta\u015f\u0131mas\u0131 demektir. Bu \u00fc\u00e7 \u00f6z\u00fcr, Evs bin Samit el-Ensari ve Seleme bin Sehhar Beyadi olaylar\u0131n\u0131 anlatan sahih hadislere g\u00f6re belirlenmi\u015ftir. Ancak hastal\u0131k \u00f6zr\u00fc hakk\u0131nda fakihler aras\u0131nda g\u00f6r\u00fc\u015f ayr\u0131l\u0131\u011f\u0131 vard\u0131r. Hanefi’lere g\u00f6re, hastal\u0131k \u00f6zr\u00fcn\u00fcn ge\u00e7erli olabilmesi i\u00e7in hastal\u0131\u011f\u0131n ilerlemesi veya iyile\u015fmesinin m\u00fcmk\u00fcn olmamas\u0131 gibi \u015fartlar mevcut bulunmaktad\u0131r. Ancak bu takdirde hastal\u0131k \u00f6z\u00fcr olarak kabul edilir. \u015eafii’lere g\u00f6re m\u00fckellef, orucun me\u015fakkati kar\u015f\u0131s\u0131nda orucu iki ay aras\u0131nda b\u0131rakmak zorunda kalacaksa e\u011fer, bu \u00f6z\u00fcr olarak kabul edilir. Maliki’lere g\u00f6re m\u00fckellef, ileride oru\u00e7 tutabilecek bir duruma gelecekse beklemelidir.
\nFakat ileride de oru\u00e7 tutam\u0131yacaksa ancak bu takdirde 60 fakiri doyurur. Hanbeli’lere g\u00f6reyse, m\u00fckellef oru\u00e7 tuttu\u011fu takdirde, hastal\u0131\u011f\u0131n\u0131n artmas\u0131 s\u00f6z konusu ise bu \u00f6z\u00fcr yeterlidir.<\/p>\n

bb) Doyurulacak fakirler, ge\u00e7im y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc z\u0131har yapan kimseye ait bulunmayan kimseler olmal\u0131d\u0131rlar.<\/p>\n

cc) Hanefi’lere g\u00f6re, M\u00fcsl\u00fcman veya z\u0131mmi her iki gruptan fakirler de doyurulabilir. Ancak M\u00fcsl\u00fcmanlarla sava\u015fan kafirler bu kapsam\u0131n d\u0131\u015f\u0131ndad\u0131rlar. Maliki’lere, \u015eafii’lere ve Hanbeli’lere g\u00f6re ise, ancak M\u00fcsl\u00fcman fakirler doyurulmal\u0131d\u0131r.<\/p>\n

dd) Doyurmak ile, iki vakit yemek yedirmenin kastolundu\u011fu hususunda g\u00f6r\u00fc\u015f birli\u011fi vard\u0131r. Ancak doyurman\u0131n anlam\u0131nda ihtilaf edilmi\u015ftir. Hanefi’lere g\u00f6re iki vakit kar\u0131n doyurmaya yetecek kadar bu\u011fday verilebilir veya yemek pi\u015firilerek de da\u011f\u0131t\u0131labilir. Yahut her ikisi de olabilir. \u00c7\u00fcnk\u00fc Kur’an’da “it’am” kelimesi kullan\u0131lm\u0131\u015ft\u0131r ve “doyurmak” anlam\u0131ndad\u0131r. Fakat Malikiler, \u015eafiiler, Hanbeliler yeme\u011fi pi\u015firerek vermek yerine, yemek malzemesinin verilmesini \u015fart ko\u015fmu\u015flard\u0131r.
