Hamd kendisinden ba\u015fka ilah olmayan, mutlak manada tek g\u00fc\u00e7 ve kudret sahibi olan Allah\u2019a mahsustur. Salat ve selam t\u00fcm peygamberlerin ve onlar\u0131 takip eden tabilerinin \u00fczerine olsun<\/strong><\/p>\n

9- M\u00fc’minlerden iki topluluk \u00e7arp\u0131\u015facak olursa,(12) aralar\u0131n\u0131 bulup-d\u00fczeltin.(13) \u015eayet biri di\u011ferine haks\u0131zl\u0131kla-tecav\u00fczde bulunacak olursa, art\u0131k, haks\u0131zl\u0131kla-tecav\u00fczde bulunanla, Allah’\u0131n emrine d\u00f6n\u00fcnceye kadar(14) sava\u015f\u0131n;(15) e\u011fer sonunda (Allah’\u0131n emrini kabul edip) d\u00f6nerse, bu durumda adaletle aralar\u0131n\u0131 bulun ve (her konuda) adil davran\u0131n.(16) \u015e\u00fcphesiz Allah, adil olanlar\u0131 sever.(17)<\/strong>
\n10- M\u00fc’minler ancak karde\u015ftirler. \u00d6yleyse karde\u015flerinizin aras\u0131n\u0131 bulup-d\u00fczeltin (18) ve Allah’tan korkup-sak\u0131n\u0131n; umulur ki esirgenirsiniz.<\/strong><\/p>\n

A\u00c7IKLAMA<\/strong><\/p>\n

12. Burada, m\u00fcsl\u00fcmanlardan iki taife “vuru\u015ftuklar\u0131nda” de\u011fil, “vuru\u015furlarsa e\u011fer” denilmi\u015ftir. Bu ifade bi\u00e7iminden m\u00fcsl\u00fcmanlar aras\u0131nda bir sava\u015f\u0131n \u00e7\u0131kmas\u0131n\u0131n, m\u00fcsl\u00fcmanlar\u0131n birbirine d\u00fc\u015fmelerinin tabii ve ola\u011fan olmad\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r. Fakat b\u00f6yle bir olay vukubulursa e\u011fer, bu konuda nas\u0131l bir tav\u0131r al\u0131naca\u011f\u0131 ortaya konulmaktad\u0131r. Ayr\u0131ca ayette “F\u0131rka” yerine “Taife” kelimesi kullan\u0131lmaktad\u0131r. Arap\u00e7a’da “F\u0131rka” kelimesi b\u00fcy\u00fck bir kitleyi tan\u0131tmak i\u00e7in, “Taife” kelimesi ise, k\u00fc\u00e7\u00fck bir toplulu\u011fu tarif etmek i\u00e7in kullan\u0131l\u0131r. Bu kullan\u0131mdan, Allah nezdinde m\u00fcsl\u00fcmanlar\u0131n aralar\u0131nda b\u00fcy\u00fck kitleler halinde \u00e7arp\u0131\u015fmalar\u0131n\u0131n ho\u015f kar\u015f\u0131lanmayaca\u011f\u0131 ve bunun \u00e7ok \u00e7irkin bir olay oldu\u011fu anla\u015f\u0131lmaktad\u0131r.<\/p>\n

13. Bu emrin muhatab\u0131, vuru\u015fan iki grubun d\u0131\u015f\u0131ndaki, bu iki grubu bar\u0131\u015ft\u0131rma imkan\u0131na sahip t\u00fcm m\u00fcsl\u00fcmanlard\u0131r. Di\u011fer bir ifadeyle, Allah kat\u0131nda, m\u00fcsl\u00fcmanlar\u0131n i\u00e7lerinde vuru\u015fan iki grubu \u00f6ylece seyretmeleri ho\u015f g\u00f6r\u00fclmez.
\nBu \u00fcz\u00fcc\u00fc hadisenin meydana gelmesi halinde, t\u00fcm m\u00fcsl\u00fcmanlar bu olay\u0131n \u0131zd\u0131rab\u0131n\u0131 i\u00e7lerinde duymal\u0131 ve onlar\u0131n aralar\u0131n\u0131 bulmak i\u00e7in gayret g\u00f6stermelidirler. Sava\u015fan muhalif gruplara Allah’tan korkmalar\u0131n\u0131 telkin etmeli ve taraflar\u0131n ileri gelenleriyle irtibat kurarak, sava\u015f\u0131n sebeplerini ara\u015ft\u0131rmal\u0131, her t\u00fcrl\u00fc gayreti g\u00f6stererek onlar\u0131 bar\u0131\u015ft\u0131rmaya \u00e7al\u0131\u015fmal\u0131d\u0131rlar.<\/p>\n

14. Yani m\u00fcsl\u00fcmanlara, kendisine sald\u0131r\u0131lan tarafa sald\u0131rmak veya sald\u0131r\u0131lan, mazlum olan taraf\u0131 kendi haline b\u0131rakmak ya da sald\u0131ran taraf\u0131 desteklemek yak\u0131\u015fmaz. \u015eayet taraflar\u0131 bar\u0131\u015ft\u0131rmak m\u00fcmk\u00fcn olmuyorsa, o takdirde hakl\u0131n\u0131n ve haks\u0131z\u0131n kim oldu\u011fu ara\u015ft\u0131r\u0131lmal\u0131d\u0131r. Sonra da hak \u00fczerinde olana yard\u0131m edilip, zulmeden tarafa engel olunmal\u0131d\u0131r. \u00c7\u00fcnk\u00fc bu, Allah’\u0131n bir olmas\u0131 dolay\u0131s\u0131yla vaciptir ve bu gaye u\u011fruna sava\u015fmak cihad kategorisine girer. Ancak bu Hz. Peygamber’in (s.a.) i\u015faret etti\u011fi “Ayaktakinin y\u00fcr\u00fcyenden, oturan\u0131n ayaktakinden hay\u0131rl\u0131 oldu\u011fu” bir fitne b\u00f6l\u00fcm\u00fcne girmez. \u00c7\u00fcnk\u00fc Hz. Peygamber’in (s.a.) i\u015faret etti\u011fi fitne ile m\u00fcsl\u00fcmanlar\u0131n asabiyyet ve cahiliyye davas\u0131 i\u00e7in veya d\u00fcnya menfaatleri u\u011fruna sava\u015ft\u0131klar\u0131 ve her iki taraf\u0131n da haks\u0131z oldu\u011fu bir durum kastolunmaktad\u0131r. Oysa hakl\u0131 olana yard\u0131m edip, m\u00fctecaviz tarafa kar\u015f\u0131 sava\u015fmak bu t\u00fcr bir fitne tan\u0131m\u0131na uymaz. Tam aksine b\u00f6yle davranmak, Allah’\u0131n emrine uymak demektir ve t\u00fcm \u0130slam hukuk\u00e7ular\u0131 bu m\u00fcdahalenin vacip oldu\u011funda g\u00f6r\u00fc\u015f birli\u011fi i\u00e7indedirler, sahabe aras\u0131nda da bu konuda ihtilaf yoktur. (Ahkamu’l Kur’an, Cassas) Hatta baz\u0131 alimler bu m\u00fcdahalenin cihadtan efdal oldu\u011funa karar vermi\u015flerdir. Bu alimlerin delili, Hz. Ali’nin kendi hilafet d\u00f6neminde kafirlere kar\u015f\u0131 de\u011fil, asilere kar\u015f\u0131 cihad etmi\u015f olmas\u0131d\u0131r. (Ruhu’l-Meani) Bu vucubiyete, Hz. Ali’nin sava\u015flar\u0131na \u0130bn \u00d6mer ve baz\u0131 sahabelerin i\u015ftirak etmediklerini ileri s\u00fcrerek kar\u015f\u0131 \u00e7\u0131kan baz\u0131 kimseler yan\u0131lmaktad\u0131rlar ve bu, s\u0131hhatli bir delil de\u011fildir. \u00c7\u00fcnk\u00fc \u0130bn \u00d6mer \u015f\u00f6yle demi\u015ftir: “Allah’\u0131n bu ayeti gere\u011fince asilere kar\u015f\u0131 sava\u015fmad\u0131\u011f\u0131m hususunda oldu\u011fu kadar hi\u00e7bir \u015fey kalbimde beni endi\u015feye sevketmemi\u015ftir.” (M\u00fcstedrek, Hakim)
\nM\u00fctecaviz gruba kar\u015f\u0131 sava\u015fmak, sadece onlarla silahl\u0131 sava\u015fmak ve onlar\u0131 \u00f6ld\u00fcrmek anlam\u0131na gelmez. As\u0131l tecav\u00fcze mani olabilmek maksad\u0131yla ne az ne de \u00e7ok, gere\u011fi kadar kuvvet kullanmak kastolunmaktad\u0131r.
\nBu emrin muhatab\u0131, bu zulm\u00fc ortadan kald\u0131rabilme imkan\u0131na sahip her m\u00fcsl\u00fcmand\u0131r.<\/p>\n

15. Bu ifadeden de anla\u015f\u0131ld\u0131\u011f\u0131 gibi m\u00fcdahale emri, asi ve ba\u015fkald\u0131ran gruba bir ceza de\u011fildir. \u0130stenilen onlar\u0131n sald\u0131r\u0131lar\u0131n\u0131n engellenerek, Allah’\u0131n Kitab\u0131’na ve Hz. Peygamber’in (s.a.) S\u00fcnneti’ne g\u00f6re hak olan\u0131 kabul etmek ve sald\u0131r\u0131dan vazge\u00e7mektir.
\nAsi olan grup bu emre uymay\u0131 kabul etti\u011fi takdirde, onlara kar\u015f\u0131 kuvvet kullanmaktan vazge\u00e7mek gerekir. \u00c7\u00fcnk\u00fc sava\u015f\u0131n ger\u00e7ek amac\u0131 ve nihai hedefi budur. Art\u0131k bundan sonra hududu \u00e7i\u011fneyip onlara zulmetmek do\u011fru olmaz. Yap\u0131lmas\u0131 gereken, Allah’\u0131n Kitab\u0131 ve Hz. Peygamber’in (s.a.) S\u00fcnneti \u0131\u015f\u0131\u011f\u0131nda s\u00f6zkonusu ihtilaf\u0131n nedenlerini ara\u015ft\u0131rmak ve haks\u0131z\u0131n kim oldu\u011funa yetkililerce karar vermektir.<\/p>\n

16. Burada, sadece iki taraf\u0131 bar\u0131\u015ft\u0131rmak emredilmemi\u015f, onlar\u0131n hak ve adaletle bar\u0131\u015ft\u0131r\u0131lmas\u0131 gerekti\u011fi de vurgulanm\u0131\u015ft\u0131r. Bu bak\u0131mdan hakl\u0131 ve haks\u0131z dikkate al\u0131nmaks\u0131z\u0131n sava\u015f\u0131n durdurulmas\u0131n\u0131n Allah nezdinde bir de\u011fer ta\u015f\u0131mayaca\u011f\u0131 ortadad\u0131r. Ayr\u0131ca, hakl\u0131 olan tarafa bask\u0131 yaparak, haks\u0131z olan di\u011fer taraf\u0131n yan\u0131nda yer al\u0131p, iki grubu bar\u0131\u015ft\u0131rmaya kalk\u0131\u015fmak do\u011fru de\u011fildir. \u00c7\u00fcnk\u00fc ger\u00e7ek bar\u0131\u015f ancak hak ve adalete dayanan bar\u0131\u015ft\u0131r. Aksi takdirde fesad s\u00fcrer, m\u00fctecaviz taraf\u0131n cesareti artar. Sonu\u00e7ta da bu fesad\u0131n illeti kalkmam\u0131\u015f olaca\u011f\u0131ndan, fesad daha da \u00e7o\u011fal\u0131r ve tekrar tekrar g\u00fcn y\u00fcz\u00fcne \u00e7\u0131kar.<\/p>\n

17. Bu ayet, m\u00fcsl\u00fcmanlar aras\u0131nda vukubulmas\u0131 muhtemel bir sava\u015f hakk\u0131ndaki kanunlar\u0131n kayna\u011f\u0131d\u0131r. \u0130leride zikredece\u011fimiz bir hadis d\u0131\u015f\u0131nda, bu konunun izah\u0131 Hz. Peygamber’in (s.a.) S\u00fcnneti’nde bulunmamaktad\u0131r. \u00c7\u00fcnk\u00fc Hz. Peygamber’in (s.a.) d\u00f6neminde, kendisinin s\u00f6z ve davran\u0131\u015flar\u0131n\u0131n bir \u00f6rnek te\u015fkil edece\u011fi m\u00fcsl\u00fcmanlar aras\u0131 bir sava\u015f vukubulmam\u0131\u015ft\u0131r. Ancak daha sonralar\u0131 Hz. Ali d\u00f6neminde, bu kanunun istinad edece\u011fi m\u00fcsl\u00fcmanlar aras\u0131 bir sava\u015f meydana geldi. \u00c7\u00fcnk\u00fc o d\u00f6nemde bir\u00e7ok sahabe hayattayd\u0131. Dolay\u0131s\u0131yla onlar\u0131n davran\u0131\u015flar\u0131 ve a\u00e7\u0131klamalar\u0131ndan yararlan\u0131larak \u0130slam’\u0131n bu konudaki emir ve prensipleri ayr\u0131nt\u0131lar\u0131yla tertip edilmi\u015ftir. \u00d6zellikle Hz. Ali’nin izledi\u011fi yol, \u0130slam hukuk\u00e7ular\u0131 a\u00e7\u0131s\u0131ndan bu kanunun tertibinde \u00f6nemli bir kaynak vazifesi g\u00f6rm\u00fc\u015ft\u00fcr. A\u015fa\u011f\u0131da bu kanun ile ilgili olarak bir \u00f6zet verdik:
\n1) M\u00fcsl\u00fcmanlar aras\u0131nda yap\u0131lan sava\u015f\u0131n bir \u00e7ok \u015fekli olabilir:
\na) Sava\u015fan her iki taraf\u0131n \u0130slam devletinin tebaas\u0131 olmas\u0131 durumunda, iki taraf\u0131 bar\u0131\u015ft\u0131rmak, s\u00f6zkonusu ihtilaf hakk\u0131nda karar vermek ve verilen karar\u0131 uygulamak \u0130slam devletinin g\u00f6revidir.
\nb) Sava\u015fan her iki taraf\u0131n, b\u00fcy\u00fck kitleler veya birer \u0130slam devleti olmas\u0131 durumunda, her iki taraf da e\u011fer d\u00fcnyevi ama\u00e7lar u\u011fruna sava\u015f\u0131yorlarsa, m\u00fc’minler kesinlikle bu fitneden uzak durmal\u0131d\u0131rlar. Yap\u0131lmas\u0131 gereken \u015fey, her iki tarafa da Allah’tan korkmalar\u0131n\u0131 tavsiye etmektir.
\nc) “b” \u015f\u0131kk\u0131nda zikredildi\u011fi \u015fekildeki taraflar\u0131n, biri hakl\u0131 di\u011feri haks\u0131z olmas\u0131 ve haks\u0131z taraf\u0131n tavsiyeye kulak asmamas\u0131 durumunda m\u00fcminler, hakl\u0131 olan tarafa, haks\u0131zl\u0131k yapan tarafa kar\u015f\u0131 yard\u0131m etmelidirler.
\nd) Taraflardan birinin teba olup, \u0130slam devletine kar\u015f\u0131 ayaklanmas\u0131 durumu, (F\u0131k\u0131h terminolojisinde bu kimseler “Ba\u011fi” olarak tan\u0131mlan\u0131rlar)
\n2) Ba\u011fi, yani devlete kar\u015f\u0131 ayaklananlar \u00e7e\u015fitli kategorilerde ele al\u0131nabilir:
\na) Ellerinde \u015fer’i bir delil olmaks\u0131z\u0131n ayaklanan kimselerle sava\u015fmak caizdir ve bu konuda ittifak has\u0131l olmu\u015ftur. B\u00f6yle bir sava\u015fta m\u00fc’minlerin adil olsa da olmasa da devletin yan\u0131nda yer almalar\u0131 vaciptir.
\nb) Elde \u015fer’i bir delil olmaks\u0131z\u0131n, h\u00fck\u00fcmeti devirmek amac\u0131yla ayaklanma yap\u0131lm\u0131\u015fsa ve ayaklanan kimseler zahiren zalim ve fas\u0131k, h\u00fck\u00fcmet de adil ise, h\u00fck\u00fcmetin yan\u0131nda yer almak hi\u00e7 ku\u015fkusuz vaciptir. H\u00fck\u00fcmet adil olmasa bile onu ayakta tutmak ve asilere kar\u015f\u0131 sava\u015fmak m\u00fc’minlere vaciptir, zira h\u00fck\u00fcmet her ne kadar adil olmasa da \u00fclkenin d\u00fczenini sa\u011flamaktad\u0131r.
\nc) Elde \u015fer’i bir delil olmaks\u0131z\u0131n h\u00fck\u00fcmete kar\u015f\u0131 ayaklan\u0131ld\u0131\u011f\u0131nda delilleri bat\u0131l, akideleri fasid ise (Hariciler gibi) o takdirde adil olsa da olmasa da devletin yan\u0131nda yer almak m\u00fc’minlere vaciptir.
\nd) Me\u015fru bir yolla kurulmu\u015f adil bir h\u00fck\u00fcmete, ellerinde \u015fer’i bir dayanak olmaks\u0131z\u0131n ayaklanan kimselere kar\u015f\u0131 sava\u015fmak ve adil h\u00fck\u00fcmetin yan\u0131nda yer almak t\u00fcm m\u00fc’minlere vaciptir.
\ne) Zalim bir h\u00fck\u00fcmete kar\u015f\u0131 (ki y\u00f6neticileri iktidar\u0131 zorla ele ge\u00e7irmi\u015flerdir ve fas\u0131kt\u0131rlar) ayaklanan kimseler \u015fayet Allah’\u0131n hududunun ve adaletinin yerle\u015ftirilmesi u\u011fruna k\u0131yam etmi\u015flerse ve zahiren salih kimseler iseler bu takdirde bu kimseler “Ba\u011fi” olarak nitelenemez. Bu kimselere kar\u015f\u0131 sava\u015fman\u0131n vacip olmad\u0131\u011f\u0131na karar vermede \u0130slam hukuk\u00e7ular\u0131 aras\u0131nda \u015fiddetli anla\u015fmazl\u0131klar ortaya \u00e7\u0131km\u0131\u015ft\u0131r.
\nFukahan\u0131n cumhuruna ve Ehli Hadis’e g\u00f6re: \u0130ktidar\u0131n\u0131 yerle\u015ftirmi\u015f, \u00fclkede asayi\u015f sa\u011flam\u0131\u015f ve \u00fclkede bir devlet nizam\u0131 kurmu\u015f ve me\u015fru ya da gayrime\u015fru bir \u015fekilde iktidar\u0131 ele ge\u00e7irmi\u015f olsa da adil veya zalim devlet ba\u015fkan\u0131na kar\u015f\u0131 ayaklanma, k\u00fcfr\u00fc a\u00e7\u0131k\u00e7a irtikap etmemesi kayd\u0131yla haramd\u0131r.
\n\u0130mam Serahsi, m\u00fcsl\u00fcmanlar\u0131n hakk\u0131nda icma ettikleri ve onun vas\u0131tas\u0131yla asayi\u015fin sa\u011fland\u0131\u011f\u0131, yollar\u0131n korunma alt\u0131nda oldu\u011fu bir devlet ba\u015fkan\u0131na kar\u015f\u0131 m\u00fcsl\u00fcmanlardan bir grubun ayaklanmas\u0131 halinde di\u011fer m\u00fcsl\u00fcmanlar\u0131n bu kimselere kar\u015f\u0131 sava\u015fmas\u0131n\u0131n vacip oldu\u011funu yazmaktad\u0131r. \n\u0130mam Nevevi, \u015eerhi M\u00fcslim’de, m\u00fcsl\u00fcmanlar\u0131n imamlar\u0131na (Eimme) kar\u015f\u0131 ayaklanman\u0131n ve sava\u015fman\u0131n, h\u00fck\u00fcmdar\u0131n fas\u0131k ve zalim olmas\u0131 halinde bile haram oldu\u011funu yazmaktad\u0131r. Ayr\u0131ca \u0130mam Nevevi bu hususta icma oldu\u011funu iddia etmektedir. Bu hususta icma oldu\u011fu iddias\u0131 do\u011fru de\u011fildir. Zira, aralar\u0131nda ileri gelen alimlerin de bulundu\u011fu \u0130slam hukuk\u00e7ular\u0131ndan b\u00fcy\u00fck bir guruba g\u00f6re devlet ba\u015fkan\u0131na muslihlerin ba\u015fkald\u0131r\u0131\u015f\u0131 Kur’an terminolojisinde be\u011favet olarak tarif edilmemi\u015ftir. \u00dcstelik, bu t\u00fcr kimselere ba\u015f kald\u0131rman\u0131n vacip oldu\u011fu s\u00f6ylenmi\u015ftir. \u0130mam Ebu Hanife’nin zalim devlet ba\u015fkan\u0131na kar\u015f\u0131 sava\u015f\u0131lmas\u0131 konusundaki g\u00f6r\u00fc\u015fleri ilim ehlince malumdur. Ebu Bekir el-Cessas, “Ahkamu’l-Kur’an” adl\u0131 eserinde \u0130mam Ebu Hanife’nin sava\u015fa sadece caiz de\u011fil, \u015fartlar\u0131n m\u00fcsait olmas\u0131 durumunda vacip h\u00fckm\u00fcn\u00fc verdi\u011fini yazmaktad\u0131r. \nEbu Hanife, Emevilere kar\u015f\u0131 \u0130mam Zeyd’in k\u0131yam\u0131 i\u00e7in ona sadece maddi yard\u0131mda bulunmakla kalmam\u0131\u015f, ba\u015fkalar\u0131na da bu konuda yard\u0131mc\u0131 olmalar\u0131 i\u00e7in telkinde bulunmu\u015ftur. Yine Nefsi Zekiyye’nin Halife Mansur’a k\u0131yam\u0131nda ona co\u015fkuyla yard\u0131m etmi\u015f ve bu sava\u015f\u0131 k\u00fcffara kar\u015f\u0131 yap\u0131lan cihaddan daha efdal saym\u0131\u015ft\u0131r. Ayr\u0131ca Fukaha, \u0130mam Serahsi’nin dedi\u011fi gibi, g\u00f6r\u00fc\u015f birli\u011fi i\u00e7inde de\u011fillerdir. \u0130bn H\u00fcmam, Hidaye \u015ferhi “Fethul Kadir” de, fukahan\u0131n \u00f6rf\u00fcne g\u00f6re be\u011favetin hak imama kar\u015f\u0131 \u00e7\u0131kmak oldu\u011funu yazmaktad\u0131r. Hanbeli’lerden de \u0130bni Akil ve \u0130bnu’l Cevzi, adil olmayan imama kar\u015f\u0131 ayaklanman\u0131n caiz oldu\u011fu g\u00f6r\u00fc\u015f\u00fcndedirler ve Hz. H\u00fcseyin’in k\u0131yam\u0131n\u0131 delil olarak g\u00f6stermektedirler. Kad\u0131 Ebubekir \u0130bnu’l Arabi “Ahkamu’l-Kur’an” da onun bu g\u00f6r\u00fc\u015f\u00fcn\u00fc \u015f\u00f6yle nakleder: “\u00d6mer bin Abd\u00fclaziz gibi adil bir imama kar\u015f\u0131 yap\u0131lan bir ayaklanman\u0131n bast\u0131r\u0131lmas\u0131 vaciptir, di\u011fer t\u00fcrdeki devlet ba\u015fkanlar\u0131n\u0131 ise (zalim, fas\u0131k) kendi haline b\u0131rak\u0131n, Allah onlar\u0131 ba\u015fka bir zalimle cezaland\u0131r\u0131r, o zalimi de \u00fc\u00e7\u00fcnc\u00fc bir zalimle cezaland\u0131r\u0131r,” \u0130mam Malik’ten bir ba\u015fka g\u00f6r\u00fc\u015fte \u015f\u00f6yle nakledilir: “Kendisine biat edilmi\u015f adil bir imam\u0131n ba\u015fka bir karde\u015fi ayn\u0131 iddia ile ortaya \u00e7\u0131karsa ona kar\u015f\u0131 sava\u015f\u0131n, g\u00fcn\u00fcm\u00fczdeki imamlara biat zaten s\u00f6zkonusu de\u011fildir, \u00e7\u00fcnk\u00fc onlar biat\u0131 zorla alm\u0131\u015flard\u0131r.” Maliki mezhebinin bir di\u011fer g\u00f6r\u00fc\u015f\u00fcn\u00fc \u0130bn\u00fc’l Arabi \u015f\u00f6yle beyan eder: “Sava\u015f ancak adil imam\u0131n saflar\u0131nda yap\u0131l\u0131r, iktidarda olan imam\u0131n veya ayaklananlar\u0131n hangisi adilse onun yan\u0131nda yer al\u0131nmal\u0131d\u0131r.
\nAncak her ikisinin de adil olmamas\u0131 halinde, iki taraftan da uzak durulmal\u0131d\u0131r. \u015eayet can\u0131n\u0131z tehlikedeyse veyahut m\u00fcsl\u00fcmanlara zulmediliyorsa kendinizi savunun.” Kad\u0131 \u0130bn\u00fc’l Arabi bu g\u00f6r\u00fc\u015f\u00fc naklettikten sonra \u015f\u00f6yle der: “Biz ancak hak ehlinin \u00f6nder olarak kabullenmi\u015f oldu\u011fu adil imam\u0131n saflar\u0131nda sava\u015fmal\u0131y\u0131z.”
\n3) Ayaklanan kimseler say\u0131ca az iseler, arkalar\u0131nda b\u00fcy\u00fck bir kitle yoksa ve silahl\u0131 de\u011filseler, onlara “Ba\u011fi” muamelesi yap\u0131lamaz. Tazir kanunlar\u0131na g\u00f6re normal olan \u015fekilde davran\u0131l\u0131r. Yani cana kastetmi\u015flerse k\u0131sas cezas\u0131, mala zarar vermi\u015flerse mali cezalar verilir. Be\u011favet yasas\u0131, arkalar\u0131nda b\u00fcy\u00fck bir kitle ve g\u00fc\u00e7 bulunan ve silahl\u0131 olarak ayaklanan kimselere tatbik edilir.
\n4) Ki\u015filer kendi fasid inan\u00e7lar\u0131n\u0131 a\u00e7\u0131k\u00e7a beyan ettikleri veya bu inan\u00e7lar\u0131n\u0131 devlete ve devlet g\u00fc\u00e7lerine kar\u015f\u0131 sert bir dille a\u00e7\u0131klad\u0131klar\u0131 i\u00e7in \u00f6ld\u00fcr\u00fclemez ve tutuklanamazlar. Ancak fiilen bir isyan olmas\u0131 ve kan d\u00f6kmeyi asilerin ba\u015flatmas\u0131 halinde \u015fiddete ba\u015fvurulur. (El-Mebsut, Fethu’l-Kadir, Ahkamu’l-Kur’an, Cassas)
\n5) Ayaklananlara kar\u015f\u0131 sava\u015fa ba\u015flamadan \u00f6nce, isyandan vazge\u00e7ip hak ve adalet yolunu se\u00e7meleri i\u00e7in onlar\u0131 Kur’an yoluna davet etmek gerekir. \u015eayet baz\u0131 \u015f\u00fcphe ve itirazlar\u0131 varsa onlar\u0131 ikna etmeye \u00e7al\u0131\u015fmal\u0131, yine yola gelmezlerse ve kan d\u00f6kmeyi onlar ba\u015flat\u0131rlarsa o zaman k\u0131l\u0131ca ba\u015fvurulmal\u0131d\u0131r. \n6) Ayaklananlara kar\u015f\u0131 yap\u0131lacak sava\u015fta hangi kaidelerin dikkate al\u0131naca\u011f\u0131 Hz. Peygamber’in (s.a.) \u0130bn \u00d6mer’den rivayet edilen \u015fu buyru\u011funda ortaya konulmu\u015ftur. Hz. Peygamber, \u0130bn Mesud’a: “Ey \u0130bn Ummi Abd! Bu \u00fcmmetin ba\u011filerine nas\u0131l davran\u0131laca\u011f\u0131 konusunda Allah’\u0131n emirlerinin neler oldu\u011funu biliyor musun?” diye sordu\u011funda, O, “Allah ve Rasul\u00fc daha iyi bilir” diye cevap verir. Bunun \u00fczerine Hz. Peygamber (s.a.) \u015f\u00f6yle buyurmu\u015ftur: “Onlar\u0131n yaral\u0131lar\u0131na dokunulmaz, esirleri \u00f6ld\u00fcr\u00fclmez, ka\u00e7anlar\u0131 takip edilmez, mallar\u0131 ganimet olarak payla\u015ft\u0131r\u0131lmaz.” (Hakim, Bezzar, Cassas.) Bu konuda fukahan\u0131n dayand\u0131\u011f\u0131 bu kaidenin ikinci kayna\u011f\u0131, Hz. Ali’nin s\u00f6zleri ve tatbikat\u0131d\u0131r. Hz. Ali, Cemel vak\u0131as\u0131nda zafer kazand\u0131ktan sonra, askerlerine \u015f\u00f6yle emir vermi\u015ftir: “Ka\u00e7anlar\u0131 takip etmeyin, yaral\u0131lara dokunmay\u0131n, esirleri \u00f6ld\u00fcrmeyin, silahlar\u0131 teslim edenlere eman verin, halk\u0131n evine girmeyin, sizlere s\u00f6vseler bile kad\u0131nlara bir\u015fey yapmay\u0131n.” Ancak askerlerden baz\u0131lar\u0131n\u0131n muhaliflerinin \u00e7ocuk ve kad\u0131nlar\u0131n\u0131n k\u00f6le olarak payla\u015ft\u0131r\u0131lmas\u0131 talebinde bulunmalar\u0131 \u00fczerine, Hz. Ali \u00f6fke ile \u015f\u00f6yle buyurur: “\u0130\u00e7inizden, \u00fcmm\u00fc’l-m\u00fc’minin Ai\u015fe’yi kendine kim alacak?”
\n7) Hz. Ali’nin tatbikat\u0131ndan istihra\u00e7 edilen ba\u011filerin mallar\u0131 ile ilgili h\u00fck\u00fcmler \u015funlard\u0131r: Onlar\u0131n orduya ait veya evlerinde bulunan ya da hayatta iken veyahut vefatlar\u0131ndan sonra her iki halde de mallar\u0131 ganimet olarak payla\u015ft\u0131r\u0131lamaz. Ancak mallar\u0131n\u0131n telef olmas\u0131 durumunda tazminat da \u00f6denmez. Sava\u015f bitiminde mallar\u0131 kendilerine iade edilir. Ele ge\u00e7en silah ve binekler sava\u015f s\u0131ras\u0131nda onlara kar\u015f\u0131 kullan\u0131labilir, ama ganimet mal\u0131 olarak taksim edilemez. \u015eayet yeniden ayaklanmalar\u0131ndan endi\u015fe edilmiyorsa bu mallar da iade edilmelidir. Devletin bu mallara ganimet olarak el koyaca\u011f\u0131 g\u00f6r\u00fc\u015f\u00fc sadece \u0130mam Yusuf’a aittir. (Mebsut, Fethu’l-Kadir, Cassas.)
\n8) Esirleri kendilerinden bir daha ayaklanmayacaklar\u0131na dair s\u00f6z al\u0131narak serbest b\u0131rak\u0131rlar. (Mebsut)
\n9) Asilerin ba\u015flar\u0131 kesilerek te\u015fhir edilmeleri \u00e7ok \u00e7irkin bir davran\u0131\u015ft\u0131r. \u00c7\u00fcnk\u00fc Hz. Peygamber (s.a.) \u00f6l\u00fclerin cesedlerine dokunmaktan (onlar\u0131n uzuvlar\u0131n\u0131 kesmekten) men etmi\u015ftir. Nitekim bir defas\u0131nda Hz. Ebu Bekir, kendisine bir Rum Patri\u011finin kesilmi\u015f ba\u015f\u0131 getirildi\u011finde \u00e7ok \u00f6fkelenerek “Bize Rumlar\u0131 ve \u0130ranl\u0131lar\u0131 taklit etmek yak\u0131\u015fmaz” demi\u015ftir. \u015eayet b\u00f6yle bir davran\u0131\u015f kafirlere reva g\u00f6r\u00fclm\u00fcyorsa, elbette m\u00fcsl\u00fcmanlara da reva g\u00f6r\u00fclemez. \n10) Sava\u015f esnas\u0131nda asilerin yol a\u00e7t\u0131klar\u0131 can ve mali zararlara kar\u015f\u0131 sava\u015f bittikten ve asayi\u015f sa\u011fland\u0131ktan sonra, k\u0131sas, tazminat talep edilmez. Fitnenin yeniden dirilmemesi i\u00e7in, hi\u00e7 bir \u00f6l\u00fcye kar\u015f\u0131 diyet al\u0131nmaz. Nitekim sahabe aras\u0131nda vukubulan sava\u015flarda bu kaide uygulanm\u0131\u015ft\u0131r. \n11) Asiler, sava\u015f esnas\u0131nda ellerine ge\u00e7irdikleri b\u00f6lgelerde bir nizam kurup, halktan zekat ve di\u011fer vergileri alm\u0131\u015flarsa devlet yeniden bu b\u00f6lgelere hakim oldu\u011funda halktan yeniden zekat ve di\u011fer vergi taleplerinde bulunamaz. \u015eayet asiler, halktan mal, zekat, vs. \u015fer’i esaslara g\u00f6re alm\u0131\u015f ve sarfetmi\u015flerse, o halk Allah indinde vazifesini yapm\u0131\u015f say\u0131l\u0131r ve bu vucubiyet kendisinden sak\u0131t olur. Fakat asiler halktan mal\u0131 \u015fer’i olmayan bir yolla alm\u0131\u015f ve sarfetmi\u015flerse art\u0131k bu Allah ile kul aras\u0131ndaki bir meseledir. \n12) Asilerin kendi tasarruflar\u0131 alt\u0131ndaki b\u00f6lgelerde kurmu\u015f olduklar\u0131 mahkemelerin hakimlerinin adil ve bu hakimlerin verdikleri kararlar \u015feriata uygunsa, kendilerini tayin edenler ba\u011fi ve m\u00fccrim olsalar bile verdikleri kararlar ge\u00e7erlidir. Ancak \u015feriata uygun kararlar vermemi\u015flerse ve be\u011favet d\u00f6neminden sonra h\u00fck\u00fcmetin mahkemelerine yeniden ba\u015f vurulmu\u015fsa, bu kararlar infaz edilemez. Bunun yan\u0131s\u0131ra be\u011favet d\u00f6neminde kurulan mahkemelerin verdi\u011fi tutuklama kararlar\u0131 ge\u00e7ersizdir. (Mebsut, Ahkamu’l-Kur’an, Cassas.)

Peygamber (s.a.) \u015f\u00f6yle buyurmu\u015ftur: “M\u00fcsl\u00fcman m\u00fcsl\u00fcman\u0131n karde\u015fidir ve m\u00fcsl\u00fcman karde\u015fine zulmetmez, onunla dost olmaktan vazge\u00e7mez, onu zelil etmez. Bir kimse i\u00e7in, bir m\u00fcsl\u00fcman karde\u015fini hakir g\u00f6rmek kadar b\u00fcy\u00fck bir k\u00f6t\u00fcl\u00fck yoktur.” (M\u00fcsned-i Ahmed)
\nSelh bin Sa’d es-Saidi’nin Hz. Peygamber’den rivayet etti\u011fine g\u00f6re o, \u015f\u00f6yle buyurmu\u015ftur: “Bir m\u00fc’minin cemaat ile m\u00fcnasebeti, ba\u015f ile bedenin irtibat\u0131 gibidir. \u00d6yle ki, m\u00fc’min, cemaatinin \u00e7ekti\u011fi eziyeti, bedenin bir uzvunun \u00e7ekti\u011fi \u0131zd\u0131rab\u0131 ba\u015f nas\u0131l duyuyorsa, aynen \u00f6yle duyar.” (M\u00fcsned-i Ahmed) .
