FIKIH<\/strong><\/p>\n

Bilmek, anlamak, bir \u015feyin b\u00fct\u00fcn\u00fcne vak\u0131f olmak. Ist\u0131lahta, bir kimsenin leh ve aleyhindeki h\u00fck\u00fcmleri bilmesi demektir. Ba\u015fka bir tarife g\u00f6re f\u0131k\u0131h; ki\u015finin ibadetlere, cezalara ve muamelelere ait \u015fer’\u00ee h\u00fck\u00fcmleri mufassal delilleriyle bilmesidir. Ayr\u0131ca, s\u00f6z ve fiillerin ama\u00e7lar\u0131n\u0131 kavrayacak \u015fekilde keskin ve derin anlay\u0131\u015f diye de tarif edilmi\u015ftir.[1]<\/a><\/p>\n

Kur\u2019an\u2019da ve S\u00fcnnette F\u0131k\u0131h <\/strong><\/p>\n

\u00a0<\/strong>Kur’an-\u0131 Ker\u00eem’de: “… O kavme ne oluyor ki (kendilerine s\u00f6ylenen) hi\u00e7bir s\u00f6z\u00fc anlamaya (f\u0131khetmeye) yana\u015fm\u0131yorlar?” (en-Nis\u00e2, 4\/78) ayetinde ge\u00e7en “l\u00e2 yefkah\u00fbn” ince anlay\u0131\u015f ve keskin idrak anlam\u0131na gelmektedir. Ba\u015fka bir\u00e7ok ayette k\u00e2firler i\u00e7in “f\u0131khetmeyenler” denilmektedir (el-A ‘r\u00e2f, 7\/179; H\u00fbd, l l\/91). Tevbe suresinde, “…bir topluluk da din\u00ee h\u00fck\u00fcmleri iyice \u00f6\u011frenmek i\u00e7in kalmal\u0131d\u0131r” (et- Tevbe, 9\/122) buyru\u011funda \u00f6zel bir fukah\u00e2 toplulu\u011funa i\u015faret edilmi\u015ftir.<\/p>\n

Resulullah (s.a.s.): “Allah, kimin hayr\u0131n\u0131 dilerse, onu dinde fak\u00eeh (dini h\u00fck\u00fcmlerin inceli\u011fini kavrayan bilgin) k\u0131lar.”[2]<\/a><\/p>\n

\u201cKendisinden daha anlay\u0131\u015fl\u0131 kimseye f\u0131k\u0131h aktaran niceleri vard\u0131r.\u201d[3]<\/a><\/p>\n

\u0130bnu Abb\u00e2s rad\u0131yallahu anh\u00fcm\u00e2 anlat\u0131yor: “Res\u00fblullah (aleyhissal\u00e2tu vessel\u00e2m) buyurdular ki: “Tek bir fakih, \u015feytana bin \u00e2bidden daha yamand\u0131r.”[4]<\/a><\/p>\n

Hz. Ebu H\u00fcreyre rad\u0131yallahu anh anlat\u0131yor: “Res\u00fblullah (aleyhissal\u00e2tu vessel\u00e2m)’a Allah indinde en efdal insan\u0131n kim oldu\u011fu sorulmu\u015ftu: “Allah indinde en k\u0131ymetlileri en muttaki olanlard\u0131r!” buyurdular. “Biz bunu sormad\u0131k!” demeleri \u00fczerine: “\u00d6yleyse o, Hal\u00eelullah’\u0131n o\u011flu, Nebiyyullah’\u0131n o\u011flu Nebiyyullah’\u0131n o\u011flu Yusuf’tur” buyurmu\u015ftu. Yine itirazla: “Hay\u0131r, bunu da sormad\u0131k” dediler. Bunun \u00fczerine Aleyhissal\u00e2tu vessel\u00e2m: “Siz bana Arap hanedanlar\u0131ndan m\u0131 soruyorsunuz?” dedi. “Evet (Ey Allah’\u0131n Res\u00fbl\u00fc!)” dediler. “Onlar\u0131n cahiliye d\u00f6nemindeki hay\u0131rl\u0131lar\u0131, f\u0131k\u0131h \u00f6\u011frendikleri takdirde, \u0130sl\u00e2m’da da en hay\u0131rl\u0131lar\u0131d\u0131r!” cevab\u0131n\u0131 verdi.”[5]<\/a><\/p>\n

Hz. Ali rad\u0131yallahu anh anlat\u0131yor: “Res\u00fblullah (aleyhissal\u00e2tu vessel\u00e2m) buyurdular ki: “Dinde fak\u00eeh (bilgili) olan kimse ne iyi kimsedir! Kendisine muhta\u00e7 olununca faydal\u0131 olur. Kendisine ihtiya\u00e7 olmay\u0131nca ilmini art\u0131r\u0131r.”[6]<\/a><\/p>\n

F\u0131k\u0131h ve D\u00fcnya-Ahiret \u0130li\u015fkisi<\/strong><\/p>\n

Allah Te\u00e2l\u00e2 (c.c.)’n\u0131n imtihan i\u00e7in beyan buyurdu\u011fu emir ve nehiylerin tamam\u0131na teklif denilir ve f\u0131kh\u0131n konusu, insan\u0131n bu tekliflere muhatap olarak (m\u00fckellef) ortaya \u00e7\u0131kan fiilidir. \u0130nsan\u0131n lehindeki ve aleyhindeki b\u00fct\u00fcn haklar\u0131n\u0131 delillere dayanarak \u00e7\u0131karmak fukahan\u0131n g\u00f6revidir. Din hususunda Resulullah (s.a.s.)’dan ba\u015fka kimseye ilmi bir delile dayanmadan dinde s\u00f6z s\u00f6yleme hakk\u0131 tan\u0131nmam\u0131\u015ft\u0131r. \u0130lmi bir delile dayanmadan kas\u0131t edille-i \u015fer’iyye, yani d\u00f6rt delildir. Bunlar, Kitap, S\u00fcnnet, icma ve k\u0131yast\u0131r.[7]<\/a><\/p>\n

F\u0131k\u0131h kelimesi \u0130slam\u2019\u0131n ameli ve d\u00fcnyevi y\u00f6n\u00fcn\u00fc ifade eder. \u0130slam, Allah (cc)\u2019\u0131n insanlar i\u00e7in se\u00e7ti\u011fi bir dindir. \u0130nsanlar\u0131n d\u00fcnya hayatlar\u0131n\u0131 d\u00fczene koyup, onlar\u0131 d\u00fcnya ve ahiret mutlulu\u011funa ve Allah\u2019\u0131n r\u0131zas\u0131na kavu\u015fturmak i\u00e7in g\u00f6nderilmi\u015ftir. \u0130slam yaln\u0131zca vicdani bir kanaat, kalplerde yer alan bir inan\u00e7, s\u0131radan bir isim veya insanlar\u0131n ho\u015funa giden g\u00fczel ahlak ilkeleri de\u011fildir. \u0130slam, hayat\u0131 b\u00fct\u00fcn y\u00f6n\u00fcyle kucaklar. \u0130nsana ait b\u00fct\u00fcn sorunlara \u00e7\u00f6z\u00fcmler getirir. \u0130nsan\u0131n yolunu ayd\u0131nlat\u0131r. Onu tek do\u011fru yola ve hayata ula\u015ft\u0131r\u0131r. Onu her a\u00e7\u0131dan y\u00fcceltmeyi hedefler. \u0130slam f\u0131kh\u0131 uygulanmas\u0131yla insana fayda verebilecek b\u00fct\u00fcn unsurlar\u0131 i\u00e7ine al\u0131r. Dinin Kur\u2019an ve sahih s\u00fcnnet ile tespit edilmi\u015f ibadet, akaid ve muamelat\u0131 zamana ve zemine g\u00f6re de\u011fi\u015fmez.[8]<\/a><\/p>\n

Kur\u2019an\u2019da F\u0131kh\u0131 Anlamak<\/strong><\/p>\n

\u201cAndolsun ki, bir\u00e7ok cini ve insan\u0131 cehennemlik olarak yaratt\u0131k. Onlar\u0131n kalpleri var. Fakat anlamazlar, g\u00f6zleri var, fakat g\u00f6rmezler, kulaklar\u0131 var, fakat i\u015fitmezler. Onlar hayvanlar gibidirler. Hatta hayvanlardan da sap\u0131kt\u0131rlar. Onlar gaflet i\u00e7indedirler.\u201d(Al-i \u0130mran\/179)<\/p>\n

Lehum kul\u00fcb\u00fcn la yefkahune biha\u00bb ifadesinde ge\u00e7en \u00abkalb\u00bb ile insan\u00ee latife, tefakkuh ile de anlay\u0131\u015f kastedilmektedir. G\u00f6rme ve i\u015fitmenin nehyi ile akl\u0131n \u00f6zelli\u011fi olan idrakin giderilmi\u015f olmas\u0131 kastolunmu\u015ftur. Yani cin ve insanlar\u0131n vazifesi olan idrak etmek, ak\u0131llar\u0131n \u00f6zelli\u011fi olan g\u00f6rmek ve i\u015fitmektir. Burada bedenin hissetmesi veya sesleri i\u015fitebilmek nefyedilmemi\u015ftir. Nitekim Arap dilinde \u00abFilan ki\u015fi hainli\u011fi duymaz\u00bb denir. Yani bunun anlam\u0131 ona \u00f6nem vermez, kula\u011f\u0131n\u0131 ona a\u00e7maz, onu dinlemez, demektir.<\/p>\n

Baz\u0131lar\u0131 ise daha \u00f6nce de ge\u00e7ti\u011fi gibi burada tahsisi se\u00e7mi\u015ftir. Yani onlar hakk\u0131 ve delillerini anlamazlar. Allah’\u0131n mahl\u00fbkat\u0131na ibret g\u00f6z\u00fcyle bakmazlar, ayet ve \u00f6\u011f\u00fctleri d\u00fc\u015f\u00fcnerek dinlemezler.<\/p>\n

K\u0131saca hangi tevil kastedilmi\u015f olursa olsun, ayetten maksat \u015fudur: Onlar kendilerine verilen uzuvlar\u0131, kendilerine ni\u00e7in verilmi\u015fse onun i\u00e7in kullanmal\u0131d\u0131rlar. Aksi takdirde adeta kalpsiz, g\u00f6zs\u00fcz ve kulaks\u0131z yarat\u0131lm\u0131\u015f gibi olurlar.[9]<\/a><\/p>\n

D\u00f6rt halife ve T\u00e2bi\u00fbn devrindeki f\u0131k\u0131h kelimesiyle ilim kastediliyordu. F\u0131kh-\u0131 Ekber tabiri, ak\u00e2id ve tevhid ilmini, F\u0131kh-\u0131 Vicd\u00e2ni kavram\u0131, nefis terbiyesi ve ahl\u00e2k ilmini, sadece f\u0131k\u0131h kelimesi ise, ameli konular\u0131 kaps\u0131yordu. Usul-i F\u0131k\u0131h ilmi ise, ki\u015finin lehinde ve aleyhindeki haklar\u0131n\u0131 \u00f6\u011frenmesinde takip edece\u011fi kaide ve tav\u0131rlar konu alan ilimdi. \u0130mam Eb\u00fb Hanife (\u00d6. -150\/767)’nin f\u0131kh\u0131 “ki\u015finin leh ve aleyhinde olan h\u00fck\u00fcmleri bilmesi” \u015feklindeki tarifi, genel bir tarif olup, kel\u00e2m, iman, ahl\u00e2k ve tasavvuf gibi ana ilimler ba\u011f\u0131ms\u0131zla\u015fmam\u0131\u015f, bu y\u00fczden “el-F\u0131khu’l-Ekber” adl\u0131 eseri itik\u00e2di konular\u0131 kapsad\u0131\u011f\u0131 halde bu ismi alm\u0131\u015ft\u0131. Ancak giderek f\u0131k\u0131h ilmi yaln\u0131z ibadet, muamel\u00e2t ve ukub\u00e2ti i\u00e7ine alacak \u015fekilde “amellerin” il\u00e2vesiyle tarif edilmi\u015ftir. Mecelle’nin 1. maddesindeki t\u00e2rifte \u015f\u00f6yle denilmi\u015ftir: “\u0130lm-i f\u0131hh mes\u00e2il-i \u015fer’iyye-i ameliyye”yi bilmektir.<\/p>\n

    Be\u015feri hukuklarda kanun koyucu ve anayasalar her zaman de\u011fi\u015ftirilebilir. Kanun koyucular, bazen kral, sultan, \u015fah gibi tek ki\u015fi, bazen bir meclis vs. kalabal\u0131k bir grup olabilir.<\/p>\n

      \u0130sl\u00e2m hukuk\u00e7ular\u0131n\u0131n farkl\u0131 ictihadlar\u0131yla \u00e7\u00f6z\u00fcmlenen bu h\u00fck\u00fcmlerin dayana\u011f\u0131; istihsan, maslahat (kamu yarar\u0131), \u00f6rf, \u00e2det, sah\u00e2be kavli, \u00f6nceki \u015feriatler ve sedd-i zer\u00e2yi’ (k\u00f6t\u00fcl\u00fc\u011fe giden yolu kapama) gibi tali delillerdir. Bu \u00e7e\u015fit h\u00fck\u00fcmleri ortaya \u00e7\u0131kartan ve \u015fer’i \u00f6l\u00e7\u00fclere g\u00f6re tespit edenler m\u00fc\u00e7tehid hukuk\u00e7ulard\u0131r. Burada bir y\u00f6n\u00fcyle kanun veya kaide koyma faaliyeti mefhumu, m\u00fc\u00e7tehid imamlar\u0131n i\u00e7tihadlar\u0131na inhisar etmektedir. Bir \u0130sl\u00e2m beldesinde Ul\u00fc’l-emr yani \u00fcst otorite, i\u00e7tihad yapacak g\u00fcce sahipse, o da bu yasama i\u015fine d\u00e2hil olur. Aksi h\u00e2lde, yasama, mevcut mezhep veya i\u00e7tihadlar aras\u0131nda tercih yaparak uygulan\u0131r. \u0130sl\u00e2m Devleti’nin en \u00fcst organ\u0131n\u0131n yapt\u0131\u011f\u0131 d\u00fczenlemeler, \u015fer’\u00ee es\u00e2slar d\u00e2hilinde yap\u0131lmak \u015fart\u0131yla ba\u011flay\u0131c\u0131 ve me\u015fr\u00fbdur. Ul\u00fb’l-emr’in bu faaliyeti \u00f6zellikle i\u00e7tih\u00e2d\u0131 h\u00fck\u00fcmlerin ba\u011flay\u0131c\u0131l\u0131k vasf\u0131n\u0131 kazanmas\u0131 i\u00e7in gereklidir. O, isterse bu meseleleri m\u00fctalaa ve m\u00fczakere etmek \u00fczere ehli’l-hal ve’l-akd denilen uzman ki\u015filerden olu\u015fan \u015f\u00fbra meclisinin g\u00f6r\u00fc\u015flerini al\u0131r (bkz. en-Nis\u00e2, 4\/59; Buh\u00e2ri, Ahk\u00e2m, 4; M\u00fcslim, \u0130m\u00e2re, 39).<\/p>\n

C) \u0130sl\u00e2m f\u0131kh\u0131n\u0131n kapsam\u0131 insan\u0131n kendisi, toplum ve yarat\u0131c\u0131yla olan m\u00fcnasebetlerini d\u00fczenler. \u00c7\u00fcnk\u00fc f\u0131k\u0131h, hem d\u00fcnyev\u00ee, hem uhrev\u00ee niteli\u011fe sahiptir. Hem din, hem devlettir, k\u0131yamete kadar s\u00fcreklidir ve b\u00fct\u00fcn insanl\u0131\u011fa y\u00f6neliktir. Bu h\u00fck\u00fcmlerin \u00f6zelli\u011fi b\u00fct\u00fcnc\u00fcl olu\u015fudur. Yani iman, ahl\u00e2k, ib\u00e2det, muameleler i\u00e7i\u00e7edir, birbirinden ayr\u0131\u015fm\u0131\u015f hayat alanlar\u0131 veya l\u00e2ik temellerle dini h\u00fck\u00fcmlerin ayr\u0131\u015fm\u0131\u015fl\u0131\u011f\u0131 s\u00f6zkonusu de\u011fildir. G\u00f6n\u00fcl huzuru, toplum d\u00fczeni, fert ve toplum hayat\u0131, herkesi mutlu ve huzurlu k\u0131lma d\u00fc\u015f\u00fcncesi, Allah’\u0131n gizli-a\u00e7\u0131k her \u015feyi kontrol etmekte oldu\u011fu esas\u0131 bu hukuku g\u00fc\u00e7lendiren i\u00e7 motiflerdir. \u0130sl\u00e2m, bu anlamda b\u00fct\u00fcn be\u015fer\u00ee sistemlerden ayr\u0131lmaktad\u0131r.<\/li>\n<\/ol>\n

        F\u0131kh’\u0131n y\u00f6neldi\u011fi m\u00fckelleflere ait s\u00f6z, fiil, akit ve tasarruflar iki alanda cereyan eder: 1) \u0130badetlere ait h\u00fck\u00fcmler; temizlik, namaz, oru\u00e7, hac, zek\u00e2t, adak, yemin gibi insanla Rabbi aras\u0131ndaki m\u00fcnasebetleri d\u00fczenleyen h\u00fck\u00fcmler. Bu konu ile ilgili olarak, Kur’an-\u0131 Ker\u00eem’de y\u00fczk\u0131rk kadar ayet vard\u0131r.<\/p>\n

        2) Muamelata ait h\u00fck\u00fcmleridir. Akit, hukuki tasarruf, su\u00e7 ve ceza gibi insanlar\u0131n birbirleriyle ve toplumla olan m\u00fcnasebetlerini d\u00fczenleyen h\u00fck\u00fcmler.
