Hamd kendisinden ba\u015fka ilah olmayan, mutlak manada tek g\u00fc\u00e7 ve kudret sahibi olan Allah\u2019a mahsustur. Salat ve selam t\u00fcm peygamberlerin ve onlar\u0131 takip eden tabilerinin \u00fczerine olsun<\/strong><\/p>\n

4- \u00d6yleyse, k\u00fcfredenlerle kar\u015f\u0131 kar\u015f\u0131ya geldi\u011finiz zaman, hemen boyunlar\u0131n\u0131 vurun; sonunda onlar\u0131 iyice bozguna u\u011frat\u0131p zafer kazan\u0131nca da art\u0131k (esirler i\u00e7in) ba\u011f\u0131 s\u0131ms\u0131k\u0131 tutun. Bundan sonra ya bir l\u00fctuf olarak (onlar\u0131 b\u0131rak\u0131n) ya da bir fidye (kar\u015f\u0131l\u0131\u011f\u0131 sal\u0131verin) . \u00d6yle ki sava\u015f a\u011f\u0131rl\u0131klar\u0131n\u0131 b\u0131raks\u0131n (sona ersin) .(8) \u0130\u015fte b\u00f6yle; e\u011fer Allah dilemi\u015f olsayd\u0131, elbette onlardan intikam al\u0131rd\u0131. Ancak (sava\u015f,) sizleri birbirinizle denemesi i\u00e7indir.(9) Allah yolunda \u00f6ld\u00fcr\u00fclenler ise; (Allah,) kesin olarak onlar\u0131n amellerini giderip-bo\u015fa \u00e7\u0131karmaz.(10)<\/strong><\/p>\n

A\u00c7IKLAMA<\/strong><\/p>\n

8. Bu ayet, anlam\u0131ndan ve anlat\u0131m\u0131n\u0131n ahenginden anla\u015f\u0131ld\u0131\u011f\u0131 \u00fczere, sava\u015fma emri geldikten sonra, fakat fiilen sava\u015fa girilmeden \u00f6nce nazil olmu\u015ftur. “Kafirlerle kar\u015f\u0131la\u015ft\u0131\u011f\u0131n\u0131z zaman” ifadesi, hen\u00fcz kar\u015f\u0131la\u015fman\u0131n olmad\u0131\u011f\u0131na, bu kar\u015f\u0131la\u015fma olmadan \u00f6nce b\u00f6yle bir kar\u015f\u0131la\u015fma an\u0131nda nas\u0131l hareket edilece\u011fine i\u015faret etmektedir.
\nSure’nin 20. ayetinden anla\u015f\u0131l\u0131yor ki, bu sure, Hac Suresi’nin 39. ve Bakara Suresi’nin 190. ayetlerinin gelmesi \u00fczerine, Medine’deki m\u00fcnaf\u0131klar\u0131n ve iman\u0131 zay\u0131f olan kimselerin \u00f6l\u00fcm bayg\u0131nl\u0131\u011f\u0131 ge\u00e7irdikleri s\u0131rada nazil olmu\u015ftur. Ayr\u0131ca, Enfal Suresi’nin 67, 68 ve 69. ayetleri de bu ayetin Bedir Sava\u015f\u0131’ndan \u00f6nce nazil oldu\u011funu ispat etmektedir.
\nO ayetlerde \u015f\u00f6yle buyurulmu\u015ftur: “Hi\u00e7 bir peygambere, yery\u00fcz\u00fcnde d\u00fc\u015fmanlar\u0131n\u0131 tamamen hezimete u\u011frat\u0131p k\u00f6k\u00fcn\u00fc kurutmadan esir almak yak\u0131\u015fmaz. Siz d\u00fcnya menfaatini taleb ediyorsunuz. Halbuki ahireti (oradaki huzur) vermek ister. Allah en \u00fcst\u00fcn ve hikmet sahibi oland\u0131r. E\u011fer Allah’\u0131n \u00f6nceki yaz\u0131s\u0131 (takdiri) olmasayd\u0131, ald\u0131\u011f\u0131n\u0131z fidyeden dolay\u0131 \u015f\u00fcphesiz b\u00fcy\u00fck bir azaba u\u011frard\u0131n\u0131z. Art\u0131k (sava\u015fta) elde ettiklerinizi yiyiniz, \u00e7\u00fcnk\u00fc onlar (size) helal ve temiz k\u0131l\u0131nm\u0131\u015ft\u0131r.”
\nBu ayete ve \u00f6zellikle \u00e7izdi\u011fi s\u0131n\u0131ra dikkatle bakarsak, ayetin ifadesinde yer alan tenkidin Bedir Sava\u015f\u0131’nda m\u00fc\u015friklerin tam olarak hezimete u\u011frat\u0131lmas\u0131ndan \u00f6nce, m\u00fcsl\u00fcmanlar\u0131n d\u00fc\u015fman askerlerini esir almaya ba\u015flamalar\u0131 \u00fczerine yap\u0131ld\u0131\u011f\u0131 a\u00e7\u0131k\u00e7a anla\u015f\u0131lmaktad\u0131r. Halbuki sava\u015ftan \u00f6nce inen Muhammed Suresi’nde g\u00f6sterilen yol, “Onlar\u0131 tamamen hezimete u\u011fratt\u0131ktan sonra esirlerini s\u0131k\u0131ca ba\u011flay\u0131n” ifadesi ile a\u00e7\u0131klanm\u0131\u015ft\u0131. Hatta Muhammed Suresi’nde, m\u00fcsl\u00fcmanlar\u0131n esirlerden fidye almalar\u0131na da izin verilmi\u015fti. Bu y\u00fczden Allah, Bedir Sava\u015f\u0131’nda al\u0131nan esirlerden elde edilen ganimet mallar\u0131n\u0131 helal k\u0131lm\u0131\u015f ve fidye almalar\u0131ndan dolay\u0131 m\u00fcsl\u00fcmanlara bir ceza vermemi\u015fti: “E\u011fer Allah’\u0131n \u00f6nceki yaz\u0131s\u0131 olmasayd\u0131…” buyru\u011fu, bu olaydan \u00f6nce Kur’an’da fidye almaya izin veren emrin geldi\u011fini a\u00e7\u0131kca g\u00f6stermektedir.
\nKur’an’da, Muhammed Suresi’nin bu ayetinin d\u0131\u015f\u0131nda yukardaki emri i\u00e7ine alan ba\u015fka bir ayet olmad\u0131\u011f\u0131na g\u00f6re, bu ayetin Enfal Suresi’nin yukar\u0131da zikredilen ayetinden daha \u00f6nce nazil oldu\u011funu kabul etmemiz gerekecektir. \nBu ayet, sava\u015f kurallar\u0131ndan bahseden ilk ayettir. Bu ayetten \u00e7\u0131kan h\u00fck\u00fcmleri, Peygamberimiz (s.a) ve ashab\u0131n\u0131n bu ayete uygun olarak yapt\u0131klar\u0131 uygulamalar\u0131 ve m\u00fcctehidlerin bu ayet ile s\u00fcnnete dayanarak yapt\u0131klar\u0131 ictihadlar\u0131 \u015f\u00f6yle \u00f6zetleyebiliriz:<\/p>\n

1. Sava\u015fta \u0130slam ordusunun as\u0131l hedefi, d\u00fc\u015fman\u0131 y\u0131pratarak sava\u015f g\u00fcc\u00fcn\u00fc k\u0131rmak ve sava\u015fa son vermektir. Bu hedeften saparak d\u00fc\u015fman askerlerini yakalamaya u\u011fra\u015fmamak gerekir. Esir almaya, d\u00fc\u015fman\u0131n k\u00f6k\u00fc kaz\u0131n\u0131p sava\u015f alan\u0131nda m\u00fccadele eden hi\u00e7bir asker kalmay\u0131nca ba\u015flanmal\u0131d\u0131r. Araplara daha ba\u015flang\u0131\u00e7ta b\u00f6yle bir emrin verilmesi, fidye elde etmek veya k\u00f6le temin etmek h\u0131rs\u0131na kap\u0131larak sava\u015f\u0131n as\u0131l hedefini unutmamalar\u0131 i\u00e7indir.<\/p>\n

2. Sava\u015fta esir al\u0131nanlar hakk\u0131nda: M\u00fcsl\u00fcmanlar, sava\u015f esirlerine iyilik yap\u0131p onlar\u0131 serbest b\u0131rakma veya fidye alma hususunda serbest b\u0131rak\u0131lm\u0131\u015flard\u0131r. Bundan, sava\u015f esirlerinin \u00f6ld\u00fcr\u00fclmeyece\u011fi genel h\u00fckm\u00fc \u00e7\u0131kmaktad\u0131r.
\nHz. Abdullah ibn \u00d6mer, Hasan Basri, At\u00e2 ve Hammad bin ebi S\u00fcleyman bu h\u00fckm\u00fc genel anlamda kabul etmektedirler. Bu g\u00f6r\u00fc\u015f, yerine g\u00f6re en do\u011fru olan\u0131d\u0131r. Onlar, ki\u015finin ancak sava\u015f durumunda \u00f6ld\u00fcr\u00fclmesinin caiz olabilece\u011fini, sava\u015f bittikten sonra, elimize esir d\u00fc\u015fenleri \u00f6ld\u00fcrmenin caiz olmad\u0131\u011f\u0131n\u0131 savunurlar.
\n\u0130bn Cerir ve Ebubekir el-Cessas’\u0131n anlatt\u0131klar\u0131na g\u00f6re, Haccac bin Yusuf, sava\u015f esirlerinden birini Abdullah bin \u00d6mer’e g\u00f6ndererek onu \u00f6ld\u00fcrmesini emreder. O da bu ayeti okuyarak, “Esir edilmi\u015f birinin \u00f6ld\u00fcr\u00fclmesine, bu ayete g\u00f6re izin yoktur,” diye esiri \u00f6ld\u00fcrmeyi reddeder.
\n\u0130mam Muhammed, el-Siyer el-Kebir adl\u0131 eserinde, Abdullah bin Amir’in Hz. Abdullah ibn \u00d6mer’e \u00f6ld\u00fcrmesi i\u00e7in bir sava\u015f esiri g\u00f6nderdi\u011fini, onun da bu ayetin h\u00fckm\u00fcne uyarak verilen emri yerine getirmedi\u011fini nakletmektedir.<\/p>\n

  1. \nHer\u015feye ra\u011fmen, bu ayette esirleri \u00f6ld\u00fcrme a\u00e7\u0131k bir \u015fekilde yasaklanmam\u0131\u015ft\u0131r. Bundan yola \u00e7\u0131karak Hz. Peygamber (s.a) Allah’\u0131n emrinin \u00f6z\u00fcn\u00fc \u015fu \u015fekilde anlam\u0131\u015f ve uygulam\u0131\u015ft\u0131r: \u0130slam devlet ba\u015fkan\u0131, baz\u0131 sava\u015f esirlerinin \u00f6ld\u00fcr\u00fclmesini gerekli buluyorsa ve bunun i\u00e7in \u00f6zel durumlar ve mecburiyetler hissediyorsa \u00f6ld\u00fcrebilir. Fakat bu genel bir kural de\u011fil, tersine genel kural i\u00e7inde \u00f6zel bir durumdur. Buna da mecbur kal\u0131nd\u0131\u011f\u0131 takdirde ba\u015fvurulabilir.
    \nNitekim, Hz. Peygamber (s.a) , Bedir Sava\u015f\u0131’nda esir al\u0131nan yetmi\u015f ki\u015fi i\u00e7inden sadece Ukbe bin ebi Muayt ve Nadr ibn el-Haris’i \u00f6ld\u00fcrtt\u00fc. Uhud Sava\u015f\u0131 esirlerinden yaln\u0131z \u015fair Ebu Azze’nin \u00f6ld\u00fcr\u00fclmesini emretti. Kurayza O\u011fullar\u0131, kendi haklar\u0131nda Sa’d ibn Muaz’\u0131n karar vermesini istemi\u015flerdi. \u0130bn Muaz’\u0131n erkeklerin \u00f6ld\u00fcr\u00fclmesi \u015feklindeki karar\u0131 \u00fczerine Hz. Peygamber (s.a) onlar\u0131n \u00f6ld\u00fcr\u00fclmesini emretti.
    \nHayber Sava\u015f\u0131’nda al\u0131nan esirlerden sadece Kinane \u0130bn Ebi el-Hukayk \u00f6ld\u00fcr\u00fcld\u00fc. \u00c7\u00fcnk\u00fc bu adam anla\u015fmay\u0131 bozmu\u015f, verilen s\u00f6z\u00fc tutmam\u0131\u015ft\u0131.
    \nMekke’nin fethinden sonra Hz. Peygamber (s.a) b\u00fct\u00fcn Mekke halk\u0131ndan, yaln\u0131z bir-ka\u00e7 ki\u015finin nerede yakalan\u0131rlarsa derhal \u00f6ld\u00fcr\u00fclmeleri emrini verdi.
    \nBu istisnalar\u0131n d\u0131\u015f\u0131nda Hz. Peygamber’in (s.a) genel tavr\u0131, sava\u015f esirlerinin hi\u00e7bir zaman \u00f6ld\u00fcr\u00fclmemesi do\u011frultusunda idi. Ra\u015fid halifelerin tutumu da b\u00f6yle oldu. Onlar\u0131n zaman\u0131nda da sava\u015f esirlerinin \u00f6ld\u00fcr\u00fclmesine ait \u00f6rnekler \u00e7ok nadirdir. Bu nadir \u00f6rnekler de \u00f6zel sebeblere ve mecburiyetlere dayan\u0131r. Hz. \u00d6mer ibn Abd\u00fclaziz de, b\u00fct\u00fcn halifeli\u011fi s\u00fcresince sadece bir sava\u015f esirini \u00f6ld\u00fcrtm\u00fc\u015ft\u00fcr. \u00d6ld\u00fcr\u00fclen bu esir, m\u00fcsl\u00fcmanlara yapt\u0131\u011f\u0131 a\u015f\u0131r\u0131 zul\u00fcmle me\u015fhurdu.
    \n\u0130slam bilginleri, bu uygulamalara dayanarak, \u0130slam devlet ba\u015fkan\u0131n\u0131n, gerekli g\u00f6rd\u00fc\u011f\u00fc ve mecbur kald\u0131\u011f\u0131 takdirde, sava\u015f esirlerinin \u00f6ld\u00fcr\u00fclmesini emredebilece\u011fi g\u00f6r\u00fc\u015f\u00fcne varm\u0131\u015flard\u0131r. Fakat bu karar, devlet ba\u015fkan\u0131n\u0131n (\u0130mam’\u0131n) verebilece\u011fi bir karard\u0131r. Her asker istedi\u011fi esiri \u00f6ld\u00fcremez. Ama esirin ka\u00e7maya kalk\u0131\u015fmas\u0131 durumu veya bir sabotaj yapma tehlikesi varsa, daha \u00f6nce de bu tip giri\u015fimlerde bulunmu\u015fsa, m\u00fcsl\u00fcman askerler de onu \u00f6ld\u00fcrme yetkisine sahiptir.
    \n\u0130slam m\u00fcctehidleri, bu konuda \u00fc\u00e7 a\u00e7\u0131klama daha getirmi\u015flerdir:
    \na) Esir \u0130slam’\u0131 kabul etmi\u015fse, onu \u00f6ld\u00fcrmek caiz de\u011fildir.
    \nb) Esir, \u0130slam h\u00fck\u00fcmetini y\u0131kma ve di\u011fer esirleri ayakland\u0131rma \u00e7abas\u0131nda olmad\u0131\u011f\u0131 m\u00fcddet\u00e7e \u00f6ld\u00fcr\u00fclemez. Esirlerin b\u00f6l\u00fc\u015f\u00fclerek veya sat\u0131larak herhangi bir \u015fahs\u0131n m\u00fclkiyetine ge\u00e7mesi halinde de \u00f6ld\u00fcr\u00fclmeleri yasaklanm\u0131\u015ft\u0131r.
    \nc) Esirin \u00f6ld\u00fcr\u00fclmesi gerekirse, bu, normal ve k\u0131sa yoldan halledilmelidir. \u0130\u015fkence yap\u0131larak, ac\u0131lar i\u00e7inde k\u0131vrand\u0131r\u0131larak \u00f6ld\u00fcr\u00fclmemelidir.<\/li>\n
  2. \nSava\u015f esirleri hakk\u0131nda konulan genel h\u00fck\u00fcmler \u015funlard\u0131r: Ya onlara iyilik yap\u0131l\u0131p serbest b\u0131rak\u0131l\u0131r veya fidye uygulan\u0131r.
    \n\u0130yilik yapma kavram\u0131 d\u00f6rt \u015feyi i\u00e7erir:
    \na) Esaret m\u00fcddetince esire iyi davran\u0131lmas\u0131,
    \nb) \u00d6ld\u00fcrme veya m\u00fcebbed hapse mahkum etme yerine onu k\u00f6le yaparak m\u00fcsl\u00fcmanlar\u0131n hizmetine verme,
    \nc) Cizye alarak (senelik devlet vergisi koyarak) \u0130slam devletinin vatanda\u015f\u0131 (z\u0131mmi) yap\u0131lmas\u0131,
    \nd) Bir kar\u015f\u0131l\u0131k al\u0131nmadan serbest b\u0131rak\u0131lmas\u0131.
    \nFidye uygulamas\u0131n\u0131n da \u00fc\u00e7 bi\u00e7imi vard\u0131r:
    \na) Maddi kar\u015f\u0131l\u0131k al\u0131narak esirin serbest b\u0131rak\u0131lmas\u0131,
    \nb) Birtak\u0131m \u00f6zel hizmetler yapt\u0131rd\u0131ktan sonra serbest b\u0131rak\u0131lmas\u0131,
    \nc) D\u00fc\u015fman eline esir d\u00fc\u015fm\u00fc\u015f m\u00fcsl\u00fcmanlarla takas edilmesi.
    \nHz. Peygamber (s.a.) ve ashab\u0131, \u00e7e\u015fitli zamanlarda ve yerine g\u00f6re b\u00fct\u00fcn bu uygulamalar\u0131 yapm\u0131\u015flard\u0131r. Allah’\u0131n \u015eeriat’\u0131, \u0130slam devleti y\u00f6neticilerini tek bir madde ile ba\u011fl\u0131 k\u0131lmam\u0131\u015ft\u0131r. Tersine, devlet ba\u015fkan\u0131 ve y\u00f6neticiler, en uygun g\u00f6rd\u00fckleri yolu uygulamakta serbest b\u0131rak\u0131lm\u0131\u015flard\u0131r.<\/li>\n
  3. \nHz. Peygamber (s.a) ve ashab\u0131n\u0131n uygulamalar\u0131ndan anla\u015f\u0131lmaktad\u0131r ki sava\u015f esiri, devletin iradesi ve esareti alt\u0131nda kald\u0131\u011f\u0131 m\u00fcddet\u00e7e bar\u0131nmas\u0131, beslenmesi, hasta veya yaral\u0131 ise tedavi edilmesi devletin sorumlulu\u011fundad\u0131r. Esirleri a\u00e7 ve \u00e7\u0131plak b\u0131rakmak veya onlara i\u015fkence yapmak \u0130slam hukukunun asla m\u00fcsamaha g\u00f6sterebilece\u011fi bir tutum ve davran\u0131\u015f olamaz. Aksine, onlara ilgi g\u00f6stererek iyi muamele yap\u0131lmas\u0131n\u0131 te\u015fvik edici emirler vard\u0131r.
    \nBunun \u00f6rneklerini Hz. Peygamber’in (s.a) uygulamalar\u0131nda bulabiliriz: Bedir Sava\u015f\u0131’nda Hz. Peygamber (s.a) esirleri ashab\u0131na b\u00f6l\u00fc\u015ft\u00fcrd\u00fc ve “Bu esirlere iyi muamele ediniz” diye emretti. O s\u0131rada esirler aras\u0131nda bulunan Ebu Aziz \u015f\u00f6yle anlat\u0131yor: “Beni teslim ettikleri Ensar\u0131n evinde ev halk\u0131 sabah ak\u015fam sadece hurma ile yetinirken bana yemek ikram ediyorlard\u0131.”
    \nDi\u011fer bir esir olan S\u00fcheyl bin Amr hakk\u0131nda Hz. Peygamber’e (s.a) “Ate\u015fli bir hatiptir ve sizin aleyhinizde konu\u015fmalar yap\u0131yor, bu adam\u0131n di\u015flerini k\u0131rd\u0131r\u0131n\u0131z” denildi. Buna cevap olarak Hz. Peygamber (s.a) , “Ben onun di\u015fini k\u0131rd\u0131r\u0131rsam, Allah da benim di\u015fimi k\u0131rd\u0131r\u0131r; halbuki ben peygamberim.” buyurdu. (Siret-i \u0130bn Hi\u015fam) .
    \nYine, \u0130bn Hi\u015fam’\u0131n, Siret’inde nakletti\u011fine g\u00f6re, Yemame h\u00fck\u00fcmdar\u0131 Sumame \u0130bn Usal esir al\u0131narak Medine’ye getirilmi\u015f, Hz. Peygamber’in (s.a) emriyle kendisine devaml\u0131 kaliteli yemekler ve s\u00fct ikram edilmi\u015ftir.
    \nBu tutum, ashab d\u00f6neminde de devam etmi\u015ftir. O d\u00f6nemde, sava\u015f esirlerine k\u00f6t\u00fc muamele edildi\u011fini g\u00f6steren hi\u00e7bir olaya rastlanmam\u0131\u015ft\u0131r.<\/li>\n
  4. \n\u0130slam, esirlerin devaml\u0131 esarette tutulmalar\u0131n\u0131 ve devletin onlardan, zorla yapt\u0131r\u0131lan hizmetler \u015feklinde faydalanmas\u0131na asla izin vermemi\u015ftir. Kendileriyle veya temsil ettikleri ulusun y\u00f6neticileri ile sava\u015f esirlerinin takas edilmesi yahut fidye kar\u015f\u0131l\u0131\u011f\u0131 serbest b\u0131rak\u0131lmalar\u0131 gibi bir anla\u015fmaya var\u0131lmam\u0131\u015fsa, bunlar\u0131n k\u00f6le yap\u0131larak m\u00fcsl\u00fcmanlara da\u011f\u0131t\u0131lmalar\u0131 ve sahiplerine de bunlara \u00e7ok iyi davranmalar\u0131n\u0131n emredilmesi uygun g\u00f6r\u00fclm\u00fc\u015ft\u00fcr.
    \nHz.Peygamber (s.a) devrinde bu prensiplere g\u00f6re hareket edilmi\u015f, ashab devrinde de bu uygulama devam etmi\u015ftir. \u0130slam hukuk\u00e7ular\u0131 da bu uygulaman\u0131n caiz oldu\u011fu konusunda ittifak etmi\u015flerdir.
    \nBu konuda \u015fu da bilinmelidir ki, bir ki\u015fi esir olmadan \u00f6nce \u0130slam’\u0131 kabul etmi\u015fse, derhal serbest b\u0131rak\u0131l\u0131r, ama yakalan\u0131p esir edildikten sonra \u0130slam’\u0131 kabul etmi\u015fse veya bir m\u00fcsl\u00fcmana sava\u015f ganimeti olarak verildikten sonra m\u00fcsl\u00fcman oldu\u011funu iddia etmi\u015fse, bu onun serbest b\u0131rak\u0131lmas\u0131n\u0131 sa\u011flayamaz. M\u00fcsned-i Ahmed, M\u00fcslim ve Tirmizi’de \u0130mran bin Husayn’\u0131n anlatt\u0131\u011f\u0131na g\u00f6re, Ukayl O\u011fullar\u0131’ndan bir \u015fah\u0131s esir al\u0131nd\u0131ktan sonra, “\u0130slam’\u0131 kabul ettim” demi\u015fti. Hz. Peygamber (s.a) bunun \u00fczerine \u015f\u00f6yle buyurmu\u015ftu: “Sen bu s\u00f6z\u00fc esir edilmeden \u00f6nce s\u00f6yleseydin, kesin olarak kurtulmu\u015ftun.” Bu konuda Hz. \u00d6mer de \u015f\u00f6yle demi\u015ftir: “E\u011fer bir ki\u015fi m\u00fcsl\u00fcmanlar\u0131n eline ge\u00e7tikten sonra \u0130slam’\u0131 kabul ederse, \u00f6ld\u00fcr\u00fclmekten kurtulur; ama, sava\u015f ganimeti muamelesi g\u00f6rmekten kurtulamaz.”
    \n\u0130slam hukuk\u00e7ular\u0131, bunlardan yola \u00e7\u0131karak ittifakla, esir olduktan sonra \u0130slam’\u0131 kabul eden ki\u015finin k\u00f6lelikten kurtulamayaca\u011f\u0131n\u0131 kabul etmi\u015flerdir. (\u0130mam Muhammed, el-Siyer el-Kebir) . Bu g\u00f6r\u00fc\u015f en makbul olan\u0131d\u0131r. \u00c7\u00fcnk\u00fc, her esir edilen ki\u015fi \u0130slam’\u0131 kabul etmi\u015f g\u00f6r\u00fcn\u00fcp serbest b\u0131rak\u0131l\u0131rsa, hangi ahmak \u0130slam’\u0131 kabul etmi\u015f g\u00f6r\u00fcnmeyerek tutuklu ve esir kalmay\u0131 tercih eder.<\/li>\n
  5. \n\u0130slam’da sava\u015f esirlerine iyilik yapman\u0131n \u00fc\u00e7\u00fcnc\u00fc bir \u015fekli de esirlerin cizye denilen vergilerle vergilendirilip z\u0131mmi vatanda\u015f yap\u0131lmas\u0131 ve m\u00fcsl\u00fcman vatanda\u015flar gibi serbest\u00e7e, \u00f6zg\u00fcrl\u00fck i\u00e7inde ya\u015famalar\u0131n\u0131n sa\u011flanmas\u0131d\u0131r. \u0130mam Muhammed, el-Siyer el-Kebir isimli kitab\u0131nda \u015funlar\u0131 yazar: “M\u00fcsl\u00fcman idarecinin, esirlere cizye koyarak veya hara\u00e7 vergisi alarak serbest b\u0131rakma yetkisi vard\u0131r.” Bu tarz uygulamalar, genel olarak, yeni fethedilen bir b\u00f6lgenin esir edilen halk\u0131 hakk\u0131nda yap\u0131lm\u0131\u015ft\u0131r. Hz. Peygamber (s.a) Hayber halk\u0131na bu \u00f6rne\u011fe uygun bir uygulamada bulunmu\u015ftu. Daha sonra Hz. \u00d6mer (r.a) Irak ve di\u011fer \u00fclkeleri fethetti\u011fi zaman b\u00fcy\u00fck \u00f6l\u00e7\u00fcde bu \u00f6rne\u011fe uymu\u015f ve ona g\u00f6re hareket etmi\u015fti.
    \nEbu Ubeyd’in Kitabu’l-Emval’de yazd\u0131\u011f\u0131na g\u00f6re, Irak fethedilince, b\u00f6lge halk\u0131ndan baz\u0131lar\u0131 Hz. \u00d6mer’e gelerek \u015f\u00f6yle derler: “Ey m\u00fc’minlerin emiri! Biz bundan \u00f6nce \u0130ran y\u00f6netimi alt\u0131nda idik, bize \u00e7ok eziyet ettiler, \u00e7ok k\u00f6t\u00fc muamele ettiler, \u00e7e\u015fit \u00e7e\u015fit eza ve cefa \u00e7ektirdiler. Sonra Allah sizi g\u00f6nderdi, biz de sizin geli\u015finizden memnun olduk. Size kar\u015f\u0131 ne savunma yapt\u0131k, ne de yap\u0131lan sava\u015fa kat\u0131ld\u0131k. Duydu\u011fumuza g\u00f6re bizi k\u00f6lele\u015ftirmek istiyormu\u015fsunuz. Do\u011fru mu?”
    \nHz. \u00d6mer bunlara \u015fu cevab\u0131 verir: “M\u00fcsl\u00fcmanl\u0131\u011f\u0131 kabul etme veya cizye verme yollar\u0131ndan birini se\u00e7iniz ve \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcz\u00fc koruyunuz.” Onlar da cizye vermeyi se\u00e7erek serbest b\u0131rak\u0131l\u0131rlar. Bu kitab\u0131n ba\u015fka bir yerinde Ebu Ubeyd \u015f\u00f6yle nakleder: Hz. \u00d6mer, Hz. Ebu Musa el-E\u015f’ari’ye \u015f\u00f6yle yazar: “Sava\u015fta ele ge\u00e7irilen kimselerden \u00e7ift\u00e7i ve k\u00f6yl\u00fc olanlar\u0131n\u0131 serbest b\u0131rak\u0131n\u0131z.”<\/li>\n
  6. \n\u0130yilik etmenin d\u00f6rd\u00fcnc\u00fc bir \u015fekli olarak da, esirin hi\u00e7bir bedel, vs. al\u0131nmadan serbest b\u0131rak\u0131lmas\u0131 vazedilmi\u015ftir. Bu, \u0130slam devletinin esirin genel durumu kar\u015f\u0131s\u0131nda kulland\u0131\u011f\u0131 \u00f6zel bir yetkidir. Bu \u00f6zel yetki ile, onu hayat boyu memnun b\u0131rakarak d\u00fc\u015fmanl\u0131ktan dostlu\u011fa, kafirlikten m\u00fcsl\u00fcmanl\u0131\u011fa d\u00f6nmesi \u00fcmidi ile esir serbest b\u0131rak\u0131lmaktad\u0131r. Aksi halde, d\u00fc\u015fman taraf\u0131n bir ferdini, yeniden m\u00fcsl\u00fcmanlarla sava\u015fmas\u0131 i\u00e7in serbest b\u0131rakmak hi\u00e7bir maslahata uygun d\u00fc\u015fmez. Bu bak\u0131mdan, \u0130slam hukuk\u00e7ular\u0131 buna topluca muhalefet etmi\u015fler, cevaz verilebilmesi i\u00e7in de, “\u0130slam devlet ba\u015fkan\u0131, esirlerin tamam\u0131n\u0131n veya bir k\u0131sm\u0131n\u0131n bir l\u00fctuf olarak sal\u0131verilmelerinde bir fayda g\u00f6r\u00fcyorsa, \u00f6yle hareket etmesinde bir sak\u0131nca yoktur.” (el-Siyer el-Kebir) \u015fart\u0131n\u0131 koymu\u015flard\u0131r.
    \nHz. Peygamber (s.a) d\u00f6neminde bu gibi pek\u00e7ok uygulamalar g\u00f6r\u00fclmektedir ve hemen hemen hepsinde maslahat y\u00f6n\u00fc a\u00e7\u0131k\u00e7a a\u011f\u0131r basmaktad\u0131r. Nitekim Hz. Peygamber (s.a) Bedir Sava\u015f\u0131 esirleri ile ilgili olarak “E\u011fer Mut’im bin Adiy sa\u011f olup da bu sefil adamlar\u0131 benden isteseydi, onun hat\u0131r\u0131 i\u00e7in bunlar\u0131 oldu\u011fu gibi serbest b\u0131rak\u0131rd\u0131m” buyurmu\u015ftu. (M\u00fcsned-i Ahmed, Buhari, Ebu Davud) Hz. Peygamber (s.a) bu s\u00f6z\u00fc \u015funun i\u00e7in s\u00f6ylemi\u015fti: Hz. Peygamber (s.a) Taif’ten Mekke’ye geri d\u00f6nd\u00fc\u011f\u00fcnde Mut’im kendisini himayesine alm\u0131\u015f, o\u011flu da k\u0131l\u0131c\u0131n\u0131 eline alarak korumas\u0131 alt\u0131nda Kabe’ye g\u00f6t\u00fcrm\u00fc\u015ft\u00fc. Bu bak\u0131mdan Hz. Peygamber (s.a) onun iyili\u011fine kar\u015f\u0131l\u0131k vermek istiyordu.
    \nBuhari, M\u00fcslim ve M\u00fcsned-i Ahmed’in rivayetlerine g\u00f6re Yemame Reisi Sumame bin Usal esir edilip getirilince Hz. Peygamber (s.a) ona, “Sumame ne d\u00fc\u015f\u00fcn\u00fcyorsun?” diye sordu. Sumame, “Beni \u00f6ld\u00fcr\u00fcrseniz, kan\u0131n\u0131n de\u011feri \u00e7ok y\u00fcksek birisini \u00f6ld\u00fcrm\u00fc\u015f olursunuz. E\u011fer bana iyilik yap\u0131p serbest b\u0131rak\u0131rsan\u0131z, sizden bekledi\u011fim davran\u0131\u015f\u0131 yapm\u0131\u015f olursunuz. E\u011fer mal-m\u00fclk istiyorsan\u0131z isteyin; derhal verilecektir.” cevab\u0131n\u0131 verdi. \u00dc\u00e7 g\u00fcn boyunca Hz. Peygamber (s.a) ona bu soruyu sordu ve o da s\u00fcrekli ayn\u0131 cevab\u0131 verdi. Sonunda Hz. Peygamber (s.a) “Sumame’yi serbest b\u0131rak\u0131n” buyurdu. Sumame serbest b\u0131rak\u0131l\u0131r b\u0131rak\u0131lmaz yak\u0131ndaki bir hurmal\u0131\u011fa gitti; y\u0131kan\u0131p temizlendikten sonra geri gelerek kelime-i \u015fehadet getirip m\u00fcsl\u00fcman oldu ve hareketini \u015f\u00f6yle a\u00e7\u0131klad\u0131: “Bu g\u00fcne kadar insanlar i\u00e7inde en \u00e7ok senden, dinler i\u00e7inde de en \u00e7ok senin dininden nefret ediyordum. Ama \u015fimdi, hi\u00e7bir \u015fah\u0131s ve hi\u00e7bir din benim i\u00e7in senden ve senin dininden daha sevimli de\u011fildir.”
    \nSumame, daha sonra umre i\u00e7in Mekke’ye gitti\u011finde, “Peygamber izin vermedi\u011fi m\u00fcddet\u00e7e, bundan sonra size Yemame’den tah\u0131l gelmeyecektir” diyerek Kurey\u015flileri tehdit etti ve bunu uygulad\u0131. Bunun \u00fczerine Mekkeliler Yemame’den gelen tah\u0131l\u0131n kesilmemesi i\u00e7in Hz. Peygamber’den (s.a) arac\u0131 olmas\u0131n\u0131 istediler.
    \nHz. Peygamber (s.a) ayr\u0131ca, Kurayza O\u011fullar\u0131 esirlerinden Z\u00fcbeyr bin Bata ve Amr bin Sa’d’\u0131n da hayatlar\u0131n\u0131 ba\u011f\u0131\u015flad\u0131. Z\u00fcbeyr’in hayat\u0131n\u0131 ba\u011f\u0131\u015flamas\u0131n\u0131n sebebi, cahiliye d\u00f6neminde, Buas Sava\u015f\u0131 s\u0131ras\u0131nda onun, Ensardan Sabit bin Kays’\u0131 himaye ederek korumas\u0131 idi. Hz. Peygamber (s.a) , Hz. Sabit’e yapt\u0131\u011f\u0131 iyili\u011fe kar\u015f\u0131l\u0131k olarak Z\u00fcbeyr’i serbest b\u0131rakt\u0131.
    \nAmr bin Sa’d’\u0131 ise, Kurayza O\u011fullar\u0131 Hz. Peygamber’le (s.a) yapt\u0131klar\u0131 anla\u015fmay\u0131 bozduklar\u0131 zaman, kabilesini gaddarl\u0131ktan menetmeye \u00e7al\u0131\u015fmas\u0131na kar\u015f\u0131l\u0131k olarak serbest b\u0131rakt\u0131.     \nBeni Mustal\u0131k gazas\u0131nda kabileden al\u0131nan esirler getirilerek m\u00fcsl\u00fcmanlara taksim edilmi\u015flerdi. Hz. Peygamber (s.a) Hz. C\u00fcveyriye’yi hissesine d\u00fc\u015ft\u00fc\u011f\u00fc \u015fah\u0131stan sat\u0131n ald\u0131 ve daha sonra nikahlad\u0131.     \nHudeybiye Anla\u015fmas\u0131 \u015fartlar\u0131n\u0131n haz\u0131rland\u0131\u011f\u0131 s\u0131ralarda, Mekke’den seksen ki\u015fi, sabah namaz\u0131na yak\u0131n Tanim denilen mevkiden gelip Hz. Peygamber’in (s.a) \u00e7ad\u0131r\u0131na ani bir bask\u0131n yaparak kendisini \u00f6ld\u00fcrmek istediler; ama hepsi de k\u0131sk\u0131vrak yakaland\u0131lar. Fakat Hz. Peygamber (s.a) , anla\u015fman\u0131n o kritik noktas\u0131nda bozularak sava\u015f durumunun ortaya \u00e7\u0131kmas\u0131n\u0131 istemedi\u011fi i\u00e7in hepsini serbest b\u0131rakt\u0131. (M\u00fcslim, Ebu Davud, Nesei, Tirmizi, M\u00fcsned-i Ahmed) .
    \nMekke fethedildi\u011finde, Hz. Peygamber (s.a) birka\u00e7 ki\u015fi hari\u00e7 b\u00fct\u00fcn Mekke halk\u0131n\u0131, bir l\u00fctuf olarak ba\u011f\u0131\u015flad\u0131. Sadece 3-4 ki\u015finin hayat\u0131n\u0131 ba\u011f\u0131\u015flamad\u0131. B\u00fct\u00fcn Araplar, Mekkelilerin Hz. Peygamber’e (s.a) ve m\u00fcsl\u00fcmanlara nas\u0131l i\u015fkenceler yapt\u0131\u011f\u0131n\u0131 biliyordu. Buna kar\u015f\u0131l\u0131k Mekke’yi fethettikten sonra Hz. Peygamber’in (s.a) b\u00fcy\u00fck bir m\u00fcsamaha ile bu insanlar\u0131 ba\u011f\u0131\u015flamas\u0131 Araplara \u00f6yle bir g\u00fcven ve g\u00f6n\u00fcllerine \u00f6yle bir s\u00fckun vermi\u015fti ki, art\u0131k onlar, bir diktat\u00f6r, bir zalim ve bir kralla de\u011fil, son derece \u015fefkatli, son derece zengin g\u00f6n\u00fcll\u00fc, son derece merhametli bir liderle kar\u015f\u0131 kar\u015f\u0131ya bulunduklar\u0131n\u0131 anlam\u0131\u015flard\u0131.
    \n\u0130\u015fte bu sebeble, Mekke’nin fethinden sonra b\u00fct\u00fcn Arap Yar\u0131madas\u0131’n\u0131n fethedilmesi iki seneyi ge\u00e7memi\u015fti.
    \nHuneyn Sava\u015f\u0131’ndan sonra, Havazin kabilesinden bir heyet gelerek esirlerinin serbest b\u0131rak\u0131lmas\u0131n\u0131 istemi\u015fti. Ama o s\u0131rada b\u00fct\u00fcn esirler b\u00f6l\u00fc\u015ft\u00fcr\u00fclm\u00fc\u015f durumdayd\u0131. Hz. Peygamber (s.a) m\u00fcsl\u00fcmanlar\u0131 toplayarak, “Bu insanlar t\u00f6vbe etmi\u015f ve pi\u015fman olmu\u015flard\u0131r. Esirlerinin geri verilmesini uygun g\u00f6r\u00fcyorum. Sizden kim hissesine d\u00fc\u015fen esiri kendi iste\u011fiyle kar\u015f\u0131l\u0131ks\u0131z serbest b\u0131rakmak istiyorsa, o \u015fekilde serbest b\u0131raks\u0131n. Kar\u015f\u0131l\u0131k isteyenlere ise, Beyt\u00fc’l-Mal’a ilk gelen gelirden kar\u015f\u0131l\u0131\u011f\u0131n\u0131 verece\u011fiz” buyurdu. Bunun \u00fczerine 6.000 esir serbest b\u0131rak\u0131ld\u0131. Kar\u015f\u0131l\u0131k isteyenlere de Beyt\u00fc’l Mal’dan kar\u015f\u0131l\u0131\u011f\u0131 verildi.     \nBu olaydan anla\u015f\u0131laca\u011f\u0131 \u00fczere, devlet ba\u015fkan\u0131 kendi iste\u011fi ile b\u00f6l\u00fc\u015ft\u00fcr\u00fcl\u00fcp da\u011f\u0131t\u0131lan esirleri serbest b\u0131rakamaz. Ancak sahiplerinin r\u0131zalar\u0131 al\u0131narak veya onlara kar\u015f\u0131l\u0131\u011f\u0131 verilerek serbest b\u0131rak\u0131lmalar\u0131 m\u00fcmk\u00fcnd\u00fcr.
    \nHz. Peygamber’den (s.a) sonra, ashab d\u00f6neminde de iyilik ve l\u00fctuf olarak esirlerin serbest b\u0131rak\u0131lmalar\u0131 \u00f6rneklerine rastlamaktay\u0131z. S\u00f6zgelimi Hz. Ebu Bekir, E\u015f’as bin Kays el-Kindi’yi serbest b\u0131rakt\u0131. Hz. \u00d6mer ise, H\u00fcrm\u00fczan, Menazir ve Meysan esirlerine h\u00fcrriyetlerini ba\u011f\u0131\u015flad\u0131.   7. \nEsirlerin para kar\u015f\u0131l\u0131\u011f\u0131nda serbest b\u0131rak\u0131lmalar\u0131 \u00f6rne\u011fine Hz. Peygamber (s.a) d\u00f6neminde sadece Bedir olay\u0131nda rastl\u0131yoruz. Esir ba\u015f\u0131na 1.000 ile 4.000 dirhem aras\u0131nda bedel al\u0131narak serbest b\u0131rak\u0131lm\u0131\u015flard\u0131. (Tabakat-\u0131 \u0130bn Sa’d, Kitabu’l-Emval.)
    \nBu tip bir uygulamay\u0131 ashap d\u00f6neminde g\u00f6remiyoruz. \u0130slam hukuk\u00e7ular\u0131 genel olarak bunu uygun g\u00f6rmemi\u015flerdir. \u00c7\u00fcnk\u00fc bu, para kar\u015f\u0131l\u0131\u011f\u0131nda serbest b\u0131rak\u0131lan esirin daha sonra silahlanarak yeniden m\u00fcsl\u00fcmanlarla sava\u015fmas\u0131na izin verilmesi anlam\u0131na gelmektedir.
    \nBununla birlikte Kur’an fidye al\u0131nmas\u0131na izin vermi\u015f, Hz. Peygamber de (s.a) bir defa da olsa b\u00f6yle bir uygulamada bulunmu\u015ftur. Bu bak\u0131mdan bu uygulama kesin olarak yasaklanm\u0131\u015f de\u011fildir. \u0130mam Muhammed el-Siyer el-Kebir isimli eserinde, “M\u00fcsl\u00fcmanlar mecbur kal\u0131rlarsa, esirleri para kar\u015f\u0131l\u0131\u011f\u0131nda serbest b\u0131rakabilirler” demi\u015ftir.<\/li>\n
  8. \nEsirlerin hizmetleri kar\u015f\u0131l\u0131\u011f\u0131nda serbest b\u0131rak\u0131lmas\u0131 uygulamas\u0131n\u0131n \u00f6rne\u011fini de Bedir olay\u0131nda g\u00f6r\u00fcyoruz. Kurey\u015f esirlerinden, mali g\u00fcc\u00fc olmad\u0131\u011f\u0131 i\u00e7in fidye veremeyenlerin serbest b\u0131rak\u0131lmalar\u0131 i\u00e7in Hz. Peygamber (s.a) her birinin Ensar \u00e7ocuklar\u0131ndan on tanesine okuma-yazma \u00f6\u011fretmesini \u015fart ko\u015fmu\u015ftu.   9. \nHz. Peygamber (s.a) d\u00f6neminde, esir de\u011fi\u015fiminin \u00e7e\u015fitli \u00f6rneklerini g\u00f6rmekteyiz. Bir keresinde Hz. Peygamber (s.a) , Hz. Ebu Bekir’i (r.a) bir olay\u0131n \u00e7\u00f6z\u00fcm\u00fc i\u00e7in g\u00f6nderdi. Bu olayda birka\u00e7 esir ele ge\u00e7irilmi\u015fti.
    \nAralar\u0131nda, Hz. Seleme bin Ekva’n\u0131n hissesine d\u00fc\u015fen son derece g\u00fczel bir kad\u0131n da vard\u0131. Hz. Peygamber (s.a) bu kad\u0131n\u0131 \u0131srarla isteyerek Hz. Seleme’den geri ald\u0131 ve onu Mekke’ye g\u00f6ndererek orada esir bulunan birka\u00e7 m\u00fcsl\u00fcman\u0131n serbest b\u0131rak\u0131lmas\u0131n\u0131 sa\u011flad\u0131.     \nHz. \u0130mran bin Husayn’\u0131n nakletti\u011fine g\u00f6re, bir keresinde Sakif kabilesi iki m\u00fcsl\u00fcman\u0131 esir alm\u0131\u015ft\u0131. Bu olaydan bir s\u00fcre sonra da Sakif ile aralar\u0131nda yard\u0131mla\u015fma anla\u015fmas\u0131 olan Ukayl O\u011fullar\u0131’ndan bir ki\u015fi m\u00fcsl\u00fcmanlar taraf\u0131ndan esir al\u0131nd\u0131. Hz. Peygamber (s.a) bu adam\u0131 Taif’e g\u00f6ndererek kar\u015f\u0131l\u0131\u011f\u0131nda esir edilen iki m\u00fcsl\u00fcman\u0131n serbest b\u0131rak\u0131lmas\u0131n\u0131 sa\u011flad\u0131.     \nM\u00fcctehidlerden \u0130mam Ebu Yusuf, \u0130mam Muhammed, \u0130mam \u015eafi, \u0130mam Malik ve \u0130mam Ahmed, esir m\u00fcbadelesini caiz g\u00f6rmektedirler. \u0130mam Ebu Hanife’den nakledilen bir g\u00f6r\u00fc\u015fe g\u00f6re, mubadele caizdir, di\u011fer bir g\u00f6r\u00fc\u015fe g\u00f6re de, m\u00fcbadele caiz de\u011filidr. Ama her \u015feye ra\u011fmen m\u00fcsl\u00fcmanl\u0131\u011f\u0131 kabul eden bir esirin m\u00fcbadele s\u0131ras\u0131nda kafirlere geri g\u00f6nderilmeyece\u011fi, b\u00fct\u00fcn \u0130slam m\u00fcctehidlerince ittifakla kabul edilmi\u015ftir.
    \nB\u00fct\u00fcn bu izahlardan anla\u015f\u0131ld\u0131\u011f\u0131 \u00fczere, \u0130slam’\u0131n sava\u015f esirleriyle ilgili meseleler i\u00e7in ortaya koydu\u011fu kanun, her zaman ve durumda uygulanabilme esnekli\u011fine sahiptir. Kur’an’\u0131n, sava\u015f esirleri hakk\u0131ndaki “Ondan sonra isterseniz iyilik yap\u0131p serbest b\u0131rak\u0131n, isterseniz fidye al\u0131n” mealindeki ayetini dar anlam\u0131yla ele alarak s\u0131n\u0131rland\u0131ranlar, sava\u015f esirleriyle ilgili uygulamalar\u0131n \u00e7e\u015fitli y\u00f6nlerini, \u00e7e\u015fitli zamanlarda ne kadar de\u011fi\u015fik problemler ortaya \u00e7\u0131kard\u0131\u011f\u0131n\u0131 ve gelecekte ne tip problemler \u00e7\u0131karaca\u011f\u0131n\u0131 bilmemektedirler.<\/li>\n<\/ol>\n

    9.Yani, e\u011fer Allah s\u0131rf bat\u0131la tapanlar\u0131 yok etmek isteseydi, sizin yard\u0131m\u0131n\u0131za ihtiya\u00e7 duymazd\u0131. Bu i\u015fi, Allah’\u0131n yaratt\u0131\u011f\u0131 bir yer sars\u0131nt\u0131s\u0131 veya her taraf\u0131 kaplayan bir tufan da hallederdi. Fakat Allah, Hakk’a ba\u011fl\u0131 olan insanlar\u0131n bat\u0131la tapanlar ile m\u00fccadele etmelerini, onlara kar\u015f\u0131 cihad etmelerini istemektedir. Bu sayede, kimin i\u00e7inde temiz hasletler varsa bu, imtihanla s\u00fcslenerek ortaya \u00e7\u0131kar; herkes yapt\u0131\u011f\u0131 amelden dolay\u0131 haketti\u011fi makam ve dereceye ula\u015f\u0131r.<\/p>\n
