Salat ve selam t\u00fcm peygamberlerin ve onlar\u0131 takip eden tabilerinin \u00fczerine olsun.<\/p>\n \u0130sl\u00e2m hukuku, “Kanunsuz su\u00e7 ve ceza yoktur” kural\u0131n\u0131 k\u0131sas ve diyet\u00a0su\u00e7larinda\u00a0da titizlikle uygulam\u0131\u015ft\u0131r. Bu husustaki h\u00fck\u00fcmlerin g\u00f6zden ge\u00e7irilmesinden ba\u015fka konuya delil te\u015fkil edecek, daha iyi bir \u015fey herhalde d\u00fc\u015f\u00fcn\u00fclemez.<\/span>\u00a0<\/span><\/p>\n K\u0131sas cezas\u0131yla cezaland\u0131r\u0131lan su\u00e7lar: Kas\u0131tla adam \u00f6ld\u00fcrmek, kas\u0131tla organ<\/span>\u00a0<\/span><\/p>\n tatil\u00a0ve itl\u00e2f\u0131 ve kas\u0131tla yaralamalard\u0131r.<\/span>\u00a0<\/span><\/p>\n Diyetle cezaland\u0131r\u0131lan su\u00e7lar ise \u015funlard\u0131r:\u00a0Kasden\u00a0i\u015flenilen\u00a0c\u00fcr\u00fcmlerde su\u00e7lu, k\u0131sastan affolundu\u011funda veya k\u0131sas\u0131n infaz\u0131\u00a0me\u015fr\u00fb\u00a0bir sebeple\u00a0imk\u00e2ns\u0131zl\u0131\u015ft\u0131\u011f\u0131nda\u00a0diyet cezas\u0131 verildi\u011fi gibi,\u00a0kasit\u00a0benzeriyle \u00f6ld\u00fcrme,\u00a0hataen\u00a0\u00f6ld\u00fcrme,\u00a0hataen\u00a0organ itlaf\u0131 veya tatili,\u00a0hataen\u00a0m\u00fcessir fiil\u00a0ik\u00e2i\u00a0(i\u015flenilmesi), yaralama su\u00e7lar\u0131nda yine diyet cezas\u0131 s\u00f6z konusudur.<\/span>\u00a0<\/span><\/p>\n Kas\u0131tla \u00f6ld\u00fcrme su\u00e7u hakk\u0131nda Allah (cc) \u015f\u00f6yle buyurur: “Allah’\u0131n haram<\/span>\u00a0<\/span><\/p>\n k\u0131ld\u0131\u011f\u0131\u00a0cana hakl\u0131 bir sebep olmad\u0131k\u00e7a k\u0131ymay\u0131n.\u201d (49), \u201cEy iman edenler!\u00a0Makt\u00fcller\u00a0hakk\u0131nda size k\u0131sas, misilleme yaz\u0131ld\u0131, farz edildi. H\u00fcr h\u00fcr ile, k\u00f6le k\u00f6leyle, di\u015fi di\u015fi ile k\u0131sas olunur. Fakat kimin, hangi\u00a0k\u00e2tilin\u00a0lehinde\u00a0makt\u00fbl\u00fcn\u00a0karde\u015fi,\u00a0vel\u00eesi\u00a0taraf\u0131ndan\u00a0c\u00fcz’\u00ee\u00a0bir \u015fey affolunursa, hemen k\u0131sas d\u00fc\u015fer. Art\u0131k \u00f6rfe uymak, dinin ve akl\u0131n iyi g\u00f6rd\u00fc\u011f\u00fcn\u00fc yapmak, borcu\u00a0makt\u00fbl\u00fcn\u00a0vel\u00eesine, g\u00fczellikle<\/span>\u00a0<\/span><\/p>\n \u00f6demek\u00a0l\u00e2z\u0131md\u0131r…\u201d(50), \u201cBiz onda, Tevrat’ta, onlar\u0131n \u00fczerine \u015funu da yazd\u0131k;<\/span>\u00a0<\/span><\/p>\n cana\u00a0can kar\u015f\u0131l\u0131kt\u0131r…\u201d(51). Hz. Peygamber (as) \u015f\u00f6yle buyurur: “Kim haks\u0131z yere<\/span>\u00a0<\/span><\/p>\n bir\u00a0m\u00fc’mini\u00a0\u00f6ld\u00fcr\u00fcrse\u00a0makt\u00fbl\u00fcn\u00a0miras\u00e7\u0131s\u0131\u00a0r\u00e2z\u0131\u00a0olmad\u0131k\u00e7a\u00a0k\u00e2tilin\u00a0kisasla\u00a0\u00f6ld\u00fcr\u00fclmesi l\u00e2z\u0131md\u0131r. \u201d'(52), \u201c\u00d6ld\u00fcr\u00fclenin akrabas\u0131, iki husustan birisinde muhayyerdir; isterlerse k\u0131sas olarak \u00f6ld\u00fcreni \u00f6ld\u00fcr\u00fcrler, isterlerse diyet al\u0131rlar.”(53), \u201cCana<\/span>\u00a0<\/span><\/p>\n k\u0131yman\u0131n\u00a0diyeti y\u00fcz devedir.\u201d(54).<\/span>\u00a0<\/span><\/p>\n Bu h\u00fck\u00fcmler, kas\u0131tla adam \u00f6ld\u00fcrmeyi yasaklamakta, bu c\u00fcrm\u00fcn cezas\u0131 olarak da\u00a0makt\u00fbl\u00fcn\u00a0miras\u00e7\u0131s\u0131 su\u00e7luyu diyet kar\u015f\u0131l\u0131\u011f\u0131 affetmedi\u011finde, ceza olarak<\/span>\u00a0<\/span><\/p>\n k\u0131sas\u0131\u00a0tespit etmektedir. K\u0131sas cezas\u0131n\u0131n aff\u0131 halinde ceza diyet olmaktad\u0131r. Diyetse y\u00fcz devedir.<\/span>\u00a0<\/span><\/p>\n Uzuvlar\u0131n kas\u0131tl\u0131 olarak itl\u00e2f\u0131 ve kas\u0131tl\u0131 yaralama hususunda\u00a0Cen\u00e2b-\u0131 Allah<\/span>\u00a0<\/span><\/p>\n (cc) \u015f\u00f6yle buyurur: \u201cS\u00e2lim\u00a0ak\u0131l sahipleri; k\u0131sasta sizin i\u00e7in umum\u00ee bir hayat vard\u0131r.\u00a0T\u00e2\u00a0ki, \u00f6ld\u00fcrmekten sak\u0131nas\u0131n\u0131z.”(55), \u201cBiz onda, Tevrat’ta, onlar\u0131n \u00fczerine \u015funu da yazd\u0131k; cana can, g\u00f6ze g\u00f6z, buruna burun, kula\u011fa kulak, di\u015fe di\u015f\u00a0kar\u015f\u0131l\u0131kt\u0131r. H\u00fcl\u00e2sa b\u00fct\u00fcn yaralar birbirine k\u0131sast\u0131r. Fakat kim bunu, bu\u00a0hakk\u0131ni, sadaka olarak ba\u011f\u0131\u015flarsa o, kendisine (g\u00fcnah\u0131na)\u00a0keff\u00e2ret, onun\u00a0yarl\u0131\u011fanmas\u0131na\u00a0vesiledir. “Kim Allah’\u0131n indirdi\u011fi ahk\u00e2m ile h\u00fckmetmezse onlar\u00a0z\u00e2limlerin\u00a0ta kendileridir.”(56), \u201cOnun i\u00e7in kim, sizin \u00fczerinize sald\u0131r\u0131rsa, siz de\u00a0tipki\u00a0onlar\u0131n, \u00fcst\u00fcn\u00fcze sald\u0131rd\u0131klar\u0131 gibi ona sald\u0131r\u0131n.”(57), \u201cE\u011fer herhangi bir ceza<\/span>\u00a0<\/span><\/p>\n ile\u00a0mukabele edecek olursan\u0131z, ancak size\u00a0rev\u00e2\u00a0g\u00f6r\u00fclen\u00a0uk\u00fbbetin\u00a0misillemesiyle<\/span>\u00a0<\/span><\/p>\n ceza\u00a0yap\u0131n.”(58). Bu h\u00fck\u00fcmler, kas\u0131tl\u0131 bir \u015fekilde uzuvlar\u0131n itl\u00e2f\u0131, tatili ve yaralanmas\u0131 halinde k\u0131sas\u0131n ceza olarak tespit edilip verilece\u011fi hususunda gayet a\u00e7\u0131kt\u0131r.<\/span>\u00a0<\/span><\/p>\n Kasit\u00a0benzeriyle adam \u00f6ld\u00fcrme su\u00e7u konusunda Peygamber (as) \u201cDikkat edin!<\/span>\u00a0<\/span><\/p>\n Kasit\u00a0benzeriyle yani kam\u00e7\u0131yla, sopayla veya ta\u015fla \u00f6ld\u00fcrmelerde\u00a0makt\u00fbl\u00a0i\u00e7in diyet olarak y\u00fcz deve verilir.”(59) buyurur. Bu h\u00fck\u00fcm,\u00a0kasit\u00a0benzeriyle \u00f6ld\u00fcrmeyi yasakl\u0131yor ve bu c\u00fcrme diyet cezas\u0131n\u0131\u00a0tesbit\u00a0ediyor.<\/span>\u00a0<\/span><\/p>\n Hataen\u00a0adam \u00f6ld\u00fcrme su\u00e7u hakk\u0131nda Allah (cc) \u015f\u00f6yle buyurur: \u201cBir\u00a0m\u00fc’minin\u00a0bir di\u011fer\u00a0m\u00fc’mini\u00a0yanl\u0131\u015fl\u0131k eseri olmayarak \u00f6ld\u00fcrmesi yak\u0131\u015fmaz. Kim bir<\/span>\u00a0<\/span><\/p>\n m\u00fc’mini\u00a0yanl\u0131\u015fl\u0131kla \u00f6ld\u00fcr\u00fcrse,\u00a0m\u00fc’min\u00a0bir k\u00f6leyi\u00a0\u00e2z\u00e2d\u00a0etmesi ve \u00f6lenin ailesine,<\/span>\u00a0<\/span><\/p>\n miras\u00e7\u0131lar\u0131na\u00a0teslim edilecek bir diyet, kan bahas\u0131 vermesi l\u00e2z\u0131md\u0131r. Me\u011fer ki,<\/span>\u00a0<\/span><\/p>\n onlar\u00a0o diyeti sadaka olarak ba\u011f\u0131\u015flam\u0131\u015f olsunlar. E\u011fer \u00f6ld\u00fcr\u00fclen,\u00a0m\u00fc’min\u00a0olmakla beraber size d\u00fc\u015fman bir kavimden ise o zaman, \u00f6ld\u00fcrenin\u00a0m\u00fc’min\u00a0bir<\/span>\u00a0<\/span><\/p>\n k\u00f6le\u00a0\u00e2z\u00e2d\u00a0etmesi l\u00e2z\u0131md\u0131r. \u015eayet kendileriyle aran\u0131zda anla\u015fma olan bir kavimden ise, o vakit miras\u00e7\u0131lar\u0131na bir diyet vermek ve bir\u00a0m\u00fc’min\u00a0k\u00f6le\u00a0\u00e2z\u00e2d\u00a0etmek<\/span>\u00a0<\/span><\/p>\n gerekir. Kim bunlar\u0131 bulamazsa, bulmaktan aciz ise Allah taraf\u0131ndan\u00a0tevbesinin\u00a0kabul\u00fc i\u00e7in birbiri ard\u0131nca iki ay\u00a0oruc\u00a0tutmas\u0131 gerekir. Allah her \u015feyi bilendir. Ger\u00e7ek h\u00fck\u00fcm ve hikmet sahibidir.”(60). Hz. Peygamber (as) \u015f\u00f6yle buyurur: \u201cHataen\u00a0adam \u00f6ld\u00fcrme c\u00fcrm\u00fcn\u00fcn diyeti, d\u00f6rt ya\u015f\u0131na girmi\u015f 20, be\u015f ya\u015f\u0131na<\/span>\u00a0<\/span><\/p>\n girmi\u015f\u00a020, iki ya\u015f\u0131na girmi\u015f 20, \u00fc\u00e7 ya\u015f\u0131na girmi\u015f 20 di\u015fi ve iki ya\u015f\u0131na basm\u0131\u015f 20<\/span>\u00a0<\/span><\/p>\n erkek\u00a0devedir.\u201d(61). Her iki h\u00fck\u00fcm de\u00a0hataen\u00a0adam \u00f6ld\u00fcrmeyi yasaklamakta,<\/span>\u00a0<\/span><\/p>\n ceza\u00a0olarak da diyeti tespit ederek bunun miktar ve vas\u0131flar\u0131n\u0131 a\u00e7\u0131klamaktad\u0131r.<\/span>\u00a0<\/span><\/p>\n Uzuvlar\u0131\u00a0hataen\u00a0kesme, tatil etme ve yaralaman\u0131n cezas\u0131n\u0131 da Hz. Peygamber (as) \u015f\u00f6yle tespit etmi\u015ftir; “E\u011fer uzuv insan bedeninde yaln\u0131z bir tane ise,<\/span>\u00a0<\/span><\/p>\n burun, dil ve zeker gibi, b\u00f6yle uzuvlar aleyhine i\u015flenen c\u00fcr\u00fcmler i\u00e7in tam diyet<\/span>\u00a0<\/span><\/p>\n \u00f6denir. E\u011fer organ bir \u00e7ift ise, b\u00f6yle organlar\u0131n her biri i\u00e7in yar\u0131m diyet \u00f6denir.<\/span>\u00a0<\/span><\/p>\n Bu konuda Hz. Peygamber (as) \u015f\u00f6yle buyuruyor: “Burnun bir taraf\u0131n\u0131n\u00a0tamaminin\u00a0kesilmesi diyeti gerektirir.\u201d(62), \u201cDili kesmek tam diyeti, zekeri kesmek<\/span>\u00a0<\/span><\/p>\n tam\u00a0diyeti gerektirir.\u201d (63), \u201cOmurga kemi\u011fini k\u0131rmak tam diyeti gerektirir.”(64)<\/span>\u00a0<\/span><\/p>\n \u00a0<\/span><\/p>\n \u0130ki eli kesmek tam diyeti, iki aya\u011f\u0131 kesmek de tam diyeti\u00a0iktiz\u00e2\u00a0ettirir.\u201d(65),<\/span>\u00a0<\/span><\/p>\n \u201c\u0130ki yumurtal\u0131\u011f\u0131n kesilip kopar\u0131lmas\u0131 tam diyeti gerektirir.”(66), “\u0130ki kula\u011f\u0131n<\/span>\u00a0<\/span><\/p>\n sa\u011f\u0131r, i\u015fitmez edilmesi diyeti gerektirir.”(67), \u201c\u0130ki g\u00f6zden her birinin \u00e7\u0131kar\u0131lmas\u0131,<\/span>\u00a0<\/span><\/p>\n k\u00f6r\u00a0edilmesi yar\u0131m diyeti, elli devenin verilmesini, gerektirir.\u201d(68). \u201cBir di\u015fin<\/span>\u00a0<\/span><\/p>\n k\u0131r\u0131lmas\u0131nda\u00a0be\u015f deve diyet verilir.”(69). Hz. Peygamber (as) i\u015fitme, g\u00f6rme gibi<\/span>\u00a0<\/span><\/p>\n be\u015f\u00a0duyunun her birini tatilde, alenen giderilmesinde, ki\u015fiyi deli hale getirmede<\/span>\u00a0<\/span><\/p>\n tam\u00a0diyetin\u00a0icab\u00a0etti\u011fini belirtmi\u015ftir.<\/span>\u00a0<\/span><\/p>\n Yaralamalarda ise,\u00a0Hz.Muhammed\u00a0(as), baz\u0131lar\u0131n\u0131n cezas\u0131n\u0131 tayin ve tespit<\/span>\u00a0<\/span><\/p>\n etmi\u015f, baz\u0131s\u0131n\u0131 ise etmemi\u015ftir. Mesel\u00e2 y\u00fcz veya ba\u015f nahiyesindeki kemi\u011fin g\u00f6r\u00fcnmesine sebep olan yaralama fiilinin cezas\u0131n\u0131 (er\u015fini) be\u015f deve, ba\u015f veya y\u00fcz<\/span>\u00a0<\/span><\/p>\n kemi\u011fini\u00a0k\u0131rman\u0131n\u00a0er\u015fini\u00a010 deve, beyni \u00f6rten zara kadar ula\u015fan yaralamayla<\/span>\u00a0<\/span><\/p>\n beynin\u00a0kendisine kadar ula\u015fan yaralaman\u0131n ve kar\u0131n ve g\u00f6\u011f\u00fcs bo\u015fluklar\u0131na ula\u015fan yaralamalar\u0131n\u00a0er\u015fini\u00a0tam diyetin\u00a0\u00fc\u00e7tebiri\u00a0(1\/3) olarak tespit buyurmu\u015ftur(70).<\/span>\u00a0<\/span><\/p>\n \u0130sl\u00e2m’da genel kural \u015fudur: Hz. Peygamber taraf\u0131ndan diyet yahut\u00a0er\u015fi\u00a0tespit edilmemi\u015f her m\u00fcessir fiilde, yaralamada, h\u00fck\u00fbmet (tazminat) s\u00f6z konusudur. H\u00fck\u00fbmet,\u00a0m\u00fctehassislar\u0131n\u00a0takdirine g\u00f6re h\u00e2kimin h\u00fckmetti\u011fi bir t\u00fcr tazminatt\u0131r. Fakat bir c\u00fcrme ceza olarak kararla\u015ft\u0131r\u0131lan h\u00fck\u00fbmet, Hz. Peygamber<\/span>\u00a0<\/span><\/p>\n taraf\u0131ndan\u00a0diyet veya\u00a0er\u015fi\u00a0tayin edilmi\u015f, o t\u00fcrden daha a\u011f\u0131r olan m\u00fcessir fiilin<\/span>\u00a0<\/span><\/p>\n er\u015fi\u00a0kadar olamaz veya a\u015famaz. Bu kural hakk\u0131nda\u00a0icm\u00e2\u00a0vard\u0131r.<\/span>\u00a0<\/span><\/p>\n Organ kesme ve kas\u0131tla yaralaman\u0131n diyeti,\u00a0hataen\u00a0adam \u00f6ld\u00fcrme diyetinin<\/span>\u00a0<\/span><\/p>\n ayn\u0131d\u0131r; fakat arada bir nitelik fark\u0131 vard\u0131r. Hz. Peygamber (as)’in hadislerine<\/span>\u00a0<\/span><\/p>\n g\u00f6re, kas\u0131tl\u0131 su\u00e7un diyeti a\u011f\u0131rla\u015ft\u0131r\u0131lm\u0131\u015f,\u00a0hataen\u00a0i\u015flenen c\u00fcrm\u00fcn diyeti ise, hafifletilmi\u015f diyettir.<\/span>\u00a0<\/span><\/p>\n \u015eu\u00a0halde\u00a0organ itl\u00e2f\u0131nda, bir\u00e7ok hallerde ceza a\u00e7\u0131k h\u00fck\u00fcmlerle, di\u011fer hallerde de kendisinde \u015f\u00fcphe bulunmayan bir\u00a0icm\u00e2\u00a0ile tespit olunmu\u015ftur. Bahsetti\u011fimiz gibi\u00a0icm\u00e2, \u0130sl\u00e2m’\u0131n ve hukukunun kaynaklar\u0131ndan, delillerinden birisidir.<\/span>\u00a0<\/span><\/p>\n Kur’an ve s\u00fcnnetin sarih h\u00fckm\u00fc gibi, m\u00fckellefi ba\u011flay\u0131c\u0131d\u0131r.<\/span>\u00a0<\/span><\/p>\n Bu deliller ve a\u00e7\u0131klamalar\u0131ndan anla\u015f\u0131ld\u0131\u011f\u0131 \u00fczere k\u0131sas ve diyet su\u00e7lar\u0131yla cezalar\u0131 hakk\u0131nda h\u00fck\u00fcmler vard\u0131r. \u0130sl\u00e2m hukuku cezan\u0131n tayin ve takdirinde h\u00e2kime serbesti b\u0131rakmayacak \u015fekilde bu cezalar\u0131 gayet b\u00fcy\u00fck bir titizlikle tespit<\/span>\u00a0<\/span><\/p>\n etmi\u015ftir. H\u00e2kimin yapaca\u011f\u0131 tek i\u015f, su\u00e7 ve su\u00e7lunun \u015fartlar\u0131n\u0131 nazar\u0131 dikkate almaks\u0131z\u0131n, san\u0131\u011f\u0131n su\u00e7u i\u015fledi\u011fi\u00a0s\u00fcb\u00fbt\u00a0bulursa, tespit olunmu\u015f cezaya h\u00fckmetmekten ibarettir.<\/span>\u00a0<\/span><\/p>\n G\u00f6r\u00fcl\u00fcyor ki, k\u0131sas ve diyet cezalar\u0131n\u0131 gerektiren su\u00e7larda h\u00e2kimin takdir<\/span>\u00a0<\/span><\/p>\n yetkisi\u00a0hadd\u00a0su\u00e7lar\u0131ndaki yetkisinin ayn\u0131d\u0131r. \u0130ki yetki aras\u0131ndaki fark, ma\u011fdur<\/span>\u00a0<\/span><\/p>\n yahut\u00a0miras\u00e7\u0131s\u0131 su\u00e7luyu ba\u011f\u0131\u015flarsa h\u00e2kim, k\u0131sas yahut diyet cezas\u0131n\u0131 uygulamaz.<\/span>\u00a0<\/span><\/p>\n Fakat k\u0131sas ve diyet cezalar\u0131 affedilse bile h\u00e2kim, \u0130sl\u00e2m hukuku yahut devlet<\/span>\u00a0<\/span><\/p>\n ba\u015fkan\u0131n\u0131n\u00a0verdi\u011fi\u00a0ta\u02bcz\u00eer\u00a0mahiyetindeki cezay\u0131 uygulamak mecburiyetindedir.<\/span>\u00a0<\/span><\/p>\n K\u0131sas ve diyet cezalar\u0131, tayin ve tespit olunmu\u015f cezalardand\u0131r. \u00c7e\u015fidi ve miktar\u0131<\/span>\u00a0<\/span><\/p>\n belirtilmi\u015f, fakat bunlar\u0131n ki\u015filerin bir hakk\u0131 oldu\u011fu a\u00e7\u0131klanm\u0131\u015ft\u0131r. Bunun i\u00e7in<\/span>\u00a0<\/span><\/p>\n su\u00e7luyu\u00a0ma\u011fdur veya miras\u00e7\u0131s\u0131 ba\u011f\u0131\u015flayabilir; hak sahibi hakk\u0131n\u0131 arayabildi\u011fi<\/span>\u00a0<\/span><\/p>\n gibi\u00a0hakk\u0131ndan\u00a0fer\u00e2gat\u00a0da edebilir. Devlet ba\u015fkan\u0131n\u0131n ise k\u0131sas yahut diyet\u00a0cezasini\u00a0d\u00fc\u015f\u00fcrme (isk\u00e2t) yahut ikisinden birisini affa yetkisi yoktur. T\u0131pk\u0131\u00a0hadd\u00a0cezalar\u0131n\u0131 d\u00fc\u015f\u00fcr\u00fcp affedemedi\u011fi gibi. \u00c7\u00fcnk\u00fc devlet\u00a0ba\u015fkan\u0131,\u00a0ne Allah’\u0131n ne de fertlerin hakk\u0131n\u0131 d\u00fc\u015f\u00fcrebilir, ba\u011f\u0131\u015flayabilir 71.
