Hamd kendisinden ba\u015fka ilah olmayan, mutlak manada tek g\u00fc\u00e7 ve kudret sahibi olan Allah\u2019a mahsustur. Salat ve selam t\u00fcm peygamberlerin ve onlar\u0131 takip eden tabilerinin \u00fczerine olsun.<\/p>\n

26- K\u00f6t\u00fc kad\u0131nlar, k\u00f6t\u00fc erkeklere; k\u00f6t\u00fc erkekler, k\u00f6t\u00fc kad\u0131nlara; iyi ve temiz kad\u0131nlar, iyi ve temiz erkeklere; iyi ve temiz erkekler, iyi ve temiz kad\u0131nlara (yara\u015f\u0131r) . Bunlar, onlar\u0131n demekte olduklar\u0131ndan uzakt\u0131rlar.(22) Bunlar i\u00e7in bir ba\u011f\u0131\u015flanma ve kerim (\u00fcst\u00fcn) bir r\u0131z\u0131k vard\u0131r.<\/strong>

22. Bu ayet temel bir ilke koymaktad\u0131r: Temiz erkekler, temiz kad\u0131nlar i\u00e7in ve dindar erkekler, dindar kad\u0131nlar i\u00e7in uygun e\u015ftirler. Her bak\u0131mdan iyi bir adam asla gizli bir k\u00f6t\u00fcl\u00fc\u011fe m\u00fcptel\u00e2 olmaz. B\u00f6yle bir k\u00f6t\u00fcl\u00fc\u011fe m\u00fcptel\u00e2 olan\u0131n al\u0131\u015fkanl\u0131klar\u0131, davran\u0131\u015f ve tav\u0131rlar\u0131 bu k\u00f6t\u00fcl\u00fc\u011f\u00fcn izlerini mutlaka a\u00e7\u0131\u011fa vurur. Bir kimsenin davran\u0131\u015flar\u0131nda ve ya\u015fant\u0131s\u0131nda hi\u00e7bir varl\u0131k izi ta\u015f\u0131madan birden bire k\u00f6t\u00fc bir yan\u0131n\u0131 ortaya koyuvermesi m\u00fcmk\u00fcn de\u011fildir. Herkesin, halk\u0131n g\u00fcnl\u00fck ya\u015fant\u0131s\u0131nda tecr\u00fcbe etti\u011fi psikolojik bir ger\u00e7ektir bu. Baz\u0131 m\u00fcfessirler bu ayeti, “iyi \u015feyler iyi insanlar i\u00e7indir ve iyi insanlar k\u00f6t\u00fclerin haklar\u0131nda s\u00f6yledikleri k\u00f6t\u00fcl\u00fcklerden uzakt\u0131rlar” anlam\u0131na alm\u0131\u015flard\u0131r. Baz\u0131lar\u0131, “k\u00f6t\u00fc \u015feyler ancak k\u00f6t\u00fc insanlara, iyi \u015feyler de iyi insanlara yak\u0131\u015f\u0131r, takva sahibi ki\u015filer k\u00f6t\u00fclerin kendilerine atfettikleri k\u00f6t\u00fcl\u00fcklerden uzakt\u0131r.” anlam\u0131 vermi\u015flerdir. Daha baz\u0131lar\u0131 ise ayetten, “k\u00f6t\u00fc ve kirli s\u00f6zlere ancak k\u00f6t\u00fc ve gizli ki\u015filer dalar, iyi ve takva s\u00f6zlerine de iyi ve takval\u0131 ki\u015filer dalar, takva sahibi ki\u015filer bu \u015ferli insanlar\u0131n dald\u0131klar\u0131 s\u00f6zlerden uzakt\u0131rlar” anlam\u0131n\u0131 \u00e7\u0131karm\u0131\u015flard\u0131r. Ayetteki kelimeler anlam y\u00f6n\u00fcnden kapsaml\u0131 oldu\u011fu i\u00e7in bu \u00fc\u00e7 \u015fekilden her biriyle terc\u00fcme ve tefsir edilebilir. Fakat okuyucuya \u00e7arp\u0131c\u0131 gelen birinci anlam, yukar\u0131da benimsedi\u011fimiz anlamd\u0131r ve metne di\u011fer anlamlardan daha uygun d\u00fc\u015fmektedir.
\n23. Surenin ba\u015f\u0131nda verilen h\u00fck\u00fcmler, k\u00f6t\u00fcl\u00fckleri toplumda ortaya \u00e7\u0131kt\u0131klar\u0131 anda yok etmeye y\u00f6nelikti. Burada verilen h\u00fck\u00fcmler ise, k\u00f6t\u00fcl\u00fc\u011f\u00fc daha do\u011fmadan \u00f6nlemek toplumu \u0131slah etmek ve k\u00f6t\u00fcl\u00fc\u011f\u00fcn ortaya \u00e7\u0131k\u0131p yay\u0131lmas\u0131ndan sorumlu nedenlerin k\u00f6k\u00fcn\u00fc kaz\u0131mak amac\u0131n\u0131 ta\u015f\u0131maktad\u0131r. Peygamber’in (s.a) e\u015fi gibi soylu bir ki\u015fiye at\u0131lan iftiran\u0131n toplumda yay\u0131lmas\u0131n\u0131n, cinsel a\u00e7\u0131dan y\u00fckl\u00fc bir atmosferin varl\u0131\u011f\u0131n\u0131n do\u011frudan sonucu oldu\u011funu ve Allah kat\u0131nda, ba\u015fkalar\u0131n\u0131n evlerine serbest\u00e7e giri\u015fi yasaklamak, cinslerin serbest\u00e7e kar\u0131\u015f\u0131m\u0131n\u0131 \u00f6nlemek, kad\u0131nlar\u0131n s\u00fcsleri ve makyajlar\u0131yla yabanc\u0131 erkeklere g\u00f6r\u00fcnmesinin \u00f6n\u00fcne set \u00e7ekmek fuh\u015fu yasaklamak, erkeklerle kad\u0131nlar\u0131 uzun s\u00fcre bek\u00e2r kalmamaya te\u015fvik etmek ve k\u00f6le ve cariyeleri bile evlendirmekten ba\u015fka toplumu \u015ferden temizlemenin yolunun bulunmad\u0131\u011f\u0131n\u0131 a\u00e7\u0131k\u00e7a g\u00f6stermektedir. Bir ba\u015fka deyi\u015fle, \u00f6rt\u00fcs\u00fcz kad\u0131nlar\u0131n hareketi ve toplumda \u00e7ok say\u0131da evlenmemi\u015f ki\u015finin varl\u0131\u011f\u0131, Allah’\u0131n ilminde toplumda \u015fehvet d\u00fc\u015fk\u00fcnl\u00fc\u011f\u00fcn\u00fc kam\u00e7\u0131layan ger\u00e7ek nedenlerdir. Halk\u0131n kulaklar\u0131n\u0131, g\u00f6zlerini, dillerini ve kalblerini herhangi ger\u00e7ek bir skandala dalmaya haz\u0131r halde tutan cinsel y\u00f6nden y\u00fckl\u00fc atmosferdi. Allah, bu k\u00f6t\u00fcl\u00fc\u011f\u00fc yok etmek i\u00e7in hikmetinde bir ba\u015fka tedbiri daha uygun ve etkili g\u00f6rmedi, aksi halde, daha ba\u015fka h\u00fck\u00fcmler de koyabilirdi.<\/li>\n

Yaln\u0131zca bir savc\u0131, bir infazc\u0131 olarak de\u011fil, bir k\u0131lavuz, bir \u0131slah edici ve yard\u0131mc\u0131 olarak da hareket eder. Ayette ge\u00e7en kelime “tesne’zin\u00fb” olsayd\u0131, ayetin anlam\u0131 \u015f\u00f6yle olacakt\u0131: “Ba\u015fkalar\u0131n\u0131n evlerine ev sahiplerinden izin almad\u0131k\u00e7a girmeyin.” Ama, Allah, “sevgi, yak\u0131nl\u0131k, \u00fcnsiyet” anlam\u0131ndaki \u00fcns k\u00f6k\u00fcnden t\u00fcreme teste’nis\u00fb’yu kullanm\u0131\u015ft\u0131r. Buna g\u00f6re ayetin anlam\u0131 \u015f\u00f6yledir: “Size kar\u015f\u0131 sevgi ve itibarlar\u0131na emin oluncaya kadar ba\u015fkalar\u0131n\u0131n evlerine girmeyin.” Bir ba\u015fka deyi\u015fle, eve giri\u015finizin ev sahiplerince iyi kar\u015f\u0131lanaca\u011f\u0131ndan ve size g\u00fczel bir “ho\u015f geldin” de bulunaca\u011f\u0131ndan emin olun. Bu y\u00fczden, kelimeyi “izin” yerine “onay-tasvip” \u015feklinde \u00e7evirdik, \u00e7\u00fcnk\u00fc “tasvip” kelimenin k\u00f6k anlam\u0131na daha yak\u0131nd\u0131r.<\/li>\n
  4. \n\u0130sl\u00e2m \u00f6ncesi Arap adetine g\u00f6re, insanlar birbirlerinin evlerine yaln\u0131zca, “iyi sabahlar” ya da “iyi ak\u015famlar” diyerek izin ve tasvip almadan serbest\u00e7e girerlerdi. Bu \u00f6nceden haber verilmeden yap\u0131lan giri\u015fler bazen ev halk\u0131n\u0131n ve kad\u0131nlar\u0131n gizlili\u011fini ihlal ederdi. Allah, herkesin kendi evinde bir gizlili\u011fi olabilece\u011fi ve dolay\u0131s\u0131yla kimsenin bir ba\u015fkas\u0131n\u0131n evine ev halk\u0131n\u0131n izni olmadan habersizce giremeyece\u011fi ilkesini koydu. Bu h\u00fckm\u00fcn toplumda uygulanmas\u0131yla ilgili olarak Hz. Peygamber’in (s.a) getirdi\u011fi d\u00fczenlemeler s\u0131rayla \u015f\u00f6yledir:<\/li>\n<\/ol>\n

    1) “Gizlilik hakk\u0131” yaln\u0131zca evlere giri\u015f sorunuyla ilgili olmay\u0131p, bir evi d\u0131\u015fardan g\u00f6zleme, “dikiz etme” ve hatta ba\u015fkas\u0131n\u0131n mektubunu izinsiz okuman\u0131n yasaklanmas\u0131 gibi noktalar\u0131 da i\u00e7ine almaktad\u0131r. Azadl\u0131s\u0131 Sevban’a g\u00f6re, Hz. Peygamber (s.a) \u015f\u00f6yle buyurmu\u015flard\u0131r: “Sen evin i\u00e7ine bir kez g\u00f6z att\u0131ktan sonra, giri\u015f i\u00e7in izin istemenin ne anlam\u0131 kal\u0131r?” (Ebu Davud) . Hz. Huzeyl bin \u015eurahbil’in rivayetine g\u00f6re, bir adam Hz. Peygamber’i (s.a) g\u00f6rmeye gelir ve tam kap\u0131n\u0131n \u00f6n\u00fcnde dururken giri\u015f izni ister. Hz. Peygamber (s.a) ona \u015funu s\u00f6yler: “Kenarda dur, izin isteme h\u00fckm\u00fcndeki ama\u00e7 evin i\u00e7ine g\u00f6z atmay\u0131 \u00f6nlemektir” (Ebu Davud) Hz. Peygamber’in (s.a) bu konudaki uygulamas\u0131 \u015f\u00f6yleydi:
    \nNe zaman birini g\u00f6rmeye gitse, kap\u0131n\u0131n sa\u011f\u0131nda veya solunda bir kenarda durur ve izin isterdi, o zamanlar kap\u0131lara perde as\u0131lmazd\u0131 (Ebu Davud) Hz. Peygamber’in (s.a) hizmet\u00e7isi Hz. Enes’in anlatt\u0131\u011f\u0131na g\u00f6re, “bir adam d\u0131\u015fardan Hz. Peygamber’in (s.a) odas\u0131na bakar. Bu s\u0131rada Hz. Peygamber’in (s.a) elinde bir ok vard\u0131r ve bu okuyla sanki onu karn\u0131na sapl\u0131yacakm\u0131\u015f gibi adam\u0131n \u00fcst\u00fcne y\u00fcr\u00fcr.” (Ebu Davud) Hz. Abdullah \u0130bn Abbas Hz. Peygamber’in \u015f\u00f6yle dedi\u011fini rivayet ediyor: “Kim izni olmadan karde\u015finin mektubuna bakarsa, ate\u015fe bakm\u0131\u015f olur.” (Ebu Davud) . M\u00fcslim ve Buhari’nin rivayet ettikleri bir hadiste Hz. Peygamber \u015f\u00f6yle buyurur: “E\u011fer bir kimse senin evini dikizler ve sen de ta\u015fla onun g\u00f6z\u00fcn\u00fc yaralarsan, bunun hi\u00e7bir g\u00fcnah\u0131 yoktur.” Bir ba\u015fka hadiste ise \u015f\u00f6yle buyurulur: “Evlerini dikizleyen bir adam\u0131n g\u00f6z\u00fcn\u00fc yaralayan ev halk\u0131na ceza yoktur” \u0130mam \u015eafi\u00ee bu h\u00fckm\u00fc oldu\u011fu gibi alm\u0131\u015f ve bu \u015fekilde davranan bir adam\u0131n g\u00f6z\u00fcn\u00fcn patlat\u0131labilece\u011fine izin vermi\u015ftir. Hanef\u00eeler ise bu h\u00fckm\u00fc \u00e7\u0131plak anlam\u0131yla almazlar. Onlar, d\u0131\u015fardan bir kimsenin, ev sahiplerinin kar\u015f\u0131 koymas\u0131na ra\u011fmen bir eve zorla girmeye \u00e7al\u0131\u015f\u0131r ve bu durumda \u00e7\u0131kan kavgada g\u00f6z\u00fc veya bir ba\u015fka organ\u0131 zarar g\u00f6r\u00fcrse, ev sahiplerine sorumluluk yoktur g\u00f6r\u00fc\u015f\u00fcndedirler. (Ahk\u00e2m\u00fc’l Kur’an, el-Cessas, III: 385) .<\/p>\n

    2) Fakihler, “dinleme”yi de “g\u00f6rmek”le birlikte ele alm\u0131\u015flard\u0131r. S\u00f6zgelimi, k\u00f6r bir adam, izinsiz bir eve girse kimseyi g\u00f6remeyecektir ama, evde olup bitenleri duyarak anlayabilecektir. Bu da, bir ba\u015fkas\u0131n\u0131n gizlilik hakk\u0131n\u0131 ihlal etmektir.<\/p>\n

    3) \u0130zin isteme h\u00fckm\u00fc yaln\u0131zca ki\u015finin ba\u015fkalar\u0131n\u0131n evlerine girmesinde de\u011fil, kendi annesi veya k\u0131zkarde\u015finin evine girmesinde de ge\u00e7erlidir. Bir adam, Hz. Peygamber’e (s.a) : “Efendim, annemin odas\u0131na girerken de izin isteyecek miyim?” diye sorar. Hz. Peygamber (s.a) , “evet” cevab\u0131n\u0131 verir. Adam, annesine kendinden ba\u015fka bakacak kimsenin bulunmad\u0131\u011f\u0131n\u0131 s\u00f6yler ve her giri\u015finde izin isteyecek miyim?” diye sorar. Hz. Peygamber (s.a) \u015f\u00f6yle cevap verir: “Evet, anneni \u00e7\u0131plak durumda g\u00f6rmeyi mi istersin?” (\u0130bn Cerir, Ata bin Yesar’dan) . Abdullah \u0130bn Mes’ud’a g\u00f6re, ki\u015fi annesini veya k\u0131z karde\u015fini g\u00f6rmeye gitti\u011finde bile izin isteyecektir (\u0130bn Kesir) . O’na g\u00f6re, bir ki\u015fi kar\u0131s\u0131 evdeyken eve geldi\u011finde bile, s\u00f6zgelimi \u00f6ks\u00fcrerek geldi\u011fini bildirmelidir. Kar\u0131s\u0131 Zeynep’ten, Abdullah \u0130bn Mes’ud’un her zaman \u00f6ks\u00fcrerek geli\u015fini belli etti\u011fi ve hi\u00e7bir zaman eve aniden girmek istemedi\u011fi rivayet edilmektedir (\u0130bn Cerir) .<\/p>\n

    4) Bu genel kural\u0131n tek istisnas\u0131, h\u0131rs\u0131zl\u0131k, yang\u0131n vs. gibi ani durumlarda izne ihtiya\u00e7 olmamas\u0131d\u0131r. B\u00f6yle durumlarda ki\u015fi yard\u0131m i\u00e7in izinsiz eve girebilir.<\/p>\n

    5) \u0130zin isteme kural\u0131n\u0131n konmas\u0131n\u0131n daha ilk g\u00fcnlerinde, m\u00fcsl\u00fcmanlar, izlenmesi gereken prosed\u00fcr\u00fc iyice bilmiyorlard\u0131. Bu g\u00fcnlerde bir adam Hz. Peygamber’e (s.a) gelmi\u015f ve kap\u0131da “Girebilir miyim?” diye ba\u011f\u0131rm\u0131\u015ft\u0131. Bunun \u00fczerine, Hz. Peygamber (s.a) hizmet\u00e7isi Ravda’ya “Git ve ona do\u011fru \u015fekli g\u00f6ster. ‘es-Sel\u00e2m\u00fc aleyk\u00fcm girebilir miyim?’ desin” buyurdu. (\u0130bn Cerir, Ebu Davud) . Cabir b. Abdullah, bir keresinde babas\u0131n\u0131n bor\u00e7lar\u0131yla ilgili olarak Hz. Peygamber’in (s.a) evine gidip, kap\u0131y\u0131 \u00e7ald\u0131\u011f\u0131n\u0131 ve Hz. Peygamber’in (s.a) “Kim o?” diye sordu\u011funu, kendisinin “Ben’ deyince, Hz. Peygamber’in (s.a) “Ben ben” diye iki veya \u00fc\u00e7 kez tekrarda bulunarak “kim oldu\u011fun b\u00f6yle anla\u015f\u0131l\u0131r m\u0131?” demek istedi\u011fini anlat\u0131r. (Ebu Davud) .<\/p>\n

    Kalade b. Hanbel ad\u0131nda bir adam Hz. Peygamber’i (s.a) g\u00f6rmeye gider ve sel\u00e2m vermeden oturur. Bunun \u00fczerine Hz. Peygamber (s.a) kendisine “git ve es-Sel\u00e2m\u00fc aleyk\u00fcm dedikten sonra gir” der. (Ebu Davud) . B\u00fct\u00fcn bunlardan, izin istemede do\u011fru olan y\u00f6ntemin, \u00f6nce ki\u015finin kimli\u011fini a\u00e7\u0131klamas\u0131, sonra da izin istemesi oldu\u011fu anla\u015f\u0131lmaktad\u0131r. Hz. \u00d6mer’in ne zaman Hz. Peygamber’i (s.a) g\u00f6rmeye gitse, “es-sel\u00e2m\u00fc aleyk\u00fcm ya Rasulallah, ben \u00d6mer girebilir miyim?” dedi\u011fi rivayet olunmaktad\u0131r. (Ebu Davud) . Hz. Peygamber (s.a) en \u00e7ok \u00fc\u00e7 defa izin isteme gere\u011fine h\u00fckmetmi\u015ftir.<\/p>\n

    \u00dc\u00e7\u00fcnc\u00fcde cevap gelmezse geri d\u00f6n\u00fclmelidir. (Buhar\u00ee, M\u00fcslim, Ebu Davud) Hz. Peygamber (s.a) bizzat kendisi b\u00f6yle yapard\u0131. Bir kere Hz. Sa’d bin Ubade’nin evine gitmi\u015f ve iki kez “es-sel\u00e2m\u00fc aleyk\u00fcm ve rahmetullah” diye sel\u00e2m verip izin istemi\u015fti. \u00dc\u00e7\u00fcnc\u00fc defa da izin iste\u011fine herhangi bir cevap gelmeyince d\u00f6n\u00fcp gitmi\u015fti. Ard\u0131ndan Sa’d ko\u015farak gelmi\u015f ve “Ey Allah’\u0131n Ras\u00fbl\u00fc, seni pek\u00e2la duyuyordum, fakat m\u00fcbarek a\u011fz\u0131ndan Allah’\u0131n sel\u00e2m ve rahmetini m\u00fcmk\u00fcn oldu\u011fu kadar s\u0131k ve \u00e7ok almak i\u00e7in yava\u015f sesle cevap veriyordum” demi\u015ftir. (Ebu Davud, \u0130mam Ahmed) . \u00dc\u00e7 defa izin hemen birbiri ard\u0131nca de\u011fil, ev sahiplerine, e\u011fer o anda cevap verebilecek durumda de\u011fillerse, cevap verebilmeleri i\u00e7in gerekli zaman\u0131 tan\u0131mak amac\u0131yla belli aral\u0131klarla istenmelidir.<\/p>\n

    6) Giri\u015f izni ya bizzat ev sahibinden, ya da ev sahibi ad\u0131na izin verebilecek hizmet\u00e7i veya sorumlu \u015fah\u0131s gibi bir ba\u015fka g\u00fcvenilir ki\u015fiden gelmelidir. \u00dc\u00e7 izin iste\u011finden sonra cevap gelmez veya ev sahibi geleni g\u00f6rmek istemezse geri d\u00f6n\u00fcp gidilmelidir. Israrla izin iste\u011finde bulunmak veya reddedildikten sonra da inatla kap\u0131da durmak do\u011fru de\u011fildir.
    \n7) \u0130\u00e7eri girmek i\u00e7in izin almak \u00fczerinde \u0131srar etmek veya reddedildikten sonra bile inatla kap\u0131n\u0131n \u00f6n\u00fcnde beklemeye devam etmek yasakt\u0131r. \u00dc\u00e7 kere kap\u0131y\u0131 \u00e7ald\u0131ktan sonra giri\u015f izni verilmezse veya evsahibi g\u00f6rmek istemedi\u011fini belirtirse geri d\u00f6n\u00fclmelidir.<\/p>\n","protected":false},"excerpt":{"rendered":"
