Hamd Alemlerin Rabbi Rahman ve Rahim din g\u00fcn\u00fcn\u00fcn sahibi t\u00fcm m\u00fckemmel s\u0131fatlara sahip ve noksanl\u0131klardan m\u00fcnezzeh olan kendisinden ba\u015fka Rab ve \u0130lah olmayan Allah c.c\u2019a mahsustur.<\/p>\n

Salat ve selam Alemlere rahmet olarak g\u00f6nderilen m\u00fcminlerin \u00f6rne\u011fi ve \u00f6nderi ya\u015fayan kuran kendisine uyulmad\u0131\u011f\u0131 takdirde kurtulu\u015fun m\u00fcmk\u00fcn olmad\u0131\u011f\u0131 Hz Muhammed sav\u2019e aline ve ashab\u0131na ve onlar\u0131 takip eden muvahhidlerin \u00fczerine olsun in\u015fallah.<\/p>\n

Allah cc insan\u0131 yery\u00fcz\u00fcnde halife olarak yaratm\u0131\u015ft\u0131r ve ona kendi m\u00fclk\u00fcnde Adeleti ayakta tutmay\u0131 emretmi\u015ftir. Zira halife; Allah c.c \u2018\u0131n emir ve yasaklar\u0131na uymak ve uyulmas\u0131 ad\u0131na m\u00fccadele etmekle g\u00f6revli memur anlam\u0131ndad\u0131r.<\/p>\n

\u201cEy Davud! Biz seni yery\u00fcz\u00fcnde h\u00fck\u00fcmdar yapt\u0131k. \u0130nsanlar aras\u0131nda adaletle h\u00fckmet, keyfine uyma, sonra bu seni Allah’\u0131n yolundan sapt\u0131r\u0131r. Allah’\u0131n yolundan sapanlara, hesap g\u00fcn\u00fcn\u00fc unuttuklar\u0131ndan dolay\u0131 \u00e7etin azab vard\u0131r.\u201d (sad 26)<\/em><\/strong><\/p>\n

Demek ki, Bu s\u0131naman\u0131n konusu, yery\u00fcz\u00fcnde halifelik g\u00f6revi, insanlar aras\u0131nda h\u00fckmederken hakka ba\u011fl\u0131l\u0131k, kendi arzu ve iste\u011fine uymamad\u0131r. Bir peygamberin kendi arzusuna uymas\u0131 demek, onun tepkisel olmas\u0131, ara\u015ft\u0131rmamas\u0131, incelememesi, sa\u011fl\u0131kl\u0131 h\u00fckme ula\u015fmak i\u00e7in sab\u0131rl\u0131 ve temkinli olmamas\u0131d\u0131r. B\u00f6ylesi bir hareket mant\u0131\u011f\u0131 esas al\u0131nd\u0131\u011f\u0131nda, sonu\u00e7ta sap\u0131kl\u0131\u011fa d\u00fc\u015f\u00fcl\u00fcr. Sap\u0131kl\u0131\u011f\u0131n sonunu a\u00e7\u0131klayan ayetten sonra gelen b\u00f6l\u00fcm ise, genel bir h\u00fck\u00fcmd\u00fcr. Allah’\u0131n yolundan sapman\u0131n sonu\u00e7lar\u0131m ortaya koymaktad\u0131r. Bu ceza ise, Allah’\u0131n onu unutmas\u0131 ve k\u0131yamet g\u00fcn\u00fcnde onu cezaya \u00e7arpt\u0131rmas\u0131d\u0131r.<\/p>\n

Adalet; D\u00fczenli ve dengeli davranma, her \u015feyin ve herkesin hakk\u0131n\u0131 verme, haks\u0131zl\u0131klardan uzakla\u015farak orta yolu tutma, bir \u015feyi yerli yerine koyma, insaf ve e\u015fitlik anlam\u0131nda bir terimdir. Geni\u015f kapsaml\u0131 bir kavram olan ad\u00e2letin z\u0131tt\u0131 zul\u00fcm,* gadr* ve insafs\u0131zl\u0131kt\u0131r.<\/p>\n

\u0130mam\u0131 \u015fafi r.a nin dedi\u011fine g\u00f6re ise\u201d Adalet; Allah cc.\u2019\u0131n indirdikleri ile amel etmektir.\u201d<\/p>\n

\u0130sl\u00e2m’da ad\u00e2let, hukuk \u00f6n\u00fcnde herkese e\u015fit davranmak, k\u00fclt\u00fcr, bilgi ve mevk\u00ee farkl\u0131l\u0131klar\u0131ndan dolay\u0131 insanlara ba\u015fka ba\u015fka davranmamak demektir. \u0130sl\u00e2m bu anlamda her ferdin ve her toplumun kar\u015f\u0131l\u0131kl\u0131 olarak i\u015flerinde de\u011fi\u015fmez bir \u00f6l\u00e7\u00fc \u015feklinde yerini alm\u0131\u015f, istek ve heveslere yer vermemi\u015f, sevgi ve nefretlere uymam\u0131\u015f, akrabal\u0131k ve yak\u0131nl\u0131k ba\u011flar\u0131na g\u00f6re ayarlanmam\u0131\u015f, zengin-fakir ay\u0131r\u0131m\u0131 g\u00f6zetmemi\u015f, kuvvetli ve zay\u0131f fark\u0131n\u0131 g\u00f6z \u00f6n\u00fcne alm\u0131\u015f bir adalet anlay\u0131\u015f\u0131 getirmi\u015ftir. Bunun i\u00e7in \u0130sl\u00e2m, toplum i\u00e7inde ya\u015fayan b\u00fct\u00fcn kesimlerin birli\u011fini sa\u011flayan prensipler koymu\u015f, \u00fcmmetin g\u00fcvenli\u011fini garanti alt\u0131na alan bir d\u00fczen kurmu\u015ftur.<\/p>\n

“Ey iman edenler adaleti ayakta tutarak Allah i\u00e7in \u015fahitlik* edenler olun. Kendinizin, ana ve baban\u0131z\u0131n aleyhinde bile olsa (\u015fahitlik etti\u011finiz kimseler) zengin veya fakir de olsalar (adaletten ayr\u0131lmay\u0131n). \u00c7\u00fcnk\u00fc Allah ikisine de daha yak\u0131nd\u0131r. Adaleti yerine getirebilmek i\u00e7in hev\u00e2 ve hevesinize uymay\u0131n. E\u011fer e\u011fri davran\u0131r veya y\u00fcz \u00e7evirirseniz, Allah yapt\u0131klar\u0131n\u0131zdan haberdard\u0131r.” (en-Nisa, 4\/135).<\/p>\n

Yery\u00fcz\u00fcndeki bat\u0131l sistemlerin hi\u00e7birisinin d\u00fc\u015fmanlara ve nefret edilen insanlara kar\u015f\u0131, \u0130sl\u00e2m’\u0131n kefil oldu\u011fu mutlak adaleti tekeff\u00fcl edebilmesine imk\u00e2n yoktur. \u0130sl\u00e2m, kendisine inananlar\u0131 bu konuda sadece Allah i\u00e7in hareket etmelerini, aralar\u0131ndaki m\u00fcnasebetlerini Allah’\u0131n r\u0131zas\u0131na uygun bir \u015fekilde ayarlamalar\u0131n\u0131 ve yine Allah i\u00e7in do\u011fru \u015fahitler olmas\u0131n\u0131 emretmektedir. Bu esaslar bu d\u00eenin b\u00fct\u00fcn insanl\u0131k i\u00e7in son din ve m\u00fckemmel bir nizam oldu\u011funu, adaletinden, inanan ve inanmayan b\u00fct\u00fcn insanlar\u0131n yararlanmas\u0131n\u0131 tekeff\u00fcl eden \u00fcst\u00fcn bir hukuk ve y\u00f6netim bi\u00e7imi oldu\u011funu ifadeye yeterlidir. Bu adaleti ger\u00e7ekle\u015ftirme g\u00f6revi m\u00fcsl\u00fcmanlara y\u00fcklenmi\u015f bir g\u00f6revdir. \u0130sl\u00e2m \u00fcmmeti bu ilah\u00ee emri yerine getirdi\u011fi d\u00f6nemlerde yery\u00fcz\u00fc adaletle dolup ta\u015fm\u0131\u015ft\u0131r.<\/p>\n

“…Allah insanlar aras\u0131nda h\u00fck\u00fcm verdi\u011finiz zaman, adaletle h\u00fckmetmenizi emreder.” (en-Nis\u00e2, 4\/58)<\/strong> \u0130l\u00e2h\u00ee emrin hikmeti gayet a\u00e7\u0131kt\u0131r.<\/p>\n

“Ey iman edenler, Allah i\u00e7in \u015fahitlik eden kimseler olunuz. Bir toplulu\u011fa kar\u015f\u0131 duydu\u011funuz kin sizi adaletten sapt\u0131rmas\u0131n. Adil davran\u0131n, takvaya* yak\u0131\u015fan budur. Allah’tan korkun, Allah yapt\u0131klar\u0131n\u0131zdan haberdard\u0131r.” (el-M\u00e2ide, 5\/8).<\/strong><\/p>\n

\u0130sl\u00e2m’\u0131n emretti\u011fi adalet do\u011frultusunda k\u00e2inat\u0131n d\u00fczeninin ayakta durmas\u0131 tabi\u00ee bir hadisedir. Adalet m\u00fclk’\u00fcn temelidir. Adaletin olmad\u0131\u011f\u0131 yerde zul\u00fcm h\u00e2kimdir. Allah ve onun koydu\u011fu b\u00fct\u00fcn h\u00fck\u00fcmler zulm\u00fcn her \u00e7e\u015fidinden uzakt\u0131r. Allah’\u0131n emirlerinin uyguland\u0131\u011f\u0131 bir ortamda hi\u00e7bir kimseye zerre kadar zul\u00fcm yap\u0131lmaz. (bk. en-Nisa, 4\/40). Bu Kur’an-\u0131 Kerim’de s\u0131k s\u0131k tekrarlanan ayetlerle dile getirilmektedir:<\/p>\n

“Allah, adaleti ve ihsan\u0131* emreder. ” (en-Nahl, 16\/90).<\/strong><\/p>\n

“Allah size emanetleri* ehline vermenizi ve insanlar aras\u0131nda h\u00fckmetti\u011finiz zaman, adaletle h\u00fckmetmenizi emreder.” (en-Nisa, 4\/58).<\/strong><\/p>\n

“H\u00fckmetti\u011fin zaman onlar aras\u0131nda adaletle h\u00fckmet. \u015e\u00fcphesiz Allah adil davrananlar\u0131 sever.” (el-M\u00e2ide, 5\/42; ayr\u0131ca bk. el-Hucur\u00e2t, 49\/9).<\/strong><\/p>\n

Hz. Peygamber (s.a.s.) de adalet ve adaletle h\u00fckmedenler hakk\u0131nda bir\u00e7ok had\u00ees buyurmu\u015flard\u0131r:<\/p>\n

“H\u00fckm\u00fcnde, y\u00f6netimi ve vel\u00e2yeti alt\u0131ndakiler hakk\u0131nda ad\u00eel davrananlar, Allah kat\u0131nda nurdan minberler \u00fczerinde olacaklard\u0131r.” (M\u00fcslim, \u0130m\u00e2re, 18).<\/strong><\/p>\n

Hz. Peygamber’in \u0130sl\u00e2m’\u0131 tebli\u011f etmekle g\u00f6revlendirildi\u011fi d\u00f6nemin arefesinde C\u00e2hiliye devri Araplar\u0131 bo\u011faz bo\u011faza, b\u0131\u00e7ak b\u0131\u00e7a\u011fa gelmi\u015f durumdayd\u0131lar. Bir g\u00fcn Mahzumo\u011fullar\u0131 kab\u00eelesine mensup e\u015fraftan F\u00e2t\u0131ma ad\u0131nda bir kad\u0131n\u0131n h\u0131rs\u0131zl\u0131k yapt\u0131\u011f\u0131 s\u00f6ylenerek Peygamberimiz (s.a.s.)’in huzuruna getirilmi\u015fti. Kad\u0131n\u0131n ‘elinin kesilmesi’ne h\u00fckmedildi. Fakat daha \u00f6nceki gelenek ve al\u0131\u015fkanl\u0131klara g\u00f6re Kurey\u015f’ten olan asil bir kad\u0131n hakk\u0131nda su\u00e7 i\u015flemi\u015f olsa dah\u00ee b\u00f6yle bir h\u00fck\u00fcm verilemezdi. H\u00fckm\u00fcn inf\u00e2z\u0131n\u0131n durdurulmas\u0131 i\u00e7in Kurey\u015f’in ileri gelenleri Hz. Peygamber’in \u00e7ok sevdi\u011fi \u00dcs\u00e2me b. Zeyd’i araya koyarak bu kad\u0131n\u0131n affedilmesini istediler. \u00dcs\u00e2me’nin b\u00f6yle bir \u015fefaatte bulunmas\u0131 Hz. Peygamber (s.a.s.)’e \u00e7ok a\u011f\u0131r geldi. Hemen ash\u00e2b\u0131n\u0131 ‘mescid’*de toplay\u0131p bu konuda onlara \u015f\u00f6yle hitap etti:<\/p>\n

“Ey insanlar! Sizden evvel ya\u015fam\u0131\u015f toplumlar\u0131n neden dolay\u0131 yollar\u0131n\u0131 \u015fa\u015f\u0131r\u0131p sapt\u0131klar\u0131n\u0131 biliyor musunuz? Asilz\u00e2deleri bir h\u0131rs\u0131zl\u0131k* yapt\u0131\u011f\u0131 zaman onu affeder, zay\u0131f ve kimsesizleri bir \u015fey \u00e7alarsa onlar\u0131 cezaland\u0131r\u0131rlard\u0131. Allah’a yemin ederim ki, b\u00f6ylesine k\u00f6t\u00fc bir h\u0131rs\u0131zl\u0131\u011f\u0131 Mahzum kabilesine mensup Fat\u0131ma de\u011fil, kendi k\u0131z\u0131m Fat\u0131ma yapm\u0131\u015f olsayd\u0131, kesinlikle onun elini kestirirdim. ” (M\u00fcslim, Hud\u00fbd, 2)<\/strong><\/p>\n

Bug\u00fcnk\u00fc\u00a0 sistemlerde belirli z\u00fcmre ve belirli s\u0131n\u0131flar i\u00e7in dokunulmazl\u0131klar s\u00f6z konusu oldu\u011fu halde \u0130sl\u00e2m hukuku \u00f6n\u00fcnde hi\u00e7 kimsenin bir ayr\u0131cal\u0131\u011f\u0131 ve imtiyaz hakk\u0131 yoktur.<\/p>\n

Adil Halife Hz. \u00d6mer, hil\u00e2feti d\u00f6neminde ash\u00e2btan \u00dcbey b. Ka’b ile aralar\u0131nda bir konuda anla\u015fmazl\u0131k meydana gelmi\u015f ve bu anla\u015fmazl\u0131\u011f\u0131 \u00e7\u00f6zmek \u00fczere o d\u00f6nemin Medine kad\u0131s\u0131 olan Zeyd b. S\u00e2bit*’e gitmi\u015flerdi. Kad\u0131 olan Zeyd hemen devlet ba\u015fkan\u0131 olan Hz. \u00d6mer’e kar\u015f\u0131 sayg\u0131l\u0131 davran\u0131p ona oturmas\u0131 i\u00e7in yere bir minder sermi\u015fti. Fakat adil insan Hz. \u00d6mer bu davran\u0131\u015f kar\u015f\u0131s\u0131nda \u015f\u00f6yle demi\u015fti:<\/p>\n

“\u0130\u015fte bu davran\u0131\u015f\u0131n, \u015fimdi verece\u011fin h\u00fck\u00fcmde yapt\u0131\u011f\u0131n ilk adaletsizliktir. Ben davac\u0131mla beraber ayn\u0131 yerde oturaca\u011f\u0131m.”<\/em><\/p>\n

Sonra davac\u0131 \u00dcbey b. Ka’b davas\u0131n\u0131 ileri s\u00fcr\u00fcnce Hz. \u00d6mer bu iddiay\u0131 kabul etmedi. Bu durum kar\u015f\u0131s\u0131nda Hz. \u00d6mer’in yemin etmesi gerekiyordu. Kad\u0131 Zeyd \u0130bn S\u00e2bit, \u00dcbey’e \u015f\u00f6yle dedi:<\/p>\n

“Gel Halife’yi yemin ettirme, onu bundan muaf tut. Davac\u0131 oldu\u011fun ki\u015fi bir ba\u015fkas\u0131 olsayd\u0131 sana b\u00f6yle bir feragatten s\u00f6z etmezdim.” Bu teklifi duyan Hz. \u00d6mer son derece k\u0131zarak b\u00f6yle bir ayr\u0131cal\u0131\u011f\u0131 kabul etmeyip derhal yemin etti. Sonra da Zeyd b. S\u00e2bit hakk\u0131nda \u015f\u00f6yle dedi:<\/p>\n

“Halife ile herhangi bir m\u00fcsl\u00fcman hakk\u0131nda e\u015fit davranmas\u0131n\u0131 \u00f6\u011frenmedik\u00e7e ona dava g\u00f6t\u00fcr\u00fclmemelidir.\u201d<\/em><\/p>\n

Kendinizin, ana ve baban\u0131z\u0131n aleyhinde bile olsa (\u015fahitlik etti\u011finiz kimseler) zengin veya fakir de olsalar (adaletten ayr\u0131lmay\u0131n). \u00c7\u00fcnk\u00fc Allah ikisine de daha yak\u0131nd\u0131r. Adaleti yerine getirebilmek i\u00e7in hev\u00e2 ve hevesinize uymay\u0131n. E\u011fer e\u011fri davran\u0131r veya y\u00fcz \u00e7evirirseniz, Allah yapt\u0131klar\u0131n\u0131zdan haberdard\u0131r." Bu esaslar bu d\u00eenin b\u00fct\u00fcn insanl\u0131k i\u00e7in son din ve m\u00fckemmel bir nizam oldu\u011funu, adaletinden, inanan ve inanmayan b\u00fct\u00fcn insanlar\u0131n yararlanmas\u0131n\u0131 tekeff\u00fcl eden \u00fcst\u00fcn bir hukuk ve y\u00f6netim bi\u00e7imi oldu\u011funu ifadeye yeterlidir. Ben davac\u0131mla beraber ayn\u0131 yerde oturaca\u011f\u0131m."Sonra davac\u0131 \u00dcbey b. Ka'b davas\u0131n\u0131 ileri s\u00fcr\u00fcnce Hz. \u00d6mer bu iddiay\u0131 kabul etmedi. Bu durum kar\u015f\u0131s\u0131nda Hz. \u00d6mer'in yemin etmesi gerekiyordu. Kad\u0131 Zeyd \u0130bn S\u00e2bit, \u00dcbey'e \u015f\u00f6yle dedi:"Gel Halife'yi yemin ettirme, onu bundan muaf tut. Kendinizin, ana ve baban\u0131z\u0131n aleyhinde bile olsa (\u015fahitlik etti\u011finiz kimseler) zengin veya fakir de olsalar (adaletten ayr\u0131lmay\u0131n). \u00c7\u00fcnk\u00fc Allah ikisine de daha yak\u0131nd\u0131r. Adaleti yerine getirebilmek i\u00e7in hev\u00e2 ve hevesinize uymay\u0131n. E\u011fer e\u011fri davran\u0131r veya y\u00fcz \u00e7evirirseniz, Allah yapt\u0131klar\u0131n\u0131zdan haberdard\u0131r." Fakat daha \u00f6nceki gelenek ve al\u0131\u015fkanl\u0131klara g\u00f6re Kurey\u015f'ten olan asil bir kad\u0131n hakk\u0131nda su\u00e7 i\u015flemi\u015f olsa dah\u00ee b\u00f6yle bir h\u00fck\u00fcm verilemezdi. H\u00fckm\u00fcn inf\u00e2z\u0131n\u0131n durdurulmas\u0131 i\u00e7in Kurey\u015f'in ileri gelenleri Hz. Peygamber'in \u00e7ok sevdi\u011fi \u00dcs\u00e2me b. Zeyd'i araya koyarak bu kad\u0131n\u0131n affedilmesini istediler. \u00dcs\u00e2me'nin b\u00f6yle bir \u015fefaatte bulunmas\u0131 Hz. Peygamber (s.a.s.)'e \u00e7ok a\u011f\u0131r geldi. Hemen ash\u00e2b\u0131n\u0131 'mescid'*de toplay\u0131p bu konuda onlara \u015f\u00f6yle hitap etti:"Ey insanlar! Sizden evvel ya\u015fam\u0131\u015f toplumlar\u0131n neden dolay\u0131 yollar\u0131n\u0131 \u015fa\u015f\u0131r\u0131p sapt\u0131klar\u0131n\u0131 biliyor musunuz? Asilz\u00e2deleri bir h\u0131rs\u0131zl\u0131k* yapt\u0131\u011f\u0131 zaman onu affeder, zay\u0131f ve kimsesizleri bir \u015fey \u00e7alarsa onlar\u0131 cezaland\u0131r\u0131rlard\u0131. Allah'a yemin ederim ki, b\u00f6ylesine k\u00f6t\u00fc bir h\u0131rs\u0131zl\u0131\u011f\u0131 Mahzum kabilesine mensup Fat\u0131ma de\u011fil, kendi k\u0131z\u0131m Fat\u0131ma yapm\u0131\u015f olsayd\u0131, kesinlikle onun elini kestirirdim. Zira halife; Allah c.c \u2018\u0131n emir ve yasaklar\u0131na uymak ve uyulmas\u0131 ad\u0131na m\u00fccadele etmekle g\u00f6revli memur anlam\u0131ndad\u0131r.\u201cEy Davud! Biz seni yery\u00fcz\u00fcnde h\u00fck\u00fcmdar yapt\u0131k. \u0130nsanlar aras\u0131nda adaletle h\u00fckmet, keyfine uyma, sonra bu seni Allah'\u0131n yolundan sapt\u0131r\u0131r. Allah'\u0131n yolundan sapanlara, hesap g\u00fcn\u00fcn\u00fc unuttuklar\u0131ndan dolay\u0131 \u00e7etin azab vard\u0131r.\u201d (sad 26)Demek ki, Bu s\u0131naman\u0131n konusu, yery\u00fcz\u00fcnde halifelik g\u00f6revi, insanlar aras\u0131nda h\u00fckmederken hakka ba\u011fl\u0131l\u0131k, kendi arzu ve iste\u011fine uymamad\u0131r. Bir peygamberin kendi arzusuna uymas\u0131 demek, onun tepkisel olmas\u0131, ara\u015ft\u0131rmamas\u0131, incelememesi, sa\u011fl\u0131kl\u0131 h\u00fckme ula\u015fmak i\u00e7in sab\u0131rl\u0131 ve temkinli olmamas\u0131d\u0131r. B\u00f6ylesi bir hareket mant\u0131\u011f\u0131 esas al\u0131nd\u0131\u011f\u0131nda, sonu\u00e7ta sap\u0131kl\u0131\u011fa d\u00fc\u015f\u00fcl\u00fcr. Sap\u0131kl\u0131\u011f\u0131n sonunu a\u00e7\u0131klayan ayetten sonra gelen b\u00f6l\u00fcm ise, genel bir h\u00fck\u00fcmd\u00fcr. Allah'\u0131n yolundan sapman\u0131n sonu\u00e7lar\u0131m ortaya koymaktad\u0131r. Bu ceza ise, Allah'\u0131n onu unutmas\u0131 ve k\u0131yamet g\u00fcn\u00fcnde onu cezaya \u00e7arpt\u0131rmas\u0131d\u0131r.Adalet; D\u00fczenli ve dengeli davranma, her \u015feyin ve herkesin hakk\u0131n\u0131 verme, haks\u0131zl\u0131klardan uzakla\u015farak orta yolu tutma, bir \u015feyi yerli yerine koyma, insaf ve e\u015fitlik anlam\u0131nda bir terimdir. Geni\u015f kapsaml\u0131 bir kavram olan ad\u00e2letin z\u0131tt\u0131 zul\u00fcm,* gadr* ve insafs\u0131zl\u0131kt\u0131r.\u0130mam\u0131 \u015fafi r.a nin dedi\u011fine g\u00f6re ise\u201d Adalet; Allah cc.\u2019\u0131n indirdikleri ile amel etmektir.\u201d\u0130sl\u00e2m'da ad\u00e2let, hukuk \u00f6n\u00fcnde herkese e\u015fit davranmak, k\u00fclt\u00fcr, bilgi ve mevk\u00ee farkl\u0131l\u0131klar\u0131ndan dolay\u0131 insanlara ba\u015fka ba\u015fka davranmamak demektir. \u0130sl\u00e2m bu anlamda her ferdin ve her toplumun kar\u015f\u0131l\u0131kl\u0131 olarak i\u015flerinde de\u011fi\u015fmez bir \u00f6l\u00e7\u00fc \u015feklinde yerini alm\u0131\u015f, istek ve heveslere yer vermemi\u015f, sevgi ve nefretlere uymam\u0131\u015f, akrabal\u0131k ve yak\u0131nl\u0131k ba\u011flar\u0131na g\u00f6re ayarlanmam\u0131\u015f, zengin-fakir ay\u0131r\u0131m\u0131 g\u00f6zetmemi\u015f, kuvvetli ve zay\u0131f fark\u0131n\u0131 g\u00f6z \u00f6n\u00fcne alm\u0131\u015f bir adalet anlay\u0131\u015f\u0131 getirmi\u015ftir. Bunun i\u00e7in \u0130sl\u00e2m, toplum i\u00e7inde ya\u015fayan b\u00fct\u00fcn kesimlerin birli\u011fini sa\u011flayan prensipler koymu\u015f, \u00fcmmetin g\u00fcvenli\u011fini garanti alt\u0131na alan bir d\u00fczen kurmu\u015ftur.\\\"Ey iman edenler adaleti ayakta tutarak Allah i\u00e7in \u015fahitlik* edenler olun. Kendinizin, ana ve baban\u0131z\u0131n aleyhinde bile olsa (\u015fahitlik etti\u011finiz kimseler) zengin veya fakir de olsalar (adaletten ayr\u0131lmay\u0131n). \u00c7\u00fcnk\u00fc Allah ikisine de daha yak\u0131nd\u0131r. Adaleti yerine getirebilmek i\u00e7in hev\u00e2 ve hevesinize uymay\u0131n. E\u011fer e\u011fri davran\u0131r veya y\u00fcz \u00e7evirirseniz, Allah yapt\u0131klar\u0131n\u0131zdan haberdard\u0131r.\\\" (en-Nisa, 4\/135).Yery\u00fcz\u00fcndeki bat\u0131l sistemlerin hi\u00e7birisinin d\u00fc\u015fmanlara ve nefret edilen insanlara kar\u015f\u0131, \u0130sl\u00e2m'\u0131n kefil oldu\u011fu mutlak adaleti tekeff\u00fcl edebilmesine imk\u00e2n yoktur. \u0130sl\u00e2m, kendisine inananlar\u0131 bu konuda sadece Allah i\u00e7in hareket etmelerini, aralar\u0131ndaki m\u00fcnasebetlerini Allah'\u0131n r\u0131zas\u0131na uygun bir \u015fekilde ayarlamalar\u0131n\u0131 ve yine Allah i\u00e7in do\u011fru \u015fahitler olmas\u0131n\u0131 emretmektedir. Bu esaslar bu d\u00eenin b\u00fct\u00fcn insanl\u0131k i\u00e7in son din ve m\u00fckemmel bir nizam oldu\u011funu, adaletinden, inanan ve inanmayan b\u00fct\u00fcn insanlar\u0131n yararlanmas\u0131n\u0131 tekeff\u00fcl eden \u00fcst\u00fcn bir hukuk ve y\u00f6netim bi\u00e7imi oldu\u011funu ifadeye yeterlidir. Bu adaleti ger\u00e7ekle\u015ftirme g\u00f6revi m\u00fcsl\u00fcmanlara y\u00fcklenmi\u015f bir g\u00f6revdir. \u0130sl\u00e2m \u00fcmmeti bu ilah\u00ee emri yerine getirdi\u011fi d\u00f6nemlerde yery\u00fcz\u00fc adaletle dolup ta\u015fm\u0131\u015ft\u0131r.\\\"...Allah insanlar aras\u0131nda h\u00fck\u00fcm verdi\u011finiz zaman, adaletle h\u00fckmetmenizi emreder.\\\" (en-Nis\u00e2, 4\/58) \u0130l\u00e2h\u00ee emrin hikmeti gayet a\u00e7\u0131kt\u0131r.\\\"Ey iman edenler, Allah i\u00e7in \u015fahitlik eden kimseler olunuz. Bir toplulu\u011fa kar\u015f\u0131 duydu\u011funuz kin sizi adaletten sapt\u0131rmas\u0131n. Adil davran\u0131n, takvaya* yak\u0131\u015fan budur. Allah'tan korkun, Allah yapt\u0131klar\u0131n\u0131zdan haberdard\u0131r.\\\" (el-M\u00e2ide, 5\/8).\u0130sl\u00e2m'\u0131n emretti\u011fi adalet do\u011frultusunda k\u00e2inat\u0131n d\u00fczeninin ayakta durmas\u0131 tabi\u00ee bir hadisedir. Adalet m\u00fclk'\u00fcn temelidir. Adaletin olmad\u0131\u011f\u0131 yerde zul\u00fcm h\u00e2kimdir. Allah ve onun koydu\u011fu b\u00fct\u00fcn h\u00fck\u00fcmler zulm\u00fcn her \u00e7e\u015fidinden uzakt\u0131r. Allah'\u0131n emirlerinin uyguland\u0131\u011f\u0131 bir ortamda hi\u00e7bir kimseye zerre kadar zul\u00fcm yap\u0131lmaz. (bk. en-Nisa, 4\/40). Bu Kur'an-\u0131 Kerim'de s\u0131k s\u0131k tekrarlanan ayetlerle dile getirilmektedir:\\\"Allah, adaleti ve ihsan\u0131* emreder. \\\" (en-Nahl, 16\/90).\\\"Allah size emanetleri* ehline vermenizi ve insanlar aras\u0131nda h\u00fckmetti\u011finiz zaman, adaletle h\u00fckmetmenizi emreder.\\\" (en-Nisa, 4\/58).\\\"H\u00fckmetti\u011fin zaman onlar aras\u0131nda adaletle h\u00fckmet. \u015e\u00fcphesiz Allah adil davrananlar\u0131 sever.\\\" (el-M\u00e2ide, 5\/42; ayr\u0131ca bk. el-Hucur\u00e2t, 49\/9).Hz. Peygamber (s.a.s.) de adalet ve adaletle h\u00fckmedenler hakk\u0131nda bir\u00e7ok had\u00ees buyurmu\u015flard\u0131r:\\\"H\u00fckm\u00fcnde, y\u00f6netimi ve vel\u00e2yeti alt\u0131ndakiler hakk\u0131nda ad\u00eel davrananlar, Allah kat\u0131nda nurdan minberler \u00fczerinde olacaklard\u0131r.\\\" (M\u00fcslim, \u0130m\u00e2re, 18).Hz. Peygamber'in \u0130sl\u00e2m'\u0131 tebli\u011f etmekle g\u00f6revlendirildi\u011fi d\u00f6nemin arefesinde C\u00e2hiliye devri Araplar\u0131 bo\u011faz bo\u011faza, b\u0131\u00e7ak b\u0131\u00e7a\u011fa gelmi\u015f durumdayd\u0131lar. Adaletsizli\u011fin, zulm\u00fcn kol gezdi\u011fi bir d\u00f6nemde \u0130sl\u00e2m gelmi\u015f ve yepyeni bir toplum ortaya \u00e7\u0131km\u0131\u015ft\u0131. Zengin-fakir, efendi-k\u00f6le ay\u0131r\u0131m\u0131n\u0131n yap\u0131lmad\u0131\u011f\u0131, haktan asla ayr\u0131lman\u0131n s\u00f6z konusu olmad\u0131\u011f\u0131 bir toplum olu\u015fmu\u015ftu.Bir g\u00fcn Mahzumo\u011fullar\u0131 kab\u00eelesine mensup e\u015fraftan F\u00e2t\u0131ma ad\u0131nda bir kad\u0131n\u0131n h\u0131rs\u0131zl\u0131k yapt\u0131\u011f\u0131 s\u00f6ylenerek Peygamberimiz (s.a.s.)'in huzuruna getirilmi\u015fti. Kad\u0131n\u0131n 'elinin kesilmesi'ne h\u00fckmedildi. Fakat daha \u00f6nceki gelenek ve al\u0131\u015fkanl\u0131klara g\u00f6re Kurey\u015f'ten olan asil bir kad\u0131n hakk\u0131nda su\u00e7 i\u015flemi\u015f olsa dah\u00ee b\u00f6yle bir h\u00fck\u00fcm verilemezdi. H\u00fckm\u00fcn inf\u00e2z\u0131n\u0131n durdurulmas\u0131 i\u00e7in Kurey\u015f'in ileri gelenleri Hz. Peygamber'in \u00e7ok sevdi\u011fi \u00dcs\u00e2me b. Zeyd'i araya koyarak bu kad\u0131n\u0131n affedilmesini istediler. \u00dcs\u00e2me'nin b\u00f6yle bir \u015fefaatte bulunmas\u0131 Hz. Peygamber (s.a.s.)'e \u00e7ok a\u011f\u0131r geldi. Hemen ash\u00e2b\u0131n\u0131 'mescid'*de toplay\u0131p bu konuda onlara \u015f\u00f6yle hitap etti:\\\"Ey insanlar! Sizden evvel ya\u015fam\u0131\u015f toplumlar\u0131n neden dolay\u0131 yollar\u0131n\u0131 \u015fa\u015f\u0131r\u0131p sapt\u0131klar\u0131n\u0131 biliyor musunuz? Asilz\u00e2deleri bir h\u0131rs\u0131zl\u0131k* yapt\u0131\u011f\u0131 zaman onu affeder, zay\u0131f ve kimsesizleri bir \u015fey \u00e7alarsa onlar\u0131 cezaland\u0131r\u0131rlard\u0131. Allah'a yemin ederim ki, b\u00f6ylesine k\u00f6t\u00fc bir h\u0131rs\u0131zl\u0131\u011f\u0131 Mahzum kabilesine mensup Fat\u0131ma de\u011fil, kendi k\u0131z\u0131m Fat\u0131ma yapm\u0131\u015f olsayd\u0131, kesinlikle onun elini kestirirdim. \\\" (M\u00fcslim, Hud\u00fbd, 2)Bug\u00fcnk\u00fc\u00a0 sistemlerde belirli z\u00fcmre ve belirli s\u0131n\u0131flar i\u00e7in dokunulmazl\u0131klar s\u00f6z konusu oldu\u011fu halde \u0130sl\u00e2m hukuku \u00f6n\u00fcnde hi\u00e7 kimsenin bir ayr\u0131cal\u0131\u011f\u0131 ve imtiyaz hakk\u0131 yoktur.Adil Halife Hz. \u00d6mer, hil\u00e2feti d\u00f6neminde ash\u00e2btan \u00dcbey b. Ka'b ile aralar\u0131nda bir konuda anla\u015fmazl\u0131k meydana gelmi\u015f ve bu anla\u015fmazl\u0131\u011f\u0131 \u00e7\u00f6zmek \u00fczere o d\u00f6nemin Medine kad\u0131s\u0131 olan Zeyd b. S\u00e2bit*'e gitmi\u015flerdi. Kad\u0131 olan Zeyd hemen devlet ba\u015fkan\u0131 olan Hz. \u00d6mer'e kar\u015f\u0131 sayg\u0131l\u0131 davran\u0131p ona oturmas\u0131 i\u00e7in yere bir minder sermi\u015fti. Fakat adil insan Hz. \u00d6mer bu davran\u0131\u015f kar\u015f\u0131s\u0131nda \u015f\u00f6yle demi\u015fti:\\\"\u0130\u015fte bu davran\u0131\u015f\u0131n, \u015fimdi verece\u011fin h\u00fck\u00fcmde yapt\u0131\u011f\u0131n ilk adaletsizliktir. Ben davac\u0131mla beraber ayn\u0131 yerde oturaca\u011f\u0131m.\\\"Sonra davac\u0131 \u00dcbey b. Ka'b davas\u0131n\u0131 ileri s\u00fcr\u00fcnce Hz. \u00d6mer bu iddiay\u0131 kabul etmedi. Bu durum kar\u015f\u0131s\u0131nda Hz. \u00d6mer'in yemin etmesi gerekiyordu. Kad\u0131 Zeyd \u0130bn S\u00e2bit, \u00dcbey'e \u015f\u00f6yle dedi:\\\"Gel Halife'yi yemin ettirme, onu bundan muaf tut. Davac\u0131 oldu\u011fun ki\u015fi bir ba\u015fkas\u0131 olsayd\u0131 sana b\u00f6yle bir feragatten s\u00f6z etmezdim.\\\" Bu teklifi duyan Hz. \u00d6mer son derece k\u0131zarak b\u00f6yle bir ayr\u0131cal\u0131\u011f\u0131 kabul etmeyip derhal yemin etti. Sonra da Zeyd b. S\u00e2bit hakk\u0131nda \u015f\u00f6yle dedi:\\\"Halife ile herhangi bir m\u00fcsl\u00fcman hakk\u0131nda e\u015fit davranmas\u0131n\u0131 \u00f6\u011frenmedik\u00e7e ona dava g\u00f6t\u00fcr\u00fclmemelidir.\u201d\u015euras\u0131 unutulmamal\u0131d\u0131r ki insan\u0131 var eden Allah onun f\u0131trat\u0131n\u0131 da en iyi tan\u0131yan ve o f\u0131trat\u0131n arad\u0131\u011f\u0131 saadeti onun i\u00e7in indirdi\u011fi nizamla belirleyen de yine O dur. O halde insan Allah\u2019\u0131n yaratt\u0131\u011f\u0131 m\u00fclkte O\u2019nun verdi\u011fi r\u0131z\u0131klarla hayat\u0131n\u0131 devam ettirdi\u011fini unutmamal\u0131 ve M\u00fclk\u00fcn sahibinin indirdi\u011fi nizama yani Kurana uygun bir hayat ya\u015fal\u0131 ki d\u00fcnyada da ahrette de huzura erenlerden olabilsin. Aksi taktirde d\u00fcnyada da Ahirette de zillete mahkum olacakt\u0131r. Bunun i\u00e7in \u0130sl\u00e2m, toplum i\u00e7inde ya\u015fayan b\u00fct\u00fcn kesimlerin birli\u011fini sa\u011flayan prensipler koymu\u015f, \u00fcmmetin g\u00fcvenli\u011fini garanti alt\u0131na alan bir d\u00fczen kurmu\u015ftur.\"Ey iman edenler adaleti ayakta tutarak Allah i\u00e7in \u015fahitlik* edenler olun. Kendinizin, ana ve baban\u0131z\u0131n aleyhinde bile olsa (\u015fahitlik etti\u011finiz kimseler) zengin veya fakir de olsalar (adaletten ayr\u0131lmay\u0131n). \u00c7\u00fcnk\u00fc Allah ikisine de daha yak\u0131nd\u0131r. Adaleti yerine getirebilmek i\u00e7in hev\u00e2 ve hevesinize uymay\u0131n. E\u011fer e\u011fri davran\u0131r veya y\u00fcz \u00e7evirirseniz, Allah yapt\u0131klar\u0131n\u0131zdan haberdard\u0131r.\" (en-Nisa, 4\/135).Yery\u00fcz\u00fcndeki bat\u0131l sistemlerin hi\u00e7birisinin d\u00fc\u015fmanlara ve nefret edilen insanlara kar\u015f\u0131, \u0130sl\u00e2m'\u0131n kefil oldu\u011fu mutlak adaleti tekeff\u00fcl edebilmesine imk\u00e2n yoktur. \u0130sl\u00e2m, kendisine inananlar\u0131 bu konuda sadece Allah i\u00e7in hareket etmelerini, aralar\u0131ndaki m\u00fcnasebetlerini Allah'\u0131n r\u0131zas\u0131na uygun bir \u015fekilde ayarlamalar\u0131n\u0131 ve yine Allah i\u00e7in do\u011fru \u015fahitler olmas\u0131n\u0131 emretmektedir. Bu esaslar bu d\u00eenin b\u00fct\u00fcn insanl\u0131k i\u00e7in son din ve m\u00fckemmel bir nizam oldu\u011funu, adaletinden, inanan ve inanmayan b\u00fct\u00fcn insanlar\u0131n yararlanmas\u0131n\u0131 tekeff\u00fcl eden \u00fcst\u00fcn bir hukuk ve y\u00f6netim bi\u00e7imi oldu\u011funu ifadeye yeterlidir. Bu adaleti ger\u00e7ekle\u015ftirme g\u00f6revi m\u00fcsl\u00fcmanlara y\u00fcklenmi\u015f bir g\u00f6revdir. \u0130sl\u00e2m \u00fcmmeti bu ilah\u00ee emri yerine getirdi\u011fi d\u00f6nemlerde yery\u00fcz\u00fc adaletle dolup ta\u015fm\u0131\u015ft\u0131r.\"...Allah insanlar aras\u0131nda h\u00fck\u00fcm verdi\u011finiz zaman, adaletle h\u00fckmetmenizi emreder.\" (en-Nis\u00e2, 4\/58) \u0130l\u00e2h\u00ee emrin hikmeti gayet a\u00e7\u0131kt\u0131r.\"Ey iman edenler, Allah i\u00e7in \u015fahitlik eden kimseler olunuz. Allah ve onun koydu\u011fu b\u00fct\u00fcn h\u00fck\u00fcmler zulm\u00fcn her \u00e7e\u015fidinden uzakt\u0131r. Allah'\u0131n emirlerinin uyguland\u0131\u011f\u0131 bir ortamda hi\u00e7bir kimseye zerre kadar zul\u00fcm yap\u0131lmaz. (bk. en-Nisa, 4\/40). Bu Kur'an-\u0131 Kerim'de s\u0131k s\u0131k tekrarlanan ayetlerle dile getirilmektedir:\"Allah, adaleti ve ihsan\u0131* emreder. \" (en-Nahl, 16\/90).\"Allah size emanetleri* ehline vermenizi ve insanlar aras\u0131nda h\u00fckmetti\u011finiz zaman, adaletle h\u00fckmetmenizi emreder.\" (en-Nisa, 4\/58).\"H\u00fckmetti\u011fin zaman onlar aras\u0131nda adaletle h\u00fckmet. \u015e\u00fcphesiz Allah adil davrananlar\u0131 sever.\" (el-M\u00e2ide, 5\/42; ayr\u0131ca bk. el-Hucur\u00e2t, 49\/9).Hz. Peygamber (s.a.s.) de adalet ve adaletle h\u00fckmedenler hakk\u0131nda bir\u00e7ok had\u00ees buyurmu\u015flard\u0131r:\"H\u00fckm\u00fcnde, y\u00f6netimi ve vel\u00e2yeti alt\u0131ndakiler hakk\u0131nda ad\u00eel davrananlar, Allah kat\u0131nda nurdan minberler \u00fczerinde olacaklard\u0131r.\" (M\u00fcslim, \u0130m\u00e2re, 18).Hz. Peygamber'in \u0130sl\u00e2m'\u0131 tebli\u011f etmekle g\u00f6revlendirildi\u011fi d\u00f6nemin arefesinde C\u00e2hiliye devri Araplar\u0131 bo\u011faz bo\u011faza, b\u0131\u00e7ak b\u0131\u00e7a\u011fa gelmi\u015f durumdayd\u0131lar. Adaletsizli\u011fin, zulm\u00fcn kol gezdi\u011fi bir d\u00f6nemde \u0130sl\u00e2m gelmi\u015f ve yepyeni bir toplum ortaya \u00e7\u0131km\u0131\u015ft\u0131. Zengin-fakir, efendi-k\u00f6le ay\u0131r\u0131m\u0131n\u0131n yap\u0131lmad\u0131\u011f\u0131, haktan asla ayr\u0131lman\u0131n s\u00f6z konusu olmad\u0131\u011f\u0131 bir toplum olu\u015fmu\u015ftu.Bir g\u00fcn Mahzumo\u011fullar\u0131 kab\u00eelesine mensup e\u015fraftan F\u00e2t\u0131ma ad\u0131nda bir kad\u0131n\u0131n h\u0131rs\u0131zl\u0131k yapt\u0131\u011f\u0131 s\u00f6ylenerek Peygamberimiz (s.a.s.)'in huzuruna getirilmi\u015fti. Kad\u0131n\u0131n 'elinin kesilmesi'ne h\u00fckmedildi. Fakat daha \u00f6nceki gelenek ve al\u0131\u015fkanl\u0131klara g\u00f6re Kurey\u015f'ten olan asil bir kad\u0131n hakk\u0131nda su\u00e7 i\u015flemi\u015f olsa dah\u00ee b\u00f6yle bir h\u00fck\u00fcm verilemezdi. H\u00fckm\u00fcn inf\u00e2z\u0131n\u0131n durdurulmas\u0131 i\u00e7in Kurey\u015f'in ileri gelenleri Hz. Peygamber'in \u00e7ok sevdi\u011fi \u00dcs\u00e2me b. Zeyd'i araya koyarak bu kad\u0131n\u0131n affedilmesini istediler. \u00dcs\u00e2me'nin b\u00f6yle bir \u015fefaatte bulunmas\u0131 Hz. Peygamber (s.a.s.)'e \u00e7ok a\u011f\u0131r geldi. Hemen ash\u00e2b\u0131n\u0131 'mescid'*de toplay\u0131p bu konuda onlara \u015f\u00f6yle hitap etti:\"Ey insanlar! Sizden evvel ya\u015fam\u0131\u015f toplumlar\u0131n neden dolay\u0131 yollar\u0131n\u0131 \u015fa\u015f\u0131r\u0131p sapt\u0131klar\u0131n\u0131 biliyor musunuz? Asilz\u00e2deleri bir h\u0131rs\u0131zl\u0131k* yapt\u0131\u011f\u0131 zaman onu affeder, zay\u0131f ve kimsesizleri bir \u015fey \u00e7alarsa onlar\u0131 cezaland\u0131r\u0131rlard\u0131. Allah'a yemin ederim ki, b\u00f6ylesine k\u00f6t\u00fc bir h\u0131rs\u0131zl\u0131\u011f\u0131 Mahzum kabilesine mensup Fat\u0131ma de\u011fil, kendi k\u0131z\u0131m Fat\u0131ma yapm\u0131\u015f olsayd\u0131, kesinlikle onun elini kestirirdim. \" (M\u00fcslim, Hud\u00fbd, 2)Bug\u00fcnk\u00fc\u00a0 sistemlerde belirli z\u00fcmre ve belirli s\u0131n\u0131flar i\u00e7in dokunulmazl\u0131klar s\u00f6z konusu oldu\u011fu halde \u0130sl\u00e2m hukuku \u00f6n\u00fcnde hi\u00e7 kimsenin bir ayr\u0131cal\u0131\u011f\u0131 ve imtiyaz hakk\u0131 yoktur.Adil Halife Hz. \u00d6mer, hil\u00e2feti d\u00f6neminde ash\u00e2btan \u00dcbey b. Ka'b ile aralar\u0131nda bir konuda anla\u015fmazl\u0131k meydana gelmi\u015f ve bu anla\u015fmazl\u0131\u011f\u0131 \u00e7\u00f6zmek \u00fczere o d\u00f6nemin Medine kad\u0131s\u0131 olan Zeyd b. S\u00e2bit*'e gitmi\u015flerdi. Kad\u0131 olan Zeyd hemen devlet ba\u015fkan\u0131 olan Hz. \u00d6mer'e kar\u015f\u0131 sayg\u0131l\u0131 davran\u0131p ona oturmas\u0131 i\u00e7in yere bir minder sermi\u015fti. Fakat adil insan Hz. \u00d6mer bu davran\u0131\u015f kar\u015f\u0131s\u0131nda \u015f\u00f6yle demi\u015fti:\"\u0130\u015fte bu davran\u0131\u015f\u0131n, \u015fimdi verece\u011fin h\u00fck\u00fcmde yapt\u0131\u011f\u0131n ilk adaletsizliktir. Ben davac\u0131mla beraber ayn\u0131 yerde oturaca\u011f\u0131m.\"Sonra davac\u0131 \u00dcbey b. Ka'b davas\u0131n\u0131 ileri s\u00fcr\u00fcnce Hz. \u00d6mer bu iddiay\u0131 kabul etmedi. Bu durum kar\u015f\u0131s\u0131nda Hz. \u00d6mer'in yemin etmesi gerekiyordu. Kad\u0131 Zeyd \u0130bn S\u00e2bit, \u00dcbey'e \u015f\u00f6yle dedi:\"Gel Halife'yi yemin ettirme, onu bundan muaf tut. Davac\u0131 oldu\u011fun ki\u015fi bir ba\u015fkas\u0131 olsayd\u0131 sana b\u00f6yle bir feragatten s\u00f6z etmezdim.\" Bu teklifi duyan Hz. \u00d6mer son derece k\u0131zarak b\u00f6yle bir ayr\u0131cal\u0131\u011f\u0131 kabul etmeyip derhal yemin etti. Sonra da Zeyd b. S\u00e2bit hakk\u0131nda \u015f\u00f6yle dedi:\"Halife ile herhangi bir m\u00fcsl\u00fcman hakk\u0131nda e\u015fit davranmas\u0131n\u0131 \u00f6\u011frenmedik\u00e7e ona dava g\u00f6t\u00fcr\u00fclmemelidir.\u201d\u015euras\u0131 unutulmamal\u0131d\u0131r ki insan\u0131 var eden Allah onun f\u0131trat\u0131n\u0131 da en iyi tan\u0131yan ve o f\u0131trat\u0131n arad\u0131\u011f\u0131 saadeti onun i\u00e7in indirdi\u011fi nizamla belirleyen de yine O dur. O halde insan Allah\u2019\u0131n yaratt\u0131\u011f\u0131 m\u00fclkte O\u2019nun verdi\u011fi r\u0131z\u0131klarla hayat\u0131n\u0131 devam ettirdi\u011fini unutmamal\u0131 ve M\u00fclk\u00fcn sahibinin indirdi\u011fi nizama yani Kurana uygun bir hayat ya\u015fal\u0131 ki d\u00fcnyada da ahrette de huzura erenlerden olabilsin. Aksi taktirde d\u00fcnyada da Ahirette de zillete mahkum olacakt\u0131r. Bu esaslar bu d\u00eenin b\u00fct\u00fcn insanl\u0131k i\u00e7in son din ve m\u00fckemmel bir nizam oldu\u011funu, adaletinden, inanan ve inanmayan b\u00fct\u00fcn insanlar\u0131n yararlanmas\u0131n\u0131 tekeff\u00fcl eden \u00fcst\u00fcn bir hukuk ve y\u00f6netim bi\u00e7imi oldu\u011funu ifadeye yeterlidir. Allah'\u0131n emirlerinin uyguland\u0131\u011f\u0131 bir ortamda hi\u00e7bir kimseye zerre kadar zul\u00fcm yap\u0131lmaz. (bk. en-Nisa, 4\/40). Kad\u0131n\u0131n 'elinin kesilmesi'ne h\u00fckmedildi. Fakat daha \u00f6nceki gelenek ve al\u0131\u015fkanl\u0131klara g\u00f6re Kurey\u015f'ten olan asil bir kad\u0131n hakk\u0131nda su\u00e7 i\u015flemi\u015f olsa dah\u00ee b\u00f6yle bir h\u00fck\u00fcm verilemezdi. H\u00fckm\u00fcn inf\u00e2z\u0131n\u0131n durdurulmas\u0131 i\u00e7in Kurey\u015f'in ileri gelenleri Hz. Peygamber'in \u00e7ok sevdi\u011fi \u00dcs\u00e2me b. Zeyd'i araya koyarak bu kad\u0131n\u0131n affedilmesini istediler. \u00dcs\u00e2me'nin b\u00f6yle bir \u015fefaatte bulunmas\u0131 Hz. Peygamber (s.a.s.)'e \u00e7ok a\u011f\u0131r geldi. Hemen ash\u00e2b\u0131n\u0131 'mescid'*de toplay\u0131p bu konuda onlara \u015f\u00f6yle hitap etti:\"Ey insanlar! Sizden evvel ya\u015fam\u0131\u015f toplumlar\u0131n neden dolay\u0131 yollar\u0131n\u0131 \u015fa\u015f\u0131r\u0131p sapt\u0131klar\u0131n\u0131 biliyor musunuz? Asilz\u00e2deleri bir h\u0131rs\u0131zl\u0131k* yapt\u0131\u011f\u0131 zaman onu affeder, zay\u0131f ve kimsesizleri bir \u015fey \u00e7alarsa onlar\u0131 cezaland\u0131r\u0131rlard\u0131. Allah'a yemin ederim ki, b\u00f6ylesine k\u00f6t\u00fc bir h\u0131rs\u0131zl\u0131\u011f\u0131 Mahzum kabilesine mensup Fat\u0131ma de\u011fil, kendi k\u0131z\u0131m Fat\u0131ma yapm\u0131\u015f olsayd\u0131, kesinlikle onun elini kestirirdim. \" (M\u00fcslim, Hud\u00fbd, 2)Bug\u00fcnk\u00fc\u00a0 sistemlerde belirli z\u00fcmre ve belirli s\u0131n\u0131flar i\u00e7in dokunulmazl\u0131klar s\u00f6z konusu oldu\u011fu halde \u0130sl\u00e2m hukuku \u00f6n\u00fcnde hi\u00e7 kimsenin bir ayr\u0131cal\u0131\u011f\u0131 ve imtiyaz hakk\u0131 yoktur.Adil Halife Hz. \u00d6mer, hil\u00e2feti d\u00f6neminde ash\u00e2btan \u00dcbey b. Ka'b ile aralar\u0131nda bir konuda anla\u015fmazl\u0131k meydana gelmi\u015f ve bu anla\u015fmazl\u0131\u011f\u0131 \u00e7\u00f6zmek \u00fczere o d\u00f6nemin Medine kad\u0131s\u0131 olan Zeyd b. S\u00e2bit*'e gitmi\u015flerdi. Kad\u0131 olan Zeyd hemen devlet ba\u015fkan\u0131 olan Hz. \u00d6mer'e kar\u015f\u0131 sayg\u0131l\u0131 davran\u0131p ona oturmas\u0131 i\u00e7in yere bir minder sermi\u015fti. Fakat adil insan Hz. \u00d6mer bu davran\u0131\u015f kar\u015f\u0131s\u0131nda \u015f\u00f6yle demi\u015fti:\"\u0130\u015fte bu davran\u0131\u015f\u0131n, \u015fimdi verece\u011fin h\u00fck\u00fcmde yapt\u0131\u011f\u0131n ilk adaletsizliktir. Ben davac\u0131mla beraber ayn\u0131 yerde oturaca\u011f\u0131m.\"Sonra davac\u0131 \u00dcbey b. Ka'b davas\u0131n\u0131 ileri s\u00fcr\u00fcnce Hz. \u00d6mer bu iddiay\u0131 kabul etmedi. Bu durum kar\u015f\u0131s\u0131nda Hz. \u00d6mer'in yemin etmesi gerekiyordu. Kad\u0131 Zeyd \u0130bn S\u00e2bit, \u00dcbey'e \u015f\u00f6yle dedi:\"Gel Halife'yi yemin ettirme, onu bundan muaf tut. Davac\u0131 oldu\u011fun ki\u015fi bir ba\u015fkas\u0131 olsayd\u0131 sana b\u00f6yle bir feragatten s\u00f6z etmezdim.\" Bu teklifi duyan Hz. \u00d6mer son derece k\u0131zarak b\u00f6yle bir ayr\u0131cal\u0131\u011f\u0131 kabul etmeyip derhal yemin etti. Sonra da Zeyd b. S\u00e2bit hakk\u0131nda \u015f\u00f6yle dedi:\"Halife ile herhangi bir m\u00fcsl\u00fcman hakk\u0131nda e\u015fit davranmas\u0131n\u0131 \u00f6\u011frenmedik\u00e7e ona dava g\u00f6t\u00fcr\u00fclmemelidir.\u201d\u015euras\u0131 unutulmamal\u0131d\u0131r ki insan\u0131 var eden Allah onun f\u0131trat\u0131n\u0131 da en iyi tan\u0131yan ve o f\u0131trat\u0131n arad\u0131\u011f\u0131 saadeti onun i\u00e7in indirdi\u011fi nizamla belirleyen de yine O dur. Allah'\u0131n yolundan sapanlara, hesap g\u00fcn\u00fcn\u00fc unuttuklar\u0131ndan dolay\u0131 \u00e7etin azab vard\u0131r.\u201d (sad 26)Demek ki, Bu s\u0131naman\u0131n konusu, yery\u00fcz\u00fcnde halifelik g\u00f6revi, insanlar aras\u0131nda h\u00fckmederken hakka ba\u011fl\u0131l\u0131k, kendi arzu ve iste\u011fine uymamad\u0131r. Bir peygamberin kendi arzusuna uymas\u0131 demek, onun tepkisel olmas\u0131, ara\u015ft\u0131rmamas\u0131, incelememesi, sa\u011fl\u0131kl\u0131 h\u00fckme ula\u015fmak i\u00e7in sab\u0131rl\u0131 ve temkinli olmamas\u0131d\u0131r. B\u00f6ylesi bir hareket mant\u0131\u011f\u0131 esas al\u0131nd\u0131\u011f\u0131nda, sonu\u00e7ta sap\u0131kl\u0131\u011fa d\u00fc\u015f\u00fcl\u00fcr. Sap\u0131kl\u0131\u011f\u0131n sonunu a\u00e7\u0131klayan ayetten sonra gelen b\u00f6l\u00fcm ise, genel bir h\u00fck\u00fcmd\u00fcr. Allah'\u0131n yolundan sapman\u0131n sonu\u00e7lar\u0131m ortaya koymaktad\u0131r. Bu ceza ise, Allah'\u0131n onu unutmas\u0131 ve k\u0131yamet g\u00fcn\u00fcnde onu cezaya \u00e7arpt\u0131rmas\u0131d\u0131r.Adalet; D\u00fczenli ve dengeli davranma, her \u015feyin ve herkesin hakk\u0131n\u0131 verme, haks\u0131zl\u0131klardan uzakla\u015farak orta yolu tutma, bir \u015feyi yerli yerine koyma, insaf ve e\u015fitlik anlam\u0131nda bir terimdir. Geni\u015f kapsaml\u0131 bir kavram olan ad\u00e2letin z\u0131tt\u0131 zul\u00fcm,* gadr* ve insafs\u0131zl\u0131kt\u0131r.\u0130mam\u0131 \u015fafi r.a nin dedi\u011fine g\u00f6re ise\u201d Adalet; Allah cc.\u2019\u0131n indirdikleri ile amel etmektir.\u201d\u0130sl\u00e2m'da ad\u00e2let, hukuk \u00f6n\u00fcnde herkese e\u015fit davranmak, k\u00fclt\u00fcr, bilgi ve mevk\u00ee farkl\u0131l\u0131klar\u0131ndan dolay\u0131 insanlara ba\u015fka ba\u015fka davranmamak demektir. \u0130sl\u00e2m bu anlamda her ferdin ve her toplumun kar\u015f\u0131l\u0131kl\u0131 olarak i\u015flerinde de\u011fi\u015fmez bir \u00f6l\u00e7\u00fc \u015feklinde yerini alm\u0131\u015f, istek ve heveslere yer vermemi\u015f, sevgi ve nefretlere uymam\u0131\u015f, akrabal\u0131k ve yak\u0131nl\u0131k ba\u011flar\u0131na g\u00f6re ayarlanmam\u0131\u015f, zengin-fakir ay\u0131r\u0131m\u0131 g\u00f6zetmemi\u015f, kuvvetli ve zay\u0131f fark\u0131n\u0131 g\u00f6z \u00f6n\u00fcne alm\u0131\u015f bir adalet anlay\u0131\u015f\u0131 getirmi\u015ftir. Bunun i\u00e7in \u0130sl\u00e2m, toplum i\u00e7inde ya\u015fayan b\u00fct\u00fcn kesimlerin birli\u011fini sa\u011flayan prensipler koymu\u015f, \u00fcmmetin g\u00fcvenli\u011fini garanti alt\u0131na alan bir d\u00fczen kurmu\u015ftur.\"Ey iman edenler adaleti ayakta tutarak Allah i\u00e7in \u015fahitlik* edenler olun. Kendinizin, ana ve baban\u0131z\u0131n aleyhinde bile olsa (\u015fahitlik etti\u011finiz kimseler) zengin veya fakir de olsalar (adaletten ayr\u0131lmay\u0131n). \u00c7\u00fcnk\u00fc Allah ikisine de daha yak\u0131nd\u0131r. Adaleti yerine getirebilmek i\u00e7in hev\u00e2 ve hevesinize uymay\u0131n. E\u011fer e\u011fri davran\u0131r veya y\u00fcz \u00e7evirirseniz, Allah yapt\u0131klar\u0131n\u0131zdan haberdard\u0131r.\" (en-Nisa, 4\/135).Yery\u00fcz\u00fcndeki bat\u0131l sistemlerin hi\u00e7birisinin d\u00fc\u015fmanlara ve nefret edilen insanlara kar\u015f\u0131, \u0130sl\u00e2m'\u0131n kefil oldu\u011fu mutlak adaleti tekeff\u00fcl edebilmesine imk\u00e2n yoktur. \u0130sl\u00e2m, kendisine inananlar\u0131 bu konuda sadece Allah i\u00e7in hareket etmelerini, aralar\u0131ndaki m\u00fcnasebetlerini Allah'\u0131n r\u0131zas\u0131na uygun bir \u015fekilde ayarlamalar\u0131n\u0131 ve yine Allah i\u00e7in do\u011fru \u015fahitler olmas\u0131n\u0131 emretmektedir. Bu esaslar bu d\u00eenin b\u00fct\u00fcn insanl\u0131k i\u00e7in son din ve m\u00fckemmel bir nizam oldu\u011funu, adaletinden, inanan ve inanmayan b\u00fct\u00fcn insanlar\u0131n yararlanmas\u0131n\u0131 tekeff\u00fcl eden \u00fcst\u00fcn bir hukuk ve y\u00f6netim bi\u00e7imi oldu\u011funu ifadeye yeterlidir. Bu adaleti ger\u00e7ekle\u015ftirme g\u00f6revi m\u00fcsl\u00fcmanlara y\u00fcklenmi\u015f bir g\u00f6revdir. \u0130sl\u00e2m \u00fcmmeti bu ilah\u00ee emri yerine getirdi\u011fi d\u00f6nemlerde yery\u00fcz\u00fc adaletle dolup ta\u015fm\u0131\u015ft\u0131r.\"...Allah insanlar aras\u0131nda h\u00fck\u00fcm verdi\u011finiz zaman, adaletle h\u00fckmetmenizi emreder.\" (en-Nis\u00e2, 4\/58) \u0130l\u00e2h\u00ee emrin hikmeti gayet a\u00e7\u0131kt\u0131r.\"Ey iman edenler, Allah i\u00e7in \u015fahitlik eden kimseler olunuz. Bir toplulu\u011fa kar\u015f\u0131 duydu\u011funuz kin sizi adaletten sapt\u0131rmas\u0131n. Adil davran\u0131n, takvaya* yak\u0131\u015fan budur. Allah'tan korkun, Allah yapt\u0131klar\u0131n\u0131zdan haberdard\u0131r.\" (el-M\u00e2ide, 5\/8).\u0130sl\u00e2m'\u0131n emretti\u011fi adalet do\u011frultusunda k\u00e2inat\u0131n d\u00fczeninin ayakta durmas\u0131 tabi\u00ee bir hadisedir. Adalet m\u00fclk'\u00fcn temelidir. Adaletin olmad\u0131\u011f\u0131 yerde zul\u00fcm h\u00e2kimdir. Allah ve onun koydu\u011fu b\u00fct\u00fcn h\u00fck\u00fcmler zulm\u00fcn her \u00e7e\u015fidinden uzakt\u0131r. Allah'\u0131n emirlerinin uyguland\u0131\u011f\u0131 bir ortamda hi\u00e7bir kimseye zerre kadar zul\u00fcm yap\u0131lmaz. (bk. en-Nisa, 4\/40). Bu Kur'an-\u0131 Kerim'de s\u0131k s\u0131k tekrarlanan ayetlerle dile getirilmektedir:\"Allah, adaleti ve ihsan\u0131* emreder. \" (en-Nahl, 16\/90).\"Allah size emanetleri* ehline vermenizi ve insanlar aras\u0131nda h\u00fckmetti\u011finiz zaman, adaletle h\u00fckmetmenizi emreder.\" (en-Nisa, 4\/58).\"H\u00fckmetti\u011fin zaman onlar aras\u0131nda adaletle h\u00fckmet. \u015e\u00fcphesiz Allah adil davrananlar\u0131 sever.\" (el-M\u00e2ide, 5\/42; ayr\u0131ca bk. el-Hucur\u00e2t, 49\/9).Hz. Peygamber (s.a.s.) de adalet ve adaletle h\u00fckmedenler hakk\u0131nda bir\u00e7ok had\u00ees buyurmu\u015flard\u0131r:\"H\u00fckm\u00fcnde, y\u00f6netimi ve vel\u00e2yeti alt\u0131ndakiler hakk\u0131nda ad\u00eel davrananlar, Allah kat\u0131nda nurdan minberler \u00fczerinde olacaklard\u0131r.\" (M\u00fcslim, \u0130m\u00e2re, 18).Hz. Peygamber'in \u0130sl\u00e2m'\u0131 tebli\u011f etmekle g\u00f6revlendirildi\u011fi d\u00f6nemin arefesinde C\u00e2hiliye devri Araplar\u0131 bo\u011faz bo\u011faza, b\u0131\u00e7ak b\u0131\u00e7a\u011fa gelmi\u015f durumdayd\u0131lar. Adaletsizli\u011fin, zulm\u00fcn kol gezdi\u011fi bir d\u00f6nemde \u0130sl\u00e2m gelmi\u015f ve yepyeni bir toplum ortaya \u00e7\u0131km\u0131\u015ft\u0131. Zengin-fakir, efendi-k\u00f6le ay\u0131r\u0131m\u0131n\u0131n yap\u0131lmad\u0131\u011f\u0131, haktan asla ayr\u0131lman\u0131n s\u00f6z konusu olmad\u0131\u011f\u0131 bir toplum olu\u015fmu\u015ftu.Bir g\u00fcn Mahzumo\u011fullar\u0131 kab\u00eelesine mensup e\u015fraftan F\u00e2t\u0131ma ad\u0131nda bir kad\u0131n\u0131n h\u0131rs\u0131zl\u0131k yapt\u0131\u011f\u0131 s\u00f6ylenerek Peygamberimiz (s.a.s.)'in huzuruna getirilmi\u015fti. Kad\u0131n\u0131n 'elinin kesilmesi'ne h\u00fckmedildi. Fakat daha \u00f6nceki gelenek ve al\u0131\u015fkanl\u0131klara g\u00f6re Kurey\u015f'ten olan asil bir kad\u0131n hakk\u0131nda su\u00e7 i\u015flemi\u015f olsa dah\u00ee b\u00f6yle bir h\u00fck\u00fcm verilemezdi. H\u00fckm\u00fcn inf\u00e2z\u0131n\u0131n durdurulmas\u0131 i\u00e7in Kurey\u015f'in ileri gelenleri Hz. Peygamber'in \u00e7ok sevdi\u011fi \u00dcs\u00e2me b. Zeyd'i araya koyarak bu kad\u0131n\u0131n affedilmesini istediler. \u00dcs\u00e2me'nin b\u00f6yle bir \u015fefaatte bulunmas\u0131 Hz. Peygamber (s.a.s.)'e \u00e7ok a\u011f\u0131r geldi. Hemen ash\u00e2b\u0131n\u0131 'mescid'*de toplay\u0131p bu konuda onlara \u015f\u00f6yle hitap etti:\"Ey insanlar! Sizden evvel ya\u015fam\u0131\u015f toplumlar\u0131n neden dolay\u0131 yollar\u0131n\u0131 \u015fa\u015f\u0131r\u0131p sapt\u0131klar\u0131n\u0131 biliyor musunuz? Asilz\u00e2deleri bir h\u0131rs\u0131zl\u0131k* yapt\u0131\u011f\u0131 zaman onu affeder, zay\u0131f ve kimsesizleri bir \u015fey \u00e7alarsa onlar\u0131 cezaland\u0131r\u0131rlard\u0131. Allah'a yemin ederim ki, b\u00f6ylesine k\u00f6t\u00fc bir h\u0131rs\u0131zl\u0131\u011f\u0131 Mahzum kabilesine mensup Fat\u0131ma de\u011fil, kendi k\u0131z\u0131m Fat\u0131ma yapm\u0131\u015f olsayd\u0131, kesinlikle onun elini kestirirdim. \" (M\u00fcslim, Hud\u00fbd, 2)Bug\u00fcnk\u00fc\u00a0 sistemlerde belirli z\u00fcmre ve belirli s\u0131n\u0131flar i\u00e7in dokunulmazl\u0131klar s\u00f6z konusu oldu\u011fu halde \u0130sl\u00e2m hukuku \u00f6n\u00fcnde hi\u00e7 kimsenin bir ayr\u0131cal\u0131\u011f\u0131 ve imtiyaz hakk\u0131 yoktur.Adil Halife Hz. \u00d6mer, hil\u00e2feti d\u00f6neminde ash\u00e2btan \u00dcbey b. Ka'b ile aralar\u0131nda bir konuda anla\u015fmazl\u0131k meydana gelmi\u015f ve bu anla\u015fmazl\u0131\u011f\u0131 \u00e7\u00f6zmek \u00fczere o d\u00f6nemin Medine kad\u0131s\u0131 olan Zeyd b. S\u00e2bit*'e gitmi\u015flerdi. Kad\u0131 olan Zeyd hemen devlet ba\u015fkan\u0131 olan Hz. \u00d6mer'e kar\u015f\u0131 sayg\u0131l\u0131 davran\u0131p ona oturmas\u0131 i\u00e7in yere bir minder sermi\u015fti. Fakat adil insan Hz. \u00d6mer bu davran\u0131\u015f kar\u015f\u0131s\u0131nda \u015f\u00f6yle demi\u015fti:\"\u0130\u015fte bu davran\u0131\u015f\u0131n, \u015fimdi verece\u011fin h\u00fck\u00fcmde yapt\u0131\u011f\u0131n ilk adaletsizliktir. Ben davac\u0131mla beraber ayn\u0131 yerde oturaca\u011f\u0131m.\"Sonra davac\u0131 \u00dcbey b. Ka'b davas\u0131n\u0131 ileri s\u00fcr\u00fcnce Hz. \u00d6mer bu iddiay\u0131 kabul etmedi. Bu durum kar\u015f\u0131s\u0131nda Hz. \u00d6mer'in yemin etmesi gerekiyordu. Kad\u0131 Zeyd \u0130bn S\u00e2bit, \u00dcbey'e \u015f\u00f6yle dedi:\"Gel Halife'yi yemin ettirme, onu bundan muaf tut. Davac\u0131 oldu\u011fun ki\u015fi bir ba\u015fkas\u0131 olsayd\u0131 sana b\u00f6yle bir feragatten s\u00f6z etmezdim.\" Bu teklifi duyan Hz. \u00d6mer son derece k\u0131zarak b\u00f6yle bir ayr\u0131cal\u0131\u011f\u0131 kabul etmeyip derhal yemin etti. Sonra da Zeyd b. S\u00e2bit hakk\u0131nda \u015f\u00f6yle dedi:\"Halife ile herhangi bir m\u00fcsl\u00fcman hakk\u0131nda e\u015fit davranmas\u0131n\u0131 \u00f6\u011frenmedik\u00e7e ona dava g\u00f6t\u00fcr\u00fclmemelidir.\u201d\u015euras\u0131 unutulmamal\u0131d\u0131r ki insan\u0131 var eden Allah onun f\u0131trat\u0131n\u0131 da en iyi tan\u0131yan ve o f\u0131trat\u0131n arad\u0131\u011f\u0131 saadeti onun i\u00e7in indirdi\u011fi nizamla belirleyen de yine O dur. O halde insan Allah\u2019\u0131n yaratt\u0131\u011f\u0131 m\u00fclkte O\u2019nun verdi\u011fi r\u0131z\u0131klarla hayat\u0131n\u0131 devam ettirdi\u011fini unutmamal\u0131 ve M\u00fclk\u00fcn sahibinin indirdi\u011fi nizama yani Kurana uygun bir hayat ya\u015fal\u0131 ki d\u00fcnyada da ahrette de huzura erenlerden olabilsin.
